HomeMy WebLinkAbout2004 21_Condemnation Procedures McAulif & Bowman_2004.09.19A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, RESOLVING THE NECESSITY OF INSTITUTING AND PROSECUTING CONDEMNATION PROCEDURES TO OBTAIN PERMANENT RIGHT-OF-'U/1,Y WHEREAS: The City of Owasso, by and through officers and agents thereof, has endeavored to obtain Permanent Rights-of-Way, the legal descriptions and illustrations of such are attached hereto and collectively marked Exhibit "A", deemed necessary for the 96th St. North and Garnett Intersection Project from the respective landowners, to-wit, Cornerstone Center, Inc., Parcel No. I James A. McAuliff and McAuliff Investment Company, Parcel No. 2 96th and Garnett LLC, Parcel No. 3 Owasso 7, LLC, Parcel No. 4 BYN, Inc., Parcel No. 5 Roy B. Bowman and Shirley M. Bowman, Parcel No. 6. WHEREAS: In connection with such efforts to obtain the needed Permanent Rights- of-Way consensually, the City of Owasso, by and through officers and agents thereof, has made bona fide good faith offers seeking to purchase same; and, WHEREAS: The above-referred landowners have not accepted such offers and by reason thereof Condemnation proceedings as provided for under the Constitution and Statutes of the State of Oklahoma are necessary.
