subject to the conditions imposed. The staff concurs with that recommendation.

Park Maintenance Department Capital Outlay budget, increasing expenditures by $14,705.

FINAL INSPECTIONS:
Final inspections were conducted on August 6 and August 13,2001, respectively. All punch list
items identified at the inspections have been corrected, The contractor has provided one-year
maintenance bonds for each utility (see attached).
BACKGROUND
The subject subdivision is located on NOlih Mingo 106th East Avenue (see
attached location map). The systems consist of about 5,000 lineal feet of water lines (including
the off-site line cOlmecting to the Hillside Addition to the north) and about 2,500 lineal feet

Staff recommends approval of the closing of the north 4' of the 25' utility easement located on Lot
12, Block 4, Hale Acres Second Addition.

Ifthe closing request is approved by Council, Ordinance No. 695 will formally adopt that action.
Due to the frequency of these types of requests, staff has also been instructed by the Commission
to draft an ordinance requiring a footing survey be provided to the building inspector at the time
of footing inspection. The benefit of this requirement would be to identify encroachments prior
to full construction of the dwelling.
The Owasso Planning Commission reviewed the requested easement closure at their November
13, 2001 regular meeting and recommended approval by a count of 4 to 1. Staff was instructed
at that time to send a letter to the builder on behalf of the Planning Commission to inform the
builder of the Commission's policy toward easement closings necessitated by builder error. A
copy of the letter is attached for your information and review.
The easement closing was reviewed by the Technical Advisory Committee at the October 31,2001
regular meeting and no comments and/or objections were recorded.
A variance request to the Owasso Board of Adjustment to reduce the require front yard building
setback was approved at the October 23,2001 regular meeting.
Mr. Larry Young, homeowner, has requested a partial closing of the platted 25' Utility Easement to
accommodate an error in the location of the structure on the property by the builder, Maximum
Control. Conversations with the builder revealed a conscious decision to align the residence with
the existing homes along the street built approximately 30 years ago. Those structures, if the
alignment is precise, would also be encroaching into the platted 25' front yard setback.

The Commission requested I notify you of its policy of approving only one request generated by
any particular builder's mistake. It is not the desire of the Commission to negatively impact any
innocent party. However, a second mistake, generating a second request by a particular builder,
will possibly be met with the suggestion the homeowner should seek some other avenue of
redress and denial of the request.
The staff and, particularly, the Planning Commission ofthe City of Owasso are increasingly
sensitive to the errant location of structures within the appropriate boundaries established by a
recorded plat. Also of particular concern is a secondary party, i.e. the homeowner, typically
shouldering the primary impact of such mistakes.

both OPUD-OI-04 and OZ-01-09 subject to the conditions recommended by staff as well as two
additional conditions proposed by the Commission. Staff concurs with this recommendation. A

conditions recommended by the Planning Commission are as follows:

Complete bid specifications are shown in the accompanying supporting documents. Solicitation
was for a monthly bid, including all services except building-wide carpet cleaning, which will be

LOCATION:
The proposed Preston Lakes Centennial Park is located Ii mile east ofE. 86th Street North and N. 145th
East Avenue and contains 58 acres, more or less. The area contained within the proposed park consists
of a drainage area that drains north to south with several improved pond areas for storm water
detention.
BACKGROUND:
Over the last nine months, the City of Owasso has been in negotiations with Preston Lakes, LLC in
order to allow for the donation of 58+ acres of land area to the City of Owasso for use as a regional
park. The agreement would not only allow for the donation of land, but it would also allow for the
city to purchase improvements made to the park area by the developers, establish a schedule for the
repayment of the improvements, as well as provide a funding source for a large portion of the
improvements.

MEMORANDUM
ADDITIONAL COMMENTS:
The proposal, if approved by the City Council, would provide Owasso residents with a new regional
park with the longest walking trails outside of the River Parks park system. The following items
would also be addressed:
@ Two issues incorporated into the 2010 Land Use Master Plan would be addressed. (1) The lack
of passive recreational parks for activities like nature studies, walking, picnicking, fishing, and
relaxing rather than active parks for organized team sports; and (2) Lack of greenway areas
with trails linking the community together. The 2010 Land Use Master Plan was adopted by
PAYMENT SCHEDULE:
The proposed agreement between the City of Owasso and Preston Lakes, LLC establishes the total
cost of all improvements at $315,037. The city would pay the $315,037 over a six-year period, with
$100,000 being paid to the developers upon completion of the improvements and the remaining
$215,037 would be paid in equal installments over the subsequent six years at a cost of $35,839.60 per
year.
All fees collected through the assessment ofthe Park Development Fees are deposited in the Park
Development Fund. As of November 14,2001, the Park Development Fund has a fund balance of
$296,000. Through the developers allowing the City of Owasso to continue to assess the Park
Development Fee, a total of$127,700 from the Preston Lakes Addition building permits can be
collected toward the payment of the improvements, and this does not include any park development
fee revenue generated by other newly platted additions in the city.
FUNDING SOURCE:
The agreement allows for the City of Ow as so to continue assessing the Park Development Fee on all
building permits in the Preston Lakes additions. Typically, '0'hen a residential development occurs,
there are two avenues a developer can take. The first would be the donation of land for the city
development of a parle The other alternative would be for the developer to not donate any land, at
which point the city assesses a Park Development Fee on every building permit. This fee is $75 per
dwelling, plus an additional $25 per bedroom in that dwelling.
concerns expressed by both staff and the City Council include the following:
@ The asphalt walking trail, after discussion held the last time it was presented, has been widened
from 5 feet to 7 feet. Several Council members had concerns regarding the width of the trail
and whether or not it would be in the best interest of the City to go along with a 5 foot wide
walking trail with plans to widen it later.
@ The Council had requested a more detailed site plan that would provide the locations of the
playground areas as well as all parking areas, both upon opening and in the future. The revised
site plan indicates all these areas, both at the time of dedication of the park and future
@ Woods Chips substituted the safety fall zone areas. falls
line with our policy to utilize chips rather than gravel around playground equipment.

@ The Sellers Cost of Capital to permit a 6 year payout has also been added. Originally, this was
proposed by Preston Lakes, LLC at 8% and has been reduced to 6.5%, saving slightly over

RECOMMENDATION:
Staff recommends Council approval of the Preston Lakes Centennial Park Agreement, allowing for the
donation of 58 acres, more or less, for public park use. Additionally, the agreement defines scheduled
improvements and a payment schedule for those improvements.
A copy ofthe proposed Centennial Park Preston Lakes Agreement is attached for your information
and review, as well as a reduced site plan. larger copy ofthe site plan will be available Tuesday
evening for your review. Should you have any questions prior to Tuesday evening's meeting, please

If the agreement is approved by the Council, the developers intend to begin on the
improvements immediately. goal is to have the park improvements completed by late-Spring or
early..Summer.
There have been no nevv. park areas located east of the Expressway, where a majority of
's growth has occurred in the last 20 years, since the development of Elm Creek Park.
Coincidentally, this park will offer similar amenities to public as Elm with the addition

NOW THEREFORE, in consideration of the foregoing as well as the following conditions, covenants,

improvement of the quality oflife of Buyer's citizenry by providing more recreational amenities to the
existing park and recreation inventory of the Buyer.

RECITALS
This agreement is dated this day of __ , 2001, by and between
Preston Lakes, L.L.C., (hereinafter referred to as "Sellel~') and the City of Owasso, Oklahoma,
(hereinafter referred to as "the City" or as "Buyer").
REAL ESTATE PURCHASE CONTRACT

The total purchase price for the park land property described on Exhibit "A" hereto, together with such
improvements as are outlined above, shall be Three Hundred and Fifteen Thousand, Thirty-seven Dollars
arId No/l 00 ($ 315, 037). The purchase price shall be paid as follows to-wit:
1. One Hundred Thousand Dollars and Noll 00 ($100,000.00) from the City of Ow as so, Oklahoma,
Park Development Fund, upon the closing hereof as hereinafter provided for and,
2. Two Hlmdred Fifteen Thousand, Thirty-seven Dollars and Noll 00 ($ 215, 037.00) payable in six
equal annual instalhnents ofThnty-five Thousand Eight Hundred Thirty-nine Dollars and 60/100
($35,839.60), the first instalhnent being due on or before the 30th day of July, 2002, and the
sixth instalhnent being due on or before the 30 day ofJuly, 2007.
It is specifically understood and agreed that the Two Hundred Fifteen Thousand, Thirty-seven Dollars
and No/IOO ($215,037.00) shall bear no interest. Is further specifically understood and agreed that the
Two Hundred Fifteen Thousand, Thirty-seven Dollars and No/l 00 ($215,037) shall be payable solely
from the Park Development Fees collected from the building pennits issued by the City of Owasso in
any subdivision where such Park Development Fees are collected It is expressly understood by Seller
that, despite Seller's gifting ofthe underlying park land, all of the residential building permits hereafter
issued by the City within the entire Preston Lakes Planned Unit Development (whether such pennits be
multi-family, duplex or single-family in nature), shall be subject to such Park Development Fees. . The
estimated Six Hundred Sixty-Eight (668) single family residential and duplex building permits in the
Preston Lakes P.U.D. will contain such Park Development Fees in the amount of One Hundred Fifty
Dollars and No/IOO ($150.00) each and the estimated Two Hundred Twenty (220) multi-family building
permits to be issued in the Preston Lakes P.U.D. shall also be subject to a Park Development Fee. It is
neither intended nor shall Seller consider any other source of payment, especially sales tax or general ad
valorem taxes, except from the Park Development Fees. This is a special limited source obligation
intended to be in compliance with the provisions of Oklahoma Constitution, Article 10, Section 26.
The Buyer shall pay no more and no less than the purchase plice set forth above regardless of any cost
overmns or cost savings that the Seller may experience as a result of constructing the improvements

below, convey unto Buyer by General Warranty Deed that park land described on Exhibit A hereto free
and clear of any and all liens, mortgages or claims whatsoever that would adversely

thereto, as recognized bv the Title Examination Standards of the Oklahoma Bar

SALE OF IMPROVED PARKLAND
and terms, the parties hereto agree as follows:

Seller shall furnish Buyer title evidence covering the Property, which shows marketable title vested in
Seller according to the title standards adopted by the Oklahoma Bar Association.
(a) Such title evidence shall be in the fonn of: (check one) Commitment for Owner's Title
Insurance or<<~__ Abstract of Title.
b) Seller shall make Seller's title evidence abstract of title or Owner's Title Insurance
Policy) available to the escrow agent within a reasonable time after the date ofthis
Contract.
( c) When title evidence in the fonn of a Commitment for Owner's Title Insurance Policy is fhrnished, the
cost of such policy and a loan survey shall be paid ~50%_. by Seller and ~50%~ by Buyer. Seller shall
pay any abstracting costs in excess of the title insurer's average abstracting cost. Such Owner's Title
Insurance Policy shall insure Buyer to the extent of the total purchase price. When a survey satisfactory
to the title insurer is furnished showing no encroachment and/or boundary disputes, such policies shall
provide usual encroachment coverage. In the event the survey discloses any encroachment(s) and/or
boundary dispute(s), such policies shall provide encroachment coverage with exceptiones) for matters
disclosed by such survey which exceptiones) shall be subject to acceptance by Buyer in writing.
(d) When title evidence in the form of an abstract of title is furnished, then a duly certified abstract of
title (including current Unifonn Commercial Code Certification) shall be provided at Seller's expense
and Buyer shall, at Buyer's expense, obtain either a title opinion or an Owner's Title Insurance Policy.
( e) Upon delivery to Buyer of a current Commitment for Owner's Title Insurance Policy or the abstract,
certified to date, as the case may be, Buyer shall have a reasonable time, not to exceed _ days,
to examine the same and rerum the same to Seller with any written objections concerning the
marketability of the title or such right to object shall be deemed waived. Seller shall have
days from such notice of objection to correct such defects. unless such time is further
extended by written agreement of the parties.

The foregoing represents the entire agreement existing between the parties. No prior oral or written
communications relating hereto or subsequent discussions pertaining hereto shall serve to vary the terms
hereof unless specifically reduced to writing or dually executed by the parties hereto.

ENTIRE AGREEMENT
It is intended by the Seller that this park be a "passive-use" park and is not to be used by the City or by
organized leagues for use as athletic fields for baseball, softball, soccer, etc. However, it does not violate
Seller's intent of such "passive uses" to allow construction, at a later date, by the City of a basketball
court or a sand-volleyball court. It is hoped that this park will be primarily used by all Owasso citizens
for uses such as hiking, strolling, nature-walking, bicycling, jogging, kite-flying and picnicking. The
vision is for the playground equipment to emphasize a friendly, relaxed atmosphere where all age groups
can enjoy the outdoors.

SPECIAL CONDITIONS
The park land property shall be nanled by the City of Owasso, Oklahoma as Preston Lakes Centennial
Park.

NAME
This transaction shall be closed on or before the ____ day 2002, by
Seller's delivery to Buyer a General Warranty Deed to the park land and improvements set forth on
Exhibit "A" hereto duly executed and in recordable form as well as any Bills of Sale or Warranty
to installed on the park land as well as the payment unto the Seller of the
One Hundred Thousand Dollars and No/I00 ($100,000.00) provided tor above. The provisions
relating to payment of installments shall survive the closing and shall to the extent as provided for
herein, constitute a continuing contractual obligation.

The Parks Department will be receiving a 1992 Ford pick-up later in December after the Community
Development receives their new truck. This was previously planned, however, and does not address
the cuuent problem.
On Wednesday, November 14,2001, the Parks Department pick-up truck was totaled as a result of an
accident. The Parks Department employee did not receive a ticket and was not at fault in the accident.

Staff has contacted the vendor on the state bid list, and they have indicated a 6 to 8 week delivery time.
Other vendors with the possibility of matching or beating the state bid list price have also been
contacted. Because of the time frame between the actual accident and tonight's meeting, staffhas not
heard back from all of these vendors. Therefore, staff is requesting that the Council approve the
purchase ofthe pick-up truck from the State Bid list, or equivalent, in the event that another vendor
In order to replace the pick-up truck, staff is requesting two actions from the City Council. The first
action would be to approve a supplemental appropriation to the General Fund, while the second would
be to allow staff to purchase a pick-up buck off ofthe state bid list. Staff has reviewed the vehicles
included on the state bid list, and the Chevrolet Silverado C 1500 would be the most affordable vehicle,
that could be serviced locally, with the identical options that were contained on the 1997 Ford F-150.
The options included NC, a heavy-duty tow package, and a service manual. In fact, at $14,705, the
cost would be cheaper than the vehicle purchased in 1997 ($16,080).
An estimate to repair the truck was obtained on Thursday, November 15,2001. The total cost to repair
the vehicle was estimated at $7,129. The blue book value ofthe vehicle itself is $8,675. It would
appear that the $1500 difference between the vehicle's worth and the estimate provided to repair it
would not warrant repair ofthe truck. When one considers that the collision damaged the engine area
of the huck, additional problems after the repair could be anticipated. With that in mind, staff would
like to replace the truck.

body and interior have only minor (if any) blemishes, and there are no rnajor
mechanical problems. In states where rust is a problem, this should be very
minimal, and a deduction should be made to correct it. The tires match and
have substantial tread wear left. A clean title history is assumed. A "good"
vehicle will need some reconditioning to be sold at retail; however major
reconditioning should be deducted from the value. Most recent model cars

Mr Carr said that Phase IIA of the improvements to the wastewater treatment plant have been
completed and bids have been opened for the construction of Phase IIB. Phase IIB includes

Mr Allen Brooks, Bond Counsel, presented the item. To fund planned improvements to the
wastewater utility system, Trustees approved a series of rate increases in May of 2000. Phase
IIA improvements have been completed and staff is ready to begin Phase IIB. On July 10,2001
the Oklahoma Water Resources Board approved the award of a Clean Water State Revolving
Fund loan to the OPW A. The Trustees accepted a Letter of Binding Commitment in August for
an interim construction loan maturing no later than two years following the completion of
construction. Permanent financing will be arranged at that time. OPW A Resolution #2001-20
authorizes an interim construction loan for $2,364,585 with the OWRB; approves the issuance of
promissory notes and loan agreement; approves the payment of fees. and expenses associated
with the loan closing; and approves and authorizes various other documents and actions
necessary to complete the financing. Mr Williams moved, seconded by Mr Helm, to approve
OPWA Resolution #2001-20.

Eight companies submitted bids, with the low bidder, Lamar Industries, being $561,627 below
the engineer's estimate of $2,400,000.00. Mr Helm moved, seconded by Mr Williams, to award
a contract for Wastewater Treatment Plant Improvements Phase IIB to Lamar Industries,
Shawnee, OK, in the amount of $1,838,378, contingent upon loan closing and receiving final
approval from the Oklahoma Water Resources Board; and authorization for the Chair to execute
the contract.
