TO: The Honorable Mayor and City Council City of Owasso FROM: Karl Fritschen Community Development Director SUBJECT: Proposed Zoning Code Text Amendment - Small Wind Energy Systems DATE: May 4, 2012 BACKGROUND: Alternative energy sources are becoming an affordable option for many homeowners, commercial businesses, and educational institutions. The "Go Green" Initiative, which was presented to the City Council in March 2010, is a document that identifies different opportunities the City should consider in an effort to conserve energy, protect the environment, and reduce its carbon footprint. This document recommended that development criteria be prepared to allow provisions for constructing small wind energy systems. Additionally, staff has received a few inquiries on the requirements for wind energy systems. With the price of fuel and energy showing no signs of abating, it is believed that these inquiries will continue, especially as the technology for wind energy continues to evolve and becomes more affordable. Considering the above, staff conducted research about wind energy systems and developed the attached requirements for the installation of small wind energy systems for both residential and commercial uses. The attached criteria, which will become a new section in Chapter 15 of the Owasso Zoning Code, were developed based on current technology. As the technology for wind energy improves, it will be important to revisit these criteria to ensure they remain current. The proposed change provides a comprehensive approach for the development of small wind energy systems and ensures that there is consistency in their construction and placement. PROPOSED TEXT AMENDMENT TO THE OWASSO ZONING CODE: At the April 9, 2012 Planning Commission Meeting, staff presented a proposed amendment to the Owasso Zoning Code addressing small wind energy systems. The Commission suggested some changes to consider in the text language, and these were incorporated into the final attached draft. Below are the highlights of the changes made to the draft presented to the Planning Commission on April 9, 2012: Approvals will be granted through the Planning Commission as a Specific Use Permit. An analysis of the properties inside the Owasso City Limits reveals that approximately 20- 30 residential properties would qualify for a wind tower in terms of meeting the 1 acre requirement. The section discussing the installation of large commercial wind energy systems (wind farms) has been removed. A statement was added about how private covenants or deed restrictions may prohibit wind towers and that the ordinance does not preempt these. • Clarification was added as to the height of the wind tower blades in relation to nearby structures. • Provision was added that wind energy systems 15 feet in height or less would be allowed on any size lot as long as the setback calculations are adhered to. The attached document represents the final draft of the proposed change to the Owasso Zoning Code. If approved, this document will amend Chapter 15, Telecommunication Towers, by adding a new section 1530. Additionally, the title of Chapter 15 will be changed to read Telecommunication Towers and Small Wind Energy Systems. Some key elements of the proposed amendment include: • Minimum lot size standards • Setbacks from property lines and inhabited structures • Noise levels • Visual appearance • Permit requirements • Access control REASON FOR THE PROPOSED CHANGE: This zoning code amendment recognizes the need and proliferation of alternative energy sources and is designed to ensure that a process and procedure is in place for the safe construction of wind towers. A public hearing will be held on May 22 regarding the proposed amendment. Staff will be available to answer any questions from the City Council. Once the public hearing is concluded, no action is necessary. An ordinance amending Chapter 15 of the zoning code will be brought to the June 5, 2012 City Council meeting for consideration. PLANNING COMMISSION: The Owasso Planning Commission will review this item at their regular meeting on May 7, 2012. PROPOSED ACTION: Staff intends to recommend approval of the proposed zoning code amendment to Chapter 15 of the Owasso Zoning Code. ATTACHMENTS: Section 1530, Small Wind Energy Systems 1530 SMALL WIND ENERGY AND COMMERCIAL WIND ENERGY SYSTEMS 1530.1 PURPOSE The purpose of this chapter is to provide standards that will protect the health, safety and general welfare of the public and achieve the following: • Provide design criteria that establish minimum requirements for small wind energy systems and commercial wind energy systems as defined herein to ensure the safe installation of wind towers in the City of Owasso • Promote energy savings and the use of `green infrastructure' 1530.2 APPLICABILITY The requirements of this ordinance shall apply to all small wind energy systems and commercial wind energy systems proposed after the effective date of this ordinance. Wind energy systems for which a required permit has been properly issued prior to the effective date of this ordinance shall not be required to meet the requirements of this ordinance; provided, however, that any such system shall be installed and functioning within 24 months of the date of the permit. Any system that has been installed, but not used for two consecutive years may not be subsequently used without meeting the requirements of this ordinance. No pre- existing system shall be altered in any manner that would increase the degree of nonconformity with the requirements of this ordinance and no alterations shall be made to a nonconforming pre- existing system during its life which exceeds 50% of its fair market value. If such system is destroyed or damaged to the extent of more than 50% of its fair market value at the time of destruction or damage, it shall not be reconstructed except in conformity with this ordinance. 1530.3 SMALL WIND ENERGY SYSTEM REQUIREMENTS A. Total Height. The not -to- exceed height of wind towers shall vary with the size of the lot. 1. For property sizes less than one acre in size the total height shall not exceed 15 feet. 2. For property sizes between one acre and two acres, the total height shall not exceed 60 feet. 3. For property sizes between two and five acres, the total height shall not exceed 80 feet. 4. For property sizes greater than five acres, the total height shall not exceed 100 feet. B. Location. No small wind energy system shall be located in any front or side yard. C. Setbacks. I. Property lines. A small wind energy system shall be set back from the nearest property line, public road right -of -way and communication and electrical line not less than 1.5 times the total height of the wind turbine. 2. Inhabited Structures. A small wind energy system shall be set back from the nearest inhabited structure not less than 1.5 times the total height of the wind turbine. D. Design Standards. 1. Monopole or Freestanding Design. The design of the small wind energy system shall be of a monopole or freestanding design without guy wires. 3. Minimum Blade Height. For towers in excess of 30 feet in height, the minimum height of the lowest extent of a turbine blade shall be 30 feet above finished grade and shall be separated from any structure (i.e. house, shed, barn, recreational element) not less than 1.5 times the blade height from said structure. 2. Access. No tower shall have a climbing apparatus within 12 feet of the ground. All access doors or access ways to towers and electrical equipment shall be lockable. 3. Noise. No small wind energy system shall exceed 60 dBA as measured at the nearest property line or 50 dBA as measured at the nearest neighboring inhabitable building. 4. Visual Appearance. Small wind energy systems shall be finished in a rust - resistant, non - obtrusive finish and color that is non - reflective. No small wind energy system shall be lighted unless required by the FAA. No advertising signs of any kind or nature whatsoever shall be permitted on any small wind energy system. No transmission equipment shall be installed on the tower. All equipment shall be screened with either a six foot opaque fence or with evergreen vegetation not less than six foot in height. 5. Electrical Interconnections. All electrical interconnection or distribution lines shall be underground and comply with all applicable codes and public utility requirements. 6. Signal Interference. Efforts shall be made to site small wind energy systems to reduce the likelihood of blocking or reflecting television and other communication signals. If signal interference occurs, both the small wind energy system owner and individual receiving interference shall make reasonable efforts to resolve the problem. No small wind energy system shall cause permanent and material interference with television or other communication signals. 7. Overspeed Controls. Every small wind energy system shall be equipped with both manual and automatic overspeed controls. E. Permit Applications. Application for a small wind energy system shall include the following information. 1. Approval. Small wind energy systems shall be approved with a Specific Use Permit through the Planning Commission following the procedures outlined in Chapter 13, Amendments. 2. Site plan. A site plan shall be drawn to scale based off a survey showing the location of the proposed small wind energy system and the locations of all existing buildings, structures, and property lines along with distances. 3. Elevations. Elevations shall be provided of the site drawn to scale showing the height, design, and configuration of the small wind energy system and the height and distance to all existing structures, buildings, electrical lines, and property lines. 4. Engineering Specifications. Standard drawings and an engineering analysis of the systems tower, including weight capacity shall be provided. 5. Foundations and Geotechnical. A standard foundation and anchor design along with existing soil conditions and specifications for the soil conditions at the site. 6. Tower Specifications. Specific information on the type, size, rotor material, rated power output, performance, safety, and noise characteristics of the system including the name and address of the manufacturer, model and serial number. 7. Safety Measures. Emergency and normal shutdown procedures shall be provided as part of the application for a wind energy system. 8. Electrical Connection. A line drawing of the electrical components of the system in sufficient detail to establish that the installation conforms to all applicable electrical codes shall be provided along with evidence that the provider of electrical service of the property has been notified of the intent to install an interconnected electricity generator (unless the system will not be connected to the electricity grid). 1530.5 NON USE I. Any small wind energy system which complies with the terms of this ordinance which is not used for two years, excluding repairs, shall be removed within the following six months. Failure to remove the system shall be deemed a violation of this ordinance. 2. Any small wind energy system or commercial wind energy system which is non- conforming and which is not used for one year, excluding repairs, shall be removed within the following six months. Failure to remove the system shall be deemed a violation of this ordinance. 1530.6 PRIVATE COVENANTS Private covenants or deed restrictions may prohibit the installation of small wind energy systems. The City of Owasso does not enforce private covenants and this ordinance shall not preempt private covenants. 1530.7 DEFINITIONS 1. Total Height. The distance measured from ground level to the blade extended at its highest point. 2. Small Wind Energy System. A wind energy conversion system consisting of a wind turbine, a tower, and associated control or conversion electronics which will be used primarily to reduce on -site consumption of utility power. 3. Windmill Rotor. That portion of the windmill which includes the blades, hub, and shaft. 4. Windmill Tower. The supporting structure on which the rotor, turbine, and accessory equipment are mounted. 5. Commercial Wind Energy System. A wind energy conversion system consisting of more than one wind turbine and tower; a wind energy conversion system which will be used primarily for off -site consumption of power. Stephenson, City Planner SUBJECT: 2025 Land Use Master Plan Amendment DATE: May 4, 2012 BACKGROUND: On April 9, 2012 the City of Owasso received a planned unit development /rezoning application for review and approval of a request to rezone a tract of land from OL (Office Light) and CS (Commercial Shopping) to RM (Residential Multi- family), with a Planned Unit Development (PUD) overlay. The subject property is located south of Owasso Medical Campus and north of Owasso Market. SURROUNDING ZONING: Direction Use Land Use Plan Jurisdiction North m Medical Campus Commercial Owasso South l Owasso TMeddum Market Commercial Owasso East l Undeveloped Commercial Owasso West Undeveloped Commercial Owasso Owasso Land Use Master Plan: The Owasso Land Use Master Plan (Plan) is a document representing desired future land use and transportation patterns for the physical development of the community. It serves as an adopted statement of growth policy for the city, and provides the basis for land use decisions such as zoning changes. The Plan is not meant to predict every possible scenario, but rather serve as a guide in helping to make decisions as well as offer some predictability to the public in terms of location and intensity of future uses. ANALYSIS: The proposed PUD for the 9inetyEight apartment complex is a use allowed only in the transitional category as called out in the 2025 Land Use Master Plan. The location of the subject property is between a commercial use area (Owasso Market) and a medical use area (St. Johns Owasso), but is called out as a commercial use area in the Land Use Master Plan. The location of the subject property is such that it functions as a transitional area between higher intensity commercial uses and lower intensity medical and office uses, which fits into the overall concept of the 2025 Land Use Plan. Finally, the Land Use Plan is a fluid document that periodically requires updating. It has been five years since the Plan was updated, so it is expected that amendments will occasionally be necessary. In analyzing the request, staff considered two key factors: first, what is the highest and best use of the property, and second, is the proposed land use distribution consistent and compatible with existing development patterns in the area. The Owasso 2025 Land Use Map calls for this area to be commercial in the future, but RM (Residential Multi- family) zoning would be in compliance with the goals stated in the plan and the existing development in the area. Amending the Plan to show this area as transitional rather than commercial is appropriate in terms of the proposed multi- family zoning and use and does not appear to adversely impact the surrounding properties and in fact supports them. PLANNING COMMISSION: The Owasso Planning Commission will review this item at their regular meeting on May 7, 2012. Stephenson, City Planner SUBJECT: Planned Unit Development (PUD- 12 -01) and Rezoning - 9inetyEight DATE: May 4, 2012 BACKGROUND: The City of Owasso received a Planned Unit Development (PUD) application for review and approval of a development called 9inetyEight. The 9inetyEight development proposes an apartment complex consisting of 284 -units in 21 buildings on 15.295 acres. The subject property is located along East 98th Street N and East 99th St N immediately north of the Owasso Market development and to the south of the St. Johns Owasso medical campus. The applicant also submitted a rezoning request with this PUD that would rezone the property from CS (Commercial Shopping) and OL (Office Light) to RM (Multi - Family Residential), allowing for the development of an apartment complex. SURROUNDING ZONING: Direction Zoning Use Land Use Plan Jurisdiction OfficeOMedium City of North Medical /Office Transitional South Commercial Commercial Commercial City of Sho in CS Owasso East Commercial Commercial Commercial City of Sho in CS Owasso Office dium City of West M Vacant Commercial CONCEPT OF A PUD: The concept of a Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process. ANALYSIS: The 9inetyEight development proposes a 284 -unit apartment complex on 15.295 acres, which results in a net post development density of 18.6 units per acre. The apartments are proposed as low -rise buildings three stories in height with a mixture of one and two bedroom units. The proposed PUD identifies two access points, one connecting to E 98th Street N and the other to E 100th St N. Garages will be provided for a portion of the units, bringing a total of 522 parking spaces for the entire development. The 9inetyEight site will provide a number of amenities for the residents and includes large areas of open space for recreation. The provided amenities as identified in the PUD document include: a clubhouse with exercise facilities and recreation area; a pool and spa; a covered outdoor barbeque area; a fishing pond surrounded by a walking path; and gated access to the complex. The City of Owasso will provide sanitary sewer service, with water provided by Washington County Rural Water District #3. The subject property falls within the Ator Sewer Relief Payback District and will be subject to a fee of $325.00 per acre If the PUD is approved, the applicant would provide final development plans for administrative review and approval by City staff. PUD applications presented to the Planning Commission and City Council are for approval of the uses, the overall plan as it relates to the immediate area, and the concept for the development. City staff published legal notice of the PUD request in the Owasso Reporter and mailed notices to property owners within a 300' radius of the subject property. COMPREHENSIVE PLAN CONSISTENCY: The Owasso 2025 Land Use Master Plan identifies the subject property and its surroundings as having a future land use of commercial. An amendment to the Land Use Master Plan accompanies the request for the proposed 9inteyEight PUD development. With the change to the Land Use Master Plan, the proposed project will be in conformance with the Land Use Master Plan. HARMONY WITH THE EXISTING AND EXPECTED DEVELOPMENT: This proposal appears to be consistent with the current and expected development of the area. Apartment complexes are often proposed in areas that are adjacent to single - family residential developments and there are concerns from neighboring property owners. This proposal places the apartments between two established commercial and medical uses and would not require significant buffering or transitional uses. This apartment development would be a logical fit for the area with minimal impact on surrounding properties. As the Owasso Medical Campus continues to develop, this apartment development will still be a compatible use and should not adversely affect any future or current development. This development will provide housing opportunities for employees of current and future commercial and medical uses in this area and provide the opportunity for residents to walk to work, shopping, and eating establishments. PLANNING ISSUES: Future planning issues must still be considered if the PUD is approved. If approved, the applicant will be required to adhere to all City of Owasso subdivision regulations and engineering requirements. According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: I . Whether the PUD is consistent with the Comprehensive Plan 2. Whether the PUD is in harmony with the existing and expected development of surrounding areas 3. Whether the PUD is a unified treatment of the development possibilities of the project site 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance a. To permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. To permit flexibility within the development to best utilize the unique physical features of the particular site; c. To provide and preserve meaningful open space; and d. To achieve a continuity of function and design within the development TECHNICAL ADVISORY COMMITTEE: This item was taken to the TAC for review on April 25, 2102 and the comments from that meeting are attached. PLANNING COMMISSION: The Owasso Planning Commission will review this item at their regular meeting on May 7, 2012. J Page 2 Khoury Engineering, Inc. 9inetyEight DEVELOPMENT CONCEPT & CHARACTER 9inetyEight is a proposed multifamily project, submitted as a Planned Unit Development pursuant to the provisions of the Owasso Zoning Code. The proposed PUD comprise of one development area. Development Area A consists of residential dwellings in the form of 284 low -rise apartments units contained in 21 buildings. Development Area A encompasses approximately 15.29 acres. This project is located just south of Owasso Medical Campus and North of Owasso Market. The greater part of the subject property is currently zoned CS. A portion of the property along the north side where it abuts E 100'h Street North is zoned OL. A separate re- zoning application for those areas zoned OL & CS will be submitted with this PUD. Along the west side of the property, there is a strip of land approximately 50 feet in width that is zoned OL. The north side of the subject tract abuts Lot 1, Block 6 of Owasso Medical Campus, and E. 100th Street North. A west side of the subject tract abuts Lot 1, Block 3 of Owasso Medical Campus and E. 99th Street North. The south side of the property abuts E. 98th Street North (Owasso Market). The east side of the property abuts a vacant land zoned CS. The site is currently a vacant land covered with vegetation. Section 820 of the Owasso Zoning Code states the purpose of the Planned Unit Development (PUD) are to permit innovative land development while maintaining appropriate limitations on the character and intensity of use. Additionally, a purpose of the PUD is to permit flexibility within the development to best utilize the unique physical features of the particular site and provide and preserve meaningful open space. A Planned Unit Development (PUD- 07 -02) was approved for the development of townhomes on the subject property in 2007. The project was originally approved in 2007, but the plat was never filed. Per the subdivision regulations, a final plat must be filed and recorded within six months following the approval date by the City Council. Because the plat was never filed, the approval has expired and the applicant has brought the plat back for re- approval. The plat layout is unchanged from the original final plat approval. Construction of the infrastructure has begun on the property based upon the approved engineering documents. Once the plat is filed, the applicant may commence with vertical construction of the townhomes. The proposed Villas at Stonebridge Final Plat consists of thirty -eight (38) lots on two (2) blocks with six (6) common areas (A -F) that will provide the detention, parking, and landscape areas for the residents. The lots range in size from twenty five (25) to thirty (30) feet in width, with one townhome being constructed on each lot. Per the PUD approval, one building will consist of four connected units spanning four (4) lots. The lots will all front on N 132nd E Ave, which will essentially be a wide boulevard street with reserve areas within it that will provide off - street parking. The proposed final plat provides a reserve area on the south side of the property which will contain the stormwater detention facilities. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements including, but not limited to, paved streets, landscaping, and sidewalks. The property is subject to all platting fees and a storm siren fee of $35.00 per acre. The property is served water by Rogers County Rural Water and the City of Owasso will provide sanitary sewer, police, fire, and EMS services. Utility easements are established throughout the proposed addition so as to adequately accommodate utility services. All lots meet all of the bulk area requirements of PUD 07 -02. In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use Master Plan, as the area is shown for transitional uses. Perimeter utility easements provide adequate access for utilities that will serve the property. A drainage easement on the north side of the property will provide for the placement of stormwater facilities that will serve the property. There are two (2) entrances proposed along the one - hundred twenty -five (125) feet of frontage along E 86th St N. The western entrance is a shared access entrance with the commercial center to the west and a fifteen (15) foot limit of access is shown on the plat. A second entrance is proposed along the eastern property line, which is a thirty (30) foot limit of access. These two access points provide two means of ingress and egress into the site. The easternmost access point is part of a previously filed mutual access easement that also provides a means of access to the vacant commercially zoned property to the northeast of the subject property (directly north of Bank of the Lakes). The subdivision regulations state that any final plat not recorded within six months of approval shall be null and void. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements including, but not limited to, paved streets, landscaping, and sidewalks. Sanitary sewer, water, police, fire, and EMS services will be provided by the City of Owasso. The property does not fall within a sanitary sewer payback area, but will be subject to the Storm Siren fee of $35 per acre. The report contains basic educational information on the water quality - including levels of any detected contaminants, and compliance with drinking water rules. At a minimum, the report must provide consumers with the following fundamental information: ➢ Lake, river, aquifer, or other sources of the drinking water; ➢ A brief summary of the susceptibility to contamination of the local drinking water source, based on the source water assessments that states are completing over the next five years; ➢ How to get a copy of the water system's complete source water assessment; ➢ The level (or range of levels) of any contaminant found in local drinking water, as well as EPA's health -based standard (maximum contaminant level) for comparison; ➢ The likely source of that contaminant in the local drinking water supply; ➢ The potential health effects of any contaminant detected in violation of an EPA health standard, and an accounting of the system's actions to restore safe drinking water; ➢ The water system's compliance with other drinking water - related rules; ➢ Phone numbers of additional sources of information, including the water system and EPA's safe drinking water hotline. It is worth noting that the report simply summarizes information that the City must collect to comply with the Federal Safe Drinking Water Act. No additional monitoring is required to comply with this mandate. Additionally, since the City purchases water from the City of Tulsa, Owasso's Water Quality Report uses much of the educational information and monitoring data provided by the City of Tulsa. A copy of the City of Owasso 2012 Water Quality Report is included as Attachment A. I Right -to -Know Amendment to Clean Water Act in (1996) requires that all owners of systems serving at 25 residents or more or that have 15 service connections serving year round residents distribute such report. The mandate also requires that the City mail or deliver a copy of the Water Quality Report to each water customer, make an effort to deliver the report to non - bill - paying customers, and provide copies of the report upon request. The City must send a copy of the Water Quality Report to the Oklahoma Department of Environmental Quality (ODEQ) and submit a Certificate of Completion and Distribution by October 1, 2012. The Certificate confirms that the information contained in the report is correct and that all distribution requirements have been met. We take great pride in providing you, our customer, with reliable and safe drinking water that meets all Federal and State regulations. Again this year, contaminant levels in our water are well below the maximum allowable levels. Why are there contaminants in my drinking water? Drinking water, including bottled water, may be expected to contain at least small amounts of contaminants. The presence of these contaminants does not necessarily indicate that water poses a health risk. More information about contaminants and potential health effects may be obtained by calling the Environmental Protection Agency's (EPA) Safe Drinking Water Hotline (800- 426- 4791). The sources of drinking water (both tap and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs and wells. As water travels over the surface of the land or through the ground, it dissolves naturally occurring minerals and in some cases, radioactive material, and can pick up substances resulting from the presence of animals or human activity. Contaminants that may be present in water prior to treatment include: Microbial contaminant which come from sewage treatment plants, septic systems, agricultural livestock operations and wildlife. Inorganic contaminates are naturally- occurring or a result from urban storm water runoff, industrial or domestic wastewater discharges, oil and gas production and mining or farming. Pesticides and herbicides come from a variety of sources such as agricultural urban storm water runoff and residential uses. Chemical contaminants include synthetic chemicals which are byproducts of industrial processes and petroleum production that can come from gas stations, urban storm water runoff and septic systems. Radioactive contaminants are naturally occurring substances or the result of oil and gas production and mining activities. In order to ensure that tap water is safe to drink, the EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration (FDA) regulations establish limits for contaminants in bottled water, which provide protection for public health. Is Owasso's water safe to drink? YES! The City of Owasso and the City of Tulsa routinely monitor for contaminants in your drinking water according to Federal and State laws. In 2011, the City of Tulsa analyzed more than 3,000 samples looking for pollutants that might be dangerous to your health and substances that can make the water taste or smell unpleasant. In addition, the City of Owasso collected 300 samples from many different locations throughout the distribution area. The data tabulation table shows the results of our monitoring for the period of January through December 2011. What does the data mean? This report is being provided to show that our drinking water IS SAFE and meets Federal and State requirements. As you review the data table, you will see that we had a presence of Total Coliform in October 2011. Although the contaminants were at safe levels, federal law required us to make public notification to our customers. Since October 2011, fifty water samples have been analyzed and all fifty samples were free of any contaminants. The Oklahoma Department of Environmental Quality has verified and closed out this violation. Where does Owasso's water come from? Our water is purchased from the City of Tulsa. The water is treated surface water transported from three sources in northeastern Oklahoma (Lake Oologah on the Verdigris River, Lake Spavinaw and Lake Eucha on Spavinaw Creek, and Lake Hudson on the Neosho River). After the water reaches the lakes it travels to the Mohawk and A.B. Jewell water treatment plants where it is treated to remove any substances that might threaten public health. TO: The Honorable Chair and Trustees Owasso Public Works Authority FROM: Roger Stevens Public Works Director SUBJECT: Ranch Creek Interceptor Improvements Engineering Services DATE: May 4, 2012 BACKGROUND: The Ranch Creek Sanitary Sewer Interceptor was constructed in 1984. The interceptor is operating at near capacity and provides service to approximately 2,400 acres of existing development located on the west side of HWY 169. In all, 7,500 gross acres are within the Ranch Creek sanitary sewer basin. The 2005 Wastewater Master Plan, prepared by Greely and Hansen, LLC, identified the need for improving this sewer interceptor in order to accommodate additional residential and commercial development by providing adequate conveyance capacity for current and future wastewater flows to the Santa Fe Pump Station. A subsequent study was performed by Kellogg Engineering to address the sanitary sewer overflows and accommodate new residential and commercial development. The improvements are to be upstream of the Santa Fe Pump Station (located on East 76th Street North) and extend to East 96 Street North. The project work includes upgrading the existing 18" sanitary sewer line to a new 36" diameter sewer line. The estimated project cost is $4,000,000 excluding legal and administration fees. On April 17, 2012, City staff presented to the Trustees a project concept and funding source for the Ranch Creek Interceptor Improvement Project. The Owasso Public Works Authority unanimously approved the initiation of the project at that time. REQUEST FOR PROPOSALS: A Request for Qualification /Proposals (RFQ /P) was solicited from three (3) Tulsa area firms with sanitary sewer outfall experience. The Scope of Work is the preparation of an engineering report and environmental information document to be prepared in the Funding Agency Coordinating Team (FACT) format for submittal to ODEQ and the OWRB as required for funding. After initial approvals are complete, route surveys, route layout, preliminary and final design documents will be prepared for submittal to the ODEQ /OWRB for approval. The Ranch Creek Interceptor serves the western half of Owasso, which is divided into two major and one minor drainage basin. The Interceptor serves an area west of U.S. Highway 169 from 121th Street North to 76th Street North. The interceptor terminates at the Santa Fe Lift Station, which is located 500 west of 76th Street North and the SK &O Railroad and is currently being upgraded. The current line is 18" PVC from 76th Street North to 86th Street North and 15" PVC from 86th Street North to approximately 96th Street North. The line has experienced a tremendous increase of flow due to customers and inflow /infiltration (11I). The purpose of this project is to design, permit, bid and construct the upgrade. The project will be funded through the Oklahoma Water Resources Board (OWRB) and the Clean Water State Revolving Fund (CWSRF). The engineer selected shall assist the City of Owasso with the funding package (as the package requires engineering support). Previous studies of the area have been prepared and will be made available to the engineer selected. The engineer will be responsible to preparing report in the ODEQ/Fact format and getting the report approved, as well as an Environmental Information Document. Engineer shall survey the existing alignment and the proposed alignment. Engineer shall assist with bidding and construction administration. As -built plans shall be prepared with post - construction surveys. 100 GENERAL INFORMATION A. The purpose of this Request for Proposal (RFP) is to obtain professional engineering services for the preparation of the 2012 Ranch Creek Interceptor Upgrade. B. Address and answer each question sent by each agency. Plan for securing consultants to prepare studies that may be required to get the document approved, such as an American Burying Beetle Survey, etc. Plan at least one (1) trip to OWRB during this process. 4. Assist with the funding applications, if needed, and supplying documentation for the process. 5. Attend at least two (2) public meetings regarding the project. 6. Prepare approvable plans and specifications to ODEQ and the OWRB. Secure a geotechnical company to provide test holes along the proposed and approved alignment. Plan at least one (1) trip to each agency during plan review. Plan to attend one Owasso City Council Meeting during this process. 7. Secure an abstractor to prepare a property report for each tract where an easement (whether temporary or permanent) is needed. Provide legal descriptions, exhibit maps and prepare easements for each parcel crossed by the proposed line. Be available during easement acquisition to meet with property owners on an as- needed basis. 8. When ready to bid the project, provide services to bid the project according to the State of Oklahoma and federal bidding requirements. Consulting engineering firms desiring consideration should submit Proposals in the following format: A. Cover letter B. Project Understanding and Approach: This section shall demonstrate understanding of a project needed to evaluate the need to upgrade, replace or parallel the existing interceptor, ssummarize the approach to providing each of the services included in Section 300 of the RFP. This section should not merely restate the contents of the Request for Proposals but provide a discussion of planned approach and specific work elements to be performed in accomplishing all phases of this work. Include schedule with time frames and tasks. A Scope of Work will be developed from this section. C. Project Organization and Staffing: This section shall discuss project staffing including key personnel and their qualifications. The Project Manager shall be identified. Resumes of key personnel and project manager shall be included as an appendix. D. Qualifications of the ENGINEER: 1. This section shall discuss prior experiences of the firm. Particular mention should be made regarding previous experience on similar projects. Work on previous Oklahoma Water Resources Board — Clean Water State Revolving Fund projects shall also be included. References MUST be included. 2. The section shall also include a discussion of projects performed within the past five (5) years involving sanitary sewer line design and construction. The discussion of each project shall include a description each similar project, schedules (both design and construction) and special circumstances encountered in the project and how your involvement in the selection of pipe type to use. 3. All current or pending litigation, against the firm shall be provided. 4. Description of Additional or Supporting Services: The consulting engineering firm shall submit a description of other capabilities to provide the City with additional information which may be used as a reference should they desire the firm to perform additional or supporting services. G. Selection Schedule: We anticipate contacting the successful engineering firm on Tuesday, May 8, 2012. A meeting with the firm, if necessary, shall be arranged to negotiate a fee and have a scope of service ready with an engineering agreement to discuss at the May 15, 2012 Council Meeting. H. Number of Copies of Proposal: Engineer shall submit one (1) original and four (4) copies of the proposal to the City in response to the RFP. I. CAUTION: All information requested shall be included in the proposal at the time of submittal. Incomplete proposals will be considered incomplete and may be subject to refection on that basis 500 REVIEW CRITERIA FOR THE PROPOSALS RECEIVED A. All information that have been received by the deadline and in the manner required in this RFP will be opened and evaluated by a Review Committee. The evaluation will be based upon the criteria presented in Section F. Proposals will be ranked according to the total number of evaluation points assigned by the Review Committee. Based upon this initial evaluation, the Review Committee will identify one firm as most "Qualified and Highly Responsive ". B. If warranted, the Review Committee may, at its discretion, postpone the selection and select one or more of the firms for an interview in order to exchange additional information or clarify portions of the proposal contents. C. The ENGINEER selected as most "Qualified and Highly Responsive" will be requested to submit a detailed Scope of Services and fee proposal for final evaluation by the Review committee. The detailed Scope of Services will consist of all modifications and refinements made to the original RFP Scope of Services. Street rehabilitation sites are evaluated and selected based on a comprehensive assessment of roadway conditions. The selection process is aimed at maximizing the taxpayer's return on investment by increasing roadway lifecycle and minimizing future maintenance costs while enhancing overall roadway driving conditions and public safety. As in previous years, the City of Owasso desires to further maximize cost savings by partnering with Tulsa County to complete various asphalt overlay portions of the rehabilitation project. A formal request, via an Interlocal Agreement, for the use of County labor and equipment for roadway segments receiving a 2" asphalt overlay will be submitted for City Council consideration and appropriate action subsequent to approval of the FY 2012 -2013 rehabilitation priorities. PRIORITY STREET REPAIRS /MAINTENANCE IDENTIFIED: In November 2011, the Public Works staff completed an update to the city's street inventory. The data collected for the model was adjusted to reflect changes in segment conditions and a new priority listing was generated. A map depicting the location of the proposed priority sites is attached for review. The anticipated cost for the proposed street rehabilitation priorities is approximately $1.2 million and includes 4% contingency funding. PROJECT FUNDING: Funding for this project in the amount of $1 million is proposed in the FY 2012 -2013 Capital Improvements Fund budget. As you may recall, FY 2011 -2012 Street Rehabilitation bids were significantly less than the engineering estimates. Thus, staff will be recommending approximately $200,000 be carried over in July 2012 in order to fully fund this proposed project. PROPOSED ACTION: This item will be placed on the May 8, 2012, City Council work session agenda for discussion. OVERLAY PREVENTIVE MAINTENANCE GUIDELINES AND OPTIONS Preventive Maintenance Types Pavement maintenance services are provided under two programs designed to preserve and repair roadways: 1. Preventive Maintenance, which includes • Fog Seal • Crack Seal • Micropave /Slurry Seal • Resurfacing /Overlay 2. Pavement Reconstruction Preventive Maintenance Preventive maintenance, if performed before the road begins to break up, is the most cost - effective of the two programs. Its purpose is to extend the life of the road and to keep it looking and riding, as much as possible, in like -new condition. The work performed under a preventive maintenance program could include fog sealing, micropave /slurry sealing, and resurfacing /overlay. The purpose of any type of preventive maintenance is to stop water from seeping into the roadway material, which causes early break -up of the road surface. The useful life of roadways can be extended from 20 to as much as 100 years if, on a regularly scheduled basis, small breaks are fixed and a seal coat or resurfacing is performed before severe damage occurs. This is the reason why maintenance work is sometimes performed on streets that appear to be in good addition. Fog Sealing_- A method of applying an asphalt emulsion to an existing pavement surface to improve sealing or waterproofing and prevent further stone loss by holding the aggregate in place. Typically, this method is recommended once the pavement life has reached five to seven years. By performing such maintenance, the pavement life is expected to be extended by five years. Crack Sealing - A_method of applying a long lasting, resilient sealant in cracks and joints which is flexible and expandable in varying and extreme pavement temperatures. The sealant will prevent the invasion of surface water between the layers of asphalt and sub - grade rock, thus preventing premature failures, deterioration, and potholes. By performing such maintenance, the pavement life is expected to be extended by three to five years. Micropave - Application of a mixture of fine aggregate with asphalt emulsion. Micropave is utilized on streets with higher traffic volumes. Depending on the traffic volume, this method is recommended once the pavement life has reached five to eight years. By performing such maintenance, the pavement is expected to be extended for an additional 10 years. Resurface /Overlay - Asphalt overlay is a road - resurfacing method where a lift of asphalt is placed on top of the existing roadway surface. Asphalt overlays are designed to extend the life of a road's driving surface and keep roads in good condition by preventing potholes and preserving the underlying road bed structure. With preventive maintenance measures in place, the pavement life is expected to be extended for an additional 15 -20 years. Pavement Reconstruction When the condition of a roadway reaches the point where preventive maintenance is no longer cost - effective, the entire roadway must be removed and replaced. Sd T out Limits.
