I would like. to first of all thank you for your willingness to discuss this very important
with the City As you can gather from the subject reference, union arbitration
issues are a major source of concem for numerous cities and towns throughout the State. The
City Owasso is primarily concemed with recent events stemming from interest and grievance
arbitration cases.
Municipalities across the state are frustrated with the Fire and Police Arbitration Act
(FP AA). Officials acknowledge the services provided by law enforcement officers and
firefighters, however, it appears to many of us that the police officers and firefighters fi:equently
forget that they are municipal employees and not employed by the bargaining units that represent
them. Our dissatisfaction has reached the point that multi-pronged efforts by municipal officials
are being developed to bring changes to the law, specifically to binding arbitration on wages and
benefit issues. We will strongly urge the State Legislature to consider repealing the binding
arbitration law in the upcoming 2002 legislative session.
While frustrations have historically existed with contract negotiations and arbitration, the
present interest arbitration law encourages both fire and police unions to move swiftly to
arbitration without giving much attention to the importance of setting around a negotiation table.
There is a final resolution provided to municipalities under the law, which allows cities and
towns to place contract issues before the citizens of the community through a "vote of the
people". In such elections, residents have the final decision on new contract terms. This process
is very expensive and cap spili over into other ballot questions. For example, Ponca City put its'
fire contract before the. voters last spring and it nearly cost the Mayor his seat on the City
Council, even though the community overwhelming supported the City's contract position.
Coincidentally, legislation was proposed this past session that, if passed, would have allowed
voter registration at any address, regardless of residency. Meaning, as we understand it, that
residents outside our corporate limits could have voted in a municipal election.
Municipal frustrations ,are also escalating over grievance arbitration cases involving
employee terminations. Under the law, municipalities are bound by decisions of arbitrators who
often live in states some distance from Oklahoma and are at best only marginally familiar with
Oklahoma laws. Often their decisions are made by "implying" terms and clauses that the
arbitrator believes should be in the agreement between the parties. When such elToneous
decisions are made, municipalities are left with the option of accepting the bad decision (usually

I believe there is a general consensus that the supplemental appropriation should be used
for the benefit of the entire community. The proposal to replace the City's antiquated storm
siren system certainly qualifies as a citywide project. Should the City Council agree with this
recommendation, staffwill proceed with securing equipment bids.

assist the City Council in making this one-time expenditure, I requested that each of
the department directors submit possible capital projects for consideration and provided the City
Council with a copy of the list at the June 19th workshop, see attached. I have not received any
additional suggestions since that time :from either the City Council or the department directors.
Based upon the discussion generated by the proposed project list, I have identified the top four
suggestions for the supplemental appropriation and listed them as follows:
The City's Finance Director, Sherry Bishop, indicated recently that Owasso's financial
position will be much stronger than projected at the beginning the City's fiscal year. The
improved balance sheet is the direct result departmental expenditures coming in lower than
budget allocations, coupled with higher than anticipated revenue collections. As a result, the
City Council will have the opportunity to consider a year~end supplemental
appropriation approximately $250,000.

In order to leave the amount of the RAN open for additional expenses, the Council and the OPW A
may simply extend the term of the note. New documents (Loan Agreement and Revenue
Anticipation Note) are not required. The existing note may be prepaid at any time allowing the
principal to be reduced, as funds are available from connection fees. The need to "refinance" the
project is accomplished with minimal staff time and no additional expenses.
Although construction of the sewer interceptor line is complete, other expenses associated with the
project are not. Lift station improvements are still in engineering and there is the potential for
additional expenses for loss of trees in the eaSements. The project is not at a point to be able to set
the amount of the RAN.
The RAN (Revenue Anticipation Note) between the City and the OPW A was approved August
1998 by the City Council and the OPWA Trustees. The RAN was set up as a temporary
construction loan with funds drawn as needed and interest accrued on the balance. The note is for
an amount not to exceed $1,800,000 at 5.2% interest for one year. The current balance of the
RAN is $564,544.05 with accrued interest of $13,824.40. The note matures and payment of
principal and interest is due August 4, 1999. The original concept anticipated that when the one-
year RAN matured, it would be replaced with another RAN with a fixed amount and term.

The City may, at any time prior to the due date of payment of this
Revenue Anticipation Note call for an early pre-payment in whole,
or in part, if it is determined by the City, in it's sole
discretion, that the funds heretofore advanced pursuant to this

Section 1. That the Tmstees of the Owasso Public Works Authority hereby establish the
assessment area being any area outside the boundary illustrated in Exhibit "A" which connects to
the Owasso Public Works Authority's wastewater system.
NOW, THEREFORE, BE IT RESOLVED BY THE TRUSTEES OF THE
OWASSO PUBLIC WORKS AUTHORITY, TO-WIT:
WHEREAS, the Tmstees ofthe Owasso Public Works Authority by virtue hereofhereby
create a mechanism for recoupment of the cost associated with the wastewater collection system
resulting from connection by areas other than the illustrated in Exhibit "A."
WHEREAS, by virtue of representation, on the part of the developers and owners of
property lying within the Owasso development area, the Owasso Public Works Authority, and on
behalf of it's beneficiary thereof, the City of Owasso, Oklahoma, should provide a mechanism
for recoupment of the cost associated with the cost of construction and maintenance; and,
WHEREAS, additional costs will be required to serve properties outside the area shown
in Exhibit "A" by either gravity or force mains; and,
WHEREAS, the Owasso Public Works Authority has developed the Elm Creek
wastewater sewer system in the Elm Creek Drainage Basin to serve the area defined in
Resolution 98-07 by the Owasso Public Works Authority as shown in exhibit "A" attached; and,
WHEREAS, the Owasso Public Works Authority has made provisions whereby lands
outside the City of Owasso might be served by the same wastewater system; and,

Section 2. That the portions set forth beyond the area identified in Exhibit "A" hereto,

Staff recommends Council approval and authorization of payment for the purchase of one Kubota
Diesel M4900 Tractor from Enlow Ford Tractor Inc., of Tulsa at a cost of$15,540.00
RECOIVIMENDATION:
If the purchase and payment are approved by the City Council, the new Kubota tractor will replace a
1975 Ford Tractor and a 1982 Kubota Tractor. It is anticipated that staff will ask the City Council to
declare both surplus in the near future so that they may be auctioned.
REPLACEMENT:
Funds for the purchase of the Utility tractor were included within the Capital Outlay pOliion ofthe
Parks Department budget in the amount of $17,000. Funds remaining in this line item will be used to
purchase a mowing deck for the tractor.
FUNDING:
A review of the bids indicates that both bids met bid specifications. The bid specifications, which
detail the type and size of engine, are attached for your information and review. Staff has further
reviewed the bid submitted by Enlow Ford Tractor and has determined compliance in every categOlY
specified. If approved by the Council, staff anticipates delivelY of the tractor within thirty days.

In July of this year, the Parks Depmiment began the process of adve1iising for bids in order to
purchase a Utility Tractor to be used within that department. The tractor is necessary to assist in the
mowing of the large field areas at the Owasso Sports Park and McCmiy Park and is anticipated to be
used extensively in Preston Lakes Centennial Park. All bids were to be submitted prior to 10:00

6. PAYMENT - As with all municipalities in Oklahoma, payment must be approved and
signed on a claims list by the proper city authority. Payment shall be made only after
complete and acceptable delivery of the tractor, in accordance with these specifications.
The Owasso City Council meets regularly on the first and third Tuesday of every month.
5. INSPECTION - An acceptance inspection shall be conducted between the supplier and the
City before delivery will be accepted. The inspection date shall be at the City's
convenience. All discrepancies noted during the inspection shall be remedied at the
supplier's expense, prior to payment for this equipment.
4. BIDS - The purchaser reserves the right to reject any or all bids and to waive any or all
technicalities, informalities, or other minor deviations from the bid document.
WARRANTY - A manufacturer's and/or dealer's warranty shall be supplied to cover
replacement parts and labor costs. The manufacturer agrees to promptly replace any part or
parts which by reason of defective materials or workmanship, or installation, fail under
normal use. Such replacement must be free of charge to the owner. Warranty will be for a
period of twelve (12) months from the date of delivery on parts and labor, and twenty-four
(24) months from the date of delivery on the drive train.
- The price submitted any shall include all items labor,
other costs necessary to fully prepare the tractor delivery. Any items labor
omitted from the specifications, which are clearly necessary the proper delivery of the
tractor, shall be considered a portion such specifications although not directly specified
or called for in these specifications. Price quoted shall remain effective for a period of
thirty (30) days after opening of bids.

Volunteer Network Owasso

It is understood and agreed that Volunteer Network Owasso will be required to make certain modifications to the building to meet the
Americans with Disabilities Act. It is further understood and agreed that all modification plans will be submitted to the City for final
approval. It is agreed that Volunteer Network Owasso will be responsible for all costs relateq to subject renovations, however, in the
event that the lease is terminated prior to three years, the City of Owasso agrees to reimburse Volunteer Network Owasso for its
prol'llted amount of expenses'incurred in modifYing the building.
Volunteer Network Owasso further agrees that the expiration of the time given in this lease, to-wit:

building to the City of Owasso, provided t~at Volunteer Network Owasso be offered first right of refusal in the event the City of

A secondary purpose of Network Owasso is to help the citizens of Owasso to benefit from a
more effective delivery system for social services through arrangement for provision of part-time
office or meeting space for existing social service agencies. Instead of travelling to Tulsa,
Owasso area residents will be able to meet at the Community Center or other places for such
services. In Owasso, the focus of social service programs has been piecemeal, and though there
are a few programs like Margaret Hudson and RSVP providing direct services, there is not a
well-recognized base of operations for social services. The Community Center has the built-in
recognition and facilities to become such a base.

The primary purpose of Network Owasso is to mobilize volunteer efforts in the City of Owasso.
Its philosophy is built around the concept that individuals living in any community care about
their neighbors and see needs that are unmet, but sometimes feel helpless to provide assistance.
This program is designed to harness people's energy, talent and wisdom and to enable
participants to become more involved in their own community. Network Owasso will draw
people into the process of knowing what services are available or who needs help and linking
them through an extensive database and careful matching with the appropriate individuals and/or
groups. This proposal directs the efforts of the community center to become a nucleus to
organize volunteer actiVities to meet basic human needs.
you know, a 501 (c) 3 board of trustees is currently being formed to be the recipient of this
grant and to oversee the institution and operation of this program. The budget for Network
Owasso envisions using existing resources provided by the City of Owasso in the operation of
the Community Center and provides for a full-time coordinator to supervise the activities of the
network. Supervision through the Director of the Community Center, support staff, and
facilities will provide continuity and support to initiate this program.
We received official notice at the end of December, 1993, that the Tulsa Area United Way
Board of Directors approved a recommendation from its Fund Distribution Committee to allocate
a 1994 Venture Grant of up to $23,250 to "Network Owasso." you are well aware, this is
the end of a long road begun by you over three years ago to fulfill the vision for a volunteer
"networking" program for the area.
