Tuesday, May 15, 2012
The Owasso City Council met in regular session on Tuesday, May 15, 2012 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 6:00 p.m. on Friday, May 11, 2012.
ITEM 1 CALL TO ORDER
Mayor Bonebrake called the meeting to order at 6:30 p.m.

Councilor Brown presented a Character Certificate to Mr. Bodden for displaying the character

ITEM 6 PRESENTATION OF MAYOR'S PROCLAMATION
Mayor Bonebrake presented a proclamation to Chris Greer, Owasso Girls Softball Association
declaring June 1, 2, and 3 as Strikes against Cancer weekend in the City of Owasso.
ITEM 7 CITIZEN REQUEST TO ADDRESS THE CITY COUNCIL
Ms. Kristen Saint requested this item be withdrawn from the May 15th agenda and placed on the
June 5th Council agenda.

$353,941.85. Also included for review were the healthcare self-insurance claims report and

APPROVAL OF A WORKERS' COMPENSATION SETTLEMENT
Michele Dempster presented the item recommending City Council approval and authorization
for payment on the workers' compensation settlement for David Sole in the total amount of
$30,685. After discussion, Mr. Ross moved, seconded by Ms. Moberly to approve the workers'
compensation settlement, as recommended.

ITEM 11 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR
APPROVAL OF AN AMENDMENT TO THE 2025 LAND USE MASTER PLAN
Bronce Stephenson presented the item recommending City Council approval to amend the
land use masterplan rezoning property located along 98th Street North and East 99th Street North
immediately north of the Owasso Market development and south of the St. Johns Owasso
Medical Campus from CS (Commercial Shopping) and OL (Office Light) to RM (Residential Multi-
Family). After discussion, Mr. Brown moved, seconded by Mr. Kelley to amend the 2025 Land Use
masterplan, as recommended.

ITEM 12 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL
OF A PLANNED UNIT DEVELOPMENT (PUD-12-01) AND REZONING - 91NETYEIGHT
Bronce Stephenson presented the item recommending City Council approval of PUD 12-01 for
the 9inetyEight development and associated rezoning to RM (Residential Multi-Family). After
discussion, Mr. Bonebrake moved, seconded by Mr. Kelley to approve the planned unit
development, as recommended.

ITEM 13. CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR RE-
APPROVAL OF THE FINAL PLAT, VILLAS AT STONEBRIDGE
Bronce Stephenson presented the item recommending City Council approval of the final plat for
the Villas at Stonebridge. After discussion, Ms. Moberly moved, seconded by Mr. Ross to re-
approve the final plat, as recommended.

ITEM 14 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR
APPROVAL OF THE FINAL PLAT, LAKERIDGE SHOPPING CENTER
Councilor Kelley declared a potential conflict of interest and recused himself from the discussion
and vote. Mr. Kelley exited the Council Chamber. Bronce Stephenson presented the item
recommending City Council approval of the final plat for the Lakeridge Shopping Center. After
discussion, Ms. Moberly moved, seconded by Mr. Ross to approve the final plat, as
recommended.
YEA: Moberly, Ross, Brown, Bonebrake
NAY: None
Motion carried 4-0
Councilor Kelley returned to the Council Chamber following the roll call vote.
ITEM 15 PUBLIC HEARING RELATING TO A PROPOSED ZONING CODE TEXT AMENDMENT -
SMALL WIND ENERGY SYSTEMS
Karl Fritschen presented the item recommending City Council conduct a public hearing for the
purpose of receiving comments and citizen input regarding a recommendation from City staff
to amend Chapter 15, Wind Turbines, of the Owasso Zoning Code. Mayor Bonebrake opened
the public hearing at 7:22pm and closed the public hearing at 7:23pm with no comments
received.

ITEM 16 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR
APPROVAL OF THE FY 2012-2013 STREET REHABILITATION PROGRAM PRIORITY SITES
Roger Stevens presented the item recommending City Council approval of the FY 2012-2013
Street Rehabilitation Program priority sites. After discussion, Mr. Brown moved, seconded by Ms.
Moberly to approve the FY 2012-2013 program, as recommended.

ITEM 17 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR
APPROVAL OF A LEASE-PURCHASE AGREEMENT BETWEEN THE CITY OF OWASSO, THE
OWASSO PUBLIC WORKS AUTHORITY, AND THE FIRST BANK OF OWASSO, FOR THE
PURCHASE OF REAL PROPERTY LOCATED AT THE SOUTHWEST CORNER OF E 76TH
STREET NORTH AND S MAIN STREET, FORMER SITE OF THE FIRST BANK OF OWASSO
The item was withdrawn from the agenda prior to the start of the meeting.
ITEM 18 REPORT FROM CITY MANAGER
Mr. Ray commented on the following items: 1) 2% Hotel Tax for the Owasso Strong
Neighborhood Initiative will sunset in August of 2013 and advised Council that the staff is
preparing an impact study. Mr. Fowler reported that the 4th Owasso Cares Day will take place
on Saturday, May 19th; 2) a public hearing for citizen input on the FY 2012-2013 will be held on
Tuesday, June 5th; 3) the process has begun to correct a zoning error related to the SAM'S
Development and staff anticipates bringing the item before the Council during the June 5th
meeting for consideration and appropriate action.

SUBJECT: Acceptance of Engineer's Agreement

BACKGROUND:
At the May 17, 2005 City Council meeting, the Engineering Design Criteria, Construction
Standards, and Standard Details were adopted by the City Council. Documents required as a
result of that adoption include two different agreements, one which must be submitted by the
developer and one which must be submitted by the developer's engineer. The agreements are
as follows:
ENGINEER AGREEMENT
The agreement required to be submitted by the developer's engineer is titled "Agreement for
Urban Engineering Services" (Section 0114.1 (13)). This agreement requires the engineer to list all
improvements associated with the proposed development, attest that all designs will be in
compliance with City standards (outlined in the design criteria), pay all fees associated with the
plan review, attest that he/she is a Registered Professional Engineer in the State of Oklahoma,
and attest that he/she maintains Professional Liability Insurance in limits directly correlated to the
cost of the project specified in the attached agreement. The liability insurance to project cost
ratio schedule is as follows:

DEVELOPER AGREEMENT
The agreement required to be submitted by the developer is titled "Agreement Guaranteeing
Installation of Improvements" (Section 0114.1 (C)). This agreement requires the developer to
submit engineering drawings for the proposed improvements, provide oversight of his/her
construction contractor to assure compliance with the approved plans, and submit "as-built"
drawings upon completion of the construction of improvements.
Since the approval of the Engineering Design Criteria, Construction Standards, and Standard
Details in May 2005, Developers and Engineers alike have complied with the above
requirements and submitted both agreements. The Mayor's signature is required on the
"Agreement for Urban Engineering Services" (Engineer Agreement), therefore Council approval
is needed.
RECOMMENDATION:
Staff recommends Council acceptance of the "Agreement for Urban Engineering Services"
(Engineer Agreement):
Tulsa Engineering & Planning Associates, Inc., Senior Suites-Owasso, located on Lot 2,
Block 2, "Owasso Medical Campus", a subdivision in the City of Owasso, Tulsa County,
Oklahoma according to official recorded plat No. 5862, as filed in the records of the
Tulsa County Clerk.

AGREEMENT FOR UIUU AN ENGINEERING SERVICES
THIS AGR.EEMFNT, entered into by and between the CITY OF OWASSO,
OKLAHOMA, a municipal corporation, hereinafter called `City" and
Tulsa Engineering & Planning Assoc., Inc, hereinafter called "Design Engineer".
WITNESSETH:
WHEREAS, the Design Engineer has been employed by the Owner/DeveloperiSu-bdivider
of the herein described real property to prepare all project plans and specifications and to
provide certain engineering services during the construction of the hereinafter sometimes
referred to as the "Project", upon easements and rights-of-ways to be owned or controlled by
the City; and
WHEREAS, the Design Engineer is desirous of obtaining the review (and approval) of the
plans and specifications for said project by the City of Owasso Public Works Department, and
WHEREAS, the City is willing to review the plans and specifications prepared by the
Design Engineer tinder the hereinafter described terms and conditions.
NOW, THEREFORE, in consideration of the foregoing and in consideration of the
hereinafter set forth promises and covenants, the parties hereto mutually agree as follows, to-
wit,
1. The Improvements to be designed by the Design Engineer (pursuant to this Contract)
shall generally consist of the following types of improvements

2. The Design Engineer shall, in conformity with the provisions of the City's Standard
Specifications for Urban Engineering Services, including the City's current Design
Criteria, which are hereby incorporated and made a part of this Contract by reference,
prepare project plans, specifications, and other engineering documents as may be
necessary for the proper construction of the project improvement, and shall perform
all construction layout surveys, and staking and periodic general construction
supervision on. the project improvements as they are constructed by the Owner- and his
Contractor.
3. The City shall review (and approve) the project plans, specifications, and other
engineering documents for the construction of the project improvements prepared and
submitted to the City by the Design Engineer.
4. The Design Engineer shall compensate the City for reviewing (and approving) plans
and specifications for the project at the rate of One Hundred Dollars ($100.00) for each
plan sheet submitted (other than plan sheet Standard Drawings of the City of Owasso
or of the Oklahoma Department of Transportation), except that the minimum charge
for each project shall be One Hundred-fifty Dollars ($150.00). Payment shall be due
and payable upon presentation of the plans and specifications for the project for review
by the City. PFPI plan review and permit fees are waived for governmental entities.
No fees shall be collected by the City of Owasso on any public work or improvement
per brined by or for any city, county, state, or federal governmental eritity, , provided
However, tliat this exernption shall not constitute waiver of any ordinance requiring the
issuance of such permits, and it shall apply only to such permits issued directly to the
governinental entity involved.
5. The Design Engineer hereby covenants that he/she is a Registered Professionat
Engineer in the State of Oklahoma at the time of execution of this Contract, and should
the Design Engineer cease to be a Registered Professional Engineer prior to
completing performance of the terms and conditions of this Contract, the Design
Engineer shall immediately notify the City and shall engage a Registered Professional
Engineer acceptable to the City to complete performance of the promises and
covenants contained herein.
6. The Design Engineer farther covenants and agrees that he/she maintains and is covered
by Professional Liability Insurance in limits of not less than those indicated in the
following schedule:

BACKGROUND:
The City of Owasso received a Planned Unit Development (PUD) application for review and
approval of a development called 9inetyEight. The 9inetyEight development proposes an
apartment complex consisting of 284-units in 21 buildings on 15.295 acres. The subject property
is located along East 98th Street N and East 99th St N immediately north of the Owasso Market
development and to the south of the St. John Owasso medical campus. The applicant also
submitted a rezoning request with this PUD that would rezone the property from CS (Commercial
Shopping) and OL (Office Light) to RM (Multi-Family Residential), allowing for the development of
an apartment complex.
PLANNING COMMISSION
The Owasso Planning Commission reviewed this item at their regular meeting on May 7, 2012. At
that meeting, the Planning Commission unanimously recommended approval of the Zoning
Map amendment and PUD to the City Council.
CITY COUNCIL:
On May 15, 2012, the Owasso City Council considered this item and voted unanimously to
approve the 9inetyEight PUD and the Zoning Map Amendment. This ordinance officially adopts
the zoning action taken by the City Council.
RECOMMENDATION:
Staff recommends City Council approval of the attached ordinance for the rezoning of the
subject property from OL (Office Light) and CS (Commercial Shopping) to RM (Multi-Family

BACKGROUND:
When determining zoning on a property within the Owasso fenceline, staff relies on zoning maps
provided by the Indian Nation Council of Governments (INCOG), where the official zoning maps
are maintained. The INCOG maps provided to the City of Owasso show the subject property to
be zoned as Commercial Shopping (CS). A mistake was made on INCOG's zoning map several
years ago and the subject property was coded and shown as CS, even though it was, in fact,
still zoned AG (Agricultural). The subject property was located outside of the Owasso City Limits
in Tulsa County at the time of the mapping error.
When the property was annexed into the City of Owasso in 2006 through Ordinance #869, it was
assigned CS zoning according to the INCOG zoning map. This annexation involved ten parcels
throughout the City, and included the 29.98 acre subject property. The annexation ordinance
was officially recorded in Tulsa County on August 3, 2006. Because the property was never
actually rezoned from AG to the assumed CS zoning while still in Tulsa County, this rezoning is
necessary. Additionally, INCOG, other Tulsa County Departments, and the City of Owasso, who
were all using the same incorrect zoning map, would now have correct and accurate
information as a part of this rezoning process.
The Tulsa Metropolitan Planning Commission, who handles rezoning cases for Tulsa County, was
contacted regarding this situation once it was determined that the zoning map may be
incorrect. After an extensive search of their records, they found no ordinance that rezoned the
subject property from the AG to CS while the property was in Tulsa County's jurisdiction. INCOG
indicated that the best explanation as to why the maps reflected CS zoning on this property was
due to an error made when the area was updated for their digital maps. In the conversion of
the zoning maps to the digital format in 2003, INCOG indicated that they have discovered other
similar mistakes, especially when properties were located adjacent to city limit boundary lines or
were mistaken for zoning lines.
ANALYSIS:
On April 17, 2012 the City Council approved the Final Plat for the Willis Farms Addition (Sam's
Club) under the assumption that the property was zoned CS. Because it has been discovered
that the property is actually zoned AG, the proposed commercial use for the property would be
non-conforming. In order to correct the mapping error and ensure that the proposed
commercial uses are conforming to the zoning, the property must be rezoned from AG to CS by
ordinance approved by the City Council. The approval of the plat and the site plan for the
development of the site are not impacted by this rezoning action and would still be valid.
The proposed rezoning of the subject property from AG to CS is an appropriate action. The
property is situated on the hard corner of two section line roads (E 96th St N & N 129th E Ave).
Commercial areas at hard corners of section line roads have been an established nodal
development pattern in Owasso for a number of years, and this rezoning fits within that pattern.
Additionally, the other properties on the corner of this intersection are zoned commercially and
have developed in a commercial fashion.
The subject property is also adjacent to US-169 highway access points and fronts East 96th St N,
which is the main commercial corridor in the City of Owasso. Commercial zoning is appropriate
in areas that have direct and easy access to major transportation systems.
Neighboring property owners to the south of the site who are concerned with the development
of the subject property have stated that an area of OL (Office Light) zoning should be placed
along the E 96th St N frontage to offer a buffer. If the subject property was directly abutting a
residential area, staff might agree that a buffer should be in place, but the homes are across a
section line road that will eventually become six (6) lanes in width. The residential properties are
not abutting the subject site and the areas are buffered by the E 96th St N right-of-way, existing
fencing, required building setbacks, and landscaping in the area. Based upon the location of
the residential homes to the south of the subject property, the width of the right-of-way of E 96th
St N, and the required setbacks for commercial properties, there would be approximately one-
hundred seventy-five feet minimum distance between the residential homes and any
commercial structures that could be built on the subject property. Based upon these reasons,
additional zoning buffers are not appropriate for this rezoning action.
The Council's previous action on the Construction Agreement with the developer of the Sam's
site will further improve the area for the current residents and the future commercial tenants.
The City of Owasso required much more stringent public improvements to be made surrounding
the site that will protect neighboring property owners and will make this area viable for
development for the next few decades. The City kept the needs and safety of current residents
and businesses near the subject property in mind when making the additional requirements of
the Construction Agreement, with the intended result of better infrastructure, improved
transportation, additional stormwater controls, and better quality of life.
Staff finds that CS zoning is appropriate and establishes the highest and best use of the subject
property. The Owasso Land Use Master Plan identifies the subject property for Commercial uses
and has shown it as appropriate for Commercial development prior to it being annexed into
City Limits. The smaller parcels on the subject property abutting E 96th St N will also be subject to
the rules and regulations of the US-169 Overlay that was recently adopted. The Overlay will
ensure that architecture, use, and site design elements will be complementary to the
surrounding area and the Overlay requirements will provide additional protections to
neighboring properties. Along with the US-169 Overlay requirements, the newly adopted
landscape chapter of the Owasso Zoning Code has strict requirements on the installation of
required plant materials that will screen uses from roadways and surrounding properties. A
street yard along E 96th St N will provide street trees that will offer screening and the required
parking lot yard will screen unsightly parking lots from the surrounding area. The combination of
Owasso's progressive Zoning Codes, including the US-169 Overlay, Landscape Chapter, Lighting
Ordinance, and Parking Chapter will ensure that this site will develop in an attractive,
responsible, and safe manner that will have minimal impacts on the surrounding area.
Letters were mailed to surrounding property owners within 300' of the subject property and the
notification was published in the Tulsa World.
LAND USE MASTER PLAN CONSISTENCY:
Irrespective of the annexation and subsequent mapping errors, the property has been identified
for commercial uses since 2000. The land use master plans adopted in 2000 (2010 Land Use
Master Plan), 2004 (2015 Land Use Master Plan), and in the 2008 (2025 Land Use Master Plan),
indicate the subject property is an appropriate location for commercial uses. Therefore, any
rezoning action on the subject property should be assigned a commercial zoning.
Additionally, the 2010, 2015, and the 2025 Land Use Master Plans call for the preservation of
prime commercial tracts of land through effective land use planning. This zoning action adheres
to the goals of the Land Use Master Plan.
PLANNING COMMISSION:
The Owasso Planning Commission will review this item at a meeting on June 4, 2012. Staff is
recommending Planning Commission approval of the Zoning Map Amendment.
RECOMMENDATION:
Staff recommends City Council approval of Zoning Map Amendment OZ-12-03.

BACKGROUND:
Shortly after the approval of the Willis Farms final plat for the Sam's Club, it was brought to staff's
attention by the attorney representing the Sam's property transaction, that there was an issue
regarding the zoning on the property. Apparently, during the abstract and title search for the
property as part of the closing, it was discovered that no records existed indicating the property
was zoned CS (Commercial Shopping), but rather still retained an AG (Agricultural District)
zoning classification. Rezoning the property would correct the mistake and zone the property
CS (Commercial Shopping) and would allow for the planned development of the property.
PLANNING COMMISSION
The Owasso Planning Commission will review this item at a meeting on June 4, 2012.
PROPOSED ACTION:
Staff recommends City Council approval of the attached ordinance No. 1005 for the rezoning of
the Willis Farms Addition

SUBJECT: Ordinance No. 1006, Proposed Zoning Code Amendment - Small Wind Energy
Systems - Chapter 15 of the Owasso Zoning Code

BACKGROUND:
The Community Development Department is currently working on a comprehensive update of
the Owasso Zoning Code. Alternative energy sources are becoming an affordable option for
many homeowners, commercial businesses, and educational institutions. Considering this, staff
conducted research about wind energy systems and developed the attached ordinance for
the installation of small wind energy systems for both residential and commercial uses. The
attached criteria, which will become a new section in Chapter 15 of the Owasso Zoning Code,
were developed based on current technology. As the technology for wind energy improves, it
will be important to revisit these criteria to ensure they remain current. The proposed change
provides a comprehensive approach for the development of small wind energy systems and
ensures that there is consistency in their construction and placement.
This new chapter has been taken to the OEDA, two City Council Works Sessions, and twice to the
Planning Commission. Additionally, the document has been posted on the City's web page for
over six (6) weeks. All of the comments and input received at each of these meetings were
considered and some have been incorporated into the attached ordinance.
PROPOSED AMENDMENT TO THE ZONING CODE:
If approved, this document will amend Chapter 15 of the Zoning Code, Telecommunication
Towers, by adding a new section 1530. Additionally, the title of Chapter 15 will be changed to
read Telecommunication Towers and Small Wind Energy Systems. The ordinance provides
design criteria that establish minimum requirements for small wind energy systems and
commercial wind energy systems in order to ensure their safe installation. Below is a summary of
what the ordinance addresses.
➢ Wind towers will be allowed on any lot inside the City Limits of Owasso, so long as the
tower is no taller than 15 feet in height. However, setback requirements will ensure
that said towers are placed a safe distance from property lines or other structures.
➢ Towers greater than 15 feet are allowed up to a maximum height of 100 feet. As the
tower height is increases, so must the acreage of the property on which the tower is
located.
➢ Towers may not be located in any front or side yard.
➢ All Towers are approved with a specific use permit.
➢ There are restrictions in terms of minimum blade height and proximity of the blades to
nearby structures.
➢ No small wind energy system shall exceed 60 dBA as measured at the nearest
property line or 50 dBA as measured at the nearest neighboring inhabitable building.
Additionally, all noise complaints shall be worked as a nuisance and will become a
code enforcement matter.
➢ Site plans and system specifications are required as part of the permitting process.
➢ Small wind energy systems shall be finished in a rust-resistant, non-obtrusive finish and
color that is non-reflective.
PLANNING COMMISSION:
The Owasso Planning Commission reviewed this item at their regular meeting on May 7, 2012. At
that meeting, the Planning Commission suggested minor language changes, which were
incorporated, and unanimously recommended approval of the Zoning Code amendment to
the City Council.
CITY COUNCIL:
On May 15, 2012 the City Council held a public hearing on this item. No citizen comments were
made regarding the proposed ordinance.
RECOMMENDATION:
Staff recommends City Council approval of Ordinance No. 1006, amending Chapter 15 of the
Owasso Zoning Code.

ORDINANCE NO. 1006
AN ORDINANCE AMENDING THE CITY OF OWASSO ZONING CODE AS CODIFIED IN THE
OWASSO CODE OF ORDINANCES, PART 12, PLANNING, ZONING AND DEVELOPMENT, CHAPTER
2, ZONING REGULATIONS, SUB-CHAPTER 15, TELECOMMUNICATION TOWERS AND SMALL WIND
ENERGY SYSTEMS, BY ADDING SUB-SECTION 1530, SMALL WIND ENERGY SYSTEMS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT:
SECTION ONE (1): AMENDED LANGUAGE
The Owasso Zoning Code, contained within the Owasso Code of Ordinances in Part 12,
Chapter 2, Sub-Chapter 15 shall be amended to read as follows:
CHAPTER 15
TELECOMMUNICATION TOWERS AND SMALL WIND ENERGY SYSTEMS
1530 SMALL WIND ENERGY SYSTEMS
1530.1 PURPOSE
The purpose of this chapter is to provide standards that will protect the health,
safety and general welfare of the public and achieve the following:
Provide design criteria that establish minimum requirements for small wind
energy systems and commercial wind energy systems as defined herein to
ensure the safe installation of wind towers in the City of Owasso
• Promote energy savings and the use of `green infrastructure'
1530.2 APPLICABILITY
The requirements of this ordinance shall apply to all small wind energy systems
and commercial wind energy systems proposed after the effective date of this
ordinance. Wind energy systems for which a required permit has been properly
issued prior to the effective date of this ordinance shall not be required to meet
the requirements of this ordinance; provided, however, that any such system shall
be installed and functioning within 24 months of the date of the permit. Any
system that has been installed, but not used for two consecutive years may not
be subsequently used without meeting the requirements of this ordinance. No
pre-existing system shall be altered in any manner that would increase the
degree of nonconformity with the requirements of this ordinance and no
alterations shall be made to a nonconforming pre-existing system during its life
which exceeds 50% of its fair market value. If such system is destroyed or
damaged to the extent of more than 50% of its fair market value at the time of
destruction or damage, it shall not be reconstructed except in conformity with
this ordinance.
1530.3 SMALL WIND ENERGY SYSTEM REQUIREMENTS
A. Total Height (Figure 1530-1). The not-to-exceed height of wind energy system
structures shall vary with the size of the lot.
1. For property sizes less than one acre in size the total height shall not exceed 15
feet.
2. For property sizes between one acre and two acres, the total height shall not
exceed 60 feet.
3. For property sizes between two and five acres, the total height shall not
exceed 80 feet.
4. For property sizes greater than five acres, the total height shall not exceed 100
feet.

B. Location. No small wind energy system shall be located in any front or side yard.
C. Setbacks.
1. Property lines. A small wind energy system shall be set back from the nearest
property line, public road right-of-way and communication
and electrical line not less than 1.5 times the total height of the wind turbine.
2. Inhabited Structures. A small wind energy system shall be set back
from the nearest inhabited structure not less than 1.5 times the total height of
the wind turbine.
D. Design Standards.
1. Monopole or Freestanding Design. The design of the small wind energy
2. Minimum Blade Height. For towers in excess of 30 feet in height, the minimum
height of the lowest extent of a turbine blade shall be 30 feet above finished
grade (Figure 1530-2) and shall be separated from any structure (i.e. house,
shed, barn, recreational element) not less than 1.5 times the blade height
from said structure (Figure 1530-3).

3. Access. No tower shall have a climbing apparatus within 12 feet of the
ground. All access doors or access ways to towers and electrical equipment
shall be lockable.
4. Noise. No small wind energy system shall exceed 60 dBA as measured at the
nearest property line or 50 dBA as measured at the nearest neighboring
inhabitable building. Should a wind tower produce an undulating pattern of
noise or vibrations, which cause distress to nearby residents, said tower may
be deemed a nuisance and worked as a code violation.
5. Visual Appearance. Small wind energy systems shall be finished in a rust-
resistant, non-obtrusive finish and color that is non-reflective. No small wind
energy system shall be lighted unless required by the FAA. No advertising signs
of any kind or nature whatsoever shall be permitted on any small wind energy
system. No transmission equipment shall be installed on the tower. All
equipment shall be screened with either a six foot opaque fence or with
evergreen vegetation not less than six foot in height.
6. Electrical Interconnections. All electrical interconnection or
i. distribution lines shall be underground and comply with all applicable codes
and public utility requirements.
7. Signal Interference. Efforts shall be made to site small wind energy systems to
reduce the likelihood of blocking or reflecting television and other
communication signals. If signal interference occurs, both the small wind
energy system owner and individual receiving interference shall make

reasonable efforts to resolve the problem. No small wind energy system shall
cause permanent and material interference with television or other
communication signals.
8. Overspeed Controls. Every small wind energy system shall be equipped with
both manual and automatic overspeed controls.
9. Federal Aviation Administration (FAA). All wind towers shall meet Federal
Aviation Administration (FAA) Regulations. Documentation shall be provided
that indicates the proposed wind tower meets FAA regulations.
E. Permit Requirements. Applications for a small wind energy shall be approved with
a Specific Use Permit through the Planning Commission following the procedures
outlined in Chapter 13, Amendments. Applications shall include the following
information.
1. Site plan. A site plan shall be drawn to scale based off a survey showing the
location of the proposed small wind energy system and the locations of all
existing buildings, structures, and property lines along with distances.
2. Elevations. Elevations shall be provided of the site drawn to scale showing the
height, design, and configuration of the small wind energy system and the
height and distance to all existing structures, buildings, electrical lines, and
property lines.
3. Engineering Specifications. Standard drawings and an engineering analysis
of the systems tower, including weight capacity shall be provided.
4. Foundations and Geotechnical. A standard foundation and anchor design
along with existing soil conditions and specifications for the soil conditions at
the site.
5. Tower Specifications. Specific information on the type, size, rotor material,
rated power output, performance, safety, and noise characteristics of the
system including the name and address of the manufacturer, model and
serial number.
6. Safety Measures. Emergency and normal shutdown procedures shall be
provided as part of the application for a wind energy system.
7. Electrical Connection. A line drawing of the electrical components of the
system in sufficient detail to establish that the installation conforms to all
applicable electrical codes shall be provided along with evidence that the
provider of electrical service of the property has been notified of the intent to
install an interconnected electricity generator (unless the system will not be
connected to the electricity grid).
1530.5 NON USE
1. Any small wind energy system which complies with the terms of this ordinance
which is not used for two years, excluding repairs, shall be removed within the
following six months. Failure to remove the system shall be deemed a violation
of this ordinance.
2. Any small wind energy system or commercial wind energy system which is
non-conforming and which is not used for one year, excluding repairs, shall
be removed within the following six months. Failure to remove the system shall
be deemed a violation of this ordinance.
1530.6 PRIVATE COVENANTS
Private covenants or deed restrictions may prohibit the installation of small wind
energy systems. The City of Owasso does not enforce private covenants and this
ordinance shall not preempt private covenants.
1530.7 DEFINITIONS
1. Total Height. The distance measured from ground level to the blade extended at its
highest point.
2. Small Wind Energy System. A wind energy conversion system consisting of a wind
turbine, a tower, and associated control or conversion electronics which will be used
primarily to reduce on-site consumption of utility power.
3. Windmill Rotor. That portion of the windmill which includes the blades, hub, and shaft.
4. Windmill Tower. The supporting structure on which the rotor, turbine, and accessory
equipment are mounted.
5. Commercial Wind Energy System. A wind energy conversion system consisting of
more than one wind turbine and tower, a wind energy conversion system which will
be used primarily for off-site consumption of power.
SECTION TWO (2): REPEALER
All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the
extent of the conflict only.
SECTION THREE (3): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the
remaining portion shall not be affected but shall remain in full force and effect.
SECTION FOUR (4): DECLARING AN EFFECTIVE DATE

The provisions of this ordinance shall become effective thirty (30) days from the date of final
passage as provided by state law.
SECTION FIVE (5): CODIFICATION
The Owasso Code of Ordinances, Part 12, Planning Zoning and Development, Chapter 2, Zoning
Regulations, is hereby amended as set forth above.
