ORDINANCE NO. 1007
AN ORDINANCE APPROVING ZONING APPLICATION NUMBER OZ -12 -02 CHANGING
THE ZONING OF PROPERTY LOCATED IN THE SOUTHEAST QUARTER OF SECTION 17,
TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY, OKLAHOMA, FROM A CS
(COMMERCIAL SHOPPING) DISTRICT AND AN OL (OFFICE LIGHT) DISTRICT TO AN RM
(MULTI- FAMILY RESIDENTIAL) DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described, and
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for or against the requested rezoning of application OZ-
12 -02.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
THAT TO WIT:
A tract of land located in the Southeast Quarter (SE /4) of Section Seventeen (17) of Township
Twenty -one (2 1) North and Range Fourteen (14) East of the Indian Base and Meridian (I.B. &M.),
according to the U.S. Government Survey, thereof, Tulsa County, State of Oklahoma; being
more particularly described as follows:
Commencing at the SW corner of the SE /4 of Sec. 17, T -21 -N, R -14 -E, I.B. &M.; Thence N 01 015'46"
W along the west line of said SE /4 a distance of 1050.00 feet; Thence N 88 144'33" E a distance of
658.31 feet to the POINT OF BEGINNING being the South Corner of Lot 1 of Block 3 of OWASSO
MEDICAL CAMPUS, a subdivision in the City of Owasso, according to the recorded Plat No. 5862,
thereof; Thence N 48 054'03" E along the easterly line of said Block 3 a distance of 1026.61 feet to
the SW corner of Lot 1 of Block 6 of said OWASSO MEDICAL CAMPUS; Thence N 88 °40'25" E a
distance of 513.86 feet to the SE corner of said Lot 1 of Block 6; Thence N 01 119'35" W a distance
of 240.00 feet to the NE corner of said Lot 1 of Block 6; Thence N 88 140'25" E along the south line
of a 60 foot wide dedicated roadway as recorded in Book 7279 at Page 578, Tulsa County, for a
distance of 180.53 feet; Thence S 01 °19'35" E a distance of 59.69 feet; Thence S 21 °10'25" W a
distance of 109.16 feet; Thence S 01 119'35" E a distance of 518.93 feet; Thence S 88 038'40" W a
distance of 202.84 feet; Thence S 32153'13" W a distance of 264.23 feet; Thence S 88 144'33" W a
distance of 1090.25 feet to the POINT OF BEGINNING, and containing 15.295 acres, more or less,
be, and the same is hereby zoned from CS (COMMERCIAL SHOPPING) AND OL (OFFICE
LIGHT) TO RM (MULTI- FAMILY RESIDENTIAL) District.
Section 1. That all ordinances or parts of ordinances in conflict herewith be, and the
same are hereby expressly repealed.
Section 2. All ordinances, or parts of ordinances, in conflict with this ordinance are
hereby repealed to the extent of the conflict only.
Section 3. If any part or parts of this ordinance are deemed unconstitutional, invalid
or ineffective, the remaining portion shall not be affected but shall remain in full force and
effect.
Section 4. The provisions of this ordinance shall become effective thirty (30) days
from the date of final passage as provided by state law.
Section 5. That there be filed in the office of the County Clerk of Tulsa County,
Oklahoma, a true and correct copy of this Ordinance.

The City of Owasso received a Planned Unit Development (PUD) application for review and
approval of a development called 9inetyEight. The 9inetyEight development proposes an
apartment complex consisting of 284 -units in 21 buildings on 15.295 acres. The subject property
is located along East 98th Street N and East 99th St N immediately north of the Owasso Market
development and to the south of the St. John Owasso medical campus. The applicant also
submitted a rezoning request with this PUD that would rezone the property from CS (Commercial
Shopping) and OL (Office Light) to RM (Multi - Family Residential), allowing for the development of
an apartment complex.
PLANNING COMMISSION
The Owasso Planning Commission reviewed this item at their regular meeting on May 7, 2012. At
that meeting, the Planning Commission unanimously recommended approval of the Zoning
Map amendment and PUD to the City Council.
CITY COUNCIL:
On May 15, 2012, the Owasso City Council considered this item and voted unanimously to
approve the 9inetyEight PUD and the Zoning Map Amendment. This ordinance officially adopts
the zoning action taken by the City Council.
RECOMMENDATION:
Staff recommends City Council approval of the attached ordinance for the rezoning of the
subject property from OL (Office Light) and CS (Commercial Shopping) to RM (Multi - Family
Residential) for the 9inetyEight development.
