OWASSO PUBLIC WORKS AUTHORITY MINUTES OF REGULAR MEETING Tuesday, May 15, 2001 The Owasso Public Works Authority met in regular session on Tuesday, May 159 2001 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, May 119 2001. ITEM l: CAD TO ORDER. Mayor Barnhouse called the meeting to order at 7:06 p.m. ITEM 2: FLAG SALUTE The flag salute was held during the City Council meeting preceding this meeting. ENGINEERING PROJECT MANAGER SUBJECT: ESTABLISHMENT OF A SANITARY Y SEWER PAYBACK A 1EA QUIKTRIP COMMERCIAL, CENTER #2 DATE- March 26, 2001 BACKGROUND: The QuikTrip Corporation is in the process of relocating from the northeast corner of'761h Street North and U.S. Hwy 169 to the southeast corner (see attached map), Development includes installation of a new 8 -inch line from the existing sanitary sewer termination at the southwest corner of the holiday Inn Express property to the southwest corner of the Chimi's property. Representatives from the QuikTrip Corporation and their consulting engineer (DeShazo, Tang .Associates, Inc.) approached the City in late 2000 requesting that a sanitary sewer payback mechanism be established for any future connections to the sanitary sewer line constructed to serve their new location. The QuikTrip Commercial Center #2R sanitary line design has been approved by the public Works Department Engineering Division and permitted by ODEQ. Following completion, SANTTARY SEWER PAYBACK AREA MARCH 2b, 2001 PAGE 2 acceptance and the required maintenance period, the new lino will become City property, City approval and ODEQ permits for any connections to this line (except for four-inch service lines) will also be required whether within or outside either the city limits or payback area limits, The City of Owasso will notify potential developers proposing to construct improvements within the designated pay back area of the pay back requirement early in the planning stage. A letter of agreement executed by the QuikTrip Corporation is attached for signature by the Chair. RECOMMENDATION: Staff recommends acceptance of the Quill rip Commercial Center ,`12R Sanitary Sorer Pay Back Area as proposed, collection by the Owasso Public `Yorks Authority of an amount not to exceed $5,580,31 for each acre or portion of acre for future connections to the new lino, remittance of such payment to QuilTrip Corporation, and authorization for the Chair to execute the Letter of Agreement. ARTICLE 11 TERMINATION Unless terminated sooner by mutual agreement of the parties or repayment of Owner's expenses associated with Article 1, without any interest thereon, the activities enumerated in this Agreement shall expire ten (10) years from the date of execution below. This agreement shall be binding upon the heirs, successors, and assigns of the parties, and shall not be altered without the express written consent of both parties. State statutes require adoption of an annual budget by resolution. CPA Resolution #2001-05 provides for the adoption of a fiscal year budget for the Owasso Public Works Authority. The staff recoromends Trustee approval of Resolution #2001-05 adopting a fiscal year 2001® 2002 budget for the OPWA.
