The Owasso Public Works Authority met in regular session on Tuesday, May 159 2001 in the
Council Chambers at the Owasso Community Center per the Notice of Public Meeting and
Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, May 119 2001.

BACKGROUND:
An agreement has now been developed which addresses the above items, as well as notification
of potential developers proposing construction within the payback area and establishment of a
ten-year time limit on the agreement.
Staff recommends that the Trustees approve the Sanitary Sewer Payback Agreement with
QuikTrip Corporation, and that the Chair be authorized to execute the agreement.

SUBJECT: ESTABLISHMENT OF A SANITARY Y SEWER PAYBACK A 1EA
QUIKTRIP COMMERCIAL, CENTER #2
DATE- March 26, 2001
BACKGROUND:
The QuikTrip Corporation is in the process of relocating from the northeast corner of'761h Street
North and U.S. Hwy 169 to the southeast corner (see attached map), Development includes
installation of a new 8 -inch line from the existing sanitary sewer termination at the southwest
corner of the holiday Inn Express property to the southwest corner of the Chimi's property.
Representatives from the QuikTrip Corporation and their consulting engineer (DeShazo, Tang
.Associates, Inc.) approached the City in late 2000 requesting that a sanitary sewer payback
mechanism be established for any future connections to the sanitary sewer line constructed to
serve their new location.
The QuikTrip Commercial Center #2R sanitary line design has been approved by the public
Works Department Engineering Division and permitted by ODEQ. Following completion,

acceptance and the required maintenance period, the new lino will become City property, City
approval and ODEQ permits for any connections to this line (except for four-inch service lines)
will also be required whether within or outside either the city limits or payback area limits, The
City of Owasso will notify potential developers proposing to construct improvements within the
designated pay back area of the pay back requirement early in the planning stage. A letter of
agreement executed by the QuikTrip Corporation is attached for signature by the Chair.
RECOMMENDATION:
Staff recommends acceptance of the Quill rip Commercial Center ,`12R Sanitary Sorer Pay Back
Area as proposed, collection by the Owasso Public `Yorks Authority of an amount not to exceed
$5,580,31 for each acre or portion of acre for future connections to the new lino, remittance of
such payment to QuilTrip Corporation, and authorization for the Chair to execute the Letter of
Agreement.

THIS AGREEMENT ENT by and between the Owasso public Works Authority, a Public
Trust, first party, hereinafter called "Authority" and QuikTrip Corporation, an Oklahoma

That for and in consideration of the terns, covenants, and conditions herein set forth, said
parties have agreed and hereby agree as follows;

hereof, and thereafter declare the following described property not already directly billed for the
sanitary sewer extension as a Sanitary Sewer Payback Area:
A parcel of land located in the Northeast Quarter of the Northwest Quarter of the
Northwest Quarter (NE /4 NW /4 NW /4) of Section 32, Township 21 North, Lange 14
East of the Indian Base and Meridian, Tulsa County, State of Oklahoma, according to the
U.S. Government Survey thereof, further described as follows:
The south 260.0 feet of the west 483.0 of the Northeast Quarter of the Northwest
Quarter of the Northwest Quarter (NE /4 NW /4 NW /4 of said Section 32, and
The north 150.0 feet of the west 260.79 feet of the Southeast Quarter of the
Northwest Quarter of the Northwest Quarter (SE /4 NW /4 NW /4) of said Section 32,
and
The north 150.0 feet of the east 373.67 feet of the Southwest Quarter of the
Northwest Quarter of the Northwest Quarter (SW /4 NW /4 NW /4) of said Section 32,
containing 5.07 acres more or less.
Authority shall advise any future developers of property within the stated service area that
connection to the sanitary sewer line, or any other use of said service line, shall require the
payment of $5580.31 per acre. Payment shall be made to Authority at the time of the
construction permit application to ODEQ. Upon receipt of payment, Authority shall remit same
to Owner.
ARTICLE 11
TERMINATION
Unless terminated sooner by mutual agreement of the parties or repayment of Owner's
expenses associated with Article 1, without any interest thereon, the activities enumerated in this
Agreement shall expire ten (10) years from the date of execution below.
This agreement shall be binding upon the heirs, successors, and assigns of the parties, and
shall not be altered without the express written consent of both parties.
IN WITNESS WHEREOF, said parties have executed this contract in triplicate, this 15th
day of May, 2001

FINAL LNSPECTION:
A final inspection was held on May 2, 2001. All deficiencies identified during the inspection
have been corrected to the satisfaction of the resident inspector and the City of Owasso. The
project is considered complete and acceptable to the City.
The contractor has provided a one-year maintenance bond which will be effective upon
acceptance of the work (see attached).
FUNDING:
Project funding is provided by a loan from the Oklahoma Water Resources Board.

Enclosed is Permit No. ST0000 7299104-9 for improvements to the Owasso wastewater treatment plant
including 515 linear feet of eight (8) inch PVC sanitary sewer line, new impellers for the raw sewage pumps,
new mechanical barscreen and aerated grit chamber, modifications to the existing aerobic digester and
installion of a new aerobic digester, new UPI disinfection unit, new 18 -inch parshall flume, new sludge belt
press plus all appurtenances to serve the City of Owasso Wastewater "freatrnent Facility Improvements (Phase
IIA), Tulsa County, Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans approved by this
department on December 21, 1999. Any deviations from the approved plans and specifications affecting
capacity, flow or operation of units must be approved, in writing, by the Department before changes are made.
Receipt of this permit should be noted in the minutes of the next regular meeting of the Owasso Public Works
Authority, after which it should be made a matter of permanent record.
We are returning one (1) set of the approved plans to you and retaining one (1) set for our files.

provides for the adoption of a fiscal year budget for the Owasso Public Works Authority.
The staff recoromends Trustee approval of Resolution #2001-05 adopting a fiscal year 2001®
2002 budget for the OPWA.

operating budget for fiscal year 2001 -2002; and
WHEREAS- The adoption of such budget is vital to the continuation of services to the
citizens of Owasso; and

WHEREAS: Certain publication and fling requirements are mandated by State
Statutes,
