Councilors,
Last night, July 2, 2012, the Owasso Planning Commission held a meeting and public hearing for the
rezoning of the property at the northeast corner of E 9(`h St N and N 129th E Ave for rezoning application
OZ- 12 -03. This 29.99 acre property is known as Willis Farms and is the proposed site for the Owasso
Sam's Club. After receiving staff's report and presentation, the Planning Commission opened the public
hearing and received public input from surrounding property owners. There were eighteen (18)
members of the audience who spoke about the proposed zoning map amendment. Seventeen (17) of
the speakers were generally opposed to the rezoning and one (1) speaker was in favor of the rezoning.
Attached you will find the name and address of each of the speakers, along with a brief synopsis of their
comments. After receiving public input, the Planning Commission closed the public hearing. After
discussion with staff and the representative for the applicant, the Planning Commission voted 4 -1 to
recommend approval of OZ -12 -03 to rezone the subject property from AG (Agricultural) to CS
(Commercial Shopping). Please accept this letter as the final report and recommendation from the
Planning Commission to the City Council for approval of OZ- 12 -03.

PUBLIC HEARING WAS OPENED AT 6:17 PM.
The Chairman made a statement that everyone that wishes to speak will have three (3) minutes.
Mr. Dale Alimena stated that three (3) citizens are going to use the 10 minute limit, cilocated to
them by other citizens and that Mr. John Moody, Mr. Greg Alberty and himself would take these 10
minute slots. The Chairmen agreed to the request.
Approximately forty -seven (47) citizens were present and the following comments were expressed:
Julie McCartt - 9314 North 133 East Avenue - Commented about safety in the Windsor Lake
neighborhood in that more traffic will come though. Please do not recommend commercial
zoning. Concerned with the North 133 East Avenue signal light being at the entrance of Windsor
Lake. Trees are not a buffer, six (6) lanes of traffic is not a buffer. She claimed that the traffic report
that was done was incorrect.
Jennifer Koscelny - 9225 North 133 East Avenue - Not against Sam's coming to Owasso but not
happy with the site plan. Consider office light zoning as buffer. Concerned with traffic at that
location and congestion.
Eli Smith - 9217 North 133 East Avenue - At the last planning commission meeting I asked the
Commissioners to discuss the Life Church location with the Nottingham residents and the impact
the church had on them. Has any of you spoken to anyone from Nottingham Estates? Who wants
to live next to a six (6) lane roadway? There are infrastructure concerns in this area. You talk about
the previous land use plans, plans change and neighborhoods change. Look at alternative sites,
for instance, the vacant land east of the Neighborhood Market on East 86 Street North. if Sam's
Club builds at this location it will have negative impact on our property values.
John Moody, Attorney for Windsor Lake residents -This property lacks proper buffering. There needs
to be a buffer of lower intensity zoning across the street that allows only for less intense uses
between residential and commercial zoning. Arterial streets are not good buffers. Subdivision
regulations require the service roads to service the out parcels. Site plan shows out parcels along
East 96 Street North and too many access points off of East 96 Street North. Vote no and bring back
as a PUD. Possibly an office zoning for a buffer along East 96 Street North. The zoning map shows
the property to the northeast with an office zoning buffer. Mr. Moody pointed out, on Owasso
zoning map, that several parcels in Owasso have office zoning as a buffer.
Dale Alimena - 9316 North 132 East Avenue - Twenty -nine acres is too much land to be considered
a hard corner. Vote no. Don't rush this process. This is going too fast. The traffic study is flawed.
Think about the traffic, think about your residents. Consider the dam for the pond Within the
Windsor Lake neighborhood. Commercial zoning across from residential is not normal. I have
concerns for the citizens in this area. There are a lot of children in our neighborhood, fear for their
safety. The streets along East 96 Street North are caving in. Fear for wife and children pulling out
into traffic on East 96 Street North. This project is a safety hazard and a health hazard for this
community.
Tom Koscelny - 9225 North 133 East Avenue - Lived here for 17 years. Not opposed to the rezoning,
but we need to look closer at the access points. Concerned With safety. More access points
increases safety risks. We need an access management study. What is the price of progress?
Burt Stuburg - 9206 North 103 East Avenue - Need to consider a transitional zoning buffer. It keeps
the higher intensity uses away from residential. Consider offsetting the access points. Have Sam's
access off the service road rather an 96th. Provide a buffer along East 96th Street North with office
zoning.
Jill Phillips - 9318 North 133 East Avenue - Stop and consider what you are doing. Children will be at
risk. Make this property light commercial.
Jenny Woods - 13301 E 94 Place North - Opposed to the rezoning. Qualify of life is what we want.
We like the fields in the area. This will drive families out of town. Office zoning would be a better
solution. We want to see the horses on that property stay.
Josh McAlister - 13108 East 95 Court North - Lived in Owasso 20 years. Sam's is not built like this in
other areas.
Greg Alberty - 13307 East 95 Place North - Thank you for your service. Loves Owasso and was
raised here. Never thought that corner would have blanket commercial zoning. Meet with the
neighborhoods to listen to their concerns. Take time to consider everything, don't rush the process.
Control land use in this area. Want Sam's to do a PUD. Require a buffer of office light zoning. There
will be 24 hour businesses in that development. Trees are not buffers. Read an email that was sent
to Owasso City Council.
Jordan Alimena - 9316 North 132 East Avenue - If it's God will, Sam's will come. If God doesn't
want Sam's to be built, it might be built but something might happen.
Ken Krisoft- 9110 North 137 East Avenue - Nottingham HOA president. Here to support the Windsor
Lake people. If the intersection was at my street, I would be concerned. The use of the frontage
road would lessen the impact. Not opposed to Sam's, just needs buffering.
Dan Collard - 13105 East 95 Street North - Thought about living in Jenks, but decided on Owasso.
Progress is fine but don't rush.
Carol Wells - 9309 North 133 East Avenue - Love Owasso and love Sam's. Don't want Sam's in my
backyard.
Keri Phillips- 9005 North 135 East Avenue- Supports the Sam's Club project. It will bring 300 plus jobs
to the area. Wishes more consideration for the traffic.
Wade Schenk - 13202 East 92 Place North - Sam's Club is a good thing for Owasso, but look at a
transition zone between Sam's and the out parcels. Consider an entrance into Sam's on the
service road.

ITEM 5. Preliminary Plat of Maple Glen III - Consideration and appropriate action related
to the request for the review and acceptance of the Maple Glen III
Preliminary Plat of forty -four (44) residential lots, in five (5) blocks on
approximately 9.93 acres, located on the east side of Maple Glen II and
approximately a half of a mile north of East 106th Street North.
Bronce Stephenson presented a brief overview, recommending the Planning Commission
approval of the preliminary plat of Maple Glen III.
Alex Mills moved, seconded by David Vines, to approve the preliminary plat subject to TAC
and staff requirements. A vote on the motion was recorded as follows:

ITEM b. Public Hearing - Rezoning OZ 12 -03, Willis Farms - Consideration and appropriate
action related to the request for the review and acceptance of a zoning
map amendment to rezone 29.99 acres of land from AG (Agriculture) to CS
(Commercial Shopping). The general location of the property is the
northeast corner of North 129th East Avenue and East 96th Street North.
Alternative zoning designations may be considered.
Bronce Stephenson presented an overview, recommending the Planning Commission
approval of the rezoning #OZ 12 -03, Willis Farms. Mr. John Moody, attorney representing
the Winsor Lake Homeowners Association, Dale Alimena and other residents in the vicinity,
hand delivered a letter to the Commissioners, regarding the zoning application (attached).

Background:
When determining zoning on a property within the Owasso fenceline, staff relies on zoning maps
provided by the Indian Notion Council of Governments ( INCOG), where the official zoning maps
are maintained. The INCOG maps provided to the City of Owasso show the subject property to
be zoned as Commercial Shopping (CS). A mistake was made on INCOG's zoning map several
years ago and the subject property was coded and shown as CS, even though it was, in fact,
still zoned AG (Agricultural). The subject property was located outside of the Owasso City Limits
in Tulsa County at the time of the mapping error.
When the property was annexed into the City of Owasso in 2006 through Ordinance #869, it was
assigned CS zoning according to the INCOG zoning map. This annexation involved ten parcels
throughout the entire City, and included the 29.99 acre subject property. The annexation
ordinance was officially recorded in Tulsa County on August 3, 2006. Because the property was
never actually rezoned from AG to the assumed CS zoning while still in Tulsa County, this rezoning
is necessary. Additionally, INCOG, other Tulsa County Departments, and the City of Owasso,
who were all using the some incorrect zoning map, would now have correct and accurate
information as a part of this rezoning process.
The Tulsa Metropolitan Planning Commission, who handles rezoning cases for Tulsa County, was
contacted regarding this situation once it was determined that the zoning map may be
incorrect. After an extensive search of their records, they found no ordinance that rezoned the
subject property from the AG to CS while the property was in Tulsa County's jurisdiction. INCOG
indicated that the best explanation as to why the maps reflected CS zoning on this property was
due to an error made when the area was updated for their digital maps. In the conversion of
the zoning maps to the digital format in 2003, INCOG indicated that they have discovered other
similar mistakes, especially when properties were located adjacent to city limit boundary lines or.
were mistaken for zoning lines.
This item was scheduled to be brought to the City Council for review on June 5, but it was
determined that the required public notice of the zoning amendment that was placed in the
Tulsa World did not have the required area map. Upon discovering this, staff rescheduled the
item for the July 3 City Council meeting, sent new notices to all neighboring property owners
within 300 feet of the property, posted new notice on the property, and put a new legal notice
with a map in the Tulsa World, meeting all noticing requirements.
Analysis:
On April 17, 2012 the City Council approved the Final Plat for the Willis Farms Addition (Sam's
Club), subdividing the land for the development of the property. Because it was discovered that
the property is actually zoned AG, the proposed commercial use for the property would be non-
conforming. In order to correct the mapping error and ensure that the proposed commercial
uses are conforming to the zoning, the property must be rezoned from AG to CS by ordinance
approved by the City Council. The approval of the plat for the development of the site is not
impacted by this rezoning action and would still be valid. The site plan has already been
reviewed by the TAC and final approval will be given after the completion of this rezoning
action.
The proposed rezoning of the subject property from AG to CS is appropriate, as the property is
situated on the hard corner of two section line roads (E 96th St N & N 129th E Ave). Commercial
areas at hard corners of section line roads have been an established nodal development
pa[fern in Owasso for a number of years, and this rezoning fits within that pattern. Additionally,
the other properties on the corner of this intersection are zoned commercially and have
developed in a commercial fashion.
The subject property is also adjacent to US -169 highway access points and fronts East 9611i St N,
which is the main commercial corridor in the City of Owasso. Commercial zoning is appropriate
in areas that have direct and easy access to major transportation systems.
Neighboring property owners to the south of the site who are concerned with the development
of the subject property have stated that an area of OL (Office Light) zoning should be placed
along the E 9611, St N frontage to offer a buffer. If the subject property was directly abutting a
residential area, staff might agree that a buffer should be in place, but the homes are across a
section line road that will eventually become six (6) lanes in width. The residential properties are
not abutting the subject site and are buffered by the E 9611) St N right -of -way, existing fencing,
required building setbacks and landscaping in the area. Based upon the location of the
residential homes to the south of the subject property, the width of the right -of -way of E 961h St N
and the required setbacks for commercial properties, there would be approximately one -
hundred seventy -five feet (175') between the residential homes and any commercial structures
that could be built on the subject property. Based upon these reasons, additional zoning buffers
are not appropriate for this rezoning action.
The Council's previous action on the Construction Agreement with the developer of the Sam's
site will further improve the area for the current residents and the future commercial tenants.
The City of Owasso required much more stringent public improvements to be made surrounding
the site that will protect neighboring property owners and will make this area viable for
development for the next few decades. The City kept the needs and safety of current residents
and businesses near the subject property in mind when making the additional requirements of
the Construction Agreement, with the intended result of better infrastructure, improved
transportation, additional stormwater controls, and better quality of life.
Staff finds that CS zoning is appropriate and establishes the highest and best use of the subject
property. The Owasso Land Use Master Plan identifies the subject property for Commercial uses
and has shown it as appropriate for Commercial development prior to it being annexed into
City Limits. The smaller parcels on the subject property abutting E 9611, St N will also be subject to
the rules and regulations of the US -169 Overlay that was recently adopted. The Overlay will
ensure that architecture, use, and site design elements complement the surrounding area and
the Overlay requirements will add additional protections to neighboring properties. Along with
the US -169 Overlay requirements, the newly adopted Landscape Chapter of the Owasso Zoning
Code has strict requirements on the installation of required plant materials that will screen uses
from roadways and surrounding properties. A street yard along E 96th St N will provide street
trees that will offer screening and the required parking lot yard will screen unsightly parking lots
from the surrounding area. The combination of Owasso's progressive Zoning Codes, including
the US -169 Overlay, Landscape Chapter, Lighting Ordinance, and Parking Chapter will ensure
that this site will develop in an attractive, responsible and safe manner that will have minimal
impacts on the surrounding area.
Letters were mailed to surrounding property owners within 300' of the subject property and the
notification was published in the Tulsa World.
Land Use Master Plan:
Irrespective of the annexation and subsequent mapping errors, the property has been identified
for commercial uses since 1985. The land use master plan adopted in 2000 (2010 Land Use
Master Plan), the 2004 update (2015 Land Use Master Plan), and the most recently adopted 2025
Land Use Master Plan indicate the subject property is an appropriate location for commercial
uses. Therefore, any rezoning action on the subject property should be assigned a commercial
zoning.
Additionally, the 2010 and the 2025 Land' Use Master Plans call for the preservation of prime
commercial tracts of land through effective land use planning. This zoning action adheres to
the goals of the Land Use Master Plan.
Staff also located the 1985 Land Use Master Plan prepared by INCOG. In the 1985 Land Use
Master Plan, the subject property is called out for Industrial, Commercial, and High Intensity
Residential land use. This Land Use Master Plan continues the trend of this corner property being
called out for higher intensity land uses for at least the last twenty -five years.
Recommendation:
Staff recommends approval of Zoning Map Amendment OZ 12 -03 rezoning the subject property
from AG to CS.

The Tulsa Metropolitan Planning Commission, who handles rezoning cases for Tulsa County, W
contacted regarding this situation once it was determined that the zoning map may
incorrect. After • extensive search of their records, they found no ordinance that rezoned •

The proposed rezoning of the subject property from AG to CS is appropriate, as the property is
situated on the hard corner of two section line roads (E 96th St IN & N 129th E Ave). Commercial
areas at hard corners of section line roads have been an established nodal development
pattern in Owasso for a number of years, and this rezoning fits within that pattern. Additionally,
RV, the other properties on the corner of this intersection are zoned commercially and have
developed in a commercial fashion,
The subject property is also adjacent to US-1 69 highway access points and fronts East 96th St N,
which is the main commercial corridor in the City ♦ Owasso. Commercial zoning is appropriate
in areas that have direct and easy access to major transportation systems,
The Council's previous action on the Construction Agreement with the developer of the Sam's
site will further improve the area for the current residents and the future commercial tenants.
Letters were mailed to surrounding property owners within 300' of the subject property and the
notification was published in the Tulsa World.

BACKGROUND:
Shortly after the approval of the Willis Farms final plat for the Sam's Club, it was brought to staff's
attention by the attorney representing the Sam's property transaction, that there was an issue
regarding the zoning on the property. Apparently, during the abstract and title search for the
property as part of the closing, it was discovered that no records existed indicating the property
was zoned CS (Commercial Shopping), but rather still retained an AG (Agricultural District)
zoning classification. Rezoning the property would correct the mistake and zone the property
CS (Commercial Shopping) and would allow for the planned development of the property.
PLANNING COMMISSION
The Owasso Planning Commission will review this item at a meeting on July 2, 2012.

Staff recommends City Council approval of the attached ordinance No.1005 for the rezoning of

BACKGROUND:
On the afternoon of June 29, 2012, Dale Alimena, 9316 N. 132nd East Avenue, delivered a cover
letter and signature pages to City Hall in protest of Zoning Application OZ 12 -03, a request to
change the zoning of property, known as the Willis Farms (SAM's Development), from Agriculture
to Commercial Shopping District.
The petition contains 76 signatures. Of these 76 signatures, eleven are duplicates, for a total of
65 signatures. These signatures represent forty -one properties.
ATTACHMENT:

Subject: Protest Petition Opposing Zoning Application No. OZ -12 -03
We, the undersigned owners of property affected by the requested zoning change listed as
Amendment OZ -12 -03 hereby protest against the aforementioned application and submit our
signatures to validate the protest and request that said application be denied.
We protest the recommendation to rezone the entire 29+ acre property proposed for the Willis Farms
Addition from AG (Agricultural) District to a CS (Commercial) District in that it provides harm to
the health, welfare, and safety of the citizens of Owasso especially the citizens of the Windsor Lake
Neighborhood.
Additionally, we, the undersigned owners of property affected by the requested zoning change listed
as Amendment OZ -12 -03 oppose the Wills Farms Addition (Sam's Club) final plat approved by the
Owasso City Council in April 2012. The approval was based on the false presentation by the City of
Owasso Planner that the property had been zoned CS when in fact the property was zoned AG. The
said Plat as approved is non - conforming to current zoning and the decision should be vacated and the
developer should be required to submit a new application for proper processing in compliance with
the City of Owasso Ordinances. The current Plat provides harm to the public by not limiting the
points of access to the commercial property across from the residential properties on 96th Street and
does not provide a buffer of OL (Office Light) zoning along 96th Street as well as safety buffer of
free space.
Given that the citizens of Owasso were falsely informed regarding the existing zoning for the Plat
change recommendation of said Property, Owasso citizens were denied due process to file a protest
of the City Council's vote within the 10 -day filing period and were denied their legal right to file a
legal appeal of the Plat approval. This violated our civil rights of due - process and we ask that you act
with character to correct this situation by vacating Plat approval.
We submit that zoning laws are in place to protect the health, safety and welfare of the citizens and
zoning approvals are not to consider the financial benefit of the Wills Farms Developer (Sam's Club)
over the citizen health, safety and welfare. Never before has the City Council or Planning
Commission acted so hostile toward the health, safety, and welfare of the citizens of Owasso by not
requiring normal and routine application processing and buffer requirements between Commercial
and Residential uses. Never before has a developer been given such grace without due process.
Please find the enclosed Protest Petitions signed by a significant majority of the property owners in
Windsor Lake neighborhood.

We, the undersigned owners of property affected by the requested zoning change listed as
Amendment OZ -12 -03 hereby protest against the aforementioned application and submit our
signatures to validate the protest and request that said application be denied.
We protest the recommendation to rezone the entire 29+ acre property proposed for the Willis Farms
Addition from AG (Agricultural) District to a CS (Commercial) District in that it provides harm to
the health, welfare, and safety of the citizens of Owasso especially the citizens of the Windsor Lake
Neighborhood.
Additionally, we, the undersigned owners of property affected by the requested zoning change listed
as Amendment OZ -12 -03 oppose the Wills Farms Addition (Sam's Club) final plat approved by the
Owasso City Council in April 2012. The approval was based on the false presentation by the City of
Owasso Planner that the property had been zoned CS when in fact the property was zoned AG. The
said Plat as approved is non - conforming to current zoning and the decision should be vacated and the
developer should be required to submit a new application for proper processing in compliance with
the City of Owasso Ordinances. The current Plat provides harm to the public by not limiting the
points of access to the commercial property across from the residential properties on 96th Street and
does not provide a buffer of OL (Office Light) zoning along 96th Street as well as safety buffer of
free space.
Given that the citizens of Owasso were falsely informed regarding the existing zoning for the Plat
change recommendation of said Property, Owasso citizens were denied due process to file a protest
of the City Council's vote within the 10 -day filing period and were denied their legal right to file a
legal appeal of the Plat approval. This violated our civil rights of due - process and we ask that you act
with character to correct this situation by vacating Plat approval.
We submit that zoning laws are in place to protect the health, safety and welfare of the citizens and
zoning approvals are not to consider the financial benefit of the Wills Farms Developer (Sam's Club)
over the citizen health, safety and welfare. Never before has the City Council or Planning
Commission acted so hostile toward the health, safety, and welfare of the citizens of Owasso by not
requiring normal and routine application processing and buffer requirements between Commercial
and Residential uses. Never before has a developer been given such grace without due process.
Please find the enclosed Protest Petitions signed by a significant majority of the property owners in
Windsor Lake neighborhood.
