WHEREAS, public hearings have been held regarding the request for annexation of the property herein described, and WHEREAS, the Owasso City Council has considered the recommendation of the Owasso Annexation Committee, the Owasso Planning Commission and all statements for or against the requested annexation the property referenced in application OA-12-01. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, THAT TO WIT: A tract of land located in the East Half (E/2) of Section Twelve (12), of Township Twenty-one (21) North and Range Thirteen (13) East of the Indian Base and Meridian (I.B.&M.), according to the U.S. Government Survey, thereof, Tulsa County, State of Oklahoma; being more particularly described as follows: Commencing at the East 1 /4 corner of said section; thence S 88° 30' 17" W along the North line of the NE/4 NE/4 SE/4 a distance of 16.50 feet to the POINT OF BEGINNING; thence S 01 ° 36' 13" E and parallel with the East line of said section a distance of 1,327.37 feet to a point on the South line of the NE/4 SE/4 of said section; thence S 88° 32'37" W along said South line a distance of 1,308.98 feet to the SW corner of said NE/4 SE/4; thence N O1° 32'59" W along the West line of said NE/4 SE/4 a distance of 1,326.48 feet to the NW corner of said NE/4 SE/4, said point also being the SW corner of the SW/4 SE/4 NE/4 of said section; thence N 01° 32' 1 1" W along the West line of said SW/4 SE/4 NE/4 a distance of 663.36 feet to the NW corner of said SW/4 SE/4 NE/4; thence N 88° 29'00" E along the North line of said SW/4 SE/4 NE/4 a distance of 661.87 feet to the NE corner of said SW/4 SE/4 NE/4; thence S 01° 33'26" E along the East line of said SW/4 SE/4 NE/4 a distance of 663.60 feet to the SE corner of said SW/4 SE/4 NE/4, said point also being the NW corner of the NE/4 NE/4 SE/4 of said section; thence N 88° 30' 17" E along the North line of said NE/4 NE/4 SE/4 a distance of 645.61 feet to the POINT OF BEGINNING, containing 49.94 acres, more or CITY OF OWASSO JULIE STEVENS P0BOX180 OWASSO, OK 74055 less be, and the same is hereby annexed to, made a part of, and added to the City of Owasso, Oklahoma, and the corporate limits thereof be and are hereby extended to include the above described territory and real estate. Section 1. That from and after the passage and publication of this Ordinance, the real estate and territory described in Section 1 hereof shall be a part of the City of Owasso, Oklahoma, and in Ward One thereof, and all persons residing therein, and all property situated thereon, shall be and are hereby declared to be subject to the jurisdiction, control, laws, and ordinances of the City of Owasso, Oklahoma, in all respects and particulars. Section 2. All ordinances, or parts of ordinances, in conflict with this ordinance are hereby repealed to the extent of the conflict only. Section 3. If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the remaining portion shall not be affected but shall remain in full force and effect. Section 4. The provisions of this ordinance shall become effective thirty (30) days from the date of final passage as provided by state law. Section 5. That there be filed in the office of the County Clerk of Tulsa County, Oklahoma, a true and correct copy of this Ordinance and correct map of the territory annexed. Stephenson City Planner SUBJECT: Ordinance No. 1012, Annexation of Powderhorn Ranch DATE: September 14, 2012 BACKGROUND: The City of Owasso received a request for annexation for a 49.94 acre piece of property known as the Powderhorn Ranch. The subject property is in Tulsa County and zoned AG (Agriculture). The applicant has petitioned the City of Owasso to annex the property. ANNEXATION COMMITTEE: The Owasso Annexation Committee reviewed this request during their meeting of July 25, 2012 and recommended approval of the annexation request. PLANNING COMMISSION: The Owasso Planning Commission reviewed this item at their regular meeting on August 13, 2012 and voted unanimously to recommend approval of the annexation to the Council. CITY COUNCIL: The City Council held a Public Hearing on August 21, 2012 to hear input from citizens regarding the proposed annexation. In addition, the City of Owasso staff held a neighborhood meeting on August 30, 2012 at the home of R.L. and Sandy, 11236 N 94th E Ave, to further discuss the annexation and development process for the property. On September 4, 2012, the Owasso City Council considered this item and voted 3 -2 to approve the annexation of the property known as Powderhorn Ranch. This ordinance officially adopts the action taken by the City Council. RECOMMENDATION: Staff recommends City Council approval of the attached ordinance for the annexation of the subject property known as Powderhorn Ranch. ATTACHMENT: Ordinance No. 1012
