Consideration and Appropriate Action Relating to Resolution #2000 -02, a Resolution Approving the Adoption of the 2010 Land Use Master flan for the City of Owasso. Consideration and Appropriate Action Relating to a bequest from David Charney for Annexation of an 80 -Acre Tract of Land Generally Located on the North Side of East 106'1' Street North, East of Mingo Road, and Immediately South of the Owasso Sports Park. Mr Warlick Attachment #12 The Owasso Annexation Committee and the Owasso Planning Commission have conducted hearings on this request and recommend Council approval of the requested annexation. Consideration and Appropriate Action Relating to a Request from David Charmey on Behalf of Owasso Land Trust LLC for Annexation of a 10 -Acre Tract of Land Located on the Northeast Corner of Last 96"' Street North and Mingo Road. Mr Warlick Attachment # 14 The Owasso Annexation Committee and the Owasso Planning Commission have conducted hearings on this request and recommend Council approval of the requested annexation. The staff concurs with the recommendation. 15. Consideration and Appropriate Action Relating to a Request from Joe Wolfe for Annexation of Approximately 22 Acres of Land Located to the North of East 76t" Street North Between North 129`x' East Avenue and North 145"' East Avenue. Cedar Owasso, OK 74055 REQUESTING PERMISSION TO ADDRESS CITY COUNSIL MEMBERS REGARDING TORT CLAIM REQUESTING REIMBURSEMENT FOR DAMAGE FROM CITY SEWAGE Dear Members and Nlr. Rooney: Our homeowners insurance will not cover the damages occurred due to the fact that it was the city's line (not ours) that cause damage. We filed a Tort claim with the city but was informed that this claim was denied by the city's insurance company. We are respectfully requesting that the City of Owasso reimburse us for the expenses incurred for cleanup and carpet replacement. Copies of all expenses incurred have been given to Mr. Rooney and Regina Guthrie. This incident occurred at a very inconvenient time of the year with holidays so close and has caused much distress to the family. This has also depleted our emergency savings. We are also very concerned regarding the health and safety issues from the sewage and a concern over the problem in our area not being resolved. We sincerely hope that the City of Owasso honors our request speak at the next city council meeting. Al and I appreciate any effort on your part to help us resolve this situation in a timely manner. ITEM 1: CA' LL_, TO ORDER Mayor Wilkcn called the meeting to order at 6:30 p.m. ITEM 2: INVOCATIONT The invocation was offered by Councilor Williams. ITEM 3: FLAG SALUTE Boy Scout Troop #84 presented the colors and led in the flag salute. ITEM 4: ROLL CALF, PRESENT ABSENT Mark Wilken, Mayor Mary Lou Barnhousc, Nice Mayor Denise Bode, Councilor Melinda Voss, Councilor H C "Will" Williams, Councilor- STAFF Timothy Rooney, Acting City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. Mayor Wilkcn was joined at the podium by Owasso Boy Scouts and leaders, where he read a proclamation designating Boy Scout Day as February 8 "' and recognizing the 90"' anniversary of the Boy Scouts of America. ITEM 6: RE _VEST BY CITIZEN TO ADDRESS THE CITY COUNCIL. Mr James Wilson, rcprescnting the Baptist Retirement Ccntcr Council, addressed the City Council r °cgarding the streets in the Center. A petition was presented requesting repairs to a U- shaped street within the Centel- starting as 122"' East Ave and ending as 127 "' East Ave. David 11,111, administrator at the Center echoed what had been said. Owasso City Council February 1, 2000 R1; - VEST BY CITIZEIN TO ADDRESS THE CITY COUNCIL. Mr Gary Wells addressed the Council with concerns about the lack of a fire truck to reach taller structures in Owasso, and requested that the City think about budgeting for a ladder- truck. Fire Chicf Slob Allcu said that the City is looking for alternative ways of funding a ladder trLrcic. ITEM 8: RE VEST BY CITIZEN TO ADDRESS THE CITY COUNCIL Mr Bill Rothrock addressed the Council relative to inequities in the rates charged to businesses for cornrncrcial refuse hauling. 11c requested that the City look at permitting haulers and allow businesses to choose the harder they want, rather than bidding out commercial refuse. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE' VEST FOR APPROVAL OF THE CONSENT AGENDA. _ A. Approval of the Minutes of January 18, 2000 Regular Meeting. B. Approval of Claims. C. Action Relating to Acceptance of Improvements to the Water and Sanitary Sewer Systems Constructed to Serve Camden Park 11, an addition to the City of Owasso, Tulsa County, Oklahoma. D. Action Relating to Acceptance of Improvements to the Sanitary Sewer System Constructed to Serve Owasso Commercial Plaza (IMO), an Addition to the City of Owasso, Tulsa County, Oklahoma. E. Action Relating to Acceptance of Improvements to the Water- and Sanitary Sewer Systems Constructed to Serve the Willows at Silver Creek, an Addition to the City of Owasso, Tulsa County, Oklahoma. The consent agenda included minutes of the January 18, 2000 regular meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) General Fund $49,182.34; (2) Workers Comp Self-Insurance Plan $5,839.43; (3) Ambulance Service Fund $2,593.57; (4) Juvenile Court Fund $75.00; (5) City Garage $8,215.26; (6) Bond Projects Fund $25,774.82; (7) Payroll $162,382.89; (8) City Garage Payroll $3,800.83. Itern C requested acceptance of improvements to the streets and storm drainage systems constructed to serve Camden Park 11. Item D requested acceptance of improvements to the sanitary sewer system constructed to serve Owasso Commercial Plaza (IMO). Item E requested acceptance of improvements to the water and sanitary sewer systems constructed to serve the Willows at Silver Creek. Dr Bode moved, seconded by Mr Williams, to approve the consent agenda. AYE: Bode, Williams, Voss, Barnhouse, Wilken NAY: None Motion carried 5 -0. -2 Owasso City Council February 1, 2000 1`I'EM 10: CONSIDEIZATION AND APPROPRIATE ACTION RELATING TO THE PIZESENTATION OF AN INDEPENDENT AUDIT OF FINANCIAL Tl, ANSACTIONS FOR-THE—GENERAL FUND AND OTHER FUNDS FOR FY 1998x999 AND A REQ-UES!1 FOR THE _COUNCIL TO RECEIVE THE AUDIT Ms Bishop said that Mr Crawford could not be present to present the audit, but will be present at the next regular rriecting of the Council to make his official presentation. She and Mr Cates suggested that the Council vote to receive the audit so that it can be fled with the State. Dr Bode moved, seconded by I`=1Ir Williams, to receive the audit for review and information. AYE: Bode, Williams, Voss, Barnhousc., Wilken NAY: None Motion carried 5-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING _ TO A CONTRACT WITH CAPROCK COMMUNICATIONS FOR THE COLLECTION OF E«911 FUNDS AND REMITTANCE OF SAME TO THE CITE' OF OWASSO. Mr Cates said that Ordinance #571 allows for 5% of telephone customer's bills to be returned to the City of Owasso to aid in the support of providing E -911 service. Currently Southwestern Bill and Logix Communications provide telephone service to Owasso citizens and are contracted to collect the E -911 fee and remit the fee to the City. For this service, the providers retain 2% of' the fee collected. CapRock Communications has now requested approval to provide the same service. A contract has been provided to CapRock, which they have executed and returned. Ms Voss moved, seconded by Mr Williams, to approve a contract with CapRock Communications and authorize the Mayor to execute the appropriate documents which will approve the collection of E-91 l funds and remittance of those funds to the City of Owasso. Fcbruary 1, 2000 Mark Wilken, Mayor OWASSO CITY COUNCIL MINUTES OF SPECIAL MEETING Tuesday, February 8, 2000 The Owasso City Council met in special session on Tuesday, February 8, 2000 in the Lower Level Conference Room at Owasso City Hall per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:30 p.rn. on Thursday, February 3, 2000. ITEM 1: CALL TO ORDER Mayor Wilken called the meeting to order at 5:30 p.m. PRESENT Dark Wilken, mayor Mary Lou Barnhouse, Vice Mayor Melinda Voss, Councilor H C "Will " Williams, Councilor STAFF Tim Rooney, Acting City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk A quorum was declared present. ITEM 2: PUBLIC WORDS ITEMS ABSENT Denise Bode, Councilor Mr Carr discussed the current commercial refuse contract. He said that there are some businesses using commercial haulers other than the one holding a contract with the city. It has been suggested that it would be more equitable to permit haulers and allow businesses to choose the one they want to use. Mr Carr will begin the process to accomplish this by meeting with refuse haulers and with business owners. The 96`x' & U.S. 169 project was discussed at some length. It was suggested that it alight be prudent to signalize the intersection of 96"' St N & 129"' East Ave. No consensus was arrived at. Mr Rooney and Mr Carr will meet with Mr Cates on Wednesday to further discuss the funding on the project. Mr Carr said that bids for street repairs will be opened on February 15 "' and bids for the wastewater treatment plant expansion will be opened on February 14"'. Documents are being prepared to bid the improvements to the public works facility and vehicle maintenance facility. Owasso City COUnei) February 8, 2000 11'EM 3: UPDATE /DISCUSSION RELATING TO REMAINING EASEMENTS FOR 86'11 & MAIN INTERSECTION PROJECT. Mi- Rooney distributed a report from Cinnabar relating to the 86`x' & Main project casements. One more casement has been acquired, with two remaining. The final three easements will be taken to the Council for acceptance when all three have been secured. ITEM 4: DISCUSSION RELATING TO _. APPOINTMENT 'TO THE BOARD OF — ADJUSTMENT AND T' FREE APDOINTMENZT._TO THE SALES TAX WATCHDOG COMMITTEE. Mr Rooney advised the Council that there is a vacancy on the Board of Adjustment as the result of a resignation. Ms Boutwell said that there are three vacancies on the Sales Tax Watchdog Committee - two representing Retail Sales and one representing Financial Institutions. Councilors were asked to suggest names of persons to fill these positions to Mr Rooney or Ms Boutwcll. Appointments will be made in March. ITEM S: DISCUSSION RELATING TO INCREASING THE SALARY OF MR ROONEY T FI DURING THE TIME E IS SERVING AS INTERIM CITY MANAGER. _ The Council discussed a one -time adjustment to Mr Rooney's salary to compensate for the time he is serving as interim City Manager. An item will appear on the regular City Council agenda to accomplish this. ITEM 6: REPORT & DISCUSSION FROM INTERIM CITY MANAGER. Mr Rooney discussed several items with the Council, including pending litigation, the status of projects, and project protocol. February 11, 2000 BACKGROUND: City charter and state statutes require that an independent accountant perform an annual audit of the City's finances, In February of 1998, the city accepted proposals for auditing services from accounting firms. Those proposals included a fixed fee for each of five years. The firm of Crawford & Associates, P.C. was selected and a one -year contract was approved by the City Council. Approval of a contract allows the firm to schedule their audit plan for the coming fiscal year end. The Audit Contract Cost Summary and Audit Engagement better are attached. The not- to- exceed fee of $21,200 itemized in the contract is consistent with the fees in the original five - year audit proposal. Finance department staff is pleased with the quality, expertise and cooperation provided by the firm and wishes to continue to utilize the services of Crawford & Associates, P.C. as auditors for the City and its trust authorities. I A` E' February 8, 2000 The 86 "' Street North/ 123" East Avenue Signalization Project was initially designed as a locally funded project using bond issue funds. The design was based on used pedestal poles to mount the signal heads on because of the low clearance between the new signals and overhead electric. When the project was submitted to the Oklahoma Department of Transportation (ODOT) for potential funding, ODOT required the signal heads to be mounted on mast arms, instead of the pedestals that CH2MH1ll designed. CH21MI-Iill made the required changes on the plans per ODOT direction, but inadvertently did not change the bid schedule to reflect the changes. Therefore, the contractor bid the pedestal mounted signal heads. In order to keep the traffic signals in compliance with ODOT, the mast arras mounted signals will need to be substituted for the pedestal mounted signals. A change order has been processed by Horizon Construction for $7,144.25 to make the changes. Horizon was warded the contract in the amount of $ 1,268,129.64. WIIEREAS, the City of Owasso did cause to be prepared and subsequently adopted in 1969, and again in 1978, a Comprehensive Plan for the City of Owasso for the orderly growth and development of the community; and WHEREAS, since that time the City of Owasso and its environs have experienced a hWh level of growth, increasing the burden Ora public utilities, facilities and service systems, and increased traffic congestion such that an update of the Comprehensive Plat, was dccn -,cd to be desirable and necessary; and WHEREAS, beginning in November of 1998, a 7 member committee ( "Master Plan Steenn�� Committee ") was formed to work with staff on updating the Comprehensive Plan composed of members from the City Council, Planning Couunission, bU5n1eSS C0111r11llntty, local InedlB, and general citizenry; and WHEREAS, a l0 -year planning horizon was recommended with the 2010 Land Use Master Plan being crafted in such a way as to allow for periodic updates, adjustments, and modifications; and WHERE, AS, in January of 1999, staff conducted the first of seven Master Plan Steering Comsnittec meetings, each open to the public, to formalize the content and direction of the proposed plan; and WHEREAS, beginning in May of 1999, a total of four public hcarings regarding the proposed 2010 Land Use Master Plan was conducted throughout Owasso to obtain public input regarding the plan; and WHEREAS, final adjustments to the plan were made based upon the public input that vvas received and two open house sessions were conducted in November- of 1999 in order to allow for additional public input and to allow visual inspection of the 2010 Land Use Master Plan; and WHEREAS, the Owasso Planning Commission and the Owasso City Council conducted a joint meeting on January 18, 2000 and reviewed the recommendations by staff, the Master Plan Steering Committee, as well as comments received during the public input meetings and approved the Owasso 2010 Land Use Master Plan's Goal Statements, Action Plans, and Land Use Map. The subject property is described as the E/2 SW /4- of Section 7, T-21-N, RYe14»E. The subject property abuts the existing City Limits on the E 106" Street N (south) side. Opposite E 106 "' N, the Lakes at Dailey Ranch, a large planned unit development. The subject property is undeveloped and presently zoned AG (Agriculture) in Tulsa County. Upon annexation, the subject property will be given the City of Owasso AO designation. To the west of the subject property, an existing rural residence is located approximately '/4 mile north of E 106" Street N on a deep, but narrow tract. To the north of the subject property is the Owasso Sports Park. To the east of the subject property is approximately 10 acres of additional undeveloped land. Meadowcrest subdivision is also located approximately 1/8 mile to the east of the subject property. The development of this tract will most likely be in conjunction with the development of the Lakes PLTD to the south of E 106`" Street N. It is most likely that sewer collection for the subject property will be interconnected in some fashion with the system that is developed at the Lakes. This property lies within the 1981 court settlement boundary and, although it is a portion of the Rural Washington Water District #3, it can also be served by OPWA. So long as the developer pays $50 per tap to the Rural Water District, provision of water by the City of Owasso is possible. As noted in previous annexation cases, it is prudent to discuss the feasibility of providing `eater and sewer to the subject property. However, since development plans have not been prepared, the discussion of these critical facilities remains somewhat abstract. Nevertheless, it appears that there will be multiple options for providing adequate water and sewer- service to the subject property. The developer will ultimately need to provide an adequate alternative during later stages of the development. February 9, 2000 BACKGROUND David Charney has requested the annexation of two tracts and a portion of right-of-way located in Sections 9, 16, and 219 all in T-21-N9 R-14-E. The subject properties are in two locations on the west side of N 145"' E Avenue. Tracts G through I are related to the proposed site for the Tulsa Technology Center. This property consists of approximately 40 acres and is located approximately t/4 mile north of E 106" Street N on the west side of N 145t" E Avenue. These properties are located in the water service area of Rural Washington Water District #3. The developer is proposing to extend the Elm Creek Sewer Interceptor to the north along N 145" E Avenue. The extension of this sewer will be critical for the future development of this site. Preliminary discussion of the sewer situation indicates that the developer is moving forward with a plan to extend sewers to this area, which should eliminate this barrier to development. February 9, 2000 BACKGROUND David Charney, on behalf of Owasso band Trust, LL,C, has requested the annexation of an 10 acre tract located on the northwest corner of E 96 "' Street ITT and bingo Load (N 97 "' E Avenue). The subject property is described as the S/2 E/2 SE /4 SEA of Section 13, T -21 -N, R-13 -E. Mater and sewer is reasonably close to the subject property site. Existing portions of the Fairways addition are located approximately 1/4 mile to the east of the subject property. This property lies within the 1981 court settlement boundary and, although it is a portion of the Rural Washington Water District #3, it can also be served by OPWA. So long as the developer pays $50 per tap to the Rural Water District, provision of water by the City of Owasso is possible. As noted in previous annexation cases, it is prudent to discuss the feasibility of providing water and sewer to the subject property. At this time, it appears that water and sewer will be available to the site and there are no barriers to development noted. The subject property is generally located to the north of E 76 "' Street N, between N 129"' E Avenue and ITT 145 "' E Avenue. The subject property is located between The Owasso Golf and Athletic Club golf course to the north and east of the subject property; Graceland Acres, a Tulsa County Subdivision, to the south; and an undeveloped 20 acre tract to the west. Copper Meadows is located approximately 1/8 mile to the west of the subject property. City water is available to the site. The Elm Creek Sewer interceptor is located on the eastern portion of the property. The subject property is an internal tract and access to future development will need to be derived from existing development. In this case, the developer has proposed the annexation of a lot located in Graceland acres. The connection through Graceland acres should provide adequate access to the site. Additionally, the anticipated scale and type of development in this area should not present a substantial additional traffic burden for the existing subdivision. There is an access easement to the east of the subject property on the east on the Greens at Owasso property. While it is possible that the easement could provide a construction access to the subject property, the use of this easement for a permanent roadway is not practical. Our development standards would increase costs, but development would not still not be allowed on either side of the road. Also, in order to keep the roadway out of the 100 year floodplain, a substantial bridge is required. Ultimately, the development of the tract to the west will provide an additional connection to Copper Meadows addition. Copper Meadows has a stub street that connects to allow future east/west traffic flow. The developer should be aware of this connection and should plan on creating a means of access to the west. Additionally, Elm Creek is located on the eastern portion of the subject property. LEGISLATIVE CONSORTIUM — Both Houses of the Legislature have pre -filed bills for the current lcgislative session. The best estimate for the total number of bills to be considered during the session is between 3,500 and 3,600 with the Senate bills filed exceeding 1,300, which l�cbruary 11, 2000 ]'A(i1 2 is an cxtrcmely large number for them. The total number should be reduced by approximately half by the February 24`x' Committee deadline. In the most recent meeting, the Consortium voted to `support" a revision of the Oklahoma House Finance Authority Rules. The revision has been submitted to the Governor who has 4.5 calendar days to amend, reject, or accept and submit them to the legislature. The legislature would then have 20 legislative days to take the same actions. In its final form, the revision will be effective 2001. Among the changes is a change in the roles a municipality plays in tax credit applications. Also, current revision language that affects the HOPE - -6 program will be considered for further revision to accommodate an approved project funded by that program for the City of Tulsa. In a continuous improvement mode, the Consortium is planning a facilitated forum to review the processes through which the Consortium operates. It is anticipated that former State Senator and current Director of the OU /DHS Training Center, Robert Funston would act as facilitator of an afternoon review session on either February 25 or March 3. Jerry Lasker of INCOG is coordinating with Mr. Funston to set the date of the session. Consortium Member Elected Officials are encouraged to participate. Interested officials should contact Allan E. Harder who will notify INCOG through the Consortium of space needed. GENERAL GOVERNMENT: SMALL CITIES SET -ASIDE COMMUNITY DEVELOPMENT BLOCK GRANT — In 1997, the Department of Commerce established a three -year community development demonstration program for communities with populations between 15,000 and 50,000. This program was extended one more year to all eligible communities under the FY 2000 program. Communities with a 1998 census population update of 15,000 to 50,000, which are currently not PAID designated entitlement communities, are eligible to participate. Owasso was notified last week that we have received a potential grant of $67,132. hl order to utilize the funds, a letter of intent must be filed by May 30, 2000, and a project plan must be approved by October 1, 2000. It is anticipated that the funds allocated to Owasso could assist with the Main Street plans through sidewalk replacement. A total of six steel bleacher sets will be purchased at a cost of $4,991.32. Funds to purchase the bleachers are available in the Parks Department budget as a result of a carry -over request from the FYI 998-99 budget. ELECTRIC LINE EXTENSION — Public Service Company of Oklahoma has installed a main power source along the western boundary of the Owasso Sports Park. The installation, completed last month, was at no cost to the city and will be useful in supplying electric power to the BMX and football areas at the Sports Park. PARKING LOT LIGHTING — The installation of parking lot lighting will be completed at the Sports Park by Friday, February 18, 2000. The installation of six wooden poles and the accompanying lighting fixtures are being performed by Public Service Company of Oklahoma and are free of charge to the City. The parking lot lighting should assist in providing a safer parking lot for motorists and pedestrians alike, as well as reduce the minor events of vandalism that have occurred recently at the Sports Park. Pads staff have extended the sewer line to the Hale Acres Addition and the installation of the lift station is remaining. The lift station was previously utilized at the Albertson's area prior to the completion of the Elm Creels Interceptor last year. PLAYGROUND EQUIPMENT -- Park staff is in the process of reviewing options for the purchase of additional playground equipment. Options include going out to bid for the purchase of the equipment or possibly utilizing bids obtained from the City of Tulsa, Oklahoma City, or broken Arrow. The advantage of utilizing the latter of the two options is avoiding an often times complicated bid process as no two pieces of playground equipment are the same, which can result in an "apples to oranges" comparison. If any of the cities listed have purchased equipment in the last year and it is comparable to what is needed, staff will seriously consider that option. RAYOLA P — The final area remaining at Rayola Park that requires a safety fall zone area will be completed the week of February 21S`. The installation of the safety fall zone areas throughout the city's park system has become a goal of both Parks and Risk Management personnel. Rayola Park will be a `fall safe" park upon completion of the installation with all equipment surrounded by safety fall zones. SPORTS PARK USER GROUP — The next meeting of the Sports Park User Group will be conducted at 6:00 p.m. on Wednesday, February 23, 2000, in the Lower Level Conference Room at City Fall. Right of Way acquisition is continuing in preparation for work to begin the 86 1h and Main Intersection Improvement project. The City Council has approved the purchase of nine of the parcels and staff is working toward closing of these properties. The remaining three properties include one on which staff has recently secured a signed contract but which has yet to be submitted to Council for their approval. The final two properties remain in the final stages of negotiation, and contracts on them should be obtained within the next few weeks. Once Council has approved the contracts secured on these final three properties and once all purchases have been closed, relocation of utilities can commence in preparation for the roadway improvements. POLICE REVIEW BOARDS - Eleven Police Candidates who successfully passed the Police entrance examination have been scheduled to move on to the Police review Boards. The review boards will be held on February 16 and 17, 2000. Upon conriplction of this review process, the candidates will be ranked in order of how well they scored, and the top six will move onto the "background investigation" phase of the process. Once backgrounds have been completed, two individuals will be identified for hire and will replace Officers Willingham and Quintero who resigned in December of 1999. The two top candidates will then move on to Police Pension examinations, physiological interviews, and drug and alcohol screening. MALICIOUS MISCHIEF - During the early morning hours of February 4, 2000, a rash of vandalism occurred to several homes, vehicles, and mailboxes of both Owasso residents and persons who reside within the county. Thousands of dollars worth of damage was done to windows of homes and vehicles as well as several mailboxes being destroyed. Officer David Renfro was dispatched to one of the homes that had been vandalized when he spotted the suspect vehicle. Officer Renfro stopped the vehicle and subsequently arrested three individuals on traffic charges. Further investigation into the vandalism incidents revealed that the three individuals Officer Renfro had arrested were also responsible for all damage that had taken place. Officer Renfro and the other shift Officers who worked on this case did an excellent job. TRAFFIC CHECKPOINT _ The Oklahoma Highway Patrol has requested that our Department assist them with a "motor Vehicle Traffic Checkpoint99 that they will be doing in Owasso. The Highway Patrol will be doing their checkpoint on Friday, February 11, 2000. Approximately six off-duty Owasso Officers will be on overtime utilizing our OHSO grant, and will be assigned to the Highway Patrols enforcement operation. OHSO GRANT - During the month of January 2000, Officers worked 28.5 hours of overtime, at a cost of $ 651.19 out of the grant funds. Officers made 64 traffic contacts, which resulted in 27 citations, 44 written warnings, and 2 arrests. Officers also presented three "public information and education" programs to the community. POLICE `IEHICLES - Hudiburg Auto Group in Midwest City has advised us that we can expect delivery of the four 2000 Chevrolet Impala police units in early March. February 11, 2000 BACKGROUND- On November 17, 1999, Mr. and Mrs. Buschman's residence located at 8341 N 121 E Avenue suffered damage due to a sewer back -up into their home as a result of a clog in the city's sewer main. A letter from Mr. and Mrs. Busclunan is attached for your information and review. National American Insurance Company denied the request submitted by Mr. and Mrs. Buschman for reimbursement of carpet replacement and clean up costs citing the City of Owasso was not liable for the damage that resulted from the sewer back -up as it was not a previously identified problem, As you can see from both the Buschman's letter and the attached memorandum submitted by Mr. Warren of the marks Department, the time frame involved from the time the Buschman's notified the city of a problem until the time that the sewer back -up was alleviated was unusually lengthy. After discussing the matter further with Mr. Cates, I was advised to have the insurance company reconsider the Buschman's request for reimbursement due to the response time. This request was again denied. At that tune, Mr. and Mrs. Buschman submitted a written request to address the City Council at the February 15, 2000 regular meeting. I again visited with Mr. Cates regarding this issue on Friday morning. I felt, and Mr. Cates agreed, that perhaps the City did have some exposure regarding this incident and should pay this claim. Again, while not the "typical" course of action, due to the time frame of our response, it is the proper thing to do. I then phoned Mr. Buschman and explained the situation regarding the denial. Mr. Buschman then offered to settle the claim for repair and damages for $ 1,000. The total cost of the repairs and damages was $1,418.16. I advised Mr. Buschman that I would agree to those terms and place his claim on the February 15, 2000 claims list for approval and payment. If approved by the Council, at the time the check is presented to Mr. Buschman, he will sign a release regarding any future claims against the City of Owasso regarding the November 17, 1999 incident. I asked if he had contacted the Police Department and he replied that he had about an hour ago, I would say about 45 rains to an hour went buy during this time and I then went out front to find Johnny-Wayne McKnight reading the sewer atlas trying to find the manhole. We all looked for a while then somebody said they found it. I then said if you got it, I am going home and it was probably around 11:00 or 11:30 PM when I got home. To ascertain the caigse of the bypass, television irtspection of the sewer main where the blockage occurred will be pe-fonned on February 8th, Information provided by Johnny-Wayne McKnight (Wastewater Collection ;re wlead er) indicated that the blockage caused a bypass from the resident's clean out, but did not create a bypass within the homeowner's residence.
