Presentation of the Character Trait of Generosity Lyndell Dunn, Character Council Member 6. Consideration and appropriate action relating to a request for City Council approval of the Consent Agenda. All matters listed under "Consent" are considered by the City Council to be routine and will be enacted by one motion. Any Councilor may, however, remove an item from the Consent Agenda by request. Approval of Ordinance No. 1017 accepting, adding, and annexing to the City of Owasso, Oklahoma, additional lands and territory and approving zoning application number OZ-12-04 changing the zoning of property located in the Southwest Quarter of, Section 8, Township 21 North, Range 14 East of the I.B. & M., Tulsa County, State of Oklahoma, according to the U.S. Government survey thereof, provided that from and offer the passage and publication of the ordinance that all of the real property within said territory herein described shall be a part of the City of Owasso, Oklahoma, and further declaring that all persons residing therein shall be subject to the jurisdiction, control, laws, and ordinances of the City of Owasso, Oklahoma establishing the same as part of Ward One of said city and directing the filing of this ordinance, and repealing all ordinances or parts of ordinances in conflict herewith Attachment # 6-C Owasso City Council December 4, 2012 Page 2 D. Approval of Resolution No, 2012-13, calling an election for City Council representation for Ward 5. Adjournment OWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, November 20, 2012 The Owasso City Council met in regular session on Tuesday, November 20, 2012 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 6:00 p.m. on Friday, November 16, 2012. ITEM 1 CALL TO ORDER Mayor Bonebrake called the meeting to order at 6:30 p.m. ITEM 2 INVOCATION The invocation was offered by Pastor Alvin Fruga of the Presence Theater Church ITEM 3 FLAG SALUTE Councilor Kelley led the flag salute ITEM 4 ROLL CALL PRESENT ABSENT Doug Bonebrake, Mayor Chris Kelley, Vice Mayor Charlie Brown, Councilor Jeri Moberly, Councilor Patrick Ross, Councilor A quorum was declared present STAFF Rodney Ray, City Manager Julie Lombardi, City Attorney ITEM 5 CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF THE CONSENT AGENDA A. Approval of Minutes of the November 6, 2012 Regular Meeting and the November 13, 2012 Special Meeting B. Approval of Claims C. Acknowledge Receipt of the Monthly Budget Status Report D. Approval to hold regular meetings on the second and third Tuesday of January 2013 at 6:30 p.m. Mr. Ray requested a scriveners change on the Claims List changing the item listed, Sports Park FY 2013 payment to Phillip R. Pennington to be changed to the company name, Penn Athletic Fields. Mr. Brown requested item B, Claims, be removed from the consent agenda for separate consideration. Mr. Brown moved, seconded by Ms. Moberly to approve item A, Minutes, item C, Monthly Budget Status Report, and item D, Approval of Meeting Change, of the consent agenda. Owasso City Council November 20, 2012 YEA: Moberly, Ross, Kelley, Brown, Bonebrake NAY: None Motion carried 5-0 ITEM 6 CONSIDERATION AND APPROPRIATE ACTION RELATING TO ITEMS REMOVED FROM THE CONSENT AGENDA Sherry Bishop responded to questions relating to item B, Claims, on the consent agenda. After discussion, Mr. Brown moved, seconded by Ms. Moberly to approve item B, Claims, with the correction of the scriveners error, totaling $280,467.66 of the consent agenda. Alto included for review were the self-insurance claims report and the payroll payment report for 1] /03/2012. YEA: Ross, Brown, Kelley, Moberly, Bonebrake NAY: None Motion carried 5-0 ITEM 7 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF THE ANNEXATION OF THE PROPERTY KNOWN AS MAPLE GLEN IV, LOCATED APPROXIMATELY ONE-HALF MILE EAST OF NORTH GARNETT ROAD AND ONE-HALF MILE NORTH OF 106TH STREET NORTH Bronce Stephenson presented the item recommending approval of the annexation of the property known as Maple Glen IV. After discussion, Ms. Moberly moved, seconded by Mr. Ross to approve the annexation, as recommended. YEA: Kelley, Moberly, Ross, Brown, Bonebrake NAY: None Motion carried 5-0 ITEM 8 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF THE REZONING OF THE PROPERTY KNOWN AS MAPLE GLEN IV, LOCATED APPROXIMATELY ONE-HALF MILE EAST OF NORTH GARNETT ROAD AND ONE-HALF MILE NORTH OF 106TH STREET NORTH Bronce Stephenson presented the item recommending approval of the rezoning of the property known as Maple Glen IV. After discussion, Dr. Kelley moved, seconded by Ms. Moberly to approve the rezoning, as recommended. YEA: Brown, Kelley, Ross, Moberly, Bonebrake NAY: None Motion carried 5-0 ITEM 9 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF AN INSPECTION SERVICES AGREEMENT FOR PRIVATE STORMWATER DETENTION POND INSPECTION Dwayne Henderson presented the item recommending approval of an engineering agreement with Meshek and Associates for an hourly contract in an amount not to exceed $40,000 for the inspection and evaluation of the private ponds as part of the 2012 Private Stormwater Detention Owasso City Council November 20, 2012 Pond Inspection Services. After discussion, Mr. Brown moved, seconded by Ms. Moberly to approve the agreement, as recommended. YEA: Kelley, Ross, Moberly, Brown, Bonebrake NAY: None Motion carried 5-0 ITEM 10 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF CHANGE ORDER NO. 1 FOR THE 86TH STREET CONSTRUCTION PROJECT, MAIN TO MEMORIAL Dwayne Henderson presented the item recommending approval of Change Order No. 1 and authorization for the Mayor to execute the agreement. After discussion, Dr. Kelley moved, seconded by Ms. Moberly to approve the agreement, as recommended. YEA: Ross, Moberly, Brown, Kelley, Bonebrake NAY: None Motion carried 5-0 ITEM 11 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF AN AGREEMENT FOR ENGINEERING SERVICES FOR THE ELM CREEK PARK IMPROVEMENTS PROJECT Larry Langford presented the item recommending an engineering service agreement with Impact Engineering and Planning, PLC, Owasso, Oklahoma for the Elm Creek Park Improvement Project in an amount not to exceed $108,725. After discussion, Ms. Moberly moved, seconded by Mr. Ross to approve the engineering service agreement, as recommended. YEA: Kelley, Moberly, Ross, Brown, Bonebrake NAY: None Motion carried 5-0 ITEM 12 CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE APPROVAL OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OWASSO, OKLAHOMA, DESIGNATING THE CITY MANAGER AS THE SETTLEMENT REPRESENTATIVE FOR THE SETTLEMENT CONFERENCE SCHEDULED TO BE HELD ON JANUARY 7, 2013, IN THE LITIGATION STYLED LARISSA DARNABY V. CITY OF OWASSO, AND ADDITIONALLY GRANTING FULL AND FINAL SETTLEMENT AUTHORITY IN THIS LITIGATION MATTER TO THE CITY MANAGER Julie Lombardi presented the item recommending approval of Resolution No. 2012-11. After discussion, Mr. Ross moved, seconded by Ms. Moberly to approve Resolution 2012-11, as recommended. The applicant is requesting to annex the subject property into Owasso's corporate limits and rezone the subject property from AG (agriculture) to RS-3 (small-lot single-family residential). ANNEXATION COMMITTEE: The Owasso Annexation Committee met on October 31, 2012 and unanimously recommended approval of the annexation request. PLANNING COMMISSION: The Owasso Planning Commission voted unanimously on November 12, 2012 to recommend Council approval of the annexation request OA-12-02 and the rezoning request OZ-12-04 of the subject property. CITY COUNCIL: On November 20, 2012, City Council considered these items and voted unanimously to approve annexation request OA-12-02 and rezoning request OZ-12-04 for the subject property. Under this program, ODOT considers any drainage structure wider than 20' a bridge. In Owasso, there are 20 such structures. In the past, we have been required to select one of three options: (1) Secure a consultant for the inspection services from a pre-qualified list and participate with ODOT in funding the program; (2) Perform our own inspections with a National Bridge Inspection Standard (NBIS) engineer; or (3) use the same consultant as the county (we have bridges in both Tulsa and Rogers counties). Historically, the City of Owasso has chosen Option 1, which ODOT funds 80% and the City funds a local 20% match. Typically, the City of Owasso matching funds have ranged between $1,000 - $2,000. This year ODOT has incorporated a new requirement into the program that requires the municipality to pass a resolution declaring which inspection option they have chosen. As in the past, the proposed option is number one, which entails the selection of a consultant after interviewing a minimum of three (3) pre-qualified engineering firms. Staff elected to interview the following four (4) firms for the project: Guy Engineering Service, Inc., Tulsa, OK EST, Inc., Tulsa, OK SAIC, Tulsa, OK Holloway, Updike and Bellen (HUB), Muskogee, OK In mid-November, staff interviewed the above mentioned engineering firms. Based on the information provided by each firm, EST, Inc. was selected as the most qualified firm to perform the bridge inspection service. FUNDING: Funding for the local 20% match is included FY 2012-2013 General Fund. RECOMMENDATION: Staff recommends approval of Resolution 2012-12 confirming the selection of EST, Inc., Tulsa, OK as the consultant for the Annual ODOT Bridge Inspection Program for the City of Owasso. It is anticipated the new routine Local Government bridge inspection contracts will start in April 2013 and extend to April 2016. This will be a three year contract. A list of the prequalified inspection firms is provided. Funding will be 100% Federal funds (20% Federal funds designated to State Government and 80% Federal funds designated to Local Governments). All Federal funding will be arranged by our Local Government Division. To comply with the National Bridge Inspection Standards and avoid federal-aid sanctions, all the Local Governments are required to do one of the following by December 31, 2012: (1) Select one of the consulting firms on the attached "Qualified Consultant List". You will be required to evaluate the Consultant's Letter of Interest (LOI) and the Consultant's response packet to determine which firms to interview.
