Mr Carr Attachment #9 Bids have been received and opened for equipment storage buildings at the public works facility and the vehicle maintenance facility, and the staff will recommend that all bids be rejected, based on prices, and request authorization to re -bid. 6. Consideration and Appropriate Action Relating to a Telecommunications Tower Tease Non-Disturbance and Attornment Agreement. Mr Cates Attachment #6 Mr Cates will recommend that the 'Trustees approve the Non- Disturbance and Attornment Agreement with Titan Towers LP, and that the Chair be authorized to execute the document. i. OWASSO PUBLIC WORDS AUTHORITY MINUTES OF REGULAR MEETING Tuesday, May 16, 2000 The Owasso Public Works Authority met in regular session on Tuesday, May 16, 2000 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, May 12, 2000. 1 TEM 1: CALL TO ORDER Chairman Williams called the meeting to order at 10:01 p.m. ITEM 2: FLAG SALUTE The flag salute was given during the City Council meeting preceding this meeting. ROBERT CAI , JR., Pogo PUBLIC WORKS DIRECTOR SUBJECT, RE JECTION OF BITES — VEHICLE MAINTENANCE/REFUSE COLLECTION AND STREETS STORAGE BUILDINGS BACKGROUND- Sale of the Public Works Department Street Maintenance Building to Precision Components was initiated in early 1999. A memorandum (see Attachment 1) was prepared that established the means by which the building would be replaced with structures that would enable identified Public Works and Support Services operations functions to be performed. It was determined in April 1999 that two (2) new structures would be needed to replace the one building. One of these structures would be located at the Vehicle Maintenance Facility to enable performing light vehicle repair, house refuse collection vehicles and store /repair refuse collection polycarts. The second structure would be located at the Public Works Department compound to provide for covered equipment storage. Estimated costs for each structure were determined based on analysis of a bid for similar construction that was completed at the Streets Maintenance Building and the Parks Building at the Sports Park in 1996. The estimated costs were as follows and served as the basis for establishing a sales price for the building: Vehicle Maintenance /Refuse Collection $113,200 Public Works storage 45,000 Total estimated costs $158,200 BIDS RECEIVED; Design of these structures was completed and bid documents prepared. In order to adequately reduce costs, re- design of both buildings will be necessary, therefore, the ability to make changes by change order was not considered to be viable. Staff is prepared to make the design changes and re -bid the project. It is expected that both buildings will be able to be built within the available funds. The anticipated schedule for re- bidding should enable construction to be completed by the end of calendar year 2000° RE COMMENDATIONS: Staff recommends 'Trustees reject all bids for the storage buildings received on April 11, 2000 and authorize rebidding following design changes. 9AIR 4 S Memorandum dated April 12, 1999 entitled 66Proposal for New Public Works/Vehicle Maintenance Buildings" 2. In the event that the City sells the present Street Department building, Support Semcel and Public Works staff has deten-nined a proposal for new facilities to replace those 10 2. When Streets department vacates the present Streets building, Vehicle Maintenance intends to transfer much of its truck and heavy equipment work to this building. This is necessitated by the increasing size of the City fleet. If the building is sold, Vehicle Maintenance will not have this option and will be faced with the need to seek other means of expansion. °< . 1 NEW FACILITIES April 12, 1999 PAGE 2 The proposed concept is as follows: All refuse vehicle and polycart operations would be moved to the area of the Vehicle Maintenance ce e. This would place the trucks in the immediate vicinity of the area where truck maintenance is performed. Non- Disturbance and Attornment Agreement Dear Mr. Mitchell: In accordance with previous conversations we have held regarding the above referenced tclecornmunications lease, I am forwarding a proposed Non - Disturbance and Attornment Agreement for placement on the agenda of the City Council of the City of Owasso, Oklahoma, as well as the Trustees of the Owasso Public Works Authority for their consideration and authorization of the Mayor and Chairman, respectively, to execute. Essentially, the Non - Disturbance and Attornment Agreement establishes recognition on the part of Titan Towers, L.P., as the City of Owasso, Oklahoma, Tenant of the interest the Owasso Public Works Authority has in and to a portion of the Water Storage Tank Site. Conversely, such document establishes recognition on the part of the Owasso Public Works Authority in and to the Titan Towers, L.P. Telecommunications Tower Lease. In addition to such mutual recognition, such document essentially sets forth that for so long as Titan Towers, L.P., is not in default under the terms of the lease with the City of Owasso, Oklahoma, then, in such event, the Owasso Public Works Authority or any successor in interest thereto, would not disturb the leasehold interest held by Titan Towers, L.P. I would recommend this be placed on the agenda for both the City Council as well as the Trust Authority and authorization for the Mayor and Chairman, respectively, to execute same.
