Tuesday, May 7, 2013
The Owasso City Council, Owasso Public Works Authority, and Owasso Public Golf Authority met
in a joint regular meeting on Tuesday, May 7, 2013 in the Council Chambers at Old Central, 109
N. Birch Street, per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 6:00 PM on Friday, May 3, 2013.
ITEM 1: CALL TO ORDER
Mayor Bonebrake called the meeting to order at 6:30 p.m.

ITEM 6: PRESENTATION OF THE CHARACTER TRAIT OF HONOR
Danny Hightower, Owasso Athletic Director, was unable to attend the meeting. Rodney Ray,
City Manager, presented "Honor" the Character Trait of the Month for May 2013.

Ms. Lombardi performed the Oath of Office for Ward 5 City Councilor Doug Bonebrake.

Chief Chambless and Chief Garrett responded to questions relating to item B, Claims, on the
consent agenda. After discussion, Mr. Ross moved, seconded by Mr. Brown to approve item B,
Claims, totaling $401,615.35 on the City Claims list, $565,587.13 on the OPWA Claims list, and
$22,464.18 on the OPGA Claims list, of the consent agenda. Also included for review were the
self - insurance claims report and the payroll payment report for 4/20/2013.

ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO CITY COUNCIL APPROVAL
TO PURCHASE ASPHALT MATERIAL NEEDED TO COMPLETE THE ASPHALT OVERLAY
PORTION OF THE FY 2012 -2013 STREET REHABILITATION PROGRAM
Earl Farris presented the item recommending Council approval to purchase asphalt material
needed to complete the 2" asphalt overlay portion of the FY 2012 -2013 Street Rehabilitation
Program utilizing the Oklahoma State Bid from Tulsa Asphalt LLC in an amount not to exceed
$165,000. After discussion, Mr. Brown moved, seconded by Ms. Moberly to approve the
purchase as recommended.

ITEM 16: CONSIDERATION AND APPROPRIATE ACTION RELATING TO THE EAST 76TH STREET NORTH
WIDENING PROJECT:
• CITY COUNCIL AUTHORIZATION TO EXECUTE AN AGREEMENT FOR
ENGINEERING SERVICES
• CITY COUNCIL APPROVAL OF RESOLUTION 2013 -09, AUTHORIZATION TO
EXECUTE THE ENGINEERING CONTRACT FUNDS AGREEMENT
• CITY COUNCIL AUTHORIZATION FOR PAYMENT TO ODOT
Dwayne Henderson presented the item recommending Council approval of:
• Agreement for Engineering Services for the 76th Street North Widening
Project with Poe and Associates, Inc., Tulsa, Oklahoma and authorization
to execute the agreement
• Approval of Resolution No. 2013 -09, authorizing the Engineering Contract
Funding Agreement between the Oklahoma Department of
Transportation and the City of Owasso for engineering services
• Authorization for payment to ODOT in the amount of $86,000 for the local
match requirement of 20% for engineering services
After discussion, Mr. Brown moved, seconded by Dr. Kelley to approve the agreement with Poe
and Associates for engineering services, to approve Resolution No. 2013 -09, and to authorize
payment to ODOT as recommended.

Julie Lombardi reminded the Council that we are still under a demand letter and to proceed
with caution. Dr. Kelley moved, seconded by Ms. Moberly to table the item to the June 11, 2013
work session.

BACKGROUND:
The City of Owasso received a request for an amendment to a Planned Unit Development (PUD)
called 9inetyEight (PUD- 12 -01). The original approval of PUD -12 -01 allowed the use of a tract of
land for the development of an apartment complex called the 9inetyEight, located along E 98th
St N, E 99th St N, and E 100th St N, immediately north of the Owasso Market development and to
the south of the St. John Owasso medical campus. Since the original approval of PUD- 12 -01, the
applicant has purchased an additional two (2) lots contiguous to the original tract totaling
approximately 4.88 acres and would like to incorporate these new lots into the existing PUD. The
applicant also submitted a rezoning request with this PUD that would rezone the property from
OM (Office Medium) to RM (Multi - Family Residential), allowing for the development of an
apartment complex.

CONCEPT OF A PUD:
The concept of a Planned Unit Development is to provide a creative alternative to conventional
development where a particular tract is under common ownership or control and where a
detailed development plan, outlining the development of the tract as a unit is proposed and
submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance
in accordance with a complete and coordinated plan of development for a larger parcel,
rather than piecemeal individual changes using the variance process. Additionally, any multi-
family residential development proposed within the City of Owasso requires a PUD.
ANALYSIS:
The amendment to the 9inetyEight development proposes an additional 58 units in 8 buildings,
making a total of a 342 -unit apartment complex on 19.53 total acres. The apartments depicted
in the PUD amendment are the same style and construction type as the original PUD, proposed
as low -rise buildings 2 and 3- stories in height with a mixture of one and two- bedroom units. The
9inetyEight development will provide a number of amenities for the residents and includes large
areas of open space for recreation. The provided amenities as identified in the original PUD
document include: a clubhouse with exercise facilities and recreation area; a pool and spa; a
covered outdoor barbeque area; a fishing pond surrounded by a walking path; and gated
access to the complex.
The City of Owasso will provide sanitary sewer service and water will be provided by Washington
County Rural Water District #3.
If the PUD amendment is approved, the applicant would provide final development plans for
review and approval by City staff and the Technical Advisory Committee.
City staff published legal notice of the PUD amendment request in the Owasso Reporter and
mailed notices to property owners within a 300' radius of the subject property.

The Owasso 2025 Land Use Master Plan was modified by the Owasso Planning Commission to
allow transitional uses in this area, with the area previously planned as future commercial. Multi-
family uses are only allowed in transitional areas. With the change to the Land Use Master Plan
to a transitional classification, the proposed project will be in conformance with the Land Use
Master Plan.
HARMONY WITH THE EXISTING AND EXPECTED DEVELOPMENT:
This PUD amendment appears to be consistent with the current and expected development of
the area. The use of apartments was approved in the original PUD- 12 -01, so this type of
development is expected in the area. Apartment complexes are often proposed in areas that
are adjacent to single - family residential developments and there are concerns from neighboring
property owners. This proposal places the apartments between two established commercial
and medical uses, not requiring great buffering or transitional uses. This is a rare case when an
apartment development would be a great fit for the area with minimal impacts on surrounding
properties. As the Owasso Medical Campus continues to develop, this apartment development
will still be a compatible use and should not adversely affect any future or current development.
This development will provide housing opportunities for employees of current and future
commercial and medical uses in this area and provide the opportunity for residents to walk to
work, shopping, and eating establishments.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the PUD Amendment for the 9inetyEight at their
regularly scheduled meeting on April 24, 2013. All TAC comments have been addressed by the
applicant or will be addressed at the site plan stage.
PLANNING COMMISSION:
The Owasso Planning Commission reviewed this item at their regular meeting on May 13, 2013
and voted unanimously to recommend approval of the amendment to PUD -12 -01 and the
rezoning of the subject properties from OM (Office Medium) to RM (Multi - Family Residential) to
the City Council.
RECOMMENDATION:
Staff recommends approval of the amendment to PUD -12 -01 on 4.88 acres including the rezoning
of the subject property from OM (Office Medium) to RM (Multi - Family Residential) and adding an
additional 58 units.

9inetyEightApartments is a proposed multifamily project, submitted as a Planned Unit Development
pursuant to the provisions of the Owasso Zoning Code. This project is located just south of Owasso
Medical Campus and North of Owasso Market. This proposed PUD is an amendment to the previous
PUD 12- 01approved by the City Council in 2012. The reason for the amendment is to add additional
units on two new lots. The PUD comprises of three development areas.
Development Area A (originally PUD 12 -01) consists of residential dwellings in the form of 274 low -
rise apartments units contained in 22 buildings. Development Area A encompasses approximately 14.65
acres.
Development Area B consists of residential dwellings in the form of 38 low -rise apartments units
contained in 4 buildings. Development Area B encompasses approximately 3.05 acres on Lot 1, Block 3,
of Owasso Medical Campus.
Development Area C consists of residential dwellings in the form of 30 low -rise apartments units
contained in 4 buildings. Development Area C encompasses approximately 1. 83 acres on Lot 1, Block 6,
of Owasso Medical Campus.
The north side of the subject PUD abuts E. 100th Street North and E. 99th Street North. The west side of
the PUD abuts E. 99th Street North. The south side of the property abuts E. 98th Street North (Owasso
Market). The east side of the property abuts a vacant land zoned CS. The site is currently a vacant land
covered with vegetation.
Section 820 of the Owasso Zoning Code states the purpose of the Planned Unit Development (PUD) are
to permit innovative land development while maintaining appropriate limitations on the character and
intensity of use. Additionally, a purpose of the PUD is to permit flexibility within the development to
best utilize the unique physical features of the particular site and provide and preserve meaningful open
space. The proposed PUD meets and exceeds this requirement and the stated purposes of the Owasso
Zoning Code.

LANDSCAPING AND SCREENING:
9inetyEight Apartments landscaping plan will be designed to enhance the E. 100th Street North frontage
and to create an attractive view form E. 98th and 99th Street North. The planting theme will highlight the
site entries and buildings, and will utilize plant selections indigenous to North East Oklahoma that are
durable and require low maintenance. All landscaping shall comply with Chapter 20 "Landscape
Requirements" of the Owasso Zoning Code.
The landscaped areas will be planted with trees and shrubs that meet or exceed the requirements of the
Owasso Zoning Code.
In order to provide security and screening from adjacent streets and properties, a 6 -foot tall wood
privacy fence will be installed along the southern, western and northern boundaries. Detail of the fence
type and materials will be presented to City Staff for approval during the site plan review process.
LIGHTING:
All outdoor lighting shall comply with Chapter 19 "Outdoor Lighting" of the Owasso Zoning Code.
TRASH CONTAINERS:
Outside trash containers will be located in a designated area within the development, and will be
screened from the view from the adjacent area and roadways.
SIGNS:
One monument sign will be located along the E. 100th Street North frontage. Additional signage and
their locations will be determined during the design phase of the project. All Signage will comply with
Chapter 18 "Signs" of the Owasso Zoning Code.
GRADING & UTILITY PLANS
During the design phase of the project, Site Grading & Utility Plans will be submitted to the City of
Owasso engineering department for review and approval. Development areas A, C and approximately
1.9 acres of Development area B will drain to the existing detention pond located along the southeast

SUBJECT: Final Plat Amendment - 96th Street North Center

BACKGROUND:
In September of 2012, the City of Owasso received a final plat for review and approval of the
96th Street North Center. The subject property is 2.2 acres in size and is comprised of two (2) lots
on one (1) block. The eastern lot (lot 1) is the planned site for a new Braum's Ice Cream and
Dairy Store.
As a part of the 2012 approval, the plat showed a mutual access easement (MAE) on the west
side of the subject property (lot 2) to facilitate a shared access with the undeveloped property
to the west. The plat also showed a twenty (20) foot wide limit of access (LOA), allowing a
driveway connection to E 96th St N. The intent was to create a shared access that would benefit
the lots being created by the plat and to provide an access point that would also serve the
undeveloped property to the west. To accomplish this, a portion of the MAE and the LOA would
be shown on the 96th Street North Center plat and the remaining portion would be obtained
through a private agreement between the parties filed as a separate instrument on the
unplatted western tract. The property owners have been unable to agree on an alignment and
other terms of the shared access that would facilitate access for both properties. Because only
twenty (20) feet of the anticipated fifty (50) feet of total access connecting to E 96th Street N via
depicted LOA was shown on the 96th Street North Center plat, there is not enough room for a full
service access to be placed that will serve just lot 2. The mutual access connection point
remains on the plat to allow the western neighbor to connect to the planned access once they
develop, but they will not be allowed a separate access in close proximity to the access that
would serve lot 2. They will be encouraged to connect to the access depicted on this plat, as
was the original intention for the orderly and safe development of this area. The planning
principle behind the shared access point is to reduce the number of curb cuts along arterials,
creating internal traffic flow between commercial areas and allowing for better connectivity.

The only change from the original plat is the MAE expanding from 20 feet to 30 feet on the
western boundary and the Limit of Access to E 96th St N changing from 20 feet to 30 feet.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. Sanitary sewer will be provided by the City of Owasso.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the amended plat for the 96th Street North Center
at their regularly scheduled meeting on April 24, 2013. All TAC comments have been addressed
by the applicant.
PLANNING COMMISSION:
The Owasso Planning Commission reviewed this item at their regular meeting on May 13, 2013
and voted unanimously to recommend approval of the amended final plat for 96th Street North
Center to the City Council.
RECOMMENDATION:
Staff recommends approval of the amended final plat for 96th Street North Center amending the
mutual access easement (MAE).

SUBJECT: Ambulance Chassis Purchase

BACKGROUND:
During FY2012, fire administrators determined that the 2004 E- 350 /Med Tec ambulance should
be replaced with a new ambulance during FY2013. On December 18, 2012, City Council
approved the purchase of one (1) new ambulance chassis from Frontier International Trucks of
Tulsa, Oklahoma in the amount of $58,412.96 as part of the ambulance replacement project.
Following the award of bid for the chassis, the manufacturer's engineers worked with fire
department administrators on the final engineering design. During this process, it was
determined that some items that were previously unknown during the specification
development process would be necessary on the chassis. In reviewing the modifications and
additional items required to ensure the new chassis is engineered appropriately, fire department
administrators believed that the content of the bid specifications changed enough to warrant
rebidding the chassis.
During the April 2, 2013 City Council meeting, fire department administrators requested that City
Council cancel the bid award to Frontier International for a new ambulance chassis and
approve solicitation for new bids. City Council approved cancelling the bid award and
rebidding the chassis.
BID PROPOSALS:
On April 3, bid proposal packages were sent to seven prospective bidders. On April 25, 2013
bids were opened, with two vendors submitting bid proposals. The first bid was from Excellance,
Incorporated of Madison, Alabama in the amount of $61,408.00. The second bid was from
Frontier International Trucks of Tulsa, Oklahoma in the amount of $66,819.75. Both bid proposals
submitted were for the International brand Terrastar model chassis. Each bid proposal was
reviewed by the project team in an effort to obtain the highest quality product at the best
value.
In their bid proposal, Excellance, Inc. took total exception to the specifications and submitted
an International Truck Company build sheet in lieu of the specified documents required as part
of the bid process. Excellance, Inc. also stated in an attached memorandum that in order to
honor the quoted bid price of $61,408.00, a signed purchase order from the City of Owasso
would be required before May 20, 2013. This stipulation on their part directly conflicts with the
bid specifications requiring the bidder to honor their bid price for 60 days from the bid opening
of April 25, 2013. Additionally, their bid proposal did not include the required documents: Non-
collusion Bid Affidavit, Notice of Award, Contract for Equipment and Services, and bid proposal -
submittal pages.
Even though the Excellance proposal was not properly formatted, nor did it include the original
bid specifications as required, staff believed that, because of the limited number of bidders, a
review of the submitted build sheet should be conducted to ensure due diligence. After the
review of the build sheet was completed, staff determined that six (6) bid criteria failed to meet
the minimum specifications.
Due to these facts, staff deemed the bid proposal from Excellance, Inc. to be substandard for
not meeting the requirements or specifications identified by the City of Owasso, and it was not
considered any further.
In reviewing the second bid proposal, staff determined that the bid proposal submitted by
Frontier International Trucks met or exceeded all 101 of the specified criteria required by the City
of Owasso. Staff found that the bid was submitted in the required format and contained the
required documents: Non - collusion Bid Affidavit, Notice of Award, Contract for Equipment and
Services, and bid proposal - submittal pages.
FUNDING:
The FY2013 Ambulance Capital Budget includes funding for the replacement of the 2004 E-
350/Med Tec ambulance; of which, this new ambulance chassis is one of two parts of the overall
project.
RECOMMENDATION:
Staff recommends approval to purchase one (1) new ambulance chassis from Frontier
International Trucks of Tulsa, Oklahoma in the amount of $66,819.75.

BACKGROUND:
On April 2, 2013 the City Council approved Resolution No. 2013 -06, amending the priority
determination of projects eligible to be funded by proceeds of the third -penny sales tax, as
recommended by the Capital Improvements Committee. As part of this action, the City Council
approved the use of $125,000 in Capital Improvement Funds for the purchase of police vehicles.
Staff informed the City Council that the intent was to procure three patrol vehicles and one
detective vehicle.
REQUEST FOR BIDS:
Requests for bids for three police package Chevrolet Tahoes were sent to three vendors. Two
bids were returned. One bid was disqualified because it was not submitted per City
requirements. The remaining bid was from Danny Beck Chevrolet in Tulsa. The bid amount was
$26,696 per vehicle for a total bid price of $80,088. The Owasso Police Department procured four
Chevrolet Tahoes from Danny Beck Chevrolet in 2012. Danny Beck has proven to be a reliable
vendor and the Tahoes have proven to be an excellent choice for patrol duty.
FUNDING:
Funding for this equipment is available within the Capital Improvements Fund.
RECOMMENDATION:
Staff recommends approval of a bid award to Danny Beck Chevrolet for three police package
Chevrolet Tahoes in the amount of $80,088 and authorization to execute the equipment
purchase.

BACKGROUND:
On April 2, 2013, the Owasso City Council approved Resolution 2013 -06 amending the priority
determination of projects to be funded by the third -penny sales tax. This resolution allows for the
expenditure of Capital Improvement Funds for the purchase of golf course equipment not to
exceed $125,000. Three of the six pieces of equipment to be purchased were under $25,000
and fell within the City Manager's purchasing authority. The equipment already purchased are
one (1) TurfBreeze greens fan ($8,935), one (1) Ben Pearson equipment lift ($4,925), and one (1)
Toro ProCore 648 walking greens aerator ($23,843). The cost of the three individual pieces
totaled $37,703 leaving a remaining available balance of $87,297 to purchase the three
additional pieces of equipment, a reel grinder, a greens mower, and a chemical spray rig.
BID ANAYLSIS:
Staff prepared bid specifications and requested sealed bids from four vendors on April 17, 2013.
Nine bids were received representing three bids for each of the three machines under
consideration. Bids were opened on April 26, 2013.

Upon review of the bids, staff found the lowest bid greens mower (John Deere 2500E hybrid
riding greens mower) and reel grinder (SIP Peerless reel grinder) met all specifications and were
deemed to be the lowest and best bids.
Upon review of the bids for a chemical spray rig, the lowest bid from Professional Turf Products
includes a new spray module mounted on a used utility vehicle with 1,890 hours of use and a six
month warranty. The bid from P &K Equipment for a John Deere HD200 Sprayer includes a new
spray module with a new ProGator utility vehicle with no hours and a two year factory warranty.
Although not the lowest bid, staff believes the purchase of a sprayer with a new utility vehicle will
allow the golf course to extend the useful life of the sprayer.
FUNDING:
The Capital Improvements Fund includes a remaining balance of $87,297 for golf equipment
purchases.
RECOMMENDATION:
Staff recommends approval to purchase one (1) John Deere 2500E hybrid riding greens mower
in the amount of $26,580 and one (1) John Deere HD200 Sprayer with ProGator Utility Vehicle in
the amount of $30,949.60 from P&K Equipment of Stillwater, Oklahoma, and one (1) Peerless 7000
reel grinder in the amount of $29,520 from Simplex Ideal Peerless of Tampa, Florida.

BACKGROUND:
Included in the FY 2013 budget, the Capital Improvements Fund allows for an expenditure to
repair and /or resurface residential and non - residential roadways throughout the City as part of
the street rehabilitation program.
In October 2012, City Council approved a construction contract with Tri -Star Construction in the
amount of $977,194.10 to perform milling (removal of the top layer of asphalt), base repair, and
fog sealing where warranted.
In addition, City Council approved Change Order #1 in January 2013 to include additional pay
items to the contract for raising curb and gutter, sidewalk replacement, and meter can
adjustment along Cedar St. These items utilized contingency funding in the amount of $29,645,
leaving a balance of $20,355 in contingency funding.
CHANGE ORDER #2 - REVISE CONTRACT AMOUNT:
During construction, city staff identified additional street and drainage deficiencies at some of
the approved rehabilitation sites. These conditions will result in quantity overruns for various unit -
cost items within the contract. For your review, the work description and cost overruns are
summarized below:
• Additional curb and gutter replacement to ensure proper drainage in Hale Acres and
Willawood - $17,430 above projection
• Additional base repairs in multiple locations where existing asphalt failed to meet
thickness requirements for repair - $34,450 above projection
• Additional approaches needed as gutter elevations changed to ensure proper
drainage - $3,900 above projection
• Additional asphalt removal from gutters to ensure proper drainage - $785 above
projection
• Additional valley gutters to adequately drain water across intersections to elevation
changes in gutter line and overlay - $19,260 above projection
• Additional unit cost item overruns may occur in the remaining sites of El Rio Vista, Post
Office road (E 87th St North), and Preston Lakes as the project nears completion. City
staff is estimating an additional $14,500 for base repair and curb and gutter
replacement.
The additional work is necessary in order to correct existing pavement conditions and ensure
future maintenance and repairs will be kept at a minimum. In the event additional funding is
not approved by Council, the elimination of fog seal will occur in Metro Heights I and II, Honey
Creek and El Rio Vista.
FUNDING:
Funding is available in the Capital Improvements Fund.
RECOMMENDATION:
Staff recommends approval of change order #2 requesting additional funding for the FY 2013
Street Rehabilitation Program in the amount of $70,000 and amending the current construction
contract amount of $977,194.10 with Tri -Star Construction to $1,047,194.10.
