L CALL. TO ORDER - Chairperson Ray Haynes called the meeting to order at: 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL, Oh' THE MINUTES OF NOVEMBER 10, 1998 REGULAR MEETING. - The Commission reviewed the minutes of November 10, 1993 Regular Meeting, Charles Willey moved, seconded by Bob Randolph to approve the minutes as written. A vote on the motion was recorded as follows: Ray Haynes - `des Bob Randolph - Yes Larry Helton - Yes Charles Tilley - Yes The motion carried 4 -0. 4. Appeal of Site Plan Review ®Bob Ary - A request for a reduction in landscaping requirements on a site plan for the "fire Barn, a proposed automotive center, located on Lots 6 & 7, Block 19, original plat of Owasso. The proposed building is generally located at 112 & 116 W Broadway Street, on the southeast corner of the intersection of Broadway and Atlanta .Streets. The site plan was reviewed and approved at the November 10, 1998 regular meeting. Theron Warlick presented the item to the Commissioners. The location of the property was described. At the November 10, 1998 regular Owasso Planning Commission meeting this site plan was reviewed and approved subject to the following conditions: 1) That the developer install a concrete detention device in the swale on the south side of the subject property per OPWA specifications, 2) That a continuous sidewalk be installed on the Broadway side of the property, 3) That signage will be reviewed by separate sign permit, O ASSO PLANNING COMMISSION December 8, 1998 Page Noe 2 4) And that the developer eliminate the easternmost two (2) parking spaces and establish a vegetative buffer area in their place. Ray Haynes stated. that the public library, which will be across the street, represents a. substantial investment in the downtown area and should be protected. Mr. Ary, the applicant, addressed the Commissioners. lie was concerned that the elimination of parking spaces would effect his ability to conduct business and that he needs all the parking he can get. He also stated that he will do the very best he can to have ample landscaping around the area. Ray Haynes recommended the City of Owasso work on a landscape ordinance. After discussion, Larry Helton moved to grant the applicants request to exclude item #4., but Mr. Ary will landscape the project as extensive as possible. Charles Willey seconded the; .motion. A request for the annexation of property for Preston Lakes, LLC. The subject property is located in the north half of the southwest quarter (N /2 SCI /4) of the Section 22, T -21 -N, R-14--E, Rogers County, Oklahoma. The subject property is further described as a 60 acre tract located east of N 145th E Avenue between E 86th Street N and E 96th Street N. Theron Warlick briefed the Commissioners on this item. The property lies in unincorporated Rogers County and is currently zoned AR (Agricultural Residential). Upon annexation it would be zoned to the City's comparable AG (Agricultural) zoning district. Acceleration /deceleration lanes and sidewalks will be required along forth 145th East Avenue. The Owasso "technical Advisory Committee reviewed the request at their November 25, 1998 regular meeting. No comments were received. The Owasso Annexation Committee reviewed and approved the request at the November 30, 1995 special meeting. There will be no building permits issued until the approval of the water and sewer. A surrounding property owner to the north was present and had concerns regarding what type of development was going into this area. Charles Willey moved to approve the annexation request, Bob Randolph seconded. Fanrrily District), Op, (light Office District), CG (General Commercial District), and CS (Shopping Center District). The subject property is located between bingo road and Garnett road and E 86th ,Street N and E 96th Street N. Theron Warlick presented the item. Mr. Warlick explained that this item and OPUD -16 will be presented together since the rezoning request and the request for approval of the PUD are related to one another. Although, the Commissioners will be voting on the items #6 and #7 separately. The proposed zoning district sizes were described to the Commissioners. Also noted was the proposed rezoning is identical to the 'Tulsa County zoning that was in effect since 1991 prior to annexation of the property. The Technical Advisory Committee reviewed the proposed zoning change at the November 25, 1998 meeting. Notices were mailed to the surrounding property owners and legal advertisement was published in the Owasso reporter on November 19, 1998. The following are comments /concerns made by surrounding property owners: Sam Henderson _. Concerns with traffic on Mingo road and the conditions of the streets surrounding this area, especially 106th Street North. Kelly McLaughlin - Commercial zoning at the intersections and the traffic it would create. Concerns with the train track which runs through the northwest corner of this property. Connie Kannady - Moved to Owasso for the country atmosphere. Had concerns regarding the traffic and against the area designated for commercial. Pat Kirkland - Questions on flooding at Mingo & 96th since the golf course was constructed, Kim Griffin - Concerns on the maintenance of the lakes and parr areas in this proposed project. Jay Hendrix - .Sewer problems in the area. OWASSO PLANNING COMMISSION Deem -iber 8, 1.998 Page No© 4 Mr. 'Tim Terral of Pittman - -Poe made a short presentation. Mr. 'f'erral explained that the preliminary plat and the final plat will come before the Owasso Planning Commission for review and approval. 'There was also a discussion on flag lots. Mr. Roy Cartwright, a member of the Larkin Bailey Foundation, addressed. the Commissions and surrounding properties owners, He stated this land will be developed to please the public. Bob Randolph moved to approve the rezoning request, Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bob Randolph -- ales Larry Helton - Yes Charles Willey - Yes The motion carried 4 -0. 7. OP UD 16 _'The Lakes at Bailed! ranch - A request for approval of a planned unit development for Kourtis Properties, LLC. The applicant has submitted the Lakes at Bailey Ranch, a mixed -use development plan for the north half (N /2) and portions of the southwest quarter (SST /4) of Section 18, T -21 -N, R-.14-E, City of Owasso, Oklahoma. The property is located between Mingo Road and Garnett Road and E. 86th Street N and B 96th Street N and contains 4.08.1 acres more or less. Theron Warlick presented this item in conjunction with item #6. ,Staff recommends approval of OPLJD --12 with the following conditions; 1) That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development flan as required by the PUD Chapter of the Owasso Zoning Code, 2) That unless specifically set out in the standards and conditions of this PUD, all development in the proposed subject site shall be in accordance with the overlaying zoning districts as described in OZ -98 -14 and shall meet all the necessary requirements of the respective overlay districts, 3) That a subdivision plat be approved by the Owasso City Council and filed with the County Clerk's Office prior to the issuance of a building permit. Said covenants shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary, 4) That a reference on page 23 of the PUD text pertaining to a lien being placed on a Property Owner's dissociation member's "personal property" be changed to "real property ", O BASSO PLANNING COMMISSION December 8, 1998 Page No. 5 5) That minor transfers (15 % increase in a development area's density) of dwelling units from one residential development area to another can occur if a significant change in the character of either development is not created, 6) That no building permits be issued within any portion of the PUD until all items in Chapter S "Building hermits" of the Owasso Subdivision regulations are fulfilled, 7) All conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval be met as conditions of the PUD, 8) That a detailed drainage report be submitted at the three of platting and certification of such document by an (engineer, 9) That within the PUD, the maximum number of dwelling units shall not exceed 1,898 units, 10) That acceleration /deceleration lanes will be required at intersections with PUD collector streets on B 96th Street N, B 106th_ Street N, Garnett road, and Mingo Road, 11) That the developer shall incorporate access management techniques in the development of commercial areas. Such techniques may include but not be limited to: unified circulation and parking plans, joint access and parking lot cross access, restriction of the number of driveways per parcel, controlling driveway spacing, sight distance and corner clearance. 12) That a barrier fence be erected between the SILO railroad tracks and proposed commercial area near the corner of E 106th Street N and Mingo road and the abutting multi - family area, 13) Detailed landscaping plans (type, species, size, location, and irrigation) shall be required to be submitted with site plans of any commercial development. Said plans will be reviewed by staff and must be approved by the Planning Commission. 14) That sidewalks be provided on all road frontage within the subject property, including B 96th Street lei, B 106th Street %1, Garnett road and bingo Road, 15) That the minimum side yard of any corner lot be no less than 25 feet, 16) That all landscaping plans for the entrances shall be reviewed and approved by the Owasso Planning Commission and installed prior to the occupancy of any buildings, 17) That no flag lots are permitted within any portion of the PUD, 18) If needed, commercial areas may be required to provide on -site detention. This is to be determined at site plan review for commercial property. After lengthy discussion, Charles Willey moved to approve the request subject to the all of the above staff recommendations. Bob Randolph seconded the motion. Preliminary Ilaviselµ_puntr I stag__ L - A request for review of a revised -, preliminary plat for Country Estates III a 1.7.37 acre, 61 -.lot subdivision. The subject property is zoned S-3 (Residential Single- family High Density) and is generally located west of the Country Estates III and Westport Additions. Theron Warlick presented this item. A preliminary plat was approved at the July 14, 1998 regular meeting of the Owasso Planning Commission. One change was made on this revised plat. A change in the street layout (oast 118th Court North) to allow for a new access to the planned Country Estates IV addition. The `technical Advisory Committee reviewed the preliminary plat at their November 25, 1998 meeting. "I'he following are the comments made at that meeting: ONO - Label 17.5' easement on Lot 27, Block 5. PSO - U/E declared on south side. of Block 5, Lots 1 - -3. Ray Haynes moved to approve the preliminary plat, subject to the provision of the T'AC easement requests. Charles Willey seconded. A. vote on the motion was recorded as follows: Ray Haynes - Yes Bob Randolph - Yes Larry Felton - Yes Charles Willey - Yes The motion carried 4 -0. 9. Preliminaa Plat - Counter Estates IV - A. request for review of a preliminary plat for Country Estates IV, a 46.29 acre, 164 lot subdivision. The subject property is described as part of the S/2 of Section 6, T'21N, R14E, and is located west of Country Estates II and north of Country Estates III and Westport Additions. This item was withdrawn by the applicant. 10. Site Plan - Children's Depot - A request for review of a site plan for the Children's Depot, a day care center proposed for part of pots 2 & 3, dock 1, Castle Point Addition, City of Owasso. The subject property is generally located north of Owasso Wal-Mart Addition, between E 86th Street N and E 96th Street N on the east side of the Owasso Expressway. OWASSO PLANNING COMMISSION December 8, 1998 Page Noe 7 Theron Warlick briefed this item with the Commissioners. The subject property is currently zoned CG (Commercial General) and O (Office Medium Intensity). A daycare is defined as a Use Unit 5 within the zoning code. All uses that are described as in Use Unit 5 are permitted by right in the CG district. T wenty -three pat -king spaces, two of which are designated handicapped are shown on the site plan. The 'Technical Advisory Committee reviewed the site plan at their November 25, 1998 meeting. No comments or concerns were expressed. Stormwater would be directed to a ditch in the front of the property and a detention pond for Castle Point Addition in the rear. Also a, separate permit will be needed for signage, Bob Randolph moved to approve the site plan as submitted, Larry Felton seconded.
