The agenda for the regular meeting was posted at the north entrance to City Hall on April 1,
2003 at 12:00 PM.
1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at '7,05 PM
and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF MARCH 10, 2003 REGULAR
MEETING - The Commission reviewed the minutes of Larch 10, 2003 Regular Meeting,
Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the
motion was recorded as follows

4. OZ -03 -02 -- DG & S Pro erties - A request to rezone approximately 11.33 acres, more
or less from AG (Agriculture General District) to RS -3 (Residential Single Family High
Density District). The subject property is located on the west side of N. Garnett Rd,
approximately 2,640 feet north of the E. 116' St. N. and N. Garnett Rd. intersection.
The Chair introduced the case and Robert presented the item. The applicant is requesting
this review in order to complete Country Estates III. The applicant has completed the
infrastructure and utility construction. betters were mailed to surrounding property
owners and the legal advertisement was published in the Owasso Reporter. No calls have
been received. The Technical Advisory Committee reviewed the request on Larch 26,
2003, Staff or utility provided no comments. ,Staff recommends approval of OZ -03 -02,
rezoning approximately 11.33 acres, from AG to RS -3. Chairperson Haynes asked if
there were any comments regarding this item from audience. Ms. Jennifer Pinkstaff
(11111 E 121 St No) has concerns with speeding vehicles in the neighborhood. She
would like to see a "Slow Children Playing" sign posted or speed bumps.

to RS -3 (Residential Single Family High Density District), Dale Prevett seconded the

5. OPP -03 -01 Counfiry Estates Y1_ - -- A request for the review of a preliminary plat for
the Country Estates VI Addition containing approximately 11.33 acres, more or less.
The Country Estates VI Addition contains 37 residential lots within 3 blocks. The
subject property is located on the west side of N. Garnett Rd., approximately 2,640 feet
north of the R. 116" St. N. and N. Garnett Rd. intersection.
Ray Haynes moved to approval the Preliminary Flat request subject to the above TAC
and staff recommendations, along with the addition of Item #S stated below.
S. Provide landscaping around the detention pond.

6. O%- 03 -03,.: my coot -- A request to rezone approximately .32 acres, snore or less
from BS-3 (Residential Single Family High Density District) to C (Commercial General
District). The subject property is located at the southwest corner of the S. Birch St. and
E. 3 "` Ave. intersection, further described as 304 S. Birch St.
The Chair introduced the item and Robert reviewed the staff report. The applicant is
proposing to rezone in order to accommodate a lawn care and landscaping office. The
Owasso 2010 Master Flan and Owasso Downtown Development District Plan was
discussed. fetters were mailed to surrounding property owners and legal advertisement
was published in the Owasso Reporter. Staff has received several phone calls in
opposition. The `technical Advisory Committee reviewed the application at their March
26, 2003 meeting. Staff recommends approval of OZ- 03 -03, rezoning approximately .32
acre, from RS -3 to CG. Mr. Scott Moody, the applicant, was present to answer any
questions and requested a brief presentation. He stated that the facility will be used for a
meeting place in the mornings and evenings. Also, there will be inside storage for
vehicles and an office. He proposes to build a 4.05 x 60' metal building, paved and striped
parking lot with landscaping. Privacy fencing will be used to obstruct any vehicles or
machinery left outside. Employee parking was discussed along with noise concerns.
Below are a few of the corm -nents made by surrounding property owners which were in
attendance:
Melody Naves - 404 South Birch - Does not want commercial buildings in the
neighborhood. Had comments regarding a portion of the Owasso Downtown
Development Plan.
Albio Daniel - 305 South fain Street -v Questioned the appearance of the
proposed building and fencing. Doesn't mind commercial businesses in the area.
Delores Hayes - 408 South Birch - Had a problem with privacy fences in the
neighborhood. This neighborhood has supported the community since the
subdivision was constructed. Wants homes in the neighborhood not businesses or
industry.

of the E. 5" Ave, right -of- way for a part of the E/2 of the NE /4 of Section 31, `township
21 Forth, flange 14 east. The subject property is located approximately 600 feet west of
the B. 5"' Ave. and H.S. Henry 169 Service Road intersection, further described as 301 E.
5 "' Ave.
The Chair introduced the item. and Robert reviewed the staff report. The applicant is
requesting this right -of -way closure to permit the expansion of the existing National Steak
Processors facility. The addition would provide several new employment opportunities.
The Board of Adjustment approved the encroachment into the minimum 50 foot building
setback line at the March 25, 2003 meeting. The Technical Advisory Committee
reviewed the request at their March 26, 2003 meeting. Below are conurients noted at that
meeting. Staff recommends approval of the request to close a portion of the northern 409
right-of-way along E. 5`h Ave., subject to the following conditions:

and TAC recommendation, along with the addition of Item #4 which states:
4. The building addition can not encroach nearer than 12 feet from existing
roadway.

Chairperson Haynes called for a 5-minute recess. The meeting resumed at 8;05 PM.
q. OPP 03 -02 -. Preston tales III A request for the review of a preliminary plat for the
Preston takes Ill .Addition containing approximately 44.78 acres, more or less. The
Preston Lakes ill Addition contains 139 residential lots within 5 blocks. The subject
property is located in the E/2 of Section 22, Township 21 North, Range 14 past and
adjacent to the Preston Lakes 11 Addition,
The Chair introduced the item and Robert reviewed the staff report. The surrounding
land use and surrounding coning was described. The Technical Advisory Committee
reviewed the preliminary plat at the March 26, 2003 meeting. Below are the comments
noted at that meeting. ,Staff recommends approval of the Preston takes 111 preliminary
plat, subject to the following conditions:
I . Community Development Addressing will be provided, prior to the final plat
submittal.
2. Community Development An addition to the covenants stating, "All single
family residential structures shall front to the street with the greatest building
setback ", is required.
3. Public Works Department -- Question whether Lot(s) 28 & 29, block 1 and
Lot 24, Block 3 can accommodate residential structures. Please provide
copies of house plans that can be accommodated on these lots.
4. Public Works Department - Please provide an access point along N. 161 E;
Ave.
5. Fire Department - Hydrant locations must be coordinated with the City of
Owasso Fire Department.
Mr. David Charney and Mr. fete Kourtis were present to answer questions. Discussion
was held regarding a possible access point along N. 1615` B. Ave.

10. OPP 03-03- Metro Lakes -- A request for the review of a preliminary plat for the Metro
Lakes Addition containing approximately 65 acres, more or less. The Metro Lakes
Addition contains 158 residential lots within 5 blocks. The subject property is located at
the southeast corner of the F. 116 "' ,St. N. and N. 97"' F. Ave, intersection.
The Chair introduced the item and Robert reviewed the staff report. The applicant is
requesting this review in order to acconnnodate single family residential uses. 1`he
preliminary plat application is consistent with the OPUD 01 -01 abandonment and the City
of Owasso :coning code. The Owasso 'Technical Advisory Committee reviewed the plat at
their March 26, 2003 meeting. Below are the comments submitted. Staff` recommends
approval of the Metro Hakes preliminary plat, subject to the following conditions:
1. Community Development Addressing will be provided prior to final plat
submittal.
1 Community Development - An addition to the covenants stating, "All single
family residential structures shall front to the street with the greatest building
setback ", is required.
3. Community anity Development -- Major street right - -of may corners rriust be a
minimum 40' radius. please correct.
4. Community Development - - -- Additional rear and side easements are required in
Block 2.
5. Community Development The southern most col -de -sac must be a minim-urn
50' radius.
Mr. Brian Kellogg, with Kellogg Engineering, was present to address any concerns. Mr.
Kellogg explained that the proposed drainage flow will run from the west and south into
the drainage areas. Ray Haynes had concerns regarding the maintenance of the lakes.
Mr. Kellogg explained that the Metro Lakes Homeowners Association will be responsible
for the upkeep. Fencing along the railroad tracks was discussed.
Ray Haynes moved to approve the preliminary plat request subject to the above ,Staff and
TAC recommendations, Dewey Brown seconded the motion. A vote on the motion was

11. O P 03-04 Metro Villas -- A request for the review of a preliminary plat for the Metro
Villas Addition containing approximately 11.68 acres, more or less. 'T'he Metro Villas
Addition contains 23 residential lots and 1 commercial lot within 2 blocks. The subject
property is located at the southeast corner of the 1';. 116"' St, N. and N. 97`1 F. Ave.
intersection.
Chairperson Haynes presented the item and Robert described the surrounding land use.
'The preliminary plat application is consistent with the approval and subsequent
abandonment of the OPUD- 01 - -01 application. The 'T'echnical Advisory Committee
reviewed the plat at their March 26, 2003 meeting. below are the conirrients submitted at
that meeting. Staff recommends approval of the Metro Villas preliminary plats subject to
the following conditions;
1. Community Development -.- Addressing will be provided prior to final plat
submittal.
2. Community Development - An addition to the covenants stating, "All single
family residential structures shall front to the street with the greatest building
setback ", is required,
3. Fire Department -- hydrant locations must be coordinated with the City of
Owasso Fire Department.
4. Washington County R D #3 - -- This subdivision is subject to a $50.00 per tap
fee.
5. 'Tulsa County - -- please provide Limits of No access along N. 97"' E Ave. and
F. 116"' St. N.
6. 'Tulsa County W Please provide a copy of the hydrology study.
