The notice for the Addendum to Agenda was posted in the Owasso City Hall, 207 S Cedar, on October 3, 2001 at 5000 p. 1. CALL TO ORDER - Charles Willey called the meeting to order at 7000 PM and declared a quorum present. 1 ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 1.7, 2001 SPECIAL MEETING -- The Commission reviewed the minutes of ,September 17, 2001 Special Meeting;, Bill Ellison moved to approve the minutes. The motion was seconded by Bill Williams. A vote on the motion was recorded as follows: Charles Willey -- Yes Bill Williams W Yes Bill Alison - Yes The motion carried 3 -0. Charles Willey stated that case #OZ- 01 -05, rezoning for First Baptist Church property, was tabled at the September 17, 2001 special meeting. The tabling of this item needs to be extended to the November 2001 regular meeting. 4-. Annexation - City of wasso - A request for review of an annexation of street right-of- way located at the southeast corner of the intersection of E. 86" Street N. and N. 145" Street N. and generally described as a portion of the Northwest Quarter (NW /4) of the Northwest Quarter (NW /4) of Section 27, Township 21 forth, Range 14E, Rogers County, States of Oklahoma. Donna presented the item and described the property location. The property is zoned AG (Agriculture) and would remain AG. Two legal notifications will appear in the October 11`" and 18`" editions of the Owasso Reporter prior to submittal to the City Council. The Technical Advisory Committee reviewed this request with utility providers asking for information regarding utility locations near the subject property. The Owasso Annexation Committee reviewed the request and recommended approval. Annexation m Charney Charney ..- A request for review of an annexation of a tract of land located north of east 96 ' Street N. and East of the U.S. Highway 169 right-of-way and generally described as a portion of the Northwest Quarter (NW /4) of the Southwest Quarter (SW /4.) of Section 16, Township 21 North, Range 14 East, 'Tulsa County, State of Oklahoma. Rill Ellison moved to approve the annexation request, Dill Williams seconded the motion. A vote on the motion was recorded as follows: Charles Willey -. Annexation - Pittman Poe & Associates - Request for review of an annexation of a tract of land located south of E. 116`h Street N. (State Highway 20) and west of N. 145" E. Avenue and generally described as a portion of the East Half (E /2) of Section 9, Township 21 North, Range 14 East, 'Tulsa County, States of Oklahoma. Donna presented the item and described the location of the property. This property is currently zoned AG (Agriculture) and totals approximately 89.34 acres. The 'Technical Advisory Committee reviewed the request at their September 26, 2001 meeting. The Owasso Annexation Committee reviewed the request also and recommended approval. Acceleration /deceleration lanes will be required along N. 145"' E Avenue at the time of platting. A sealed engineering report or letter confirming the ability of Washington County R D3 to provide adequate fire protection standards prior to approval of any plat associated with the annexed property, Pill Williams moved to approve the above annexation subject to the above stall' recommendation, bill Ellison seconded the motion. OPUD -01-03 & OZ-01 -0 - Charnel_ harney w- Request for review of a plaDned unit development for fake Valley. The 160 acre subject property is located at the northeast corner of E. 106" Street N. and N. 145 "' E Avenue and is described as the Southwest Quarter (SCI /4) of Section 10, Township 21. North, Range 14 East, Rogers County, Mates of Oklahoma. (Ward 1) Staff recommends approval of OPUD -01 -03 and OZ -01 -08 subject to the following conditions: 1. The primarily east -west road proposed shall be developed as a collector road. 2. All cul -de -sac lots and lots along curves shall meet the minimum lot width within five feet of the front yard setback or rear property line. 3. Sidewalks along all public rights -of -way be required at the time of platting. 4. Acceleration /deceleration lanes be required at the time of platting. 5. Detailed covenants and restrictions governing the unified design and function of the PUD be required at the time of platting. 6. The applicant's Development Text shall be considered the Outline Development Plan and shall be filed of record in the office of the "Tulsa County Clerk. 7. Unless specifically set out in the standards and conditions of this PUD, single- OWASSO PLANNING COMMISSION October 9, 2001 Page Naga family development shall meet the requirements of a typical S -3 district, & Unless specifically set out in the standards and conditions of this PUD, cornrwercial development shall meet the requirements of a typical CG district. 9, Within this PUD, the maximum number of dwelling unit shall not exceed 560 single -- family residence. 10. Minor transfers (10% increase in a development area's density) of dwelling from one residential development area to another may occur if a significant change in the character of the development area is not created. 11. All conditions imposed by the Owasso 'technical Advisory Committee for subdivision plat approval be reset as conditions of the PUD. 12. A detailed drainage report be submitted at the time of platting and the document be certified by registered engineering. 13. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 14. No building permit be issued within any portion of the PUD until all criteria outlined within Chapter S of the Owasso Subdivision Regulations are met by the developer. 15. Detailed landscape plans shall be submitted at the time of site plan review. 16. The Planning Commission reserves the right to prescribe additional buffering screening and setbacks during the platting process. Gale Beckman -- 10990 No 155 E Ave -- Drainage problems in the area. Lydia Snyder - Overcrowding of the schools and concerns with drainage on 'East 106 ", Street North. David Hamlin -- Expressed problems with drainage and questioned the liability for his property flooding. Concerns with the amount of water runoff approximately 560 new homes will cause. Also, stormwater detention pond questions. Tony Swindel - 14511 E 102 ,St No - Stormwater runoff concerns. Leslie Martini - 10113 N 151 E Ave - Stormwater concerns also, problems with the ditches being too deep along various roads in Rogers County. Larry Loffer _ -- 13227 E 106 St No - Concerns regarding the conditions of roads, such as East 106"' ,Street North. Adding more houses and people will cause further deterioration. Also, questions on acceleration/deceleration lanes. Roy Crowe _._ 15901 E 109 ,St No - Questions on how far east the sewer system will go. Paula Hamlin - 15052 E 106 St No v- More homes in the area adding more traffic on East 106`'' Street North. elopes that she will be able to exit her driveway. Dale Albersmeyer - 10124 N 151 E Ave - Questioned when the property was annexed into the city limits of Owasso. Has problems with stormwater runoff in the area. Stated that there are five (5) homes that get land locked after a substantial rain. Emergency vehicles are not able to reach these homes. Wants to see Owasso grow but, there is an existing problem and we don't need additional problems in the area. Tim Burrnett - 15675 E 110 5t No - Questioned the size of the lots that will be in this development. He and his family moved to Owasso for a rural setting. Mr. Charney explained that the detention ponds are there to retain the water. These ponds are designed to maintain the water then release in a controlled manner. Mr. Charney assured the property owners that this plat would be reviewed very carefully and that he would also check into the stormwaters problems running downstream. Charles Willey moved to approve OPUD -- 01--03 and OZ -01 -089 subject to the above staff and TAC recommendations, with the deletion of Item #1 and Item #2, Bill Williams seconded the motion. Request for review of a lot split for property described as Lot 1, block 1, Three Lakes Industrial Park and located at 5291 Owasso Expressway. (Ward 3) Donna described the location of the property and explained that this property is zoned IL (Industrial Light), Access to Tract 2 will be by way of a 259 mutual access easement through Tract 1. The Owasso Planning Commission reviewed a site plan for the rear portion at the January 9, 2001 meeting. No comments were recorded at the Technical Advisory Committee which was held on September 26, 2001. Charles Willey questioned the flow of traffic through the access easement. Staff recommends approval of OLS -01 -05 subject to the following condition: 1. The 259 mutual access easement shall be recorded with the Tulsa County Clerk prior to the issuance of a building permit. Pill Alison moved to approve the lot split request subject to the above condition, Charles Willey seconded the motion. Final Plat - Saw sass Park at Bailey Ranch - A request for review of a final plat for Sawgrass Park at Bailey Ranch, a 53.24 acre, 179 lot subdivision located north of E. 96 ' Street N. and east of N. Garnett Road and generally described as a portion of the West Half (W /2) of Section 17, Township 21N, Range 14E. (Ward 1) ASSO PLANNING INC COM ISSION October 9, 2001 Page No. `i Staff recommends approval of the preliminary plat subject to the following conditions: 1. All TAC comments shall be addressed prior to release of the final plat for filing. 2. A covenant stipulating that `the proposed subdivision shall meet or exceed all requirements of the Bailey Ranch Planned Unit Development Amended (OPUD- -12A), the Owasso Subdivision Regulations and the Owasso Zoning Code" shall be added to the text of the plat prior to forwarding the plat to Council. 3. A covenant stipulating that G6All improvements shall be 1) constructed and accepted by the Owasso City Council, or 2) insured by performance bond naming the City of Owasso co-- obligee" shall be added to the text of the plat prior to forwarding the plat to Council. Final Plat - Preston Lakes II - Request for review of a final plat for Preston Lakes 11, a 32.62 acre, 120 lot subdivision located north of E. 86`h Street N. and east of N. 1451` E Avenue and generally described as a portion of the South Half (S /2) and Northeast Quarter (NE /4) of Section 22, 'Township 21N, Range 14E. (Ward 3) The item was presented and the location was described. The subject property is zoned RS -2 /PUD (residential Single- Family, Medium Density /Planned Unit Development). The "Technical Advisory Committee reviewed this plat at their September 26, 2001 meeting. This property lies within the Elm Creek Sanitary Sewer Interceptor payback area and is subject to $1580.00 per acre assessment. Staff recommends approval of the final plat subject to the following conditions: 1. All TAC comments shall be addressed prior to release of the final plat for filing. 2. (Ward 3) Charles Willey moved to approve the site plan request subject to the deletion of Item #39 of the above staff recommendations and a modification on Item #4. Avenue and described as Lot 3, Block 10, Preston Lakes, (Ward 3) Bill Alison moved to approve the site plan request subject to the deletion of Item #3, of the above staff recommendations and a modification on Item #4. Item #4 condition should read as follows: Provided sidewalks along N. 145 "' E. Avenue prior to the issuance of an occupancy permit. Yes The motion carried 3-0. 13. OPUD -1 A Freston Lakes PUD Amendment - Request for review of a minor amendment to the Freston Lakes Planned Unit Development. The subject property is located north of E. 86" Street N. and east of N. 145`" E avenue and is generally described as a portion of the Southeast Quarter (SE /4) of Section 22, Township 21 forth, flange 14 East. (Ward 3) The location of the property was described. This amendment request is to allow for a deviation from the approved minimum 65 foot width for single- family residential lots. If approved it will accommodate lots 3, 8, 13 and 18, Block 1, Preston Lakes. Mr. David Charney made a brief presentation. Staff recommends approval subject to the following conditions: 1. All conditions of approval of OPUD -15 shall be conditions of approval of OPUD -15A. 2. No variance to the required setbacks shall be granted by the Owasso Board of Adjustment on Lots 3, 8, 13 and 18, Block 1, Preston bakes. Bill Williams moved to approve the amendment of OPUD -15A request subject to the above staff recommendations, Bill Ellison seconded the motion.
