6 61 SSO PLANNING COMMISSION MINUTES OF REA GULAR MEETING Monday, August 12, 2002 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Dale Prevett Dewey Brown Bill Williams MEMBERS ABSENT STAFF PRESENT SENT Tern looney Marsha Hensley Robert Moore Eric Wiles The agenda for the regular meeting was posted at the north entrance to City Hall on July 15, 2002 at 12:00 PM. L CALL TO ORDER d Chairperson Ray Haynes called the meeting to order at 1.00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JULY 8, 2002 REGULAR MEETING -- The Commission reviewed the minutes of July 8, 2002 Regular Meeting, Bill. Williams moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes -- Yes Dale Prevett - Yes Charles Willey _ Yes Dewey Brown -- Ices Bill Williams - Yes The motion carried 5 -0. 4. Annexation Re nest - Noble Sokoloslg - A request for the annexation of approximately 292 acres, more or less. The subject property is located west of Mingo Road, between E. 96"' Street Forth and E. 106`' Street North and east of Memorial Drive, between E. 106 "' Street Forth and E. 116"' Street Forth. Tim presented the item and described the location. The subject property is located in two different Sections. Tract A totals 160 acres and is zoned RE (Residential Estates) in Tulsa County. The applicant has requested to retain this zoning classification. Tracts B and C of the property total 132.22 acres. Both are zoned AG (Agriculture) and would remain zoned AG if annexation is approved. Notification of the annexation request was published in the Owasso Reporter. The Owasso Annexation Committee reviewed the request and unanimously recommended approval, contingent upon the contiguous issue OWASSO PLANNING COMMISSION August 129 2002 Page No. 2 being addressed. The property meets all of the requirements included within the Annexation Policy. Contiguity was a question regarding Tract A, however the applicant is proposing to annex the public right -of -way. ,Staff has received several phone calls and emails regarding this request. Staff recomrnends approval of the annexation request. The following are con-iments /concerns of several surrounding; property owners that were in attendance; Matt Slavin - Not opposed to development on the subject property but has concerns with stormwater runoff. Owns a $250,000.00 home down slope and does not want flooding problems. Jan 'Thomas m Wanted clarification on Item #5 of the Annexation policy. Also had questions regarding the police and fire coverage if annexation is approved. Requested a definition of RE (Residential Estates) zoning, such as the minimum size of lots, curb and guttering, sideways, etc. Doesn't want this subdivision to have the sarne hooding issues as Metro Heights 1 and 11. Mould like to see postponement of the annexation in order to make sure Tract C is correct. Sue Piggott _. Would like items carefully reviewed. Offered to show the Commissions pictures of flooding within Metro Heights 1 and 11. Glen Hereden - Owns vacant property on Memorial Drive, had questions regarding the supply of water. Also has a concern with the possibility of overloading the sewer system. Bill Mitchell - Attorney obtained by Jim and Bonnie Williams. He has concerns with the annexation of 'Tract C regarding the applicant annexing public right-of-way in order to fulfill the contiguity requirement. He stated that 'Tract C is owned by Mr. And Mrs. Williams. The location map does not show the curve on East 106`" Street North and wants to make sure that the Williams' property is not being taken in by this annexation. Would like to have this request tabled until further notice in order to allow the surrounding property owners to study the situation. Phillip Barnes - Had questions regarding the amount of homesites 'Tract A will provide. Lonnie Lamb - Stormwater and sewer line concerns. Wanted to know who would be responsible if his land and house floods because of what the City of Owasso has approved. Audrey ldartcher ® Questioned what Mr. Sokolosky and the City of Owasso is going to do for the ranch Creek subdivision residents if this land is annexed. Expressed a desire for an environmental study to be performed prior to annexation. OWASSO PLANNING COMMISSION August 12, 2002 Page No. 3 Harold Ledbetter -- Had stormwater concerns. Also had concerns regarding the possibility of Mr. Sokolosky requesting a higher density such as RS -3 in the future. Councilor Armstrong was present to address some of the citizen concerns. She explained that the Community Development Department has hired some new staff members and these issues will be reviewed. lay Haynes stated that this is an annexation request, it will go through the platting process both with Preliminary and Final flat reviews. Charles Willey asked if Tract B could be approved and table Tract A and Tract C until further notice. 'rim explained that if Tract A and Tract C are tabled they would more than likely come before the planning Commission for approval in September. Tract B would go to City Council on August 20, 2002. Following discussion, Tray Haynes moved to approve Tract B of the annexation request and to table Tract A and Tract C until further notice is given to the Commissioners on the legality of Tract C. Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Williams ._ Yes Charles Willey --- Yes Dewey gown - Yes Dale Prevett - Yes The motion carried 5 -0. Ray Haynes announced a 10- minute recess at 8:15 PM. The meeting reconvened at 8:25 PM. 5. Annexation IZeq�xest ®wass® Sep °t® a C_ lug - A request for the annexation of approximately 1.019 acres, more or less. The subject property is located on E. 76"' Street North, immediately west of the SIB &O railroad property. "Tim presented the item and described the property location. The Annexation Committee reviewed the request and it was approved unanimously. No calls or letters have been received regarding this request. Staff recommends approval of the annexation request. Discussion was held regarding the platting process. Tim stated that Staff's goal is to alleviate the platting requirements for civic clubs such as Owasso Sertoma Club. Ray Haynes moved to approve the annexation request and to waive the platting requirements, Dale Prevett seconded the motion. The subject property is located east of the northeast corner of E. 116`' Street North and Garnett Load. Tim presented the item to the Commissioners and described the property location. The Technical Advisory Committee reviewed the request; all comments have been addressed. Permits for the construction of water and wastewater improvements have been applied for through DEQ. he installation of sidewalks along the arterial street frontage as well as acceleration/deceleration lanes will be required. Staff recommends approval of the final plat. Ray Haynes had questions regarding the water flow direction. Mr. Lincoln Sallee, the applicant, was present to answer questions. Mr. Sallee explained that there is drainage easement to the south of the subject property, Lot 33 and Lot 34, Block 2. Ray Haynes moved to approve the final plat subject to the Staff and TAC recommendations, Dewey gown seconded the motion. Preliminary Plat — Champion East and West -- A request for the review of a preliminary plat for Champion East and West, a 39.72 acre subdivision containing 126 RS -3 residential lots. The subject property is located north of E. 76"' Street North, west of N. 145`' E. Avenue, and east of the Graceland Acres. Tim presented the item and described the subject property. The subject property was zoned RS -3 with residential lots of 70' in width (as opposed to the permitted 65'). The Technical Advisory Committee reviewed the preliminary plat and had several comments. The developer is not required to pay the Elm Creek Interceptor Payback pee with this property. Emergency Siren pee in the amount of $635.52 will be required. Staff recommends approval of the preliminary plat for Champion past and West. A representative from Kellogg Engineering ineering was present to address any concerns. A brief discussion was held regarding the right of 'way on either side of forth 1.45`h East Avenue. Charles Willey wanted to verify that the Fire Department was comfortable with the lay out of this subdivision. Tiny stated that the Fire Department reviewed the plat request at the 'i'AC meeting and had no objections. Ray Haynes moved to approve the preliminary plat subject to TAC and Staff recommendations, Pill Williams seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Williams -- Yes Charles Willey - Yes Dewey Brown -. Yes Dale Prevett - Yes The motion carried 5-0. 8. Preliminar Plat berts - -- A request for review for the preliminary plat for Eggberts, a one lot, one block addition containing 1.35 acres, more or less. The subject property is located on State highway 20, immediately east of the newly constructed QuikTrip. Tim introduced the item to the Commissioners. Staff is requesting the Planning Commission to act upon this plat as a final plat in nature. The Technical Advisory Committee reviewed the preliminary plat and had a few corrections; the applicant has addressed the concerns. Staff recommends approval of the final plat with the following additional requirements: 1. Sidewalks will need to be added along the M 140 "' E. Avenue frontage. 2. The Elm Creek Interceptor payback fee would need to be paid by the applicants prior to obtaining signatures on the final plat. The Elm Creek Interceptor° payback fee is $1,580 per acre, or $2,133.00 for the subject property. 3. In addition to the Elm Creek Interceptor° payback fee, the applicants must also address a payback fee to Owasso Land Trust, the entity that extended the sewer lines from Elm Creek Interceptor. The applicable fee for that payback is $1,000 per acre, or $1,350 for the subject property. 4. There is a storm siren fee of $16.00 per acre that would need to be paid by the applicants. This fee would amount to $21.60. Site Plan _- _ bei °ts _ Restaurant - A request to review a site plan for Eggberts Restaurant. The subject property is located on State Highway 20, immediately east of the newly constructed Qu.ikTrip. 'Tim presented the item to the Commissioners and described the location. The applicant has met all necessary parking requirements. The property is zoned CS (Cornmercial Shopping Center). A complete landscaping plan is required to be submitted by the applicant at the time of building permit. The 'technical Advisory Committee reviewed the site plan; all corrections have been made. A brief discussion was held regarding stormwater drainage. Staff` recommends approval of the site plan with the following conditions of approval: 1. A separate permit for the sign will need to be obtained. 2. The applicant will need to install signage for handicapped accessibility parking in compliance with ADA standards. 3. Sidewalk will be required across the frontage of N. 140"' F. Avenue. 4. Coordination with the Owasso Fire Department regarding fire lane locations at time of parking lot striping. Ray Haynes moved to approve the site plan subject to the above Staff and TAC recommendations, Charles Willey seconded the motion. Site Plan __- F& _M Bane -- A request for the review of a site playa for F & M Bank. The subject property is described as Lot 2, Bloch 1, Owasso Market 11 and is located on E. 96"' Street North, 'rim described the location and stated that all necessary parking requirements have been met. A complete landscaping plan is required at the time of building permit- the applicant is aware of this requirement. All concerns /comments from the Technical advisory Committee meeting have been addressed. A brief discussion was held regarding concerns with the entrance on the southeast corner being too close to the intersection. Also, questions on stormwater flow. 'rim stated that the stormwater will run to the detention pond on East 96`h Street North which is in front of the Tulsa Teacher's Credit Union. Staff recommends approval of the proposed site plan as presented with the following conditions of approval: 1. A fire hydrant needs to be located at the northwest area of the subject property. 2. Coordination with the Fire Department regarding; the location of the fire lanes to occur at the time of parking lot striping. 3. 1landicappped accessible parking will need to be signed in accordance with ADA standards. 4. Washington County Rural Water District requested a copy of the water line easement that is to be filed by separate instrument. 5. All signage will require separate permits. 6. Applicant to submit landscaping plan at time of building permit. Ray Haynes moved to approve the site plan subject to the above Staff and TAC recommendations, Pill Williams seconded the motion. Election of Officers - Chairman `Mice -- Chairman Secretary 'The by -laws of the Owasso Planning Commission .state that the Commission shall have a chairperson, vice -- chairperson and secretary, and that election of said officers shall be held biennially at the first meeting of the Commission alter July 1 of each of the even_- numbered years. The term of each office shall be for two years beginning immediately upon the election of each officer. 'fhe Chair opened the floor for nominations for Chairperson. Flay Haynes was nominated by Bill Williams, with the nomination being seconded by Dewey Brown. Hearing no further nominations, the nominations were declared closed and Ray Haynes was elected Chairperson by acclamation. The Chair opened the floor for nominations for Mice Chairperson. Charles Willey was nominated by Bill Williams, with the nomination being seconded by Ray Haynes. Hearing no further nominations, the nominations were declared closed and Charles Willey was elected Mice Chairperson by acclamation. The Chair opened the floor for nominations for Secretary. Bill Williams was nominated by Charles Willey, with the nomination being seconded by Dewey Brown.
