CARL, TO CORDER --- Chairperson Ray Haynes called the meeting to order at 7;00 PM and declared a quorum present. 2. ROLE CALL, 3. CONSIDER APPROVAL, OF THE MINUTES OF MAY 13, 2002 REGULAR MEETING - The Conurrission reviewed the minutes of May 13, 2002 Regular Meeting, Charles Willey roved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows; Ray Haynes - Yes Bill Ellison -- Yes Charles Willey -- Yes Dewey Brown - Yes The motion carried 4 -0. 4. OZ-02-04 - Jerry Russell - A request to rezone Lot 1, Block 3 of Owasso Commercial Center from CS (Commercial Shopping Center) to CG (Commercial General). The subject property is located at 11501 E 76 Street North and is the former location of the Quik Trip Convenience Store. Tim presented the item and described the location. The applicant is requesting to rezone from CS (Commercial Shopping Center) to CG (Commercial General) in order to allow the sales of pre -owned automobiles. The subject property is currently developed but vacant. The Board of Adjustment unanimously denied a Special Exception request to use the property for auto sales without changing the zoning. Staff recommends denial of this request, due to the fact that there is CG zoning located elsewhere in the community. Also, this property is a gateway area to the City of Owasso. This use would not coincide with that of gateway areas as defined in the 2010 Master Plan. Notices were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. Staff received two phone calls in opposition and one letter (attached). The Technical Advisory Committee reviewed the request at their May 29, 2002 meeting. Mr. Jerry Russell, the applicant, was present to answer questions and requested a brief presentation. He stated that Mays County Chrysler has sales lots in Tahlequah and Pryor at this time and are doing well. Each lot normally has around 25 cars on the lots with ® ASS® PLANNING COMMISSION June 10, 2002 Page No. 2 three to four employees per dealership. ray Haynes expressed his concerns with the rezoning stating that a Special Exception is really what should have been approved, that way the City of Owasso would have more control if Mayes Country Chrysler fails. 'hanging the zoning; permanently could open this property to less desirable businesses. Ray Haynes moved to deny the rezoning request:, Charles Willey seconded the motion. A vote on the motion was recorded as follows; Ray Haynes -- `des Pill Alison - des Charles Willey _. Yes Dewey brown - Yes The motion carried 4-0 for denial. 5. OZ -02 -05 -ISM Sokolosky - A request to rezone approximately 40 acres of land from RE (residential Estates) to RS-3 (residential Single- Tarnily High Density). The subject property is located north of E. 76`h Sheet North, west of N. 145"' E. avenue, and east of the Graceland. Acres Addition. M. L. Jacobsen ._ 7489 Forth 147 East Avenue - Lindsay Management assured us in 1998 that we had no worries regarding the subject property because it will probably never get developed. Also, inquired sewer availability to this area. Gary Baxter - 7590 Forth 140 Place East - Had concerns with the good faith agreement of a PUD (underlying zoning of RS-1) and now trying to change that zoning. Why approve a PUD if it gets changed? Also had concerns with traffic in the area. The roads are not growing with the same pace of the developments. Around 300 more vehicles in the area are just too many. Randi Farwell . 7585 North 143 East A venc §e - The additional traffic is the major problem, has nothing against Mr. Sokolosky. She was hoping that there would be another way in and out of the property. Ray Haynes moved to approve the rezoning from RS -1 (Residential Single Family Low Density) to RS -3 (Residential Single Family High Density) subject to a minimum lot width of 70 feet, Charles Tilley seconded the motion. A vote on the motion was recorded as follows; Ray Haynes -files Bill Ellison W Yes Charles Willey - ales Dewey Brown -files The motion carried 4 -0, Chairperson Ray Haynes announced a 10- minute recess at 8:00 PM. 6. LS- 02-0 „- S_ co A request for a lot split on Lot 2, Block 1, Owasso Market 11. The subject property is located on E. 96`" Street North, between the Wal -Mart and Dowe's facilities, Ray Haynes moved to approve the lot split subject to the Board of .Adjustment approval of a Variance request on Tract #C, Dewey Brown seconded the motion. Plat Amendment -.� W_. Elm Creek mCommercial Corner emended ­ A request for the review of a plat amendment for palm Creep Commercial Corner, amending the front building line on pots 6 and 79 Bloch 2, from 25 feet to 11 feet. The subject property is located at 8514 N. 128 '11 E. Avenue, Ray Haynes moved to approve the plat amendment, Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes -- Yes Bill Ellison -- Yes Charles Willey - Yes Dewey Brown _. Yes The motion carried 4 -0. S. Zoi�in ode Amendment Staff Initiated m An amendment to the Owasso Zoning Code, Chapter 10 - Use Units, Section 1017 Automotive and Allied Activities which would require mini - storage units to be permitted by Special Exception only in all commercial zoning districts. Currently, mini - storage units are permitted outright in CG (Commercial General) and CH (Commercial Nigh Intensity) zoning districts. Tim introduced the item to the Commissioners and explained that Owasso permits mini - storage units in CG (Commercial General) and CH (Commercial high Intensity) districts outright. A change in the zoning code that would require the Board of Adjustment to approve mini- storage units by Special Exception in all commercial districts is appropriate. The amendment being proposed by staff would appear to be the appropriate step to ensure a public review process. Staff is recommending Planning Commission approval on this request. Ray Haynes moved to approve the zoning code amendment, Bill Ellison seconded the motion. Please accept this letter as ray voice of objection to the request to rezone Lot 1, Block 43 (located at 11501 E. 011 Street North) of Owasso Co _ ercial Center &orn CS (Commercial Shopping Center) to CG (Commercial General). I do not believe rezoning this property is in the lest interest of our community. I understand that a used car dealership is pursuing locating on this property, but caret do so under current zoning. I also understand why they would desire this location because it is highly visible, proximal to a major entrance of Owasso, and close to other similar dealerships where clustering provides for "feeding off ®f each other' However, f ®r the same reasons, I believe Owasso rest use prudent judgment, through zoning, in the types of businesses allowed in this prime location.
