Adjournment. hi mV11 T: U1 lu TO: HONORABLE MAYOR AND MEMBERS OF THE COUNCIL CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: REQUEST FOR A PARTIAL EASEMENT CLOSURE DATE: NOVEMBER 2, 2009 BACKGROUND: The City of Owasso has received a request for the partial closure of a utility easement located in the rear yard of 13800 East 94`h Street North. A survey of the site is included for your review. PROPERTY CHARACTERISTICS: The legal description of the property is Lot 1, Block 5, Nottingham Estates III Addition. The tract is zoned for RS -2 Single - Family Residential use and is occupied by a 2 -story house. The existing land use is residential for the subject property, as is land to the east, south and west. The property is served by municipal water, wastewater, police, and fire services. ANALYSIS: The applicant desires to close a portion of the existing 25' utility easement in order to correct the title work regarding the existing swimming pool and pool house that was built over a portion of the utility easement. All utility companies have been notified, and have accepted the modification to the utility easement. If the easement closure request is approved, the existing 25' utility easement would be modified to allow access to utility lines. The staff finds that this request will have no detrimental impacts to the subject tract, or the surrounding areas. TECHNICAL ADVISORY COMMITTEE: The request for the partial utility easement closure was reviewed by the Owasso Technical Advisory Committee at their regular meeting on October 28, 2009. At that meeting, utility providers and city staff are afforded the opportunity to comment on the application and request any changes or modifications. There were no comments made in regards to this item. PLANNING COMMISSION: The Owasso Planning Commission will consider the request at their regularly scheduled meeting on November 9, 2009. DATE: NOVEMBER 2, 2009 BACKGROUND: In order to further facilitate the development of their property for commercial use, Vines Properties, Incorporated has submitted a request that their property be rezoned from a Residential Duplex (RD) Zoning District to a Commercial Shopping (CS) Zoning District. A general area map is attached for review. PROPERTY CHARACTERISTICS: The property is currently developed and is zoned RD (Residential Duplex). The subject site is .24 acres in size. The property will be served by municipal water, wastewater, police, and fire services. LEGAL CONSIDERATIONS OF ZONING REQUESTS: Section 1500 of the Owasso Zoning Code outlines the city's policy on zoning amendments. The code states that amendments will be adopted to recognize changes in the Comprehensive Plan, or to recognize changing conditions in a particular area or in the jurisdictional area. Zoning changes must be based on two fundamental questions: 1) Does the requested zoning allow a land use that is appropriate for the subject property, and 2) Is the requested zoning in conformance with the Owasso Land Use Master Plan? Development considerations such as traffic, roads, grading, drainage, stormwater detention, utilities, rights -of -way, etc, are not to be considered until the platting stage of development. At the platting (and site planning) stage, the Planning Commission, municipal staff, and the Technical Advisory Committee work with the applicant to solve these types of specific development concerns. The proposed development for this property is unknown. CONFORMANCE TO MASTER PLAN DESIGNATION: The requested zoning designation, Commercial Shopping (CS), is compatible within the Owasso Land Use Master Plan's designation for the property. ANALYSIS: The subject property lies to the southeast of 2 "d and Atlanta, and is adjacent to compatible developments. The applicant has requested a Commercial Shopping (CS) Zoning Designation to allow for the construction of facilities that would support light commercial uses such as retail or office space. The requested use is found to be in accordance with the Owasso Land Use Master Plan. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved drives and storm water detention. Sewer service and water service will be provided by the City of Owasso. PLANNING COMMISSION: The Owasso Planning Commission will consider the request at their regularly scheduled meeting on November 9, 2009. EXISTING LAND USE: A portion of the property contains a golf driving range SURROUNDING LAND USE: North: Large Lot Residential / Agriculture South: Large Lot Residential / Agriculture East: Large Lot Residential / Agriculture West: Large Lot Residential / Agriculture PRESENT ZONING: Agricultural (AG) — Tulsa County DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the city limits is made a part of the city. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PUD is often the preferred land use control mechanism The third step in the development of a piece of property in Owasso is platting. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. ANALYSIS: The purpose of the applicant's annexation request is to bring the property into the City Limits of Owasso in order to receive city services. The applicant has agreed to dedicate necessary right -of- way, as deemed by Public Works, for future road expansion. The property is currently zoned Agricultural (AG) in Tulsa County and would remain this same classification upon annexation. Prior to any action relative to a rezoning request, a rezoning sign will be posted on the property and property owners within 300' will be notified. All development that occurs on the subject property must adhere to all subdivision and zoning requirements including but not limited to paved streets and sidewalks. Residential sewer and water service will be provided by the City of Owasso upon the applicant's request. Staff published legal notice of the annexation petition in the Owasso Reporter. Staff has received no phone calls or correspondence concerning the annexation request. ANNEXATION COMMITTEE MEETING: The Owasso Annexation Committee met at their regularly scheduled meeting on October 28, 2009. At that meeting members have the opportunity to comment on the City's ability to provide service to the proposed annexation site. At that meeting, the committee determined the subject area would be serviceable by Police, Fire, and Public Works Departments. The committee unanimously recommended approval of the annexation. PLANNING COMMISSION: The Owasso Planning Commission will consider the request at their regularly scheduled meeting on November 9, 2009. RECOMMENDATION: Staff intends to recommend approval of the request to annex the property into the corporate limits of the City of Owasso. CLARK FIRE CHIEF SUBJECT: RECORDS MANAGEMENT /FIRE INCIDENT AND PATIENT CARE REPORTING SOFTWARE BID DATE: November 6, 2009 In FY 2008 -09, the Owasso Fire Department formed a software review and specification team, whose mission was to evaluate the existing and future needs of the Owasso Fire Department's electronic reporting capability. The team began the process of determining software needs by evaluating records management systems in surrounding communities and interviewing users of the software programs. Following the conclusion of their research, the staff developed bid specifications for potential software packages. These specifications were designed to be broad in nature due to the variety in software functionality. The specifications were designed to ensure the software packages meet the needs of the organization, and that each bidder would demonstrate their product's usability and functionality. In addition to meeting the records maintenance needs of the Owasso Fire Department, this software purchase will enhance electronic record submittal to various state agencies, such as the Oklahoma State Fire Marshal and the Oklahoma State Department of Health. The software programs would also enhance the reporting capability of the department through sophisticated data analysis that will provide reports indicating call times and locations, resource allocation, and staffing needs based upon historical data. BIDS RECEIVED: Three bid packets were distributed to vendors of fire and emergency medical services (EMS) software. A bid opening was held at City Hall on October 12, 2009 at 11:00 AM. Two bids were received and evaluated by staff from both the fire department and the Information Technology department, and were determined to meet all of the specifications. hi addition to submitting the bids, both vendors demonstrated the software packages at the fire department on October 22 and 23, 2009. The two bids received for the records management software are: 1. Zoll Software Solutions Inc. BID: $48,465 ANNUAL MAINTENANCE FEES: $12.286 TOTAL: $60,751 2. ImageTrend Software Solutions BID: $38,300 ANNUAL MAINTENANCE FEES: $ 3,400 TOTAL: $41,700 ANALYSIS: After extensive review and evaluation, as well as discussions with current users of both software programs and demonstrations from each vendor, the staff concluded the Zoll Software was readily able to meet the specific needs of the Owasso Fire Department and better prepared to provide support services as the software transition is made. In addition to the base software bid, Zoll Software has many available upgrades that will be considered in future budgets, which would significantly enhance the efficiency of the fire department For example, Zoll has a bar -code inventory program and bar scanners for the laptop computers the fire department uses. The inventory program is capable of inventorying consumable supplies or permanent equipment on both ambulances and fire engines. Also, Zoll provides an upgrade that is used by on -scene commanders to track the accountability of all personnel on the scene of an emergency, including their time and location in the building, medical monitoring such as blood pressures of the firefighters, and fire progression in the building. Zoll software also is GIS compliant, and will be capable of incorporating the Owasso Dispatch Center's data from the Computer Aided Dispatch (CAD) software. When evaluating ImageTrend software, the resounding theme for the program was that their aspirations for growth and development over the next couple of years would take the software program closer to where Zoll Software is today. ImageTrend acknowledged that it will be several months and in many cases years before the functions and options available through Zoll would be available through ImageTrend. BID EXTENSION: Zoll and ImageTrend both have voluntarily extended the bid period by 15 days, allowing for further review and discussion. The extension also allowed for the item to be discussed at the City Council Work Session. RECOMMENDATION: Unless there are concerns presented at the City Council Work Session, staff intends to recommend Council award the contract and authorize payment in the amount of $60,751 to Zoll Software Solutions, Incorporated of Broomfield, Colorado. CITY ENGINEER SUBJECT: RECOMMENDATION FOR CONTRACT AWARD GARNETT REGIONAL DETENTION FACILITY DATE: November 5, 2009 BACKGROUND: In accordance with the 2005 Stormwater Master Plan, the Garnett Regional Detention project includes the construction of a 67- acre -foot regional detention facility with conveyance systems, to remediate drainage issues in Ator Heights and to provide additional storage capacity for future development. The detention facility will be located west of the Smith Farm Market in the Northeast '/4 of the Northeast '/4 of Section 19 (T21N, R14E). It is directly south of Caudle Estates and the Caudle Commercial Center, East of Fairways III Extended and north of Ator Heights Fourth Addition. In August 2007, City Council approved an Engineering Services Agreement with Meshek and Associates, LLC for the preparation of construction documents for the Regional Detention Facility and other upstream improvements for a sum not to exceed $150,000. Additionally, in June 2009, the City Council approved amendment No. 1 for additional services necessary in the design phase and for work they will be required to undertake in the construction phase to support the completion of the project. Design phase services total $27,330 and construction phase services total $21,670. The revised total compensation for the contract as amended was $199,000. In February 2009, the Oklahoma Department of Environmental Quality issued the required Water Quality 401 Certification (See Attachment A). In addition, U.S. Army Corps of Engineers issued the required permit to construct in May 2009 (See Attachment B). SOLICITATION OF BIDS: A notice to bidders was published in the Tulsa World Newspaper on October 10, 2009 and October 17, 2009 to solicit bids for the construction of the regional detention facility. A mandatory pre -bid meeting was held October 29, 2009, with twelve general contractors in attendance. The bids will be publically opened on November 9, 2009. FUNDING: Funding for this project will be obtained from the American Recovery and Reinvestment Act of 2009. RECOMMENDATION: Upon thorough review of all bids received on November 9, 2009, staff will provide the Council with results of the bid evaluation process during the November 10, 2009 worksession meeting. The project site can be found on the Collinsville, Oklahoma 7.5 Minute USGS Quadrangle map. The certification for this project was denied on December 18, 2008 due to the unresolved issue of inadequate compensation for the loss of beneficial uses assigned to the unnamed tributary of Ranch Creek and surrounding wetlands. On February 23, 2009 additional off -site mitigation plan was submitted by the applicant. The plan included a restoration and preservation of 575 feet (0.55 acres) of stream channel approximately 2000 feet downstream of the project as well as restoration of two small drainage channels. Since the issue that led to the denial has been resolved, the DEQ has reconsidered the denial and now issues the certification for the project in question. The conditions attached to this Conditional Certification will be the same terns of any 404 permit. The state may require compliance with these conditions under state and/or federal law. Failure to comply with the conditions or any other applicable state requirements may result in proceedings brought by the state for the suspension, termination, modification or revocation of this Certification and/or for injunctive relief, damages and/or penalties as allowed by law. This Certification may be revoked or modified upon subsequent amendments or revisions to Oklahoma's Water Quality Standards requirements or upon expiration of the federal permit for the described activity. This conditioned Water Quality Certification does not supersede the requirements of a Section 404 permit from the U.S. Army Corps of Engineers, a permit required by the local floodplain board, or any other permit required for this project. The certification is granted subject to the following conditions: ' 1) All spills of fuel or other pollutants in excess of five gallons shall be reported to the DEQ, within twenty-four (24) hours, to the pollution prevention hotline at 1- 800 -522 -0206. 2) All fueling and servicing of vehicles and equipment shall be done above the Ordinary High Water Mark (OHWM). 3) Activities authorized by Department of the Army permits sometimes require floodplain development - permits. Stream Reestablishment: To compensate for unavoidable impacts to 1,166 linear feet of stream, the permittee shall reestablish 866 linear feet of stream. The newly established stream segment shall follow the existing stream alignment with Ranch Creek tributary, both upstream and downstream. b. Pond Creation: To compensate for unavoidable impacts to a 0.42 -acre pond area, the permittee shall create a 1.97 -acre pond adjacent to and continuous with the reestablished stream channel. c. Wetland Creation: To compensate for unavoidable impacts to 1.78 acres of wetland area, the permittee shall reestablish 3.01 acres of wetland area along both banks adjacent to the newly excavated stream channel. The permittee shall preserve previously existing hydric soils; these hydric soils shall be reused to establish an acceptable medium for hydrophytic vegetation propagation. d. Planting Plan: To reestablish a diverse ecosystem of native plant species that reflect the original displaced resources and other natural systems within the project area, a 4.67 -acre riparian buffer shall be established in association with the reestablished stream channel. The permittee shall adhere to the planting plan as defined in the submitted mitigation plan. The permittee shall organize the planting based on a 100 - square foot (10- by 10 foot squares) planting unit. Each unit shall be planted to a specified ratio of large trees (total plants = 412), understory trees and large shrubs (total plants = 791), and small shrubs and woody vines (total plants = 2,255). e. Site Protection Instrument: The permittee shall dedicate this area, in perpetuity, as an aquatic ecosystem preserve and submit deed restriction confirmation documents to the Corps. f Mitigation Performance Standards: The permittee shall achieve 80 percent wetland and/or aquatic plant species ground cover for the re- established wetland and riparian areas after 5 years. g. Mitigation Monitoring and Renortine: The permittee shall monitor mitigation activities for no less than 5 years. The permittee shall conduct monitoring inspections corresponding to spring, summer, and fall seasons; any deficiencies identified shall be rectified as soon as practicable. Mitigation site monitoring reports shall be submitted annually to the Corps, and shall not exceed 10 pages (including photos). Monitoring reports shall be formatted in accordance with requirements set forth in the Corps, Tulsa District, Aquatic Resource Mitigation and Monitoring Guidelines (http://www.swt.usace.army.mftermitsMtigation.cfin . 4. Erosion and Sediment Control: Properly installed erosion control measures, such as staked hay bales or silt screen barriers, shall be incorporated and maintained to curtail unnecessary turbidity in receiving waters. Erosion control measures shall be inspected by the permittee after every storm event and repaired as necessary within 24 hours. Accumulations of sediment will be removed from silt fences when it reaches 1/3 the height of the fence. Long slopes may require multiple barriers to effectively control sediment. Barriers shall remain in place and effective until sufficient vegetation coverage on exposed areas is established. 5. Archeological Survey: Based on the topographic and hydrologic setting of the project site, archeological materials are likely to be encountered. The permittee shall conduct an archeological field inspection prior to project commencement. If archaeological resources are encountered, the permittee shall notify the Oklahoma Archeological Survey. 6. Flood Plains: All construction, both final and temporary, shall conform to existing local, State, and Federal flood plain management ordinances. The permittee shall contact the Tulsa County Floodplain Administrator for a determination as to whether a Floodplain Development Permit would be required. Further Information: 1. The existing collection system consists of over 100 miles of sanitary sewer line (ranging in size from 6 to 30 inches in diameter), 11 pump stations, and a 3.3 million gallon per day (MGD) treatment facility. In 2005, the City of Owasso commissioned an update of its 1997 Wastewater Master Plan. The updated plan provides a 20 -year guide for the prioritization and construction of upgrades to the City's conveyance and wastewater treatment infrastructure. Among the immediate needs identified, the plan recommends the investment of approximately $10 million for the upgrade the Wastewater Treatment Plant and the 117`h Street Pump Station. These recommended improvements will increase the average treatment plant capacity to 4.2 MGD, which is anticipated to meet wastewater treatment demands for the next 5 years. Similarly, the recommended improvements to the 117`h Street Pump Station will upgrade existing facilities thereby increasing the pumping capacity to accommodate present and future needs. In August 2007, OPWA Trustees approved an Engineering Services Agreement with Greely and Hansen for the preparation of construction documents for the Wastewater Treatment Plant Expansion and 117'h Pump Station Upgrade for a sum not to exceed $545,000. A mandatory pre -bid meeting was held on October 29, 2009, with nine general contractors in attendance. The bids will be publically opened on November 11, 2009. FUNDING: Funding for this project will be obtained from the Oklahoma Water Resources Board (OWRB) via a loan from the Drinking Water State Revolving Fund. RECOMMENDATION: Upon a thorough review of all bids received on November 11, 2009, staff intends to recommend Trustee award the successful bid to the appropriate vendor at the regular meeting of November 17, 2009. MEMORANDUM TO: THE HONORABLE CHAIR AND TRUSTEES OWASSO PUBLIC WORKS AUTHORITY FROM: ROGER STEVENS PUBLIC WORK DIRECTOR SUBJECT: RECOMMENDATION FOR CONTRACT AWARD EAST 76 STREET NORTH SANITARY SEWER INTERCEPTOR DATE: November 5, 2009 BACKGROUND: Extensive current and proposed development in the southwestern corner of Rogers County, east of Owasso, has created the opportunity for the extension of City of Owasso sanitary sewer to this area. In September 2007, City of Owasso engineering and operations staff began discussions with Greeley & Hansen concerning the development of a design for a sanitary sewer interceptor along a 70 Street North alignment to serve an area generally bounded by 76`h Street North to the north, the Verdigris River to the east, 59`h Street to the south and 143`d East Avenue to the west. In August of 2008, Trustees approved an engineering services agreement with Greeley and Hanson for the design of the E. 76`h Street North Sanitary Sewer Interceptor in the amount of $358,000. The proposed 76`h Street Interceptor would be a gravity sewer line extending east from a connection to the Elm Creek Interceptor (west of the 76`h Street North/145`h East Avenue intersection) a distance of 5.5 miles to approximately 193`d East Avenue. The construction cost is estimated to be $5,500,000 which includes the 10% contingency allowance required by the OWRB. The estimated cost for legal, administrative, and right of way acquisition is estimated to be $467,000; for a total project cost of $6,325,000. On October 2, 2009, Oklahoma Department of Environmental Quality approved the engineering design and issued the required permit (Permit No. SL000072090882) for the construction of the project to include: 11,448 linear feet of twenty four (24) inch PVC pipe, 7,396 linear feet of eighteen (18) PVC pipe, 1,932 linear feet of fifteen (15) inch PVC pipe, 5,512 linear feet of twelve (12) inch PVC pipe, 1,765 linear feet of ten (10) inch PVC pipe, 1,045 linear feet of eight (8) inch PVC pipe (See Attachment A). SOLICITATION OF BIDS: A notice to bidders was published in the Tulsa World Newspaper on October 24, 2009 and October 31, 2009 to solicit bids for the construction of the sanitary sewer interceptor project. A mandatory pre -bid meeting will be held November 13, 2009 and the bids will be publically opened on November 24, 2009.
