JANUARY 16, 1990
On Tuesday, January 16, 1990 the Owasso City Council met in a
regular session in the Council Chambers at the Community Center
per the Notice of Public Meeting and Agenda posted on the City
Hall bulletin board at 4:00 p.m. on Friday, January 12, 1990.
ITEM 1: CALL TO ORDER.
The meeting was called to order at 7:00 p.m. with Mayor Marlar
presiding.
ITEM 2: FLAG SALUTE.
The flag salute was led by Mayor Marlar.
ITEM 3: ROLL CALL.
PRESENT: Patricia K. Marlar, Mayor
Mark Thompson, Vice Mayor
John P. Phillips, Councilman
Von E. Stockler, Councilman
Stacy P. Lamb, Councilman
Rodney J. Ray, City Manager
Ronald D. Cates, City Attorney
Jane Buchanan, City Clerk
ABSENT: None
A quorum was declared present.
ITEM 4: REQUEST FOR APPROVAL OF THE MINUTES OF JANUARY 2 1990
A motion was made by M. Thompson, seconded by V. Stockler, to
approve the minutes, as written, by reference made a part hereto.
AYE: Thompson, Stockler, Lamb, Phillips, Marlar
NAY: None
MOTION: Carried 5-0

ITEM 5: REQUEST FOR APPROVAL OF THE WARRANTS.
A motion was made by V. Stockler, seconded by J. Phillips, to
approve the warrants as follows: (1) General Fund $10,307.91 (2)
Ambulance Service Fund $501.24 (3) City Garage $3,933.16 (4) E-
911 $1,917.07 (5) Risk Management $1,114.22 (6) Revenue Bond
Project Fund $4,379.96 (7) General Fund Payroll $62,785.57 and
City Garage Payroll $2,622.62.
AYE: Stockler, Phillips, Lamb, Thompson, Marlar
NAY: None
MOTION: Carried 5-0
ITEM 12: NEW BUSINESS.
Mr. Wayne Collins representing Modern Woodsmen of America,
presented the City with a check for $745.42 to be used to help
fund the construction of Friendship Park.
Mayor Marlar also gave a report on the trip made to the Oklahoma
~~orporation Commission hearing on the 272-371 telephone exchange
case.
ITEM 6: RECEIVE REPORT FROM INDEPENDENT ENGINEERING FIRM
(SISEMORE-SACK-SISEMORE) RELATING TO COMPARATIVE
ANALYSIS OF QUANTITIES REQUIRED TO MEET PLAN STANDARDS
ESTABLISHED FOR 86TH STREET IMPROVEMENTS.
Mr. Ray presented this item to Council stating the report has
been submitted by the engineering firm evaluating the quantities
of asphalt and concrete.
ITEM 7: REQUEST FOR COUNCIL CONSIDERATION OF "CHANGE ORDER NO.
3" RELATING TO AN INCREASE IN THE AMOUNT OF A CONTRACT
BETWEEN CUMMINS CONSTRUCTION AND THE CITY OF OWASSO AND
PERTAINING TO CONSTRUCTION IMPROVEMENTS ON 86TH STREET
NORTH.
The project engineers have recommended a change order to the 86th
Street project that would increase the cost of the project by
$235,287.62 over the original contract. This item was discussed
extensively at your last meeting. The result of that meeting was
the employment of independent engineer for the purpose of
evaluating the quantities required for the project.
After discussion by Council, a motion was made by M. Thompson,
seconded by V. Stockler, to approve Change Order No. 3 as
requested.

ITEM 8: REPORT TO THE COUNCIL FROM THE CITY AUDITOR RELATING TO
THE PRESENTATION OF THE CITY'S FISCAL 1988-1989
INDEPENDENT AUDIT.
Mr. Frank Crawford with Michael A. Crawford and Associates
presented the audit to the Council and answered questions.
ITEM 9: REPORT FROM CITY MANAGER.
A written report was given to Councilmembers.
ITEM 10: REPORT FROM CITY ATTORNEY.
None
ITEM 11: UNFINISHED BUSINESS FROM PREVIOUS MEETING.
None
ITEM 13: REQUEST FOR AN EXECUTIVE SESSION FOR THE PURPOSE OF
DISCUSSING PENDING LITIGATION IN THE MATTERS OF "CITY
OF OWASSO VS. WHITE" AND "CITY OF OWASSO VS. WALTERS".
A motion was made by M. Thompson, seconded by J. Phillips, to
enter into Executive Session as requested.

NAY: None
MOTION: Carried 5-0
Meeting was recessed at 7:26 p.m. and reconvened at 8:30 p.m.
ITEM 14: REQUEST FOR COUNCIL ACTION RELATING TO THE PURCHASE OF
PROPERTY WHEREIN THE CITY OF OWASSO INITIATED

REPORT FROM THE CITY ATTORNEY AND THE CITY MANAGER.)

A motion was made by J. Phillips, seconded by S. Lamb, to direct
the City Attorney to not pursue the option of a jury trial in
this matter.
AYE: Phi llips, Lamb, Thompson, Stockler, Marlar
NAY: None
MOTION: Carried 5-0
ITEM 15: ADJOURN.
With there being no further business to be brought before the
Council, Mayor Marlar asked for a motion to adjourn.
A motion was made by S. Lamb, secanded by V. Stockler, to
adjourn.

NAY: None
MOTION: Carried 5-0
Meeting was adjourned at 8:35 p.m.
