CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:05 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF NOVEMBER 10, 2003 REGULAR MEETING - The Commission reviewed the minutes of November 10, 2003 Regular Meeting, Dewey Brown moved, seconded by Dale Prevett to approve the minutes. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 4. Site Plan - A request from Dan Draper for the review and approval of a site plan for a proposed mini - storage facility on approximately 2.56 acres located in the southwest corner of N. 97`'' E. Ave. (Mingo Rd.) and E. 116'h St. N. The Chair introduced the item and Duane Cuthbertson gave the staff review. He stated that the applicant is requesting a review of a site plan in order to construct a mini - storage facility. The property is zoned CS. The proposal is for seven, one story buildings comprising of 35,150 square feet on 2.56 acres. There is a 35' diagonal easement established by the Williams Pipeline Company in the eastern half of the site. The Owasso Board of Adjustment approved a Special Exception in at the July 2003 meeting. Mr. Dan Draper, the applicant, was present to address any concerns. The type of screening was discussed. Mr. Draper explained that screening would be created through the use of concrete panels along the entire parameter bordering residential uses. The Technical Advisory Committee reviewed the site plan at the August 27" regular meeting. Staff recommends approval with the following requirements: OWASSO PLANNING COMMISSION December 8, 2003 Page No. 2 1. Provide a 17.5' easement on the north side of the property. 2. All parking areas are to be paved. Ray Haynes moved to approve the site plan subject to the above recommendations, Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 5. OA 03 -10 - A request from Paragon Development Group for the annexation of approximately 0.77 acres located in the southeast corner of E. 116' St. N. and U. S. Hwy 169. The Chair introduced the case and Duane presented the item. The Paragon Development Group purchased this property, if request is approved it will be attached to the Garrett Creek Commercial Center. Staff published legal notice of the petition and mailed notices to the property owners within a 300' radius of the property. The Owasso Annexation Committee reviewed the request on November 24, 2003 and recommended approval. Staff recommends approval of the request to annex .77 acres into the corporate limits of the City of Owasso. Dale Prevett moved to approve the annexation request, Ray Haynes seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 6. OA- 03 -11- A request from Kellogg Engineering for the annexation of approximately 0.94 acres located in the northeast corner of E. 103`d St. N. and U. S. Hwy 169 service road. The Chair introduced the case and Duane gave the staff review. The Owasso Land Trust purchased this property and if approved, will be attached to the Coffee Creek Office /Commercial Center. The annexation of this property will initiate a process that will allow it to be a part of the commercial center proposed by the OPUD #18. Staff OWASSO PLANNING COMMISSION December 8, 2003 Page No. 3 published legal notice of the annexation petition in the Owasso Reporter and mailed notices to property owners within a 300' radius of the property. The Owasso Annexation Committee reviewed the request and recommended approval. Staff recommends approval to annex the above property into the corporate limits of the City of Owasso. Ray Haynes moved to approve the annexation request, Dale Prevett seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 7. OZ -03 -13 - A request Kellogg Engineering to rezone 1.71 acres of property located in the northwest corner of N. 105th E. Ave. and E. 98`' Pl. N. from AG to RS -3. The Chair introduced the case and Duane gave the staff review. A zoning sign was posted on the property and property owners within 300' radius were notified. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved streets and sidewalks. Staff published legal notice of the rezoning request in the Owasso Reporter. Staff has received no phone calls in opposition of the request. Staff recommends approval to rezone to RS -3 (Residential Single - Family District). Ray Haynes moved to approve the annexation request, Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 8. OPUD 03 -01 - A request from Owasso Land Trust, L.L.C/ to rezone 25.62 acres located on the west side of N. 145' E. Ave. between E. 106' St. N. and E. 116" St. N. to a Planned Unit Development (PUD) proposing residential uses. The Chair introduced the item and Duane reviewed the staff report. The subject property is currently a part of two PUD's (Robinson Business Park and Interchange Business Park) both outline zoning for the property as Industrial and /or Commercial. The applicant /owners of the property intend only to develop single family residential homes OWASSO PLANNING COMMISSION December 8, 2003 Page No. 4 on the site. Sidewalks will be required along all public right -of -ways. Staff published legal notice in the Owasso Reporter and mailed notices to property owners within a 300' radius. Staff recommends approval of OPUD 03 -01 subject to the following conditions: 1. That the applicant's Development Text and Conceptual Development Plan be considered to be the Outline Development Plan as required by the PUD Chapter of the Owasso Zoning Code. 2. Detailed covenants and restrictions incorporating all conditions of the PUD and governing the unified design and function of the PUD shall be required at the time of final platting. 3. Unless specifically set out in the standards and conditions of this PUD, all single family lots shall meet the requirements of a typical RS -3 district. 4. That prior to the issuance of building permits, the applicant is subject to the platting and site plan requirements of the City of Owasso and all subsequent conditions imposed by the Owasso Technical Advisory Committee. 5. Acceleration/Deceleration lanes will be required on North 145"' East Avenue. 6. Sidewalks will be required along North 145`'' East Avenue. Ms. Donna Irwin, a nearby property owner, was present to express concerns regarding stormwater drainage in the area. Discussion was held regarding acceleration/deceleration lanes required on North 145`' East Avenue. The applicant, Mr. David Charney, was present and gave a brief overview of the proposed development. The square footage of the homes was discussed along with drainage. Mr. Charney also stated that there would be a 6' fence along the southern perimeter of the development. Mr. Charney explained that due to the possibility of significant retail coming into that corridor he would suggest an escrow account being established for acceleration/deceleration lanes along North 145" East Avenue. Duane stated that Staff would feel comfortable with striking Item #5 on the above conditions. Dale Prevett moved to approve the Planned Unit Development subject to the above Staff recommendations with Item #5 being stricken. Ray Haynes seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. 9. Preliminary Plat - A request from Kellogg Engineering to review and approve a preliminary plat for the proposed Randie Lyn Addition on approximately 1.71 acres located directly north of the Kelley Ann Addition in the northwest corner of N. 105' E. OWASSO PLANNING COMMISSION December 8, 2003 Page No. 5 Ave and E. 98"' Pl. N. The Chair introduced the item and Duane reviewed the staff report. The applicant is requesting a review of the preliminary plat for the Randie Lyn Addition consisting of approximately eight lots, in one block on 1.71 acres, more or less. A discussion was held regarding the connection of East 98'" Place North on its western edge to the Honey Creek addition as opposed to the current proposal to terminate the street in a cul -de -sac. An agreement was reached that such action would be acceptable. Residential sewer and water service will be provided by the City of Owasso. The Owasso Technical Advisory Committee reviewed the request and had the following conditions: 1. Address the lots as follows: Block 1, Lot 1: 10301 East 98`' Place North Block 1, Lot 2: 10303 East 98' Place North Block 1, Lot 3: 10305 East 98`'' Place North Block 1, Lot 4: 10307 East 98`'' Place North Block 1, Lot 5: 10309 East 98'' Place North Block 1, Lot 6: 10311 East 98"' Place North Block 1, Lot 7: 10313 East 98' Place North Block 1, Lot 8: 10315 East 98' Place North 2. Increase the Utility Easement on the southern edge of the property to 17.5'. 3. Compensate Washington County Rural Water District #3 $50.00 per water tap in the Randie Lyn development. 4. Include the detention structure details south of Lot 8 in the final plat. 5. Widen the Detention Easement in Lot 8 to 100'. 6. Show any revision in the street alignment on the final plat. 7. Locate fire hydrants on the plat as acceptable to the Owasso Fire Marshall. Dale Prevett had concerns with the covenants wording. Mr. Chad Williams with Kellogg Engineering was present on behalf of the applicant and assured the Commissioners that the Final Plat will contain all the correct language. Ray Haynes moved to approve the preliminary plat subject to the above Staff & TAC conditions and the covenants being correct on the Final Plat. Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0. OWASSO PLANNING COMMISSION December 8, 2003 Page No. 6 10. Preliminary Plat - A request from Paragon Development Group to review and approve a preliminary plat for the proposed Garrett Creek Center on approximately 9.65 acres located in the southwest corner of E. 116`'' St. N. and U. S. Hwy 169. The Chair presented the item and Duane described the location. The preliminary plat is part of the Garrett Creek PUD (OPUD 02 -02) which outlines the use of the property as commercial. The developer would like to divide the property into seven (7) lots on two (2) blocks. The Owasso Technical Advisory Committee reviewed the preliminary plat at its November 24, 2003 meeting and had the following conditions: 1. Incorporate the small parcel of land currently being annexed in the northeast corner of the site into any future final plat and site development plan. 2. Revise the plat legal description to incorporate the small parcel currently being annexed in the northeast corner of the site. 3. Correct the section line numbers shown in the upper left side of the drawing on the plat. 4. Name the service road: North 135"' East Avenue. 5. Show addresses on the plat as follows: Block 1, Lot 1: 13302 East 116' Street North Block 1, Lot 2: 13308 East 116' Street North Block 1, Lot 3: 13314 East 116'b Street North Block 1, Lot 4: 13318 East 116' Street North Block 2, Lot 1: 11507 North 135' East Avenue Block 2, Lot 2: 13506 East 116'h Street North Block 2, Lot 3: 11503 North 135"' East Avenue 6. Show a 50' building setback line from East 116'h Street North and U.S. Highway 169 on the plat. 7. Show sidewalks on the plat. 8. Apply a 150' Limits of No Access to the northern lot line of Lot 2 in Block 1 from the northeast corner. 9. Show the width of the Sewer Force Main Easement on the plat. 10. Provide site detention details to Public Works as part of the Final Plat. 11. Provide covenants that detail responsibility of maintenance and utility provisions. 12. Drainage facilities must be approved and in place before any building permits are approved. Staff recommends approval of the Garrett Creek Center preliminary plat subject to the above conditions. Chairperson Haynes had questions regarding the possibility of a mutual access easement between Lot 1 and Lot 2. The applicant was not present to OWASSO PLANNING COMMISSION December 8, 2003 Page No. 7 address the Commissioners concerns. Ray Haynes moved to table the Garrett Creek preliminary plat request until the applicant is present. Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Dewey Brown - Yes Ray Haynes - Yes Dale Prevett - Yes The motion carried 3 -0, the item was tabled. Chairperson Haynes announced the resignation of Commissioner Charles Willey and Commissioner Bill Williams. 11. Report on monthly building permit activity. 12. Report on planning items previously forwarded to City Council. 13. Discussion of development in and near Owasso. 14. Adjournment - Dale Prevett moved, Dewey Brown seconded, to adjourn the meeting.
