Tuesday, May 20, 2014
The Owasso City Council met in regular session on Tuesday, May 20, 2014 in the Council
Chambers at Old Central per the Notice of Public Meeting and Agenda filed in the office of the
City Clerk and posted on the City Hall bulletin board at 6:00 pm on Friday, May 16, 2014.
1. Call to Order
Mayor Jeri Moberly called the meeting to order at 6:30 pm.
2. Invocation
The invocation was offered by Pastor Casey Cariker of Rejoice Church.

7. Consideration and appropriate action relating to budget amendments
Linda Jones presented the item recommending approval of budget amendments as follows:
Increase the estimated revenue and increase the appropriation for expenditures in the
General fund, police department by $1,032.
Increase the appropriation for expenditures in the Stormwater fund by $214,186.
Increase the appropriation for expenditures in the Hotel Tax fund by $500,000.
After discussion, Mr. Dunn moved, seconded by Mr. Bonebrake to approve the budget
amendments as recommended.

8. Consideration and appropriate action relating to the purchase of an ambulance and
approval of a budget amendment
Mark Stuckey presented the item recommending approval of the emergency purchase of
an ambulance from Excellance Ambulance of Madison, Alabama, in the amount of
$249,929.63; and approve a budget amendment increasing the estimated revenue in the
Self- insurance Fund by $27,500 and increasing the appropriation for expenditures in the Self -
insurance Fund by $27,500 and in the Ambulance Capital Fund by $222,430.
After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to approve the emergency
purchase of an ambulance in the amount of $249,929.63 from Excellance Ambulance and
approve the budget amendments, as recommended.

9. Consideration and appropriate action relating to a change order to the 86th St North from
Main to Memorial project, a joint project between Tulsa County, the City of Owasso, and the
Oklahoma Department of Transportation (ODOT)
Dwayne Henderson presented the item recommending approval of Change Order No. 2 in
the form of a credit in the amount of $1,895.02.
After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve the change order,
as recommended.

10. Consideration and appropriate action relating to three change orders to the E 106th St North
and N Garnett Road intersection project, a joint project with ODOT and the City of Owasso
Dwayne Henderson presented the item recommending approval of Change Orders No. 1, 2,
and 3 in the total amount of $46,302.73.
After discussion, Mr. Dunn moved, seconded by Mr. Bonebrake to approve Change Orders
No. 1, 2, and 3, as recommended.

11. Consideration and appropriate action relating to the rezoning request of Rejoice Christian
School located at US169 and north of E 106th St North
Bronce Stephenson presented the item recommending approval to rezone the subject
property from Agricultural (AG) to Office Medium (OM).
After discussion, Mr. Bonebrake moved, seconded by Mr. Bush to approve the rezoning for
Rejoice Christian School, as recommended.

12. Consideration and appropriate action relating to the Planned Unit Development (PUD) of
Brighton Park located approximately 1/2 mile south of 116th St North on the west side of Mingo
Road
Bronce Stephenson presented the item recommending approval of the PUD and the
rezoning of the subject property from Agricultural (AG) to Residential Single Family (RS -3) with
the following amendments:
• Requirement of elevation certificates for each of the homes in the development.
• Requirement that no lots be allowed to develop in the floodplain.
8 citizens addressed the Council. Jonathan Vanbeber submitted a petition to members of
the City Council and requested a copy be entered as part of the meeting minutes.
After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to approve the Brighton Park
PUD with the amendments, as recommended.

the northwest corner of the intersection of E 661h St North and N 129th E Avenue

After discussion, Mr. Bonebrake moved, seconded by Ms. Moberly to approve the Hickory
Creek Final Plat, as recommended.

14. Consideration and appropriate action relating to the final plat for Carrington Pointe I
Extended located south of the existing Carrington Pointe development located

Warren Lehr announced:
• National Public Works Week and offered an invitation to attend the second Annual
Open House at Public Works on Wednesday, May 21, 2014;
• a Folds of Honor Scholarship will be awarded to the children of a solider in Owasso
with the Budweiser team of Clydesdale horses as part of the presentation on Sunday,
May 25, 2014;
• the Patriot Cup Golf Tournament will be Monday, May 26, 2014;
• it was reported on www.nerdwallet.com that Owasso ranked third in the best places
to live in Oklahoma.

location: one quarter mile north of East 106th Street and west of Mingo Road
This re- zoning from AG to RS -3 places this 46 acre property in opposition to the surrounding developed
properties by posing a greater risk of diverting run -off, decreasing the property values of the surrounding
properties, decreasing privacy and private enjoyment of rural setting, and adding increased traffic to
congested thoroughfares (primarily 116 h St N).
The proposed re- zoning is being pushed through with minimum regard to the disapproval of Owasso
citizens voiced at the TAC Meeting, before the City of Owasso has addressed current flooding concerns
left unresolved from previous developments adjacent to the east of this property, and before approval of a
complete plan to ensure the necessary flood prevention measures are taken. This proposed plan is
occurring during a statewide drought, therefore the results of such development and the resulting hazards of
flooding will not be seen until the end of the drought.
Approximately ninety percent (90 %) of the section bordered by 116" St N, 106'h St N, Mingo Road, and
Memorial Road are agricultural residential properties. This PUD is only bordered by a small percentage
(<30% of border) of similar residential areas. Any development of this land should first ensure no added
run -off or water is obstructed from flow, should ensure compatibility with the majority of the surrounding
properties, and should ensure access and added traffic congestion are resolved prior to taken into
consideration.
The Owasso Planning Commission has granted this zoning change despite community and citizen concerns
and despite failures of nearby developments to solve similar problems.
The following nearby citizens of Owasso have signed this petition in opposition to this proposed action:

We have here a petition signed by 44+ residents within 600 ft surrounding this proposed
development. This petition states:

In addition, I find it hard to believe that the Owasso Planning Commission and City Office of
Community Development have not reviewed some critical information prior to approving re- zoning for a
Planned Unit Development, called Brighton Park. We simply asked for the proposed square footage of
homes, a conceptual drainage map, topography map, and a few other soil tests that any responsible
developer would have completed long before proposing a 147 home, multi - million dollar project to the City
for consideration. We have been told that this is all conceptual in nature at this point and, if it is approved
and the applicant moves forward with the development, they will have to provide the necessary engineering
documents to our Engineering division and we will review their plans. The City is accepting a lot of liability
in allowing the re- zoning of a flood plain to RS -3 without seeing any of the actual plans and actual science
the developer intends to use to develop this land.
A key part of any City's master development plan should consider the appropriate pairing of
developments and should not approve any requests from to rezone our land without at least knowing the
size of the buildings that a company plans to put on there. 1, for one, do not trust developers to keep
nearby citizens concerns in mind Sk iere i ieney -b3 mvisin their.plans_latcLlo.

large business entities, capable of putting together a multi- million dollar development, without some public
information like BBB enrollment on record. This developer has been putting together projects in and around
Collinsville, but where are the records of the successes or failures of those developments? Where is their
working phone number? (not on their PUD) I certainly would not expect our City officials to allow anyone
to develop land, which the City will maintain, without assuring the citizens of the developer's capabilities
and concern for the LONG -TERM impacts on the community and surrounding properties.

BACKGROUND:
On May 20, 2014, City Council considered the rezoning of property planned for the
development of the Rejoice Christian School campus, located west of the west service road
area of US -169 and north of E 106th St North. The Council voted unanimously to approve
rezoning request OZ- 14 -02, taking the subject property from an AG (Agriculture) zoning to OM
(Office Medium). The attached ordinance officially rezones the property, codifying the action
taken by the Council.
RECOMMENDATION:
Staff recommends approval of Ordinance No. 1031 approving zoning application number OZ-
14-02 rezoning a tract of land in the SWSE /4 of the SW /4 of Section 9 Township 21 North, Range
14 East, land known as the Rejoice Christian School campus.

BACKGROUND:
The subject residential development is located at 12700 E 10011, St North. Public infrastructure
includes sanitary sewer, stormwater drainage, and approaches including sidewalk
improvements.
FINAL INSPECTIONS:
Final inspections for all infrastructure components were completed in May of 2014 by the Public
Works Department. All standards for acceptance have been met. Additionally, the construction
contractor and design engineer have supplied the necessary two -year maintenance bonds and
required as -built drawings.
RECOMMENDATION:
Staff recommends acceptance of sanitary sewer, stormwater drainage and approaches
including sidewalk improvements at 9inety Eight Multi- family Apartment Complex.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 1,281
linear feet of eight (8) inch PVC, 219. linear feet of eight (8) inch DIP sanitary sewer line and all
appurtenances to serve the City of Owasso, located in Section 17, T -21 -N, R -14 -E, Tulsa County,
Oklahoma, in accordance with the plans approved February 19, 2013.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance
with the "Oklahoma Pollutant Discharge Elimination System Standards - OPDES" (OAC 252:606) rules
and to comply with the state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and
regulations adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
1) That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
2) That construction of all phases of the project will be started within one year of the date of
approval or the phases not under construction will be resubmitted for approval as a new project.
3) That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
4) That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:656- 5- 4(c)(3) of the standards for Water
Pollution Control Facility Construction.
5) That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 10 gallons per inch of pipe
diameter per mile per day.
6) That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.
7) That the permittee will take steps to assure that the connection of house services to the sewers is
done in such a manner that the functioning of the sewers will not be impaired and that earth and
ground water will be excluded from the sewers when the connection is completed.

these facilities in accordance with rules and regulations adopted by the Environmental Quality
Board, and that this Department will be notified in writing of any sale or transfer of ownership of
these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
11) That the permittee is required to inform the developer /builder that a DEQ Storm Water
Construction Permit is required for a construction site that will disturb one (1) acre or more in
accordance with OPDES, 27A O.S. 2 -6 -201 et, seq. For Information or a copy of the GENERAL
PERMIT (GP -005) FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES,
Notice of Intent (NOI) form, Notice of Termination (NOT) form, or guidance on preparation of a
Pollution Prevention Plan, contact the Storm Water Unit of the Water Quality Division at P.O. Box
1677, Oklahoma City, OK 73101 -1677 or by phone at (405) 702 -8100.
12) That all manholes shall be constructed in accordance with the standards for Water Pollution
Control Facility Construction (OAC 252:656 -5 -3), as adopted by the Oklahoma Department of
Environmental Quality.
13) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in
Water Pollution Control Facility Construction OAC 252:656- 5- 4(c)(1) and OAC 252:656- 5- 4(c)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested using the ASTM air test procedure with no detectable leakage prior to backfilling,
in accordance with the standards for Water Pollution Control Facility Construction OAC 252:656 -
5-4(c)(3).
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will
constitute acceptance of the permit and all conditions and provisions.

Thank you for your time and information last Friday. I would like to address the city council regarding some changes to
barking dog situations involving a City of Owasso employee. I would like to suggest a time limit when it concerns an
employee of the city. I have been trying to solve a barking dog issue since July, 2013 to current date. I have
documentation and have discussed with Scott Chambliss and followed his instructions and city requirements. As of this
writing, I have not had any success with the barking dog.
Since the City Prosecutor has removed my request from docket, I have no recourse but to seek additional help from the
City Council and to amend the current requirements.

SECTION 4 -107 ANIMALS WHICH DISTURB PROHIBITED NUISANCE PROCEDURE
A. It is unlawful for any person to keep or harbor within the city any dog or other
animal which, by barking, howling or otherwise, disturbs the peace and quiet of any
person or neighborhood.
B. Any animal which:
1. Scratches, or digs, into any flower bed, garden, tilled soil, vines,
shrubbery or small plants, and in so doing injures the same;
2. Habitually prowls around or over any premises not the property of its
owner, to the annoyance of the owner or occupant of such premises;
3. Overturns any garbage can or other vessel for waste products, or
scatters the contents of same;
4. Chases or kills any chicken or other domestic fowl; or
5. Runs at large; except any cat;
is hereby declared to be a nuisance. In addition to definitions used in any other
ordinance of the city declaring when a animal is to be declared a nuisance, any
animal which barks, howls, wails, or emits or utters sounds or noises, which cause serious
annoyance and disturbs the peace or quietude of any person or persons within the
vicinity of the place where some is being kept or to the neighborhood, is a nuisance.
C. It is the duty of the animal control officer, or person designated by him, on
being notified that any person claiming that an animal is a nuisance within the
meaning of this chapter has filed a verified complaint, alleging that such animal is a
nuisance, as herein defined, to seize and impound the animal therein described. If the
municipal judge shall find that no nuisance exists, he shall order that the animal be
surrendered to the owner. If the municipal judge shall find that the nuisance exists, he
shall order the animal to be destroyed as in the case of a vicious animal. If the owner
of such animal shall give a good and sufficient bond, to be approved by the city
treasurer, and conditioned that such owner shall abate and prevent such nuisance, the
municipal judge shall order the return of such animal to the owner thereof upon
payment of the shelter fees herein specified. Nothing in this section shall be construed
to permit any animal to run or be at large except as permitted under the city
ordinances. No such animal shall be returned to the owner if the same is a vicious
animal or in any event unless the same is registered and licensed as required by the

BACKGROUND
The Municipal Budget Act establishes definitions and other requirements for budgetary
accounting. Among the requirements is a public hearing by the governing body of the
proposed budget. The hearing is to be conducted no later than fifteen days before the end of
the fiscal year. Notice of the hearing with the proposed Budget Summary must be published five
days before the hearing. The attached notice was published in the Owasso Reporter on
Thursday, May 29, 2014.
The public hearing provides an opportunity for comments or questions about the proposed
budget from the public and the City Council. The proposed budget will be on the Work Session
agenda next week for Council discussion. A resolution approving the FY 2015 budget will be on
the June 17, 2014, agenda.

BACKGROUND:
In February of 2008, the Owasso City Council approved Ordinance No. 909 that annexed
property for future development of the Lake Valley subdivision. On June 17, 2008, the City
Council approved OPUD 08 -01 and then approved Ordinance No. 923, which formally rezoned
13.5669 acres from AG to RS -3, OPUD 08 -01. All legal notices were correct, but the correct
language was not included in the final ordinance.
Research of Ordinance No. 909 indicates a scrivener's error occurred with the legal description
of the annexation. The original Ordinance No. 909 described only a 12 by 361 foot narrow strip
of land rather than 13.5669 acres which was proposed to be annexed. The scrivener's error with
Ordinance No. 909 needs to be corrected to allow for the property to be brought into City Limits
to allow for development of future phases of Lake Valley.
In order to correct the scrivener's error associated with Ordinance No.909, staff prepared a
revised legal description for the property within a new corrective ordinance called nunc pro
tunc, which is Latin literally meaning, "now for then." In order for the change to be effective, the
nunc pro tunc ordinance must be approved, thereby replacing the previous ordinance that had
an erroneous legal description. By virtue of this action, it ensures that all of Lake Valley is
annexed into the City of Owasso and can be developed accordingly.
RECOMMENDATION:
Staff recommends City Council approval of Ordinance No. 909 Nunc Pro Tunc.

Beginning at the southwest corner of the NW /4 of the NW /4 of Section 10, T -21 -N, R -14 -E
of the Indian Meridian, Rogers County, State of Oklahoma, according to the Official U.S.

the City of Owasso, Oklahoma, and notice was given that said Petition would be
considered by the City Council of the City of Owasso, at a meeting to be held on
January 15, 2008 at 6:30 PM at Old Central, Owasso, Oklahoma; and
WHEREAS, on the 151h day of January, 2008, said Petition was duly considered by
the City Council and was determined to have complied with the provisions of Title 11,

invalid or ineffective, the remaining portion shall not be affected but shall remain in full
force and effect.
Section 5. The provisions of this ordinance shall become effective thirty (30)
days from the date of final passage as provided by state law.

BACKGROUND:
As a part of the current contract with the Fraternal Order of Police, the City Council approved
language agreeing to ratify the fiscal year 2014 -2015 contract by June 30, 2014.
Based upon ratification of the second year of the contract, the following changes will be implemented
during fiscal year 2014 -2015.
• An eleventh year step will be added to the pay plan effective on the anniversary date for
employees with eleven or more years of service.
• The pay difference between Lieutenant and Captain will be increased by 5 %, separating the
two ranks by a total of 10 %. This increase in separation is congruent with the separation
between Officer and Sergeant, and Sergeant and Lieutenant.
The proposed contract provides for a continuation of existing contract language on all other issues.
The increase in compensation costs for these contract items during fiscal year 2014 -2015 is $42,456.
RECOMMENDATION:
Staff recommends approval of the 2014 -2015 contract between the City of Owasso and the Fraternal
Order of Police Lodge # 149 and authorization for the Mayor to execute the contract.

As a part of the current contract with the International Association of Firefighters, the City Council
approved language agreeing to ratify the fiscal year 2014 -2015 contract by June 30, 2014.

January 1, 2015.

The increase in compensation costs for these contract items during fiscal year 2014 -2015 is $54,884.
RECOMMENDATION:

Proposed Amendment to Hotel Tax Ordinance

BACKGROUND:
In 2002, Owasso voters approved a 3% hotel fax with the funds to be "set aside and used
exclusively to encourage, promote and foster economic development and cultural
enhancement, tourism and pursue regional promotion for the City of Owasso ...." In August
2008, Owasso citizens voted to increase the hotel tax rate to 5 %. Just prior to that election, the
City Council approved Resolution 2008 -05 designating the hotel tax increase (if approved) to
fund the Strong Neighborhood Initiative.
ORDINANCE LANGUAGE CHANGE:
Recently, one of Owasso's extended -stay hotels approached the city with an issue regarding a
definition in Ordinance No. 699. The issue questioned the length of time an occupant is in a
room defining the occupant as a "Permanent Resident" and thereby exempt from the hotel tax.
The hotel officials explained to City staff that they were losing clients due to the length of time
defined in our ordinance. The City of Owasso ordinance defines a "Permanent Resident" as
follows:
Permanent Resident shall mean any occupant who has or shall have the right of
occupancy of any room or rooms in a hotel for at least ninety 190) consecutive
days during the current calendar year.
The industry standard in Hotel Tax Ordinance language pertaining to a "Permanent Resident"
defines the occupancy in a hotel for at least thirty (30) consecutive days during the current
calendar year. The language in the City of Owasso ordinance is different than all compared
Hotel Tax Ordinances in the Tulsa region, including Bixby, Broken Arrow, Jenks, Tulsa and
Oklahoma City.
Some companies seeking extended -stay hotels in the area for their employees /clients receive a
city tax rebate after occupying room(s) for thirty (30) days. A few companies have informed the
concerned Owasso hotel they are not staying in Owasso's extended -stay hotels because of the
90 -day restriction. While these companies would receive a hotel tax rebate for their occupancy,
they will presumably add revenue to the sales tax base.
OEDA MEETING:
May 8, 2014, the Owasso Economic Development Authority (OEDA) discussed the request to
amend the Ordinance and voted unanimously to recommend changing the definition of a
"Permanent Resident" from ninety (90) days to thirty (30) days. The OEDA also recommended
restricting the tax exemption to government employees "conducting official business."
Ordinance 1033 amends the definition of a permanent resident (exempt from the tax)to be an
occupant in the hotel for at least 30 consecutive day. This ordinance also adds language to
restrict the exemption for government employees to those government employees conducting
official business.
RECOMMENDATION:
Staff recommends approval of Ordinance 1033 amending the Hotel Tax ordinance.

SECTION 7 -603 EXEMPTIONS
The following shall be exempt from the tax levied in this ordinance:
1. Permanent residents;
2. Agents, employees and /or officials of the United States
Government or any agency or division thereof conducting official
business;
3. Agents, employees and /or officials of the State of Oklahoma or
any political subdivision conducting official business.
SECTION TWO (2): REPEALER
All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of the conflict only.
SECTION THREE (3): SEVERABILITY
If any part or parts of this ordinance are deemed unconstitutional, invalid or
ineffective, the remaining portion shall not be affected but shall remain in full
force and effect.
SECTION FOUR (4): DECLARING AN EFFECTIVE DATE
The provisions of this ordinance shall become effective thirty (30) days from the
date of final passage as provided by state law.
SECTION FIVE (5): CODIFICATION
The City of Owasso Code of Ordinances is hereby amended as shown above
and codified in Part 7, Chapter 6, Section 7 -601, Subsection 5 and Section 7 -603.

litigation titled Alysia Mazzanfi v City of Owasso, 12- CV- 22- JED -PJC.

BACKGROUND:
On January 19, 2012, Alysia Mazzanti filed a lawsuit against the City of Owasso alleging that her
involuntary termination from employment with the City on February 15, 2011, was discriminatory,
violated the Americans with Disabilities Act and Title VII of the Civil Rights Act of 1964, and was
retaliatory in nature. The City retained Keith Wilkes of the Newton, O'Connor, Turner & Ketchum
firm to defend the litigation.
The parties attended a settlement conference on January 13, 2014, but were not able to
negotiate a mutually acceptable settlement agreement at that time. Subsequent to the
settlement conference, attorneys for the City of Owasso and Plaintiff continued negotiations
and reached agreement to settle this matter for payment of $44,000 to Ms. Mazzanfi.
The Open Meeting Act specifically provides in 25 O.S. §307(B)(4) that discussions between a
municipality and its attorneys concerning a pending investigation, claim or action may be held
in executive session if public disclosure of the matters to be discussed will seriously impair the City
Council's ability to act in the City's best interest. The City Attorney believes the necessary
matters to be considered and discussed by the City Council relating to settlement of this
pending litigation are within the purview of §307(8) (4), and that a full discussion of this settlement
publicly during a City Council meeting might seriously impair the City's ability to obtain a
favorable outcome in the litigation. Therefore, counsel recommends that discussion regarding
settlement of this litigation matter be conducted by the City Council in executive session.
RECOMMENDATION:
Staff recommends City Council discussion of this matter in executive session. Staff further
recommends approval of the proposed settlement agreement and authorization of payment in
the amount of $44,000 to Alysia Mazzanti in full settlement of this matter.
