HomeMy WebLinkAbout2014.05.20_City Council MinutesOWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, May 20, 2014 The Owasso City Council met in regular session on Tuesday, May 20, 2014 in the Council Chambers at Old Central per the Notice of Public Meeting and Agenda filed in the office of the City Clerk and posted on the City Hall bulletin board at 6:00 pm on Friday, May 16, 2014. 1. Call to Order Mayor Jeri Moberly called the meeting to order at 6:30 pm. 2. Invocation The invocation was offered by Pastor Casey Cariker of Rejoice Church. 3. Flag Salute Councilor Bonebrake led the flag salute. 4. Roll Call Present Mayor - Jeri Moberly Vice-Mayor - Lyndell Dunn Councilor- Doug Bonebrake Councilor-Bill Bush Absent Councilor - Chris Kelley A quorum was declared present. Staff: City Manager- Warren Lehr City Attorney - Julie Lombardi 5. Consideration and appropriate action relating Agenda. All matters listed under "Consent" are to a request for approval of the Consent considered by the City Council to be routine and will be enacted by one motion. Any Councilor may, however, remove an item from the Consent Agenda by request. A motion to adopt the Consent Agenda is non-debatable. A. Approval of Minutes of the May 6, 2014 Joint Regular Meeting and Minutes of the May 13, 2014 Joint Regular Meeting B. Approval of Claims C. Acknowledge Receipt of Monthly Budget Status Report D. Acceptance of Infrastructure including Streets, Sanitary Sewer, and Stormwater Drainage Systems at Maple Glen IV Mr. Bonebrake moved, seconded by Mr. Bush to approve the Consent Agenda with claims totaling $234,138.19. Also, included for review were the self-insurance claims and the payroll report for 5/3/14. Consideration and appropriate action relating to items removed from the Consent Agenda No action required 7. Consideration and appropriate action relating to budget amendments Linda Jones presented the item recommending approval of budget amendments as follows • Increase the estimated revenue and increase the appropriation for expenditures in the General fund, police department by $1,032. • Increase the appropriation for expenditures in the Stormwater fund by $214,186. • Increase the appropriation for expenditures in the Hotel Tax fund by $500,000. After discussion, Mr. Dunn moved, seconded by Mr. Bonebrake to approve the budget amendments as recommended. YEA: Bonebrake, Bush, Dunn, Moberly NAY: None Motion carried: 4-0 8. Consideration and appropriate action relating to the purchase of an ambulance and approval of a budget amendment Mark Stuckey presented the item recommending approval of the emergency purchase of an ambulance from Excellance Ambulance of Madison, Alabama, in the amount of $249,929.63; and approve a budget amendment increasing the estimated revenue in the Self-insurance Fund by $27,500 and increasing the appropriation for expenditures in the Self- insurance Fund by $27,500 and in the Ambulance Capital Fund by $222,430. After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to approve the emergency purchase of an ambulance in the amount of $249,929.63 from Excellence Ambulance and approve the budget amendments, as recommended. Consideration and appropriate action relating to a change order to the 86th St North from Main to Memorial project, a joint project between Tulsa County, the City of Owasso, and the Oklahoma Department of Transportation (ODOT) Dwayne Henderson presented the item recommending approval of Change Order No. 2 in the form of a credit in the amount of $1,895.02. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve the change order, as recommended. Consideration and appropriate action relating to three change orders to the E 106th St North and N Garnett Road intersection project, a joint project with ODOT and the City of Owasso Dwayne Henderson presented the item recommending approval of Change Orders No. 1, 2, and 3 in the total amount of $46,302.73. After discussion, Mr. Dunn moved, seconded by Mr. Bonebrake to approve Change Orders No. 1, 2, and 3, as recommended. YEA: Bonebrake, Bush, Dunn, Moberly NAY: None Motion carried: 4-0 11. Consideration and appropriate action relating to the rezoning request of Rejoice Christian School located at US169 and north of E 106th St North Bronce Stephenson presented the item recommending approval to rezone the subject property from Agricultural (AG) to Office Medium (OM). After discussion, Mr. Bonebrake moved, seconded by Mr. Bush to approve the rezoning for Rejoice Christian School, as recommended. YEA: Bonebrake, Bush, Dunn, Moberly NAY: None Motion carried: 4-0 12. Consideration and appropriate action relating to the Planned Unit Development (PUD) of Brighton Park located approximately Y: mile south of 116th St North on the west side of Mingo Road Bronce Stephenson presented the item recommending approval of the PUD and the rezoning of the subject property from Agricultural (AG) to Residential Single Family (RS-3) with the following amendments: • Requirement of elevation certificates for each of the homes in the development. • Requirement that no lots be allowed to develop in the floodplain. 8 citizens addressed the Council. Jonathan Vanbeber submitted a petition to members of the City Council and requested a copy be entered as part of the meeting minutes. After discussion, Mr. Bonebrake moved, seconded by Mr. Dunn to approve the Brighton Park PUD with the amendments, as recommended. Consideration and appropriate action relating to the final plat for Hickory Creek located at the northwest corner of the intersection of E 66th St North and N 129th E Avenue Bronce Stephenson presented the item recommending approval of the Final Plat. After discussion, Mr. Bonebrake moved, seconded by Ms. Moberly to approve the Hickory Creek Final Plat, as recommended. YEA: Bonebrake, Bush, Dunn, Moberly NAY: None Motion carried: 4-0 14. Consideration and appropriate action relating to the final plat for Carrington Pointe I Extended located south of the existing Carrington Pointe development located approximately 1/, mile east of the intersection of E 86th St North and N Sheridan Road on the south side of the street Bronce Stephenson presented the item recommending approval of the Final Plat. After discussion, Mr. Bush moved, seconded by Mr. Bonebrake to approve the Carrington Pointe I Final Plat, as recommended. YEA: Bonebrake, Bush, Dunn, Moberly NAY: None Motion carried: 4-0 15. Report from City Manager Warren Lehr announced: • National Public Works Week and offered an invitation to attend the second Annual Open House at Public Works on Wednesday, May 21, 2014; • a Folds of Honor Scholarship will be awarded to the children of a solider in Owasso with the Budweiser team of Clydesdale horses as part of the presentation on Sunday, May 25, 2014; • the Patriot Cup Golf Tournament will be Monday, May 26, 2014; • it was reported on www.nerdwallet.com that Owasso ranked third in the best places to live in Oklahoma. 16. Report from City Attorney No report 17. Report from City Councilors Doug Bonebrake: • acknowledged the Community Development department for strengthening planning guidelines; • offered appreciation to Dr. Tom McKeon, President of TCC for efforts to partner with Tulsa Tech prior to his retirement; • offered appreciation to the police for the courtesy escort for the Owasso High School soccer team as they headed to state play-offs. Jer' oberiy, Mayor Lisa Wilson, Minute Clerk Petition Against #OPUD 14-01 - Brighton Park - Residential zoning and development of the general location: one quarter mile north of East 106'' Street and west of Mingo Road This re-zoning from AG to RS-3 places this 46 acre property in opposition to the surrounding developed properties by posing a greater risk of diverting run-off, decreasing the property values of the surrounding properties, decreasing privacy and private enjoyment of rural setting, and adding increased traffic to congested thoroughfares (primarily 116 s St N). The proposed re-zoning is being pushed through with minimum regard to the disapproval of Owasso citizens voiced at the TAC Meeting, before the City of Owasso has addressed current flooding concerns left unresolved from previous developments adjacent to the east of this property, and before approval of a complete plan to ensure the necessary flood prevention measures are taken. This proposed plan is occurring during a statewide drought, therefore the results of such development and the resulting hazards of flooding will not be seen until the end of the drought. Approximately ninety percent (90%) of the section bordered by 116 s St N, 106`s St N, Mingo Road, and Memorial Road are agricultural residential properties. This PUD is only bordered by a small percentage (<30% of border) of similar residential areas. Any development of this land should first ensure no added run-off or water is obstructed from flow, should ensure compatibility with the majority of the surrounding properties, and should ensure access and added traffic congestion are resolved prior to taken into consideration. The Owasso Planning Commission has granted this zoning change despite community and citizen concerns and despite failures of nearby developments to solve similar problems. In addition, I find it hard to believe that the Owasso Planning Commission and City Office of Community Development have not reviewed some critical information prior to approving re-zoning for a Planned Unit Development, called Brighton Park. We simply asked for the proposed square footage of homes, a conceptual drainage map, topography map, and a few other soil tests that any responsible developer would have completed long before proposing a 147 home, multi-million dollar project to the City for consideration. We have been told that this is all conceptual in nature at this point and, if it is approved and the applicant moves forward with the development, they will have to provide the necessary engineering documents to our Engineering division and we will review their plans. The City is accepting a lot of liability in allowing the re-zoning of a flood plain to RS-3 without seeing any of the actual plans and actual science the developer intends to use to develop this land. A key part of any City's master development plan should consider the appropriate pairing of developments and should not approve any requests from to rezone our land without at least knowing the size of the buildings that a company plans to put on there. I, for one, do not trust developers to keep nearby citizens concerns in iild " a ~ez¢1Out City should not trust any developers or other large business entities, capable of putting together a multi-million dollar development, without some public S_~ infonnation like BBB enrollment on record. This developer has been putting together projects in and around Collinsville, but where are the records of the successes or failures of those developments? Where is their working phone number? (not on their PUD) I certainly would not expect our City officials to allow anyone to develop land, which the City will maintain, without assuring the citizens of the developer's capabilities and concern for the LONG-TERM impacts on the community and surrounding properties.
