HomeMy WebLinkAbout1996.09.03_City Council MinutesOWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, September 3, 1996 The Owasso City Council met in regular session on Tuesday, August 20, 1996 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p. m. on Friday, August 16, 1996. ITEM 1: CALL TO ORDER Mayor Ewing called the meeting to order at 7:40 p. m. ITEM 2: ROLL CALL PRESENT Danny Ewing, Mayor Mary Lou Barnhouse, Councilor Michael Helm, Councilor Tracy Standridge, Councilor ABSENT Toe Ramey, Vice Mayor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, City Clerk ITEM 3: SPECIAL PRESENTATION TO MR TOM KIMBALL, PAST CHAIRMAN OF THE OWASSO ECONOMIC DEVELOPMENT AUTHORITY. Councilor Helm presented a placque of thanks and appreciation to Tom Kimball for his years of work on the Owasso Economic Development Authority. In a prepared statement, Mr Kimball thanked the Council, but declined the award saying that he felt it would be hypocritical to accept the award because the people who serve on the Authority recently rejected him as Chairman. ITEM 4: REQUEST APPROVAL OF THE MINUTES OF AUGUST 20, 1996 REGULAR MEETING. Mr Helm moved, seconded by Mr Standridge, to approve the minutes as submitted, by reference made a part hereto. AYE: Helm, Standridge, Barnhouse, Ewing NAY: None Motion carried 4-0. Owasso City Council September 3, 1996 ITEM 5: REQUEST APPROVAL OF THE CLAIMS Ms Barnhouse moved, seconded by Mr Standridge, that the following claims be approved as submitted: (1) General Fund $26,992.21; (2) Workers Comp Self-Ins $406.72; (3) Ambulance Service Fund $635.15; (4) City Garage $3,511.74; (5) Capital Improvements $411.16; (6) Capital Projects Grant $20.94; (7) Interfund Transfers $27,447.91; (8) Payroll $111,829.64; (9) City Garage Payroll $2,037.36. AYE: Barnhouse, Standridge, Helm, Ewing NAY: None Motion carried 4-0. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #528 AN ORDINANCE PROVIDING FOR THE CLOSING OF A PORTION OF A DRAINAGE EASEMENT LOCATED ON LOT 13 BLOCK 1. WINDSOR LAKE II ADDITION TO THE CITY OF OWASSO TULSA COUNTY, OKLAHOMA At the August 20, 1996 meeting, the Owasso City Council approved a request to close a portion of a drainage easement located on Lot 13, Block 1, Windsor Lake II addition. Ordinance #528 formally adopts that action. Mayor Ewing moved, seconded by Mr Standridge to approve Ordinance #528. AYE: Ewing, Standridge, Helm, Barnhouse NAY: None Motion carried 4-0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #529 AN ORDINANCE APPROVING AND ADOPTING AN ACTION BY THE OWASSO PUBLIC WORKS AUTHORITY WHEREIN RATES FOR THE PURCHASE OF WATER FROM THE AUTHORITY WERE INCREASED. Ordinance #529 approves and adopts action taken by the Owasso Public Works Authority increasing the rate for water purchased from the Authority. The City of Tulsa has raised the rates it charges its master meter customers by thirteen cents per thousand gallons. Action was taken by the OPWA by resolution to pass that increase on to its in-city customers. The rates rural customers pay would remain the same in order to come closer to equalizing rates charged to all customers. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR COUNCIL APPROVAL OF "CARRY-OVER BUDGET REQUESTS" FROM VARIOUS DEPARTMENTS, SUCH ACTION REQUESTED IN THE FORM OF SUPPLEMENTAL APPROPRIATIONS TO THE FY 1996-97 BUDGET. Requests have been received for supplemental appropriations to the General Fund in the amount of $50,925, to the Capital Improvements Fund in the amount of $80,000, to the Garage Fund in the amount of $4735, and to the Capital Projects Grant Fund in the amount of $94,844; the supplemental appropriations being derived from a carryover of funds from the 1995-96 budget. There was a question about the requested carryover budget in the Fire Department relating to how the funds will be spent. Mr Ray explained that this item is a request only for the carry over funds and that no authorization for expenditures is being requested. Mayor Ewing moved, seconded by Mr Helm, to approve the requests for supplemental appropriations, derived from carryover funds from the 1995-96 budget. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN AMENDMENT TO THF, PERSONNEL POLICIES AND PROCEDURES MANUAL PROVIDING FOR PAYMENT OF TUITION COSTS TO EMPLOYEES SEEKING ADVANCED DEGREES, AND REQUIRING PRIOR APPROVAL OF COURSE WORK BY THE CITY MANAGER. The City of Owasso Personnel Policies and Procedures Manual dated July 1, 1992 allows an employee to be reimbursed for tuition expenses upon satisfactory completion of a course or school that is directly related to his job duties or in pursuit of an undergraduate degree. It does not speak to the matter of graduate course work. The staff believes that there are instances when there should be tuition reimbursement for graduate courses if such course work is authorized by the City Manager before it begins. The staff recommends that the following text be added to the Tuition Reimbursement Policy: Owasso City Council September 3, 1996 Employees may also be reimbursed for satisfactory completion (minimum grade "B") of courses taken in pursuit of a graduate degree. The course(s) on which reimbursement is requested must be approved by the City Manager prior to enrollment (Personnel Form number 10). Approval by the City Manager shall be made following the City Manager's determination that the course and graduate degree will benefit both the employee and the City of Owasso. Mr Helm moved, seconded by Ms Barnhouse, to approve an amendment to the Personnel Policies and Procedures Manual by adding the above language. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO AN AGREEMENT BETWEEN THE CITY OF OWASSO AND THE OKLAHOMA DISTRICT COURT JUDICIAL DISTRICT #14. On February 16, 1993, the City Council first authorized the Owasso Municipal Court to enter into an agreement with the Tulsa County District Court for the purpose of allowing the Municipal Court to assume jurisdiction over certain juvenile misdemeanor offenses. In August 1994 and July 1995, the Council approved renewals of that agreement. Since initiating the agreement, the Owasso court system has processed a total of 320 juvenile offenders. The Attorney General has ruled that these types of interlocal agreements must be renewed each year. The proposed renewal agreement contains no changes from the 1995 document and extends the agreement to June 30, 1997. Mayor Ewing moved, seconded by Ms Barnhouse, to approve the renewal of the Agreement for Municipal Court Jurisdiction of Juveniles, and authorize the Mayor and Judge to execute the document. AYE: Ewing, Barnhouse, Helm, Standridge NAY: None Motion carried 4-0. 4 Owasso City Council September 3, 1996 ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST TO AUTHORIZE THE CITY ATTORNEY TO FILE, ON BEHALF OF THE CITY OF OWASSO A DISCLAIMER OF INTEREST IN CASE NO CJ-96-132 A LEGAL ACTION INVOLVING THE STATE OF OKLAHOMA VS OSAGE RAILROAD CO, SUCH ACTION INVOLVING REAL PROPERTY LOCATED IN OSAGE COUNTY. This item relates to a legal action taken by the Oklahoma Department of Transportation against the Osage Railroad Company to condemn some land for use by the state transportation system. The City Attorney and City Clerk could find no interest that the City of Owasso would have to any property located in Osage County, and the City Attorney requested authorization to file a Disclaimer of Interest. Mayor Ewing moved, seconded by Mr Helm, to authorize the City Attorney to file a Disclaimer of Interest in the matter of the State of Oklahoma vs Osage Railroad Co. AYE: Ewing, Helm, Barnhouse, Standridge NAY: None Motion carried 4-0. ITEM 12: REPORT FROM CITY MANAGER No report. ITEM 13: REPORT FROM CITY ATTORNEY Mr Cates reported that the Materialman's Lien which had been filed against the City was being released. ITEM 14: REPORT FROM CITY COUNCILORS No report. ITEM 15: UNFINISHED BUSINESS Mr Groth asked if course work pursued by employees of the City of Owasso had to be related to their job. Mr Ray said that if an employee is pursuing a Bachelors Degree the courses do not need to be job-related. 5 Owasso City Council September 3, 1996 ITEM 16: NEW BUSINESS None. ITEM 17: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR AN EXECUTIVE SESSION OF THE CITY COUNCIL, SUCH SESSION REQUIRED FOR THE DISCUSSION RELATING TO A POSSIBLE LITIGATION WHEREIN DISCLOSURE OF CERTAIN FACTS WILL IMPAIR THE ABILITY OF THE COUNCIL TO CONDUCT A SUBSEQUENT PROCEEDING IN THE PUBLIC INTEREST AND AUTHORIZED BY 25 O.S.. SECTION 307-B~41 THE OKLAHOMA OPEN MEETING ACT The staff requested that the City Council enter into an executive session for the purpose of discussing a possible litigation against the City, and that the City Manager and City Attorney be invited to attend the session. Mayor Ewing moved, seconded by Mr Standridge, that the City Council entered into executive session for the stated purpose. AYE: Ewing, Standridge, Helm, Barnhouse, NAY: None Motion carried 4-0. Into executive session at 8:15 p. m. Mayor Ewing reconvened the City Council meeting at 9:20 p. m. ITEM 18: ADJOURNMENT Mr Helm moved, seconded by Mr Standridge, to adjourn.
