On Thursday, July 17, 1986 the Owasso Planning Commission met in a
regular- session in the City Council Chambers at the Community Center
per the NOtice or Public Hearing and Agenda posted on City Hall
bulletin board at 4000 p.m. on July 11, 1986
ITEM 10 CALL, TO ORDER
Meeting was called to order at 7035 p.m. with Chairman Haynes presiding,

After discussion, a motion was made by H.Henry, seconded by S.
Butler, to approve the Site Plan Review as submitted, subject
to the thirteen (13) requirements from the TAG evaluation.

The Staff presented the `I'AC Eva.l.t;tion as follows:
The Owasso Technical Advisory Committee met at 2:00 p.m. on July
9, 1986 and had the following; comments for OL,S-63A The tract is
located east of 124th E. Ave on En 89th St.. North and zonded RS-3.

There was no representative for the applicant,,
After discussion, and a. strong concern voiced by the Commission
regarding the absence of the applicant, a_ motion was made by
M. Day, seconded by S. Butler, to approve the lot splr.f, as submitted
subject to the above `_I.'AC requirement,

UTILITY EASEMENT ENCROACHMENT
ITEM 6: BEALE COMPANY - Lot 33, Block 3, Three Lakes III:
built two 22)' feet into easement. The general-
location being 8921 North 120th East Ave.
Chairman Haynes reviewed the case.
Staff presented the following TAC evalution:
The Owasso Tech.anical Advisory Committee met at 2:00 p.m.
on July 9, 1986 and had the following comments for the
Utility Easement. Encroachment located at 8921 Nn 120th E. Ave.:
I. Must meet the requirements of ONG.
20 Must meet the requirements of the City of Owasso,
Mr. Rob Miles, Superintendent for Beale Company, was present
to answer questions for the Commission,
After discussion, a motion was made by M&ay, seconded by
E, Henry, to recolrmend to the City Council to approve the
Utility Easement Encroachment subject, to the above mentioned.
`1'AC requirements plus the following requirement of the
Planning
Commission:
1. A Hold Harmless Agreement be presented to the City's
Legal Counsel for review. This document is to be
signed by the builder and purchaser. This document
is to be Filed of Pecord at the Tulsa County C Lerk ; -,
office to he r'ef'lected in the chain of title le for,
future reference,

The applicant,, 1' ='[r.. David Acree asked the Commission to table
this agenda item until a later date pending additional study
by his attorney and the city.,

this item,

ITEM 8: NEW AND GENERAL BUSINESS
Chairman Haynes stated his growing concern for _repeated requests
for lot splits and utility easement encroachments. It was
discussed at length by the Commission.
In agreement with the Chairman, the Commission has requested
the Secretary to prepare a. letter of concern to the City
Manager asking that he look into the problem and come back to
the Commission with a remedy to the problem. This letter
is to be ready for Commission signatures at the August meeting.
With there being no more new business, a motion was made by
V Da.y 9 seconded by E. Henry, to adjourn
