HomeMy WebLinkAbout1993.12.21_City Council MinutesOWASSO CITY COUNCIL MINUTES OF REGULAR MEETING Tuesday, December 21, 1993 The Owasso City Council met in regular session on Tuesday, December 21, 1993 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p. m. on Friday, December 17, 1993. ITEM 1: CALL TO ORDER Mayor Randolph called the meeting to order at 7:00 p. m. ITEM 2: FLAG SALUTE The flag salute was led by Mayor Randolph. ITEM 3: ROLL CALL PRESENT ABSENT Bob Randolph, Mayor John Phillips, Vice Mayor Mary Lou Barnhouse, Councilor Rex Bowen, Councilor Charles Burns, Councilor STAFF Rodney J Ray, City Manager Ronald D Cates, City Attorney Marcia Boutwell, Council Clerk A quorum was declared present. ITEM 4: REOUEST APPROVAL OF THE MINUTES OF DECEMBER 7. 1993 REGULAR MEETING. Charles Bums moved, seconded by John Phillips, to approve the minutes, by reference made a part hereto. AYE: Bums, Phillips, Bowen, Barnhouse, Randolph NAY: None Motion carried 5-0. Owasso City Council December 21, 1993 ITEM 5: REQUEST APPROVAL OF THE CLAIMS John Phillips moved, seconded by Rex Bowen, that the following claims be approved: (1) General Fund $28,650.73; (2) Workers' Compensation Self-Insurance Plan $1,698.43; (3) Ambulance Service Fund $868.48; (4) Community Center $130.00; (5) Debt Service $169.18; (6) City Garage $2,664.23; (7) General Fund Payroll $93,161.27; (8) City Garage Payroll $1,474.98. AYE: Phillips, Bowen, Barnhouse, Bums, Randolph NAY: None Motion carried 5-0. ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO ORDINANCE #474, AN ORDINANCE INCREASING THE MUNICIPAL SALES TAX FROM 3 % TO 3.5 % AND PROVIDING FOR THE USE OF THE PROCEEDS OF SUCH INCREASE TO BE DEDICATED TO THE POLICE AND FIRE DEPARTMENTS. Staff presented a funding concept which was developed by a team created for the purpose of finding a solution to provide a permanent funding source for police and fire services. The proposed concept would increase sales tax from 3 % to 3.5 %, dedicating the entire increase to uses in the police and fire departments only. One member from the firefighters bargaining unit and one member from the police bargaining unit would be added to the Sales Tax Watchdog Committee to oversee the revenue generated. An ordinance would be submitted to the voters for their approval or rejection on March 1, 1994. A copy of the proposed ordinance was contained in the agenda packet. Following discussion, during which Council members expressed concern about the provision to allocate the funds, Mayor Randolph moved to approve Ordinance #474 striking item C. (4) which pertained to the distribution of funds, and adding a provision for the proceeds of the fund to be controlled by the City Council. Motion seconded by John Phillips. AYE: Randolph, Phillips, Barnhouse, Bowen NAY: Bums Motion carried 4-1. 2 Owasso City Council December 21, 1993 ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO RESOLUTION #93-10, A RESOLUTION CALLING AN ELECTION FOR THE PURPOSE OF SUBMITTING ORDINANCE #474 TO THE VOTERS OF OWASSO FOR APPROVAL OR REJECTION. Resolution #93-10 notifies the election board of an election for the purpose of the voters approval or rejection of Ordinance #474, such election to be held on March 1, 1994. Mayor Randolph moved, seconded by John Phillips, to approve Resolution #93-10 calling an election for the purpose of submitting to the Owasso voters Ordinance #474 for their approval or rejection. AYE: Randolph, Phillips, Bowen, Barnhouse, Bums NAY: None Motion carried 5-0. ITEM 8: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE ZUEST FOR A WAIVER OF SECTION 5-3(C) OF CHAPTER 5. CITY OF OWASSO PERSONNEL POLICIES AND PROCEDURES. Ralph Griffin addressed the Council with a request to be paid for accumulated vacation upon his retirement. Mr Griffin has been allowed to accumulate vacation in excess of the amounts allowed by policy and was duetted to take vacation leave to reduce his vacation accumulation to the maximum allowed prior to his retirement. Mayor Randolph moved that this issue be considered as a personnel matter and that the City Manager be directed to handle the request. Motion seconded by Charles Bums. AYE: Randolph, Burris, Bowen, Phillips, Barnhouse NAY: None Motion carried 5-0. ITEM 9: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE ZUEST FOR THE PURCHASE OF TWO PASSENGER VEHICLES. The 1993 Dodge Dynasty purchased for use by the City Manager, was transferred to the police chief for her use. The FY 1993-94 police department budget contains an allocation for a new vehicle for the chief. Staff proposed to use that allocation to purchase a new vehicle for the fire chief and transfer the 1989 Chevrolet Caprice being used by the fire chief to the City Manager. The Community Development Department also requested authorization to purchase a midsize 3 Owasso City Council December 21, 1993 1994 Buick Century for use by the code enforcement officer. Staff recommended purchasing the two vehicles utilizing the state bid list. Charles Bums moved, seconded by Rex Bowen, to approve the expenditure of $13,750 to Larry Spencer Chevrolet, Norman, Oklahoma, for the purchase of a 1994 Chevrolet Caprice utilizing State of Oklahoma Bid Contract #0070-06-10-100; and $11,556 to John Smicklas Chevrolet- Buick-Geo for the purchase of a 1994 Buick Century Sedan utilizing State of Oklahoma Bid Contract #0070-06-20-200. AYE: Burris, Bowen, Barnhouse, Phillips, Randolph NAY: None Motion carved 5-0. ITEM 10: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR A APPROVAL OF A FINAL PLAT FOR ELM CREEK AUTO. AN ADDITION TO THE CITY OF OWASSO AND A RESUBDIVISION OF A PORTION OF LOT 1, BLOCK 19, ELM CREEK ESTATES FIRST ADDITION. AND LOCATED IN A PART OF THE SOU1'HVVEST QUARTER OF SECTION 29. TOWNSHIP 21 NORTH, RANGE 14 EAST, TULSA COUNTY, OKLAHOMA. Elm Creek Auto is a one lot, one block commercial subdivision located at the southeast corner of E 80th St N and the Owasso Expressway service road. The Planning Commission unanimously recommended approval at their December 16, 1993 meeting. John Phillips moved, seconded by Charles Bums, to approve the final plat of Elm Creek Auto. AYE: Phillips, Burris, Bowen, Barnhouse, Randolph NAY: None Motion carried 5-0. ITEM 11: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF A FINAL PLAT FOR OKLAHOMA BAPTIST RETIREMENT CENTER II, AN ADDITION TO THE CITY OF OWASSO, OKLAHOMA AND LOCATED GENERALLY ON THE SOUTH SIDE OF 76TH STREET NORTH, WEST OF 122ND EAST AVENUE. Oklahoma Baptist Retirement Center II is afive-lot subdivision consisting of 1.56 acres and follows the development concept presented by the applicants in 1990. The Planning Commission unanimously recommended approval at their December 16, 1993 meeting. Charles Bums moved 4 Owasso City Council December 21, 1993 to approve the final plat of Oklahoma Baptist Retirement Center II. Motion seconded by Mary Lou Barnhouse. AYE: Burris, Barnhouse, Bowen, Phillips, Randolph NAY: None Motion carried 5-0. ITEM 12: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A RE ZUEST FOR COUNCIL ACCEPTANCE OF IMPROVEMENTS TO THE WATER AND WASTEWATER SYSTEMS CONSTRUCTED BY THE DEVELOPERS OF CAMDEN PARK. AN ADDITION TO THE CITY OF OWASSO. OKLAHOMA. Following Council approval of the final plat for Camden Pazk, construction began on the water and wastewater lines. They aze now complete and have been inspected, tested and approved by the necessary departments. The Oklahoma Department of Health has reviewed and assigned the water permit no. WL000072930858 and the wastewater permit no SL000072930859. Chazles Bums moved, seconded by John Phillips, to accept the water and wastewater improvements constructed by Camden Park. AYE: Bums, Phillips, Barnhouse, Bowen, Randolph NAY: None Motion carved 5-0. ITEM 13: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR THE CITY OF OWASSO TO ACCEPT DEEDS TO CERTAIN PROPERTY CURRENTLY MAINTAINED AS PUBLIC DRAINAGE WAYS BUT HELD BY ELM CREEK INC AND SHOWN ON PLATS AS "RESERVES". The City has been maintaining "reserve" azeas along the south and east boundaries of the First Christian Church property, which aze owned by Elm Creek Inc. City maintenance ensures proper drainage and Elm Creek Inc has now requested that the City accept title to those azeas. Chazles Bums moved, seconded by John Phillips, to accept the deed/title to the azeas shown as Reserve "A" on the Elm Creek plats. AYE: Bums, Phillips, Barnhouse, Bowen, Randolph NAY: None 5 Owasso City Council Motion carried 5-0. December 21, 1993 Staff was cautioned against allowing reserve areas to occur on future plats. ITEM 14: CONSIDERATION AND APPROPRIATE ACTION RELATING TO DISPOSAL OF SURPLUS EQUIPMENT FROM THE OWASSO FIRE DEPARTMENT, MORE SPECIFICALLY, A 2000 GALLON SKID MOUNTED STAINLESS STEEL WATER TANK WITH A 350 GALLON PER MINUTE GASOLINE PUMP• With the acquisition of a new water tanker, the old water tank and pump are no longer needed. These two pieces of equipment need minor repairs and are not adequate to meet our needs. Chief Allen contacted the Collinsville Rural Fire Department to see if the equipment would be of use to them. The Collinsville water tanker is out of service and they felt they could utilize our old tank and pump. The value of this equipment is estimated to be less than $1000. John Phillips moved to declare the equipment surplus to the needs of the City and to authorize the fire chief to transfer ownership without charge to the Collinsville Rural Fire District. ITEM 15: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A CONTRACT FOR THE PURCHASE OF UNIFORMS FOR MEMBERS OF THE OWASSO POLICE DEPARTMENT. Bids were opened on December 17 for the purchase of new police uniforms. Five bids were received, with the low bid being submitted by Tuxall Uniform and Equipment. Charles Burns moved to approve a contract with Tuxall Uniform and Equipment in the amount of $16,493.55 for the purchase of twenty-one sets of uniforms and leather gear as specified in the bid process. Motion seconded by Mary Lou Barnhouse. AYE: Burris, Barnhouse, Bowen, Phillips, Randolph NAY: None Motion carried 5-0. 6 Owasso City Council December 21, 1993 ITEM 16: REPORT FROM CITY MANAGER Mr Ray reported on a problem that has occurred with a prisoner being detained in the Owasso jail. As a result of the prisoner injuring himself and being hospitalized, it is necessary to have a 24-hour guard. This has resulted in an accumulation of overtime in the police department, as well as it being necessary for the City to pay the medical expenses of the prisoner. ITEM 17: REPORT FROM CITY ATTORNEY No report. ITEM 1 UNFINISHED BUSINESS Councilor Bowen commended the staff on the new lighting at the Recreation Center. ITEM 19: NEW BUSINESS None ITEM 20: ADJOURNMENT John Phillips moved, seconded by Charles Burns to adjourn.
