REQUEST-1`0 AMEND N `:t "HE NORTH BUILDING LME, OF LOT 3, BLOCK 1, DOUBLE DADS, All ADDITION TO TGIF CITY OF O ASS , TULSA COUN1 TY, OKLAHOMA - `hhe Chair introduced the case and the staff review was given by Steve Compton. The applicant is requesting an amendment to the building setbacks required for Lot 3, Flock 1 of the double Oaks subdivision plat. He is requesting that the building setback from Fast `76th Circle be amended to 20 feet, the minimum allowed by code, as opposed to the 25 feet now shorn on the plat map, which is greater than the code requires. A building permit for a residence on the lot has been approved; however, an error on the plot plan submitted was discovered when a footing inspection was performed at the site, revealing placement of the footing within an 11 foot utility easement along the south side of the lot which was not shorn on the plot plan. The builder is required to more the footing out of the easement along the south side, but because the width of the house can no longer meet the 25 foot building setbacks platted along the north side of the lot, the developer is requesting a reduction from 25 feet to 20 feet, In order to amend the plat, the applicant was required to obtain 100% ownership approval of all lot owners in the subdivision and must file those signatures with the County Clerk as an amendment to the Plat Map private covenants. All necessary signatures were presented at the Public Hearing. The amendment must also be approved by the City Council following action by the Planning Commission. Following the staff review, a lengthy discussion ensued, The applicant's engineer, Dill Lewis, and the builder, Jerry Gordon, were present, The Commission admonished the builders to take more care in the submission of their plot plans and the placement of structures on the lots and to avoid further requests of this nature. Following further discussion, Charles Willey moved Owasso Planning Commission Minutes of October 30, 1992 Page 2 to approve the request to amend the building setback line on l,ot 3, Block I, Double Oaks. Motion was s condecd by Dewey Brown and a vote on the motion was recorded as follows: Charles Willey - es Dewey Brown - Yes Gary Wells -- ` es Pat Imbriano -, Yes Ray Blaynes - Yes The motion carried 5-0. 3.
