OZ-68 Thomas Pool The Chairman reviewed the case history and the staff evaluation., The applicant requests rezoning of an approximately .55 acre tract of land from OM to CG for the purpose of building a commer- cial car wash. The vacant lot is located at the southwest corner of 8th Street North and 120th East Avenue. The lot is abutted on the north, east and south by existing single family residential neighborhoods zoned RS-3 and AG. To the west lie offices (primarily medica) zoned OM. The lot is 130 wide and abuts 8th St., North. The Comprehensive Plan recommends medium intensity non- residential land use for this area. CG zoning is considered a high intensity use in the Plan. The tract is an odd-shaped lot made rather shallow and narrow by the drainage channel that abuts the property an the east side, There are several considerations to discuss in this application,. 1. CG zoning is a higher intensity zoning than the existing shopping center located on the NE and SE corners of 86th Street North and is considered a high intensity use. CG zoning would allow certain industrial uses through the Board of Adjustment. OWASSO PLANNING COMMISSION MINUTES October 20, 1983 Page 3 2. They lot: abuts residential use on three sides. The lake area is a private park and recreation area used by Three Lakes families when would be in very close proximity to a commercial use at that location. 3 The request was made for CG partly because the 130' wide lot would not meet CS lot width requirements„ The lot was ori- ginally lot split at that size for an office density use. . Due to the size, shape and location of the lot, the required 50' building setback would severely reduce the capability of the lot to handle a commercial use plus required parking and driveway space. 5. The abutting street, 86th Street North, is a primary arterial street which is and will cont;.inue:, to be one of the most 'travelled in the city. A high inteasnity use .Located approximately 3/8 mile east of the intersection like= this would increase the traffic problems for Local and through traffic 6. He stated his clients were asking the Commission's help in providing a use for the lot, OWASSO PLANNING COMMISSION MINUTES October 20, 1985 Page 4 Chairman Hinkle read a letter of protest from Terry Le Davis, which is attached to and made a part of These Minutes. There were approximately fifteen nearby residents present in protest of the application. Several people spoke in strenuous objection to com- mercial zoning and to the car wash, including abutting property owners on three sides of the property® The president of the Three (sakes Homeowners Association stated that the entire association was totally opposed to the application. Commissioners held an extensive discussion with the applicants and the protestors The Chairman then closed the public hearing and Commissioners discussed the proposal, stating the application was spot zoning, against the planning process, that the neighborhood needed stabi- lity t° r and a buffer, R.
