Phillips called the meeting to order 2. Roll was called and a quorum was declared present. 3. M. Day moved approval of the Minutes of the June 16, written, P. Larkin seconded the motion, Aye: Phillips, flay and Larkin. Nay: None, Motion carried 3om0-0. ZONING PUBLIC HEARING 4. Vacant agri- cultural land lies .in all directions from th`e_'. parcel. Gravel and mining operations are located to the east on 66th St. North which carries heavy truck traffic to and from the industrial site aloi3g 66th Street North. 145th East Avenue toes not go through north of o"f 66th St. North. Mobile home development is listed .in the Owasso plan as a high intensity use; therefore, the application would not be in accord with the Ct?mpi'fa41er1sive Plan, Commissioners should also take into account the surrounding land uses and the potential effects a mobile home development would have an presents aY"4C.d future surrounding land uses and their potential e -, fects on a mobile home development. Tom Birmingham, attorney for the applicant, explained the project and presented an aerial and a site plan of the proposed subdivision. He said per„c tests had been run on the property, that there would be <a minimum size established in the covenants or mobile homes allowed in the subdivision, and that the Owasso School Superintendent had sent a letter s"t"a"t"ing the proposal complied with his standards. The letter is attached to these minutes Jerry Cole, president of the Owasso Home Owners Association, spoke in opposition to the application stating there was a court suit pending on the 40 acre tract zoned RMH located vest of the subject tract. He stated that the proposed rezoning Mould devalue nearby single family properties and create more traffic than 66 Street North could bear, especially with a one -lane bridge. He questioned the pert test results and stated his opposition to mobile home development in the area. Jahn Oxley, owner of land to the south of the subject tract stated his opposition to the application saying he planned to develop single family homes on his property and the proposed mobile hones would devalue the property for single family homes. He said he had protested a similar case in Rogers county that was defeated. Mr. Cole interjected that an appraiser of his property told him a mobile home develoment would de- value his property by $8500. Mrs. Shaffer, a nearby resident, questioned the availability of adequate water from the rural water district through 4" mains. Commissioners asked questions about the effects o.f the nearby quarry on existing homes in .terms of shaking, foundation cracks from blasting, noise and dust. Mr. Birmingham stated, in rebuttal, that he had received no negative remarks from the water district, stressed how far away the proposed development would be from other Igo €nets and said builders had told him the site wasn't suited for single family homes, He said residents would be owners of the property and that by doubling the size of the lots, to r.`cre,' mobile homes would be use by right. . Erect an opaque screening fence between the CS and reside- ntial property. e Locate a 5' gate in the screening fence on the east which would be clue west of the hydrant located in the mobile home park. Construct a de- acceleration lane for the driveway from Garnett into the lots. Rex Hall and Mike Losh, applicants, discussed the site plan and the TAC evaluation with commissioners. Staff stated that all parities had agreed to the first seven TAC items© The applicants questioned item 8, calling attention to the existing de- acceleration lane into 113th Street north. Commissioners discussed the proposed lane cosh length and building standards, P. Larkin moved approval of the site plan subject to completion of the first seven TAC requirements and an amendment of the eighth requirement to .leave building of a de-acceleration lane to the discretion of the city manager. Realign street stub on east to coincide with unplatted 99th Street forth to the east of the subject area. Motion carried 3 --0-0 BUILDING COLPL= RL_V:p W f Building Standards for the Handicapped Wayne Vincent and fury Caroline Cole presented a letter, attached to these minutes, requesting Planning Commission support of their proposal to adopt an ordinance adding the American (National `standards Institute, Inc. (ANSI) standards for construction of public improvements and household structures to the BOCA building code. In the letter they also proposed curb cuts at all street corners and making all public, buildings accessible to the handicapped and elderly. Commissioners discussed the ANSI standards arcls anal the other proposals with them. Mr. V.si,3cena:, clarified his proposals by stating that he wished to have the ANSI. standards used on those apartment units required by federal law or the BOCA code to be built to accommodate the handicapped. He also proposed that when a single family home is to be constructed For the handicapped rare. elderly, the ANSI standards should be used. Commissioners agreed, saying they wanted more time to review the code, There was no action taken on this item. I INFORMATION ITEMS 10. Buildinq Permit Review. There were no building permits to review. There being no further business to consider, Pm Larkin moved to adjourn the meeting Zvii;h M.
