SPECIAL MEETING OWASSO PLANNING COMMISSION MINUTES Tuesday, October 23, 1984, 7:30 p,m® City Hall MEMBERS PRESENT MEMBERS ABSENT STAFF PRESENT Ken Wood Pat Larkin Carol Dickey Michael Day Ray Haynes 1� Vice - Chairman, R. Haynes called the meeting to order at 7 :30 p.m., Z roll was called and a quorum was declared present, 3. Me Day moved approval of the minutes of the September 20, 19134 meeting, KS Wood seconded the motion., Aye: Wood, Day and Haynes, Nay: None. Motion carried 3 -0 -0. Vice- Chairman Haynes introduced Dan Galloway, Owasso's new City Manager, to the Commission, LOT SPLIT REVIEW 4, OLS-51 Bill Lewis Vice-Chairman R. Haynes reviewed the case history and the staff f evaluation: The applicant requests a .lot spl.i.t on Lot 1, Block 1, Ater Heights located north off the NW/c of 19th Street and 1-169. The lot split would split a 196' x 150' lot from a 600' lone com- mercial lot facing 1-169,. The lot to be created already has a car wash on it, The lot is already served by all utilities and there have been no requests for additional easements,,. The new lot to be created would meet the bulk and area requirements for, a lot in a CG district, although it is 4' to narrow to be split again (CG .lots are required to have 100' frontage on an arterial street), Approving this lot split, however„ would leave a 59 strip of land on the south end of the larder lot that would be substandard in frontage as a future lots, Its is unlikely that the original lot will remain as an individual commercial tract afar into the future° and explained that the case was continued from the last meeting Dill Lewis, engineer for they applicant, explained the request saying that he didn't know why the car wash was located where it was leaving the 69' strip to the south, indicating that ministorage is planned for the area to the rear of the car wash and saying that there was one access road from this large lot feeding onto Garnett from which all lot driveways would Owasso Planning Commission Minutes October 23, 19$4 Page 2 enter and therefore the 59' strip of land had access to -the access road and not to a public street so only 50' of frontage was required for a lot. Staff pointed out that the commercial lot was platted to the public right - of-way of the arterial Garnett /1 -169 and -that when the new highway was completed Garnett would revert to a county arterial, so the 100w lot frontage requirement did apply. Commissioners held an extensive discussion with Lewis and Tom Ethridge, buyer of the car wash, and asked several questions® Several alternatives to the lot split were discussed. After much consideration, M. Day moved approval of the lot split as submitted,, K. Wood seconded the motion, Aye: Day and Wood. Nay: Haynes. Motion carried 2 -1 -0m R. Haynes then made a statement, emphasizing -the need for good planning in designing lots and subdivisions so the developers don't later on ask the city for mercy for development problems 5H OLS -52 John Se'lbv - PRIOR APPROVAL Staff related that this lot split was approved under 'the "prior approval" lot split ordinance and was before the Commission for ratification, The applicant was not present Commissioners asked several questions about the property,, Km Wood m oved ratification of the lot split approval, M, Day seconded the motion, Aye: Wood, Day and Haynes Nay: None Motion carried S -O -O SUBDIVISION REV'I" W 6, Baptist. Convalescent Center Staff reviewed the case history and .th© TAC; evaluation: The Technical Advisory Committee had the following comments re- garding approval of a preliminary plat for the Baptist Convalescent Center: I�, Eliminate duplicate street names from the plat- 2. Show 25' building lines on the north and east borders, 53 Draw plat on standard-sized paper. 6. Add acreage and number of lots to plat. 7� Add name of record owner to plat as well as covenants,, 8. Amend paragraph 5 in covenants, 9. On the west and south sides, either retain the 20' utility easement or divide the easement and grant, by separate instrument, part of the 20' easement on the abut- ting property,, Monroe Palmer, director of the Baptist Center, explained the plat and plans for the nursing home, Commissioners asked several questions and discussed the plat with Mr, Palmer,, K,,. Wood moved approval of the preliminary plat subject to completion of the TAC requirements, M, Day seconded the motion, Aye: Wood, Day and Haynes,,, Nay: None, Motion carried 3-0-0. ZONfNG PUBLIC HEARING 7o OZ-71 Enterline & Adams - - - -------- Staff reviewed the case history and the staff evaluation: The he applicants request rezoning of an 8.9 acre tract from RM-2 (multifamily) to CG (commercial general) for office, shopping and automotive activities. The tract is vacant and is surrounded on all sides by vacant property. Land to the north and west is zoned AG. To the east and south land is zoned AG (for the expressway right-of-way that abuts the property), RM-1 and RS-2. The tract was zoned RM-2 several years ago as part of an overall plan for the east half of the square mile. The tract has a long zoning history as reflected in the attached case report for OZ-48 (in which the RM-2 zoning for the subject tract was re-affirmed, OZ-48, approved in 1979 increased the overall density in the section by increasing the acreage of RM-2 land (from RM-1) and RS-2 (from RS•1). The Comprehensive Plan indicates the subject tract as suitable for low Owasso Planning Commission Minutes October 23, 1.981 Page 4 intensity residential development and includes the area in Special District 5 which is an area "requiring detailed plan- ning and engineering due to the proposed alignment of the Mingo Valley Expressway," There is an existing 9 acre commer- cial node zoned CS located less than 112 mile east of the subject tract at the intersection of 96th Street North and 129th East Avenue,, The property was zoned RM-2 with the expressway alignment in place and the zoning was re-affirmed in 1979. No physical or design factors have changed since that time to make commercial zoning more appropriate than multifamily. The RM-2 zoning is a buffer between the commercial corner and the expressway and (current and future) less intense zoning in the middle of the mile, CG zoning is considered a high intensity use by the Comprehensive Plan. Extending commercial zoning to the middle of the section would be considered as strip zoning and not in agreement with the activity center concept in the Plan, The request for CG zoning would not be in accord with the Comprehensive Plan,., Staff explained that the City Council had returned this application to the Planning Commission for further consideration,, Bob Pruitt, engineer for the applicants, showed a map of the area of the subject tract that was proposed to be acquired by the state for the f-169 interchange and explained the schedule of the proposed acquisition and letting of bids to construct, He said that acquisition would take approxi-, mately half of their property, He stated that the applicants would agree to an amended CS zoning but requested the zoning on the entire tract, In response to questions, Pruitt discussed scheduling of bid letting and acquisition of the property and indicated the applicants still wanted the entire property rezoned prior to part of the land changing ownership,,, Commissioners discussed the proposal with Pruitt and among themselves. K. Wood stated that he saw no change in the situation since the last meeting, that the Owasso Planning Commission has to look at what is the best for the city, that he was resistant to changing the zoning for private commercial gain that the property has already had a long zoning history, and that should the situation change he might see the rezoning of the west half of the property as appropriate, R. Haynes stated that he was opposed to rezoning the whole parcel to commercial and that he had seen RM-2 apartments near expressways and thought it was a good use. M. Day stated that he felt the same way and that he could not decide on the rezoning until the east half of the tract is acquired, Additional discus- sion followed, Several alternative motions were discussed, K. Motion carried 3 -0-0R Bob Pruitt stated that he intended to withdraw the application and not appeal the decision to the City Council, COMPREHENSIVE PLANNING 8. Update to the Comprehensive Plan Mafia This item was continued until the November meeting in order to allow time for additional members of the Owasso Planning Commission to be appointed and to provide input NEW AND GENERAL BUSINESS 9. Commissioners decided that, due to lack of a quorum for the November 15th meeting and the uncertainty of when new members will be appointed, the regular meeting in November would be cancelled and a special meeting set for - November 29th at the regular time and placed :10. Commissioners discussed the three consecutive absences of Pat Larkin and staff confirmed that Larkin had moved out of state but had not written a letter of resignation K< Wood moved to request the City Council to appoint a replacement to serve out Pat Larkin's unexpired term as soon as possible, Mr Day seconded the motion Aye: Wood, Day and Haynes Nay :: None, Motion carried 3-0 -0e 11. The Commission discussed sending letters of appreciation to Marilyn Hinkle and Pat Larkin for all of their hard work. Marilyn Hinkle's resignation letter is attached to these minutes. Commissioners authorized the Vice- - Chairman to sign and send letters of appreciation to each former member, No formal action was 'taken on this item, 12. Staff notified commissioners that they were invited to a TMAPC workshop and tour for new planning commission members on October 31, 1984 at :1:30 p em v Staff urged members to attend if at all possible.
