Haynes called the meeting to order at 7:32 p.m., L roll was called and a quorum was declared present, 1 MA Day moved approval of the minutes of the August 16, 1984 meeting. K. Wood seconded the motion. Aye: Wood, Day and Haynes,, Nay: None, Motion carried 3-0- 0, ZONING PUBLIC HEARING & TCZ -123 REFERRAL Tulsa County Commission Staff reviewed the case history and the staff evaluation: The applicant, The Tulsa County Commission, requests downzoning of a 40 acre tract of land from RMH ( mobile home) to RE (rural residential), the tract is vacant and is surrounded on the north, west, and east: by vacant land zoned AG, 1 <o the northwest lie scattered homes zoned AG to the south lie low density, large lot homes zoned AG -R, The Co mprehensive Ilan indicates this area as suitable for rural residential land uses,, The TMAPC and County Commission request the Owasso Planning Com- mission's comments regarding this referral case There were no representatives from the Tulsa County Commission present to explain the case, Bud Iii ram, attorney for the Owasso Community Homeowners Association s upported the downzoning application and explained the pro - perty's zoning history, I here were approximately 30...40 people from the association present in support of the application, Curtis Parks, attorney for Mr., and Mrs.. York, the owners of the subject tract, registered their formal protest to the proposed downzoning of their property, Commission members discussed the application with those present and asked several questions, K. OZ-71 Enterline and Adams Staff reviewed the case history and the staff evaluation- The applicants request rezoning of an 8.9 acre tract -from RM-2 (multi -family) to CG (commercial general) for office, shopping and automotive activities. The tract is vacant and is surrounded on all sides by vacant property, Land to the north and west is zoned AG. To the east and south land is zoned AG (for the express- way right-of-way that abuts the property), RM-1 and RS-2. The tract was zoned RM-2 several years ago as part of an overall plan for the east half of the square mile. The tract has a long zoning history as reflected in the attached case report for OZ-48 (in which the RM-2 zoning for the subject tract was re-affirmed, 07 -48, approved in 1.979 increased the overall density in the section by increasing the acreage of RM--2 land (from RM-1) and RS-2 (from RS-1),, The Comprehensive Plan indicates the subject tract as suitable for low intensity residential development and includes the area in Special District 5 which is an area "requiring detailed planning and engineering due to the proposed alignment of the Mingo Valley Expressway." There is an existing 9 acre commercial node zoned CS located less than 112 mile east of the subject -tract at the inter- section of 96th Street North and 129th East. Avenue. The property was zoned RM-2 with the expressway alignment in place and the zoning was re-affirmed in 1979, No physical or design factors have changed since that time to make commercial zoning more appropriate than multi-family, The RM-2 zoning is a buffer between the commercial corner and the expressway and (current and future) less intense zoning in the middle of the mile,. CG zoning is considered a high 'intensity use by the Comprehensive Plan,, Extending commercial zoning to the middle of the section would be considered as strip zoning and not in agreement with the activity concept in the Plan, The request for CG zoning would not be in accord with the Comprehensive Plan, Bob Pruitt, engineer for the applicant, explained the request for rezoning stating that the OK State Highway Department; planned 'to acquire the east 112 of their 9 acre site to be used in the redesigned 1-169 interchange at 96th Street North,., He said a 4 acre site would not be attractive for apartments next to 'the interstate and pointed out nearby commercial zoninq, Responding to questions, he stated that they had not been approached by the highway department about buying any additional right-of-way land, Pruitt stated that the whole area -is high intensity on all sides and 'that condi- tions in the area have changed., Staff made comments that no agreement had been made to buy additional right-of-way, that the whole area was not com- mercial, that the subject property had been through rezoning at 'least twice with the subject tract remaining RM-2, that it was more appropriate to wait til the land is purchased and then request rezoning and cited the example Owasso Planning Commission Minutes September 20, 1984 Page 3 of the `three lakes commercial area at 86th Street, and that CG zoning was too intense a zoning for a commercial site at that location. R. Haynes said he thought it was premature to make any charges in zoning now, that the highway department could change -the design again and Owasso would have made the whole 9 acre more intense commercial zoning® Responding to questions Pruitt stated he did not know of any building timetable for the property. K. Wood stated that he saw the rezoning as a premature proposal and that there were no concrete right -of -way proposals now. He said that rezoning for what would appear to increase the value of the land for acqui- sition was not the responsibility of the Owasso Planning Commission, Pruitt discussed rezoning the west half of the property now. Commission members stated that there was no actual need now because purchase plans were not definite, They indicated that they might consider rezoning if the property had been purchased. Staff stated that if they were considering rezoning the property to commercial that they should consider rezoning the western side (which Would abut much less intense zoning) to a lesser zone such as office or parking as a buffer area® A detailed discussion followed concerning alternatives and possible motions, K. Wood moved to recommend denial of the rezoning„ M. bay seconded the motion, Aye: Wood, Clay and Haynes, Nay: None, Motion carried 3 --0­0,, In additional discussion responding 'to questions from Pruitt, Commissioners indicated -that they Would be favorable to the Council's sending the applica- tion back to -the GPC 'for further review, especially if additional information concerning purchase of the land game to light LOT SPLIT REVIEW 6® OLS - -51 Rill Lewis Staff reviewed the case history and the staff evaluation: The applicant requests a lot split on E-ot 1, Block e1, Ator Heights located north of the NW /c of :191:.h Street and 1-169, The lot split Would split a 196' x 150' lot from a 600.1 long commercial lot facing 1 -169, The lot to be created already has a car wash on it., the lot is already served by all utilities and there have been no requests for additional easements. The new lot to be created Would meet the bulk and area requirements for a lot in a CG district, although it is 41 to narrow to be split again (CG lots are required 'to have 100' frontage on an arterial street). Approving this lot split, however, would leave a 59° strip of land on the south end of the larger lot that would be substandard in frontage as a future lot. It is unlikely that the original lot will remain as an individual commercial tract very far into the -future. Owasso Planning Commission Minutes September 20, 1984 Page 4 No one representing the applicant was present to explain the lot splits Commission members discussed with staff the details of the lot split and expressed considerable concern over splitting a lot that would leave a 59` strip of land to the south and a IOO' strip of land with no access to a street to the rear. They expressed an interest in discussing the proposal with someone who represents the applicant. M. Day moved to continue action on the lot split until the next meetinq for -further discussion with the applicant. K Wood seconded the motion. Aye: Day, food and Haynes, Nay: None.
