Grant a 17.5' perimeter easement on the northwest and south borders of the property by separate instrument. Don Murnan, representing the church, discussed the church's plans for development and the BOA's .list of conditions, He agreed to abide by the conditions., He stated that the GRDA had agreed to subordinate their easement to the public in carder to widen the street right -of -way on 129th E. Ave, He and Bob Pruitt;, engineer, explained stormwater drainage pro- posals, The Chairman reminded them that the Planning Commission would only act on the lot split; that the conditions set by the Board of Ad- justment had already been approved. After additional general discussion G, Phillips moved approval of the lot split subject to completion of the TAC conditions, P. Larkin seconded the motion, Aye: Phillips, Larkin, Hinkle and Haynes, Nay: None,, Motion carried 4-0-0, SUBDIVISION REVIEW >„ Request or Vacation of Utility Easement Staff related the case history and the staff evaluation The applicant requests vacation of a portion of the 10' utility easement can the south side of Lot; 45, Block 3, Hale Acres 2nd, The existing house was built, approximately ' into the easements, because it was not staked properly on the lots, The TAC has received the information concerning this .lot; and staff should have their comments by the commission meeting, David Martin, representing the applicant,, discussed the lot: and the house that was built Staff related that none} of the utilities had indicated that there were any utility lines under the house.. P>C stated they would only vacate the easement when they received {a District Court order to do so, No utilities indicated opposition to vacating the easement. Commissioners discussed the application with Mr, Martin and with each other. Ga Phillips moved approval of the request to vacate a portion of the utility easement, R. Haynes seconded the motion. Motion carried 4 -0 -0, Commissioners noted their request to the building inspector to take better note of placement; of buildings on lots in future building permits, 7. Elm Creek Commercial Corner Chairman Hinkle and Pa Larkin stated they would abstain from the discussion and voce on this case due to potential conflicts of interest. Vice -Chair George Phillips conducted this portion of the meeting. Staff related the case history and the staff evaluation: The TAC had the fallowing comments regarding the conditional final plat of Elm Creek Commercial Corner: 1e Submit for city engineer's review and approval construc- tion plans for streets, water,, sanitary sewer and storl1water drainage. 2. Make minor amendments 9::o the restrictive covenants, S. Explain limits-of-no-access in covenants. Bob Pruitt, engineer, explained several details of the plat: i Owasso Planning Commission Minutes May 17, :1984 Page 7 20 A 60' wide ROW and no parking permitted on either side of the public street. 3. The Mutual Access Casements on the front and rear of the lots (principal accesses and alleys) be in- stalled as hard surface driveways at the same time as the construction of the public street and include the construction of all four accesses to connect with the MAE'sa G„ Phillips seconded the motions Aye: Haynes and Phillips. Nay: None. Abstain: Hinkle and Larkin:, Motion carried 2 -0 -2. M. Hinkle resumed chairmanship of the meeting, COMPREHENSIVE PLANNING 8. Resolution Adopting an Amended Fee Schedule Commissioners reviewed the proposed resolution to adopt an amended fee schedule, They indicated their agreements with the fee schedule,, Go Phillips moved to recommend approval of the resolution_, P. Larkin seconded the motion, Aye: Phillips, Larkin, Hinkle and Haynes. Planninq Commission Member Resignation George Phillips informed the members that he was resigning from the Commission due to a heavier workload, He indicated that he was wil- ling to stay on until someone else was found. Commissioners indicated they were sorry to see George Phillips leave. Pa Markin moved to ac- cept the resignation and to request the Council 'to appoint a replacement member. R,. Haynes seconded the motion. Aye: Larkin, Haynes and 1- Finkle. Nay: None. Motion carried 3 -0-0. There being no further business to consider, P. parkin moved to adjourn the meeting with Re Haynes seconding -the motion Aye: Hinkle, Haynes and (.Markin. Nay: None.
