Hinkle Ma Day Co Dickey Go Phillips R. Haynes Po Larkin 1. Chairman, M. Hinkle called the meeting to order at 7010 p.m., 2m roll was called and a quorum was declared present. 3. Approval of the minutes of December :159 1983 was continued until the January 199 1984 meeting. SUBDIVISION PLAT REVIEW 4. Atchison, Topeka and Santa Fe Railroad - Review of amendments to the plat was continued to the J nuary 19, 1984 meeting at the request of the applicant. 4a. Request for Vacation of Utility Easement - Eddie Proctor Staff related the case history and the staff evaluation (attached to these minutes), The applicant requests vacation of a portion of a 20' utility easement that lies along the north side of Lot 1, Block 5, Hale Acres Addition at 11309 and 11311 North 112th East Avenue. The lot is zoned RD duplex. A duplex residence has been built: on the lot, 1286' into the 20' utility easement for a length of 38.4'. (See attached surveyor's plat.) The structure was also built so that there are sideyards of 8' and 7.4' rather than the required minimums of 5' and 10'. The owner has applied to the Board of Adjustment for a variance from the sideyard requirements, The subject lot was on the perimeter of Hale Acres when it was platted in 1966 and the 20' easement ran along the entire north boundary of the plat The subject .lot is now in the middle of a block. City water and sewer lines runs along the east lot Line Gas service lies within the street right -of -way, telephone and Cable TV lines may be located within the easement. PSO has an overhead pole line within the easement:. They stated they needed at least :15' of the existing easement or additional easement granted from the lot to the north, In all cases the applicant should contact the utility companies individually and the OKI E locator service to specifically locate each utility line in order to work out agreements with the utilities to vacate the easement. The applicant will have to petition District Court, in any case, to permanently vacate a portion of the easement, OWASSO PLANNING COMMISSION MINUTES January 5, 1984 Page 2 As regards the City of Owasso`s rights 'to use the easement, Commissioners should consider whether vacating a 1206' portion of the easement would in any way impede the extension of water and sewer services to the subject lot or to surrounding lots. Pa Larkin moved approval of vacating that portion of the 20' utility easement that lies underneath the duplex structure. P:. Haynes seconded the motion. Aye: Larkin, Haynes, Phillips and Hinkle Naye None. Motion carried 4 -0-0a CODE REVIEW 5, Owasso Zoning Commissioners reviewed chapters 5, 6, 7, 8, 9 and 10 of the proposed re- visions to the Owasso Zoning Code and discussed several amendments. They decided to review chapters 4, 11, 16 and the Appendices at the January 19 meeting. They well consider another special meeting for January 25 if they do not complete their review on January 19. The Cade will be forward-,: ed to the City Council for their February 7th meeting 'There being no further business to consider, Go Phillips moved to adjourn the meeting with Po Larkin seconding the motion Aye: Larkin, Phillips, Hinkle and Haynes, Nay: None. Motion carried 4-04.
