J. Dunlap called the meeting to order at 7:10 p,m, 2. Roll was called and a quorum was declared present, 3. E. Henry moved approval of the minutes of July 18, 1.985 as written, J. Buchanan seconded the motion. Aye: Henry, Buchanan and Buffington,, Nay: None, Motion carried 3-0-0,, ZONING PUBLIC HEARING 4. OZ-72 First Bank of Owasso Staff reviewed the case history and the staff evaluation.,, The Owasso Comprehensive Plan (p. 5) states that "medium intensity reside- ntial uses will act as buffers between low intensity residential uses and higher intensity uses". The proposed RM-1 would be a medium intensity residential use and could be used as a buffer between higher intensity non- residential uses and single family development, The applicant, Alan G. Anderson presented his case, After discussion J. Buchanan moved to recommend approval of the request, E. Henry seconded the motion, Aye: Henry, Buffington and Buchanan, Nay: None, Motion carried 3-0-0., 5, Abandonment of PUD-5 First Bank of Owasso The staff reviewed the case and reconmended approval of the request, Alan G, Anderson presented his case and stated that he did not wish to continue with the development of PUD-5 and was requesting that it be abandoned at this time,, After discussion J. Buchanan moved to recommend approval of the request,,, F. Amendment to the Zoning Code - Section 10.13.4 The staff reviewed 'the item and presented a comparison of off-street park- ing requirements for surrounding communities, After discussion it was determined that the existing parking requirements for grocery stores was excessive, E. Henry moved to recommend that the portion of the section 1051364 of the zoning code be deleted, This change would group grocery stores with other trade and service establishments thereby changing the parking establishments from 1 per 100 sq. ft. of floor area to 1 per 200 sq. ft. of -floor area,, P. TCPUD -404 Clean Lowe The staff reviewed the case: He stated ed that the PUD refaced 'to a referral case (CTZ- 134), the Planning Commission had reviewed at their May meeting. - lie read the following staff evaluation that was presented at the May meet - ing The applicants request rezoning of a £1:29 vacant parcel of land .located in the Owasso fenceline from AG to CS commercial. The parcel is located 112 mile west of the SW /c of 116th Street, North and Garnett (11wy.. 169) on the south side. The tract is surrounded on the south and northwest by single family homes and lots zoned RS ,-3,, To the east is a church zoned AG, To the north and west lie vacant land zoned AG agricultural. The proposed uses are commercial businesses and restaurants. The Owasso Comprehensive Plan recommends low intensity residential land use as ap- propriate for this area The proposed rezoning ng cl ear° ly would be both spot. f ;zoning and strip zoning They Comprehensive Plan's policies strongly support locating commercial and other higher intensity land uses at the intersections of arterial streets a n d not locating them in the middle m i l e where they will encourage other nonresidential uses to locate there,, Commercial businesses stripped out along the mile arterial are incentives for ad- ditional curb cuts, additional stop- and - -go traffic which greatly interferes with traffic flow and additional noise and other negative im- pacts can nearby residential areas The proposed rezoning abuts existing residential neighborhoods. The request is not in accord with the Compre- hensive Plan. The property is suitable for residential uses, If zoned PS -3, approxi- mately 45 homes could be built on the g acres (5..12 units per acre),. With a good design, the homes would be protected from traffic along the Owasso Planning Commission Minutes August 15, 1985 Page 3 arterial street (116th Street North). There is currently a good stepped -down buffer of less intense land uses from the intersec- tion west, RMN (mobile home) zoning buffers the CS zoning on the corner. A church zoned AC abuts the RMN zoning, This is a good and effective border and buffer to protect less intense residential uses in the interior of the neighborhood from commercial uses on the corner, Staff recommends that the Owasso Planning Commission recommend to the TMAPC denial of the proposed rezoning for the above stated reasons. He stated that the PUU would prohibit the sale of alcoholic beverages in retail liquor stores and night clubs, but all other uses permitted in the CS district would be allowed, He stated that the previous evaluation applied and recommended that the Owasso Planning Commission recommend to the TMAPC denial of the proposed PUCE. Jeff Tuttle, representing the applicant presented his case, The owners of the property to the west; stated that they were at the meeting as observers, The pastor of Westpark Baptist church stated that he was against the request:. J. Buchanan asked for the staff view, J, Dunlap stated that the staff recommends denial of the request,„ After discussion, E. henry moved to recommend that the TMAPC deny the application, B. Request to vacate a portion of a Utility Easement The staff reviewed the request and stated that there was a total easement of 20' at this location and there were no utilities in the easement. The request had been reviewed by other city staff and utility companies, The staff recommended approval of the reuqest,,, The applicant, Alan G. Anderson presented his case and explained the pro- cedure required to vacate a utility easement. After discussion, J. Buchanan moved to recommend approval of the request,, E. Henry seconded the motion, Aye: Henry, Buchanan and Buffington, Nay: None. Motion carried 3-0-0, NEW AND GENERAL BUSINESS 9. Taco Bueno Site Plan The staff reviewed the case and stated that the City Council had received incomplete information at their last meeting, After discussion, the Planning Commission determined that the site plan should be returned to the City Council with complete information, There being no further business to consider, E. Henry moved to adjourn the meeting with B. Buffington seconding the motion, Aye: Henry, Buchanan and Buffington, Nay: None., Motion carried 3-0-0.
