3� Regarding the February 149 1985 minutes, M. Day noted that the minutes
should be corrected to read that he and K. Wood had abstained, and not
voted nay, on the waiver of platting requirement for the Latter Day Saints
church.. With that correction, En, Henry moved approval of the February 14,
1985 minutes, M. Day seconded the motion.

Chairman Haynes welcomed lane Buchanan to the commission to finish Ken
Wood's unexpired term,
LOT SPLIT REVIEW
& OL -53 Doctors Family Medical Clinics
Staff related that this lot split had been signed under the "prior approval"
lot split ordinance and was before the commission for ratification, The
applicant was not present Staff answered several questions concerning the
lot split, E. Henry moved ratification of OLS-53, M. Day seconded the
motion

TONING PUBLIC HEARING
55 TCZ -134 REFERRAL - Dean <& Don Lowe
The applicants request rezoning of a 9.29 vacant parcel of
land located in the Owasso fenceline from AG to CS commercial
The parcel is located Q mile west of the SW /c of 116th Street;
North and Garnett (Hwy. 169) on the south side, The tract: is
surrounded on the south and northwest by single-family homes

and lots zoned RS-3. To the east is a church zoned AG. To
the north and west lie vacant land zoned AG agricultural,
The proposed uses are commercial businesses and restaurants.
The Owasso Comprehensive Plan recommends low intensity
residential land use as appropriate for this area,
The proposed rezoning clearly would be both spot zoning
and strip zoning® The Comprehensive Plan's policies
strongly support locating commercial and other higher 4n-
tensity land uses at the intersections of arterial streets
and not locating them infh—ernfidl—e —ofthe square mile where
they will encourage other non-residential uses to locate
there. Commercial businesses stripped out along the mile
arterial are incentives for additional curb cuts, additional
stop-and-go traffic which greatly interferes with traffic
flow and additional noise and other negative impacts on near-
by residential areas. The proposed rezoning abuts existing
residential neighborhoods. The request is not in accord with
the Comprehensive Plan,
The property is suitable for residential uses, If zoned
RS-3, approximately 45 homes could be built on the 9 acres
(5.12 units per acre), With a good design, the homes would
be protected from traffic along the arterial street (116th
St. North). There is currently a good stepped-down of less
intense land uses from the intersection west. RMH (mobile
home) zoning buffers the CS zoning on the corner, A church
zoned AG abuts the RMH zoning. This is a good and effective
border and buffer to protect less intense residential uses
in the interior of the neighborhood from commercial uses on
the corner.
Staff recommends that the Owasso Planning Commission
recommend to the TMAPC denial of the proposed rezoning for
the above stated reasons,,
Mr. and Mrs, Carol White, abutting property owners to the west, asked
several questions about the proposal saying they were not for or against;
the application, but just wanted to listen, The 1. owes applicants, stated
that they wished to develop the property as "low intensity" commercial
uses-such as restaurants and auto parts store, They stated they had no
specific plans or offers so far. Wayne Vines spoke in support of the
application saying that 116th Street North would be four -laved one day and
that the area needed more commercial development,,
Commissioners discussed the application, zoning requirements, the compre-
hensive plan, other nearby development and traffic problems with the
applicants and the Whites. Commissioners asked staff questions about the
evaluation. After additional discussion among commissioners concerning
location of the property, E. Henry moved to recommend that the TMAPC deny
the application, J. Buchanan seconded the motion,

SUBDIVISION REVIEW
6. Elm Creek Commercial Corner Amended
Staff reviewed the case history:
This amended plat is being processed to correct errors on
the original plat of record. When the original plat was redrawn
during review to show 60' instead of 50' of right -of -way along
36th Street North, the perimeter distance measurements were
changed but the internal lot line measurements were not changed
leaving 10 more feet of lots than there was land, the plat has
been redrawn to correct that error. Lot width has been removed
from Lots 5, y, 8, 9, 10 and 11 in Block 2, and Pots 3, 4, 5,
6, 7, 8, 9, 10, 11 and 12 in Block 1. Amendments to these lots
will not aff=ect; location of street rights- of-way or utility
easemen ts,,
The only comment the CAC had from their May d, 1985 meeting
was to change wording in the covenant's third paragraph to
"...does further dedicate for public use al.l the street rights-
of-way as shown..." (emphasis showing added wording)
Jeff¢ Tuttle, engineer, explained the amendments and why they were needed.,
Commissioners asked several questions of Tuttle and staff,

The platted alley has never been used as alley and is not
paved. As you can see on the survey, there are several
utility lines within the alley, Any utility line that would
be affected by the proposed vacation and new building would
have to be relocated at the church's expense
The TAC had the following comments from their May 8, 1985
meeting.,
1Q The existing IPSO line must be relocated to the
southern portion of the alley
?. The footings of the buildings must be a minimum
of 3 ft, from the existing gas line
I After discussion with the church, the Southwestern
Bell line will not be moved.
4e The building will not affect existing water and
seeder lines
Rev. Atwood, pastor of the church, explained the request saying they
wished to enlarge their church, He felt that the new church would beautify
that part of town and that other churches were moving to new locations,.
Commissioners discussed the request and location of the utility _lines with
the applicants,,
M. Day moved approval of the request subject to completion of the utility
companies requirements, J. Buchanan seconded the motion:,

8.: Goldies Restaurant Site flan

The TAC had the following recommendations to makes regarding
approval of the site plan for ,oldies Restaurant, located at
the SEu /c of 86th Street North and 1-169 (south access road),
The property is zoned CS commercial,

K Locate trash container on a concrete pad according to
City of Owasso standards,
& provide an opaque screening fence along the south side
of the property abutting the RM-1 district to the south.

Gerald Sn ow, applicant, explained the proposal and answered numerous
questions from the commission, who reviewed each of the TAC requirements,
R Haynes stared that due to traffic backup problems and the western sun,
he felt strongly that the addition of an access lane was a very good idea,.
Me Day agreed. J. Buchanan discussed the potential problem of people
crossing Goldies lot from the access road to the adjacent shopping center
to avoid traffic: snarls at 86th Street North„ All commissioners agreed
that was a potential safety hazard not of Coldies making, Staff suggested
a compromise of placing a speed bump across the eastern access to slow down
but not prohibit traffic across the lot, Commissioners and the applicant

agreed that a sped bump could be a workable solution® Commissioners dis-
cussed other questions about the site and the adjacent shopping center,
Ea Henry moved approval of the site plan subject to completion of the 19
TAC requirements and a 20th item M, placing a speed bump across the eastern
access to the shopping center. M. Day seconded the motions
