Be it remembered that on the 15"' day of December, 1998, at a regular meeting of the City
Council of the City of Owasso, Oklahoma, the following resolution was presented, read, and
adopted:
WHEREAS, Surface Transportation Program Funds for urbanized areas have been made
available for transportation improvements within approved Urban Areas; and
WHEREAS, the City of Owasso has selected a project described as follows: expansion and
signalization of the intersection at East 86th Street North and North Mingo Road; and
WHEREAS, the engineer's preliminary estimate of cost is $971,579.00, and Federal
participation under the terms of the Intermodal Surface Transportation Efficiency Act of 1991
relating to Surface Transportation Program Urbanized Area funds is hereby requested for funding
80% of the project cost; and,
WHEREAS, the City proposes to use 1998 Owasso Bond Issue Funds as the source of funds
for the balance of the project costs; and,
WHEREAS, the City has arranged for CH2M Hill, a qualified engineer, to furnish
engineering services in the preparation of detailed plans, specifications, and estimates; and,
WHEREAS, the City agrees to provide for satisfactory maintenance after completion, and
to furnish the necessary right-of-way clear and unobstructed; and,
WHEREAS, the City agrees, as a condition to receiving any Federal financial assistance
from the Department of Transportation, that it will comply with Title VI of the Civil Rights Act of
1964, 78 Stat. 252, 42. U.S.C. 2000d et seq, and all requirements imposed by or pursuant to Title
49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary,
Part 21, "Nondiscrimination of Federally-Assisted Programs of the Department of Transportation-
Effectuation of Title VI of the Civil Rights Act of 1964"; and,
WHEREAS, the City agrees to become jointly responsible, with the Oklahoma Department
of Transportation and the contractor as co-applicants, for meeting all Environmental Protection
Agency (EPA) requirements for storm water runoff from this project. Further, if required, the City
agrees to file jointly, with the Department and the contractor, the general National Pollutant
Discharge Elimination System (NPDES) permit with the EPA which authorizes the storm water
discharges associated with activity from the construction site identified in this resolution; and,
WHEREAS, the City further agrees to deposit with the Oklahoma Department of
Transportation the matching funds required within thirty (3 ) 0) days after approval by the Federal
Highway Administration,
NOWT EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OWASSO, OKLAHOMA, that the Oklahoma Transportation Commission is hereby requested
to concur in the selection of the project and to submit same to the Federal Highway Administration
for its approval..
