On Tuesday, June 28, 1988 the Owasso City Council met in a special session in the
Council Chambers at the Community Center per the Notice of Public Hearing and Agenda
posted on the City Hall bulletin board at 4:00 p.m. on Friday, June 24, 1988.
ITEM 1: CALL TO ORDER.
The meeting was called to order at 7:00 p.m, with Mayor Lamb presiding.
ITEM 2: FLAG SALUTE.
The flag salute was led by Mayor Lamb.
ITEM 3: ROLL CALL.

A motion was made by M. Thompson, seconded by P. Marlar, to approve the minutes,
as written, by reference made a part hereto.

ITEM 5: CONSIDERATION TO APPROVE "i"HE WARRANTS.
A motion was made by P. Marlar, seconded by M. Thompson, to approve the warrants
as follows: (1) General fund $38,856.06 (2) General Fund Payroll $57,196.88
(3) Wastewater Treatment Plant Construction $150,888.05 (4) Community Center
$299.95 and (5) Senior Citizens $2,940.00.

ITEM 6: APPOINTMENT OF WARD ONE COUNCILMEMBER TO FILL VACANCY.
A motion was made by Mayor Lamb, seconded by P. Marlar, to appoint John P. Phillips
to the Council in Ward One.

At this time, Mr. Cates gave the Oath of Office to Mr. Phillips and he was seated.
ITEM 7: MAYOR APPOINT"MENTS AND REQUEST FOR COUNCIL CONFIRMATION OF APPOINTMENTS TO
THE FOLLOWING BOARDS AND COMMISSIONS:
(1) PERSONNEL BOARD - ONE EXPIRING TERM
(2) BOARD OF ADJUSTMENT - ONE EXPIRING TERM
(3) PLANNING COMMISSION - ~fWO EXPIRING TERMS
THESE ARE THREE-YEAR TERMS EXPIRING ON JUNE 30, 1991.
A motion was made Mayor Lamb, seconded by P. Marlar, to re-appoint the following:
(1) Mr. W.C. Carver to the Personnel Board
<2) Mr. M.O. Eckel to the Board of Adjustments
(3) Mr. Ray Haynes and Mr. Pat Imbriano to the Planning Commission

ITEM 25: (MOVED FORWARD) CITIZEN'S REQUEST TO ADDRESS THE COUNCIL IN THE MATTER OF
A GREIVANCE RELATING TO CITY SERVICES.
Mr. Harry Miller addressed the Council concerning the manner in which the water
billing cycle is managed and also the need for pothole repair in certain areas
of the City.
ITEM 8: REQUEST TO DIRECT THE CITY ATTORNEY TO PREPARE AN ORDINANCE FOR THE PURPOSE
OF ATTACHING A 20 ACRE TRACT TO THE CITY LOCATED WEST OF 110TH STREET NORTH
AND 108TH EAST AVE. (WEST OF MEADOWCREST ADDITION) THIS REQUEST IS BY THE
PROPtR~TY OWNERS, ELDON AND DOROTHY BIRKS.
Mr. Richard Hall, the City Planner, presented this item to Council. He stated all
established procedures have been followed. The Planning Commission voted to
recommend this twenty acre tract be annexed into the city limits.
At this point, the Council was addressed by a number of concerned citizens opposing
the annexation request and questioning the Planning Commission's action.
A motion was made by P. Marlar, seconded by J. Phillips, to table this item pending
an inquiry into Planning Commission process.

Mayor Lamb directed the City Attorney to develop a set of guidelines and recommended
policy for the above requested inquiry and present it to the Council at the July
19th meeting.
11EM 9: REQUEST FOR COUNCIL ADOPTION OF FISCAL 1988/1989 ANNUAL BUDGET.
Mr. Ray briefly reviewed the budget as presented previously stating he wishes to
remove $8,000.00 assigned to the Owasso Historical Society and place it on the
Capital Outlay Contingency List and use the $8,000.00 to install a Civil Defense
warning siren in the Hillside Estates addition.
A motion was made by M. Thompson, seconded by J. Phillips, to approve the budget
as presented including the requested change.

ITEM 10: REQUEST FOR COUNCIL AU~HURIZArION TO ENTER INTO AN AGREEMENT WITH MICHAEL
CRAWFORD, INC. FOR THE PURPOSE OF DEVELOPING POLICIES AND PROCEDURES
REQUIRED TO INITIATE A "FIXED ASSET ACCOUNTING SYSTEM" AT A COST NOT TO
EXCEED $1,650.00.
Mr. Ray stated currently the City has no system of accounting for fixed assests
and assigning replacement cost or replacement schedules. He stated the City will
benefit with such as system in place. Mr. Crawford will develop the necessary
system and the City staff will put the system into the current computer and main-
tain the necessary updating and record keeping.
A motion was made by M. Thompson, seconded by P. Marlar, to enter into an agreement
with Michael Crawford, Inc. as requested.

ITEM 12: PUBLIC HEARING....TO DETERMINE AS TO WHETHER THE PREMISES LOCATED AT
8205 NORTH 120TH EAST AVE. UWAS50, OKLAHOMA ARE DETRIMENTAL TO THE HEALTH,
BENEFIT AND WELFARE OF THE PUBLIC DUE TO EXCESSIVE GROWTH AND ACCUMULATION
OF WEEDS AND GRASS AND THAT 7HE STRUCTURE LACKS THE NECESSARY MAINTANCE.
REQUEST BY THE STAFF FOR COUNCIL ACTION IS IN THE FORM OF ABATEMENT.
Mr. Ray presented this item to Council stating proper publication and notices have
been issued. Pictures of the property were shown to Council.
A motion was made by M. Thompson, seconded by P. Marlar, to declare abatement of the
above noted property.

ITEM 16: REQUEST TO AWARD THE CONTRACT TO EMPIRE PLUMBING SUPPLY FOR THE PURPOSE OF
PROVIDING RES~TROOM FIXTU12tS (STAINLESS STEEL SECURITY TYPE) FOR A PROPOSED
FACILITY TO BE LOCATED AT ELM CREEK PARK IN THE AMOUNT OF $2,793.29.
Mr. Ray stated bids were opened on June 1S, 1988 per the Notice to Bidders as
published. One bid was received and it meets all specifications. Mr. Ray
recommended awarding the contract as requested.
A motion was made by J. Phillips, seconded by P. Marlar, to award the contract to
Empire Plumbing in the amount of $2,793.29 as requested.

ITEM 17: REQUEST FOR COUNCIL ADOPTION OF ORDINANCE N0. 391. AN ORDINANCE AMENDING
"PART 17, CHAPTER 1, SECTION 110" OF fHE "L'OUE OF ORDINANCES" OF T-HE CITY
OF OWASSO RAISING RATES CHARGED TO MUNICIPAL SEWER CUSTOMERS.
Mr. Ray presented this item to Council stating in concurrance with the EPA grant
received to construct the sewer treatment plant the user fees must be sufficient to
cover the operating cost of the new plant. Based on staff review the request is to
increase rates to $1.25 minimum plus .92 cents per thousand gallons of water used.
(average used calr_:~alated). He rec:ommended approval of this Grdinance.

ITEM 19: REQUEST FOR COUNCIL ADOPTION OF ORDINANCE N0. 3y2. AN ORDINANCE AMENDING
"PART 17, CHAPTER 1, SECTION 109" OF THE "CODE OR ORDINANCES" OF THE CITY
OF OWASSO RAISING RATES CHARGED 1~0 MUNICIPAL WATER CUSTOMERS.
Mr. Ray presented this item to Council stating the current rates have not been
raised since 1986 even though our rates from the City of Tulsa have increased three
times. He recommended approving Ordinance No. 392 which would increase rates to
$5.95 for the first 1000 gallons used and $2.32 per 1000 gallons thereafter.
A motion was made by M. Thompson, seconded by J. Phillips, to approve Ordinance No.
392 as presented.

ITEM 20: REQUEST TO APPROVE AN EMERGENCY CLAUSE TO BE ATTACHED TO ORDINANCE N0. 392
A motion was made by J. Phillips, seconded by M. Thompson, to approve the emergency
clause on Ordinance No. 392.

ITEM 21: REQUEST FOR COUNCIL APPROVAL OF ORDINANCE N0. 393. AN ORDINANCE AMENDING
"PART 17, UTILITIE5", PROVIDING FUR CHAPTER 3, "PUBLIC OWNED TREATMENT
WORKS" AND PROVIDING THE DISCHARGE OF CETAIN MATERIALS INTO THE SEWER
SYSTEM.
Mr. Ray stated this Ordinance is recommended by the Oklahoma State Department of
Health and has been reviewed by Staff and the City Attorney. It generally requires
the City sewer system to comply with State and Federal law regarding what discharges
are allowable through our plant and prohibits the discharge of hazardous materials.

Vice-Mayor Marlar questioned the wording the regards to New Sewers and Connections.
She requested a statement be placed in the ordinance allowing the Council to grant
a waiver of the time requirement under extraordinary circumstances.
A motion was made by J. Phillips, seconded by M. Thompson, to approve Ordinance No.
393 as amended by P. Marlar.

Mayor Lamb called a 10 minutes recess at 8:52 p.m. due to the length of the agenda.
Meeting reconvened at 9:02 p.m.
ITEM 23: REQUEST FOR COUNCIL APPROVAL OF RESOLUTION NO. 88-07. A RESOLUTION
PROVIDING FOR INCREASED RETIRtMl=NT BENEFITS FOR MUNICIPAL EMPLOYEES
COVERED UNDER THE OKLAHOMA MUNICIPAL RETIREMENT FUND, PROVIDING FOR
A "JOINER AGREEMENT" AND AUTHORIZING THE MAYOR TO EXECUTE SUCH AGREEMENT.
Mr. Ray stated it is the request of management that the City share of the retirement
contribution be increased from 0.9~ of salary to 2.8~ of salary. This is a fiscal
year 1988/1989 budgeted item and he requested approval of this Resolution.

APCO-OKLAHOMA, INC. d/b/a S(ANDAF2D INDUSTRIES DIVISION VS. ELAINE MORTON,
d/b/a MOTTON CONSTRUCTION, ROCKWOOD PROPERTIES, INC. JERRY C. ENTERLINE,
GARY ADAMS, AND (HE CITY OF OWASSO, OKLAHOMA. CASE N0. CJ-88-13497, TULSA
COUNTY DISTRICT COURT.
Mr. Cates presented this item to Council stating the papers were served to his
office instead of the City Clerk's office. He recommends the Council give him the
authority to waive the imperfection in the process service and enter the lawsuit on
behalf of the City.
A motion was made by M. Thompson, seconded by P. Marlar, to act on the City's behalf
as he has requested.

ITEM 26: REQUEST TO APPROVE THE "CLEAN AIR POLICY" FOR THE CITY OF OWASSO
FACILITIES.
Mr. Ray reviewed the proposed policy with Council stating this will more than put
us in compliance with current state law.
A motion was made by M. Thompson, seconded by P. Marlar, to approve the policy as
presented effective July 1, 1988.
