HomeMy WebLinkAbout1988.08.02_City Council Minutes OWASSO CITY COUNCIL PAGE ONE AUGUST 2, 1988 On Tuesday, August 2, 1988 the Owasso City Council met in a regular session in the Council Chambers at the Community Center per the Notice of Public Hearing and Agenda posted on the City Hall bulletin board on Friday, July 29, 1988. ITEM 1: CALL TO ORDER. The meeting was called to order at 7:00 p.m, with Mayor Lamb presiding. ITEM 2: FLAG SALUTE. The flag salute was led by Mayor Lamb. ITEM 3: ROLL CALL. PRESENT: Stacy P. Lamb, Mayor Patricia Marlar, Vice Mayor Mark Thompson, Councilman Rodney J. Ray, City Manager Ronald D. Cates, City Attorney Jane Buchanan, City Clerk ABSENT: Von E. Stockler, Councilman John P. Phillips, Councilman A quorum was declared present. ITEM 4: REQUEST TO APPROVE THE MINUTES OF JULY 19, 1988 AND THE MINUTES OF AUGUST 1, 1988. A motion was made by M. Thompson, seconded by P. Marlar, to approve the minutes, as written, by reference made a part hereto. AYE: Thompson, Marlar, Lamb NAY: None MOTION: Carried 3-0 1 ~•~. OWASSO CITY COUNCIL PAGE TWO AUGUST 2, 1988 ITEM 5: REQUEST TO APPROVE THE WARRANTS. A motion was made by P. Marlar, seconded by M. Thompson, to approve the warrants as follows: (1) General Fund $6,392.62 (2) Wastewater Treatment Plant Construction $90,088.22 and (2) Payroll $59,847.57. AYE: Marlar, Thompson, Lamb NAY: None MOTION: Carried 3-0 ITEM 6: REQUEST COUNCIL APPROVAL TO DELETE/AMEND SECTION 4 OF CITY OF OWASSO RESOLUTION N0. 88-09. THE SECTION ADDRESSING A FIDELITY BOND. Mr. Ray reviewed this item with Council stating at the last meeting the Resolution was passed except for this item.. Upon further research by staff and the City Attorney, it is the opin- ion that a bond is not required since actions taken by the dispatchers when acting as Deputy Court Clerks are adequately covered under the City comprehevsive general liability bond. After discussion, a motion was made by M. Thompson, seconded by P. Marlar, to delete Section 4 from the Resolution. AYE: Thompson, Marlar, Lamb NAY: None MOTION: Carried 3-0 ITEM 7: CONSIDERATION OF PROPOSALS SUBMITTED BY FINANCIAL ADVISORS AND BOND COUNSEL; COUNCIL VOTE TO SELECT A FINANCIAL ADVISOR FOR THE PURPOSE OF ADVISING THE CITY REGARDING AN ELECTION TO EXTEND A SALES TAX LEVY AND OTHER BOND ISSUES. Mr. Ray presented this item to Council stating at the special meeting held on August 1, 1988 five firms presented proposals to the Council for their consideration. 2 OWASSO CITY COUNCIL PAGE THREE AUGUST 2, 1988 After discussion, a motion was made by P. Marlar, seconded by M. Thompson to select Paul Neito ans Associates as financial advisors. AYE: Marlar, Thompson NAY: Lamb MOTION: Carried 3-0 Mayor Lamb stated he would like the record to show his concern for the totally unacceptable and unprofessional manner in which the selection process was implimented. He voiced great concern with selecting the highest dollar proposal with no valid justifi- cation when four other firms have submitted more detailed and professional proposals at a lesser cost to the City. ITEM 8: REQUEST FOR COUNCIL APPROVAL OF E-911 INTERLOCAL AGREE- MENT FOR THE PURPOSE OF IMPLEMENTING AN E-911 SERVICE WITH COST ALLOCATED BETWEEN NINETEEN GOVERNMENTAL ENITIES. Mr. Ray stated this is an endeavor the City has supported over the past two years as it has been developed. Both Police Chief Baker and Fire Chief Allen and City Attorney Cates have partici- pated in every step of the process and he recommended approval of this submitted agreement. A motion was made by M. Thompson, seconded by P. Marlar, to approve the agreement as submitted and to authorize the Mayor to sign such. AYE: Thompson, Marlar, Lamb NAY: None MOTION: Carried 3-0 3 OWASSO CITY COUNCIL PAGE FOUR AUGUST 2, 1988 ITEM 9: PUBLIC HEARING...TO DETERMINE AS TO WHETHER THE PREMISES LOCATED AT 108 WEST NINTH, OWASSO, OKLAHOMA ARE DETRIMENTAL TO THE HEALTH, BENEFIT AND WELFARE OF THE PUBLIC DUE TO EXCESSIVE GROWTH AND ACCUMULATION OF WEEDS AND GRASS AND THAT THE STRUCTURE LACKS THE NECESSARY MAINTANCE. (REQUEST BY STAFF FOR COUNCIL ACTION IS IN THE FORM OF ABATEMENT) Mr. Ray presented this item to Council stating all necessary notices have been given. He showed pictures of the property. A motion was made by M. Thompson, seconded by P. Marlar, to abate the above noted property as requested. AYE: Thompson, Marlar, Lamb NAY: None MOTION: Carried 3-0 ITEM 10: Stricken from the agenda. ITEM 11: ACKNOWLEDGE RECEIPT OF WL-88-092 FOR THE CONSTRUCTION OF APPROXIMATELY 86 LINEAR FEET OF EIGHT (8) INCH WATER LINE EXTENSION. Mr. Ray presented this item stating this permit is from the Oklahoma State Department of Health in reference to construction of water lines to serve the Church of the Holy-Cross Expiscopal Church on 129th East Ave. in Tulsa County. This does not require any action from the Council, only receipt acknowledgement in the minutes as a matter of permanent record. ITEM 12: REQUEST TO AUTHORIZE THE CITY ATTORNEY TO APPROVE THE JOURNEL ENTRY OF JUDGMENT IN CASE N0. CJ:88-3825. OKLAHOMA INVESTMENT CORPORATION; GOLDEN CORRAL CORP- ATION; AND BILL J. RAMSEY VS. CITY OF OWASSO, OKLAHOMA. Mr. Cates asked for this item to be continued to the first meeting in September. 4 ~r OWASSO CITY COUNCIL PAGE FIVE AUGUST 2, 1988 ITEM 13: REPORT FROM CITY MANAGER. A written report was included in Council material. ITEM 14: REPORT FROM CITY ATTORNEY. Mr. Cates delivered to Council a written report on the inquiry of the Owasso Planning Commission. He requested this item be placed on the agenda of the next regular meeting so it can be discussed. ITEM 15: UNFINISHED BUSINESS FROM PREVIOUS MEETING. None ITEM 16: NEW BUSINESS. Mayor Lamb requested of the City Manager that a policy be written addressing the way in which professional services are bid in the future. Vice Mayor Marlar stated INCOG has a similar policy that possibly the City could review and incorporate. ITEM 17: ADJOURN. With there being no further business to be brought before the Council, Mayor Lamb asked for a motion to adjourn. A motion was made by M.
