HomeMy WebLinkAbout1987.03.03_City Council MinutesOWASSO CITY COUNCIL PAGE ONE MARCH 3, 1987 On Tuesday, March 3, 1987 the Owasso City Council met in a regular session in the Council Chambers at the Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, February 27, 1987. ITEM 1: CALL TO ORDER. The meeting was called to order at 7:17 p.m. with Mayor Wood presiding. ITEM 2: FLAG SALUTE. The flag salute was led by Mayor Wood. ITEM 3: ROLL CALL. PRESENT: Kenneth M. Wood, Mayor Robert M. Peel, Vice -Mayor Boyd M. Spencer, Councilman Von E. Stockler, Councilman Allen C. Sumpter, Councilman Bob Allen, Acting City Manager Ronald D. Cates, City Attorney Jane Buchanan, City Clerk ABSENT: None ITEM 4: CONSIDERATION AND VOTE TO APPROVE THE MINUTES OF FEBRUARY 17, 1987, THE MINUTES OF THE EMERGENCY MEETING OF FEBRUARY 19,1987 AND THE MINUTES OF THE SPECIAL MEETING OF FEBRUARY 26, 1987. A motion was made by B. Spencer, seconded by V. Stockler, to approve the minutes of February 17, 1987, February 19, 1987 and February 26, 1987 by reference made a part hereof. AYE: Spencer, Stockler, Peel, Sumpter, Wood NAY: None MOTION: Carried 5 -0 ITEM 5: CONSIDERATION AND VOTE TO APPROVE THE WARRANTS AS SUBMITTED. A motion was made by B. Spencer, seconded by A. Sumpter, to approve the warrants as submitted plus the warrant amendment. AYE: Spencer, Sumpter, Stockler, Peel, Wood NAY: None MOTION: Carried 5 -0 ITEM 6: CONSIDERATION AND VOTE TO APPROVE ORDINANCE NO. 363. AN ORD- INANCE RELATING TO THE AUTHORITY OF THE RESERVE OFFICERS OF THE RESERVE OFFICERS ORGANIZATION OF THE CITY OF OWASSO, OKLA- OWASSO CITY COUNCIL PAGE TWO MARCH 3, 1987 HOMA,PROVIDING FOR AMENDMENT TO CHAPTER THREE, SECTION 13 -301 OF THE CODE OF THE CITY OF OWASSO, OKLAHOMA, BY ADDING THERETO SECTION 13 -304 RESERVE OFFICERS ORGANI- ZATION, PROVIDING AN EFFECTIVE DATE. Mr. Bob Allen stated this is the ordinance that puts into effect the Reserve Police Officer Manual that Council approved at the last meeting. A motion was made by A. Sumpter, seconded by K. Wood, to approve Ordinance No. 363. AYE: Sumpter, Wood, Spencer, Stockler NAY: Peel MOTION: Carried 4 -1 ITEM 7: CONSIDERATION AND VOTE TO APPROVE ORDINANCE NO. 364. AN ORDINANCE ACCEPTING,TnDING AND ANNEXING TO THE CITY OF OWASSO, OKLAHOMA, ADDITIONAL LANDS AND TERRITORY IN SECTION 8, TOWNSHIP 21 NORTH, RANGE 14 EAST, PROVIDING THAT FROM AND AFTER PASSAGE AND PUBLICATION OF THIS ORDINANCE THAT ALL OF THE REAL PROPERTY WITHIN SAID TERITORY HEREIN DESCRIBED SHALL BE A PART OF THE CITY OF OWASSO, OKLAHOMA, AND FURTHER DECLARING THAT ALL PERSONS RESIDING THEREIN SHALL BE SUBJECT TO THE JURISDICTION, CONTROL, LAWS AND ORDINANCES OF THE CITY OF OWASSO, OKLAHOMA, ESTABLISHING THE SAME AS PART OF WARD ONE OF SAID CITY, AND DIRECTING THE FILING OF THIS ORDINANCE. ( SOUTHEAST CORNER OF HWY 169 & HWY 20 ) Mr. Jim Dunlap stated this is an ordinance that puts into effect the annexation that Council approved at the last meeting. This annexa- tion was requested by the Quik -Trip Corporation. A motion was made by R. Peel, seconded by B. Spencer, to approve Ordinance No. 364. AAYE: Peel, Spencer, Sumpter, Stockler, Wood NAY: None MOTION: Carried 5 -0 ITEM 8: CONSIDERATION AND VOTE TO APPROVE ORDINANCE NO. 365. AN ORDINANCE AMENDING ORDINANCE NO. 175, APPROVING ZONING APPLICATION NO. OZ -74 CHANGING THE ZONING OF A TRACT CONTAINING 1.37 ACRES, MORE OR LESS, IN THE NW /4 OF THE NW /4 OF SECTION 8, TOWNSHIP 21 NORTH, RANGE 14 EAST OF THE INDIAN BASE AND MERIDAN IN TULSA COUNTY, OKLAHOMA, ACCORDING TO THE U.S. GOVERNMENT SURVEY THEREOF, FROM AG AGRICULTURE TO CS COMMERCIAL SHOPPING, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. ( SOUTHEAST CORNER OF HWY. 169 & HWY. 20 o1w, Mr. Jim Dunlap stated this is an ordinance that puts into effect the OWASSO CITY COUNCIL PAGE THREE MARCH 3, 1987 Fd zoning change on the above mentioned tract of land that was approved at the last Council meeting. This zoning request comes from the Quik -Trip Corporation. A motion was made by R. Peel, seconded by V.Stockler, to approve Ordinance No. 365. AYE: Peel, Stockler, Sumpter, Spencer, Wood NAY: None MOTION: Carried 5 -0 ITEM 9: CONSIDERATION AND VOTE TO APPROVE A REQUEST TO CLOSE A FIVE (5) FOOT EASEMENT ALONG THE WEST SIDE OF LOT 2, BLOCK 2, ATOR HEIGHTS THIRD ADDITION. THE GENERAL LOCATION IS 305 EAST 19th STREET. Mr. Jim Dunlap stated the owner of the property has requested this easement being closed so that he may erect a patio cover. This has been before the T.A.C. Committee and the Planning Commission and it has been recommended to Council to approve this easement closing. Mr. Dunlap stated there are no utilities in this easement and there is an adjoining five (5) foot easement on the property next to this. After discussion, a motion was made by R. Peel, seconded by A. Sumpter, to approve this easement closing as requested. AYE: Peel, Sumpter, Stockler, Spencer, Wood NAY: None MOTION: Carried 5 -0 ITEM 10: CONSIDERATION AND VOTE TO APPROVE A REQUEST FOR A RELEASE OF REPAYMENT AGREEMENT DATED JUNE 6, 1985 BETWEEN JOHN AND SHARON EDWARDS AND THE CITY OF OWASSO THROUGH THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM. Darlene H. Gaul with INCOG presented this item to Council stating the Edwards will be moving and selling the house and are asking the City to release the remaining amount owing on house loan agreement. The loan is in the third and final year with $2,833.00 remaining. After discussion, a motion was made by B. Spencer, seconded by R. Peel, not to release the repayment agreement with John and Sharon Edwards. AYE: Spencer, Peel, Stockler, Wood NAY: Sumpter MOTION: Carried 4 -1 OWASSO CITY COUNCIL PAGE FOUR MARCH 3, 1987 ITEM 11: REPORT ON FINANCIAL STATUS OF CITY. Mr. Bob Allen stated he and Mrs. Lambert, the City Treasurer, have put together a report that shows fixed operating costs of the City on a monthly basis plus projected income based on last years sales tax. With these figures as a guide, the City will have a deficit in the Operating Account of the General Fund. He stated the Depart- ments are holding expenses to the bare minimum. ITEM 12: REQUEST FROM MRS. PATRICIA MARLAR TO ADDRESS THE COUNCIL CONCERNING THE FINANCIAL CONDITION OF THE CITY FUNDS. Mrs. Marlar pointed out some areas of concern to her and the fact that it is illegal to operate any fund of the City in a deficit. She asked the Council to look for some long range solutions to the City's problem. ITEM 13: REPORT FROM CITY MANAGER. No Report. ITEM 14: No Report. REPORT FROM CITY ATTORNEY. ITEM 15: UNFINISHED BUSINESS FROM A PREVIOUS MEETING. None ITEM 16: NEW BUSINESS. None ITEM 17: CONSIDERATION AND VOTE TO APPROVE A REQUEST FOR AN EXECUTIVE SESSION: SALARY ADJUSTMENT FOR THE INTERIM CITY MANAGER. ITEM 17(a) F.O.P. CONTRACT FOR THE FISCAL YEAR 1987/1988 (ADDENDUM) Mayor Wood stated he has requested Item 17 and Mr. Cates, City Attorney stated he requested Item 17(a). A motion was made by K. Wood, seconded by V. Stockler, to approve the requests for an Executive Session. AYE: Wood, Stockler, Sumpter, Peel, Spencer NAY: None MOTION: Carried 5 -0 Meeting was recessed at 8:03 p.m. and reconvened at 9:20 p.m. OWASSO CITY COUNCIL PAGE FIVE MARCH 3, 1987 ITEM 18: CONSIDERATION AND VOTE TO APPROVE A SALARY ADJUSTMENT FOR THE INTERIM CITY MANAGER. A motion was made by K. Wood, seconded by R. Peel, that a supplemental salary be paid to the Interim City Manager in the amount of $3,153.00 a month for that office to be retroactive to the date of duty assump- tion and to continue to date of duty termination as Interim City Manger. AYE: Wood, Peel, Stockler, Spencer NAY: Sumpter MOTION: Carried 4 -1 Mr. Sumpter stated he would like to minutes to reflect that he is not voting against the raise only against the method of raise. ITEM 19: CONSIDERATION AND VOTE TO ADJOURN. With there being no further business coming before the Council, a motion was made by R. Peel, seconded by V. Stockler, to adjourn.
