1. Chair, M. Hinkle called the meeting to order at 7:34.
2. Roll was called and a quorum was declared present.
3. D. Cooke moved to approve the minutes of the meeting of August 30, 1981, as
written. G. Phillips seconded the motion.
Age; Hinkle, Cooke, Phillips and George.
Nay: None.
Motion passed 4-0-0.
LOT SPLIT REVIEW
4. OLS-29 Steve Longshore
Staff reviewed the case history and presented the staff recommendation:
The applicant requests a lot split on Lot 12, Block 13, Elm Creek
Addition, to add the North 5' of Lot 12 to Lot 13 because the house on
Lot 13 was inadvertently built on the property line rather than allow--
ing for a 5' sideyard setback.
In an RS-3 district, the Owasso code requires sideyard setbacks
of 5' on the one side and 10' on the other. The code also requires a
minimum 20' rear yard setback,
With the addition of the 5' (of Lot 12) added to the south of Lot
13, the new Lot 13 would meet code requirements. The house on Lot 12
faces 78th Street North, not 112th East Avenue which means the common
lot line defines Lot 12's rear yard, not side yard, There remains a.
question as to whether Lot 12's rear yard would meet the 20' rear
yard requirement with the lot split. If not, the applicant will have
to apply to the Board of Adjustment for a variance. PSO requires that
the north 5' of the new lot 12 be granted as a utility easement.
Staff recommends approval of the lot split subject to:
1) Filing of record an instrument granting a utility easement
for the north 5' of the new lot 12a
2) Approval of a variance by the BOA if the rear yard of the
remaining lot 12 does not meet zoning code requirements.

The applicant, Steve Longshore, spoke for the application stating that PSO
required that an electric line running under the house built on lot 13 must
be moved, He said he was working with PSO to accomplish that. He stated.
that the house on lot 12 would not meet the 20' back yard requirement, and
he would apply to the BOA for a variance. The Commission further discussed
the application,,
G. Phillips moved to approve the lot split per the staff recommendation
subject to Board of Adjustment approval, D. Cooke seconded the motion.
Aye: Phillips, Cooke, George, and Hinkle.
Nay: None.
Motion carried 4-0-0.
ZONING PUBLIC HEARING
5. OZ-61 Lloyd Kenne
Staff presented the case history. Lloyd Larkin, attorney for the applicant,
made a lengthy presentation and submitted a "statement of Facts" brief. A
copy is attached to these minutes.
The applicant, Mr. Kennedy, and a former owner, Mr. Hopkins, spoke for the
application,
Staff read the staff recommendation-
The applicant requests rezoning of approximately 19 acres from IL
Light Industrial to RMR Mobile Home zoning for the purpose of building
a mobile home park. The area is located west of Hwy. 169 and southeast
of City Hall. The majority of the property is in the floodplain; the
floodway runs through the property, The northern portion of the pro-
perty once contained a mobile home park.
The property is currently zoned for light industry which does not
permit a mobile home use. The Comprehensive Plan recommends this area
as an industrial special district stating it is an area of "—special
physical, locational and environmental characteristics. Additional
detailed planning and engineering will be necessary to develop these
areas in uses compatible with land characteristics. Specific problems
relate to the flooding of these highly accessible sites." RMH mobile
home zoning is considered a high intensity use. Traditionally, it has
been Owasso's policy noy to encourage development within the floodplain.
Passage of the recent floodplain ordinance is further support of that
policy. It is staff's professional opinion that development of resi-
dences within a floodplain is an unsafe situation, regardless of the
engineering safeguards employed. The property is zoned for several
industrial and commercial uses and can be developed to employ flood-
proofing techniques for commercial or industrial buildings, Families
living in floodplains are very difficult to floodproof.

Staff recommends denial of the applicaiton.
Alengthy discussion followed. D. Cooke moved to deny the application
per staff recommendation. L. George seconded the motion.

Motion carried 4-0-06
G. Phillips moved for forward the attorney's brief without Planning
Commisson recommendation to the city attorney to allow him time to re--
view the brief before the City Council reviews the case. L. George
seconded the motion,.

Staff advised the applicant that a zoning case recommended for denial..
would not be considered further unless the applicant filed a written
request with the city clerk, within 15 days, for a hearing by the City
CounciE
INFORMATION ITEMS
V Review of Building Permit Plans
One building permit for ministorage units, and the accompanying Board of
Adjustment case site plan, were reviewed by staff. Commissioners discuss-
ed the site plan, The Commission directed staff to send their recommendation.
to the Board of Adjustment to specify in the future not to allow open
storage on the grounds of ministorage businesses.
NEW AND GENERAL BUSINESS
7. Tulsa County Historic Preservation Socie
Staff discussed the INCOG county-wide survey of historic and architecturally
significant sites being conducted this year for the Tulsa County Historical
Society. Staff stated that INCOG staff would be surveying each community
and would appreciate knowing about any possible sites or persons to contact
for historic information. Commissioners suggested several persons to con-
tact and mentioned several buildings or sites to survey.
& G. Phillips discussed existing drainage problems in several parts of the
City. Commissioners again stated their strong recommendation for the
Council to adopt specific regulations to control stormwater drainage on
development within the city,.

A general discussion of planning theory and land use law followed.
There being no further business to consider for the evening, D. Cooke
moved to adjourn. M. Hinkle seconded the motion.
