Hinkle J. Wayman C. Dickey D. Cooke G. Phillips L. George 1., Chair, M. Hinkle called the meeting to order at 7:35. 2. Roll was called and a quorum was declared present, 3. L. George moved to approve the minutes of the special meeting of May 28, 1981, as written. D. Cooke seconded the motion,, Aye: Hinkle, George and Cooke, Nay: None,, Motion carried 3-0-0. ZONING PUBLIC HEARING 4, Tulsa County Referral-CZ-27 - Y Mn Sokolos Staff presented the case history and the staff recommendation: The applicant request rezoning of a 2.5 acre unplatted tract from RE Residential Estate to CG Commercial General. The tract.: is located north and east of 86th Street North and Highway 169, across the street east from Owasso city limits, The property currently contains a barn, and is abutted on the south and east by vacant land zoned AC, West, across Highway 169 (Garnett Rd.) lies predominantly vacant CG Commercial land. To the north of the tract are five single family homes zoned RE; the home abut-- ting the subject tract faces the tract, The Comprehensive Plan indicates this area as low intensity residential. The property is located in special district 5 which is recommended for further detailed planning and enginer- ring due to the proposed realignment of Highway 169. (The realignment would cut through the eastern corner of the subject property). CG zoning is considered a high intensity use in Owasso. Although the tract is recommended for single family develop- ment the physical facts is of the existing and future land development must be considered. The subject tract fronts exist- ing CG Commercial property across the street. It is bounded on the east by the new Highway 169 right-of-way. The depth of the property on the south (outside right -of --way boundaries is only 300'). The tract does not appear suitable for development of new single family homes. The tract is large enough to meet zoning code minimum requirements for frontage and setbacks. Looking at the future development and traffic patterns of this area, staff recommends CG rezoning of the subject tract. Owasso Planning Commission minutes Page 2 .June 18, 1981 The applicant, Da M. Sokolosky spoke for the application stating that due to lack of sewer service, he had pursued rezoning in the county rather th.a:n an. -- nexai-ion and rezoning in Owasso, Don Morton, prospective buyer,, stated that sales service business that would h.a.ve. outdoor he planned to put:: _rr7. <�. boat ��ale � and storage of boats and a. Lest tank for the engines. Commissioners discussed i :.h.e pr :went and future land use patterns of the area. and the effect of Highway 169 construction to the east of the p-r.opert::y. D. Cooke noted his reluctance to make recommendations to create or extend strip commercial. development. Other commissioners noted that the :Canal use pattern in this area largely had been determined already. L. George moved to recommend approval of the CG rezoning. D. Cooke seconded the motion. Ayes Cooke, George and Hinkle. Nay: None. Motion. carried 3 -0 -0. SUBDIVISION REVIEW 5. Owasso Office Pare. Conditional Final Plat The applicant requested a continuance of this plat until_ the next meeting. The Chair set the plat:: for consid.era.tion at the July 16 meeting, V Elm Creek Estates First, ]docks 1-6 - Conditional Final Plat Staff presented the case history and the list of 'Technical Advisory Committee conditions: K Section 3,03412 and statement dedicating all easements. Z Section 3003413 add statement dedicating all streets and public areas not previously dedicated. 3. Add certification statements of owner and engineer. 4. Tie legal description to section corner or other easily identified point to correspond to legal description in dedication statement. 5. Section 206 zoning code, Lots must have minimum 309 frontage on public street. 6. Lots in an RS -3 district must have 659 frontage and a. minimum of 7000 square feet lot area, 7< Add planted Elm Creek subdivision. abutting; the southern boundary of the plat, and indetify by name other abutting subdivisions and unplatted lands. In Block 4, change 4 lots (lots 9-12) to three equally divided lots. 10. Add the following utility easements: K A 10' U/E immediately east and parallel to the drainage easement at the NW/c of the plat, & A 25' U/E that corresponds to the 25' front buLlding line on on Lots 11 through 17, Block V C. A 15' U/E that corresponds to the 15' side building line on Lots 20 and 21, Block 1. D. A 5' U/E along the northerly lot line of Lot 27, Block E. A 5' U/E along each side of the common lot lines separating Lots 7 and 8, Block 1; Lots I and 2, Block 5; Lots 11 and 12, Block 1; Lots 5 and 6, Block 5; Lots 8 and 9, Block 2, Lots 72 and 73, Block 2; Lots 10 and 11, Block 5; Lots 11 and 12, Block 2; Lots 13 and 14, Block 5; Lots 15 and 16, Block 2; Lots 17 and 18, Block 5; and Lots 59 and 60, Block 2 to form 10 utility easements,, F A 10' U/E along the east lot line of Lots 4 and 5, Block 4, and a 5' U/E along the west lot line of Lot 6, Block 4. V A 5' U/E along the west lot line of Lot 47, Block 2. H, A 705' U/E along the easterly lot lines of Lots 45 and 46, Block 2 and a 15' U/E along the westerly lot lines of Lots 19 and 20, Block 2, General discussion followed concerning lot sizes, tying in proposed streets to existing streets and the need to have construction plans submitted, L. George moved to conditionally approve the final plat subject to completion of all TAC conditions. D. Cooke seconded the motion. Aye: Cooke, George and Hinkle. Nay: None. Motion carried 3-0-0. Staff reminded the applicant that the plat would be scheduled for consideration by the city council when the TAG conditions have been completed, L. George and D. Cooke suggested the planning commission consider scheduling a work session for updating and further detailing of the comprehensive plan map to aid in making zoning recommendations. Owasso Planning Commission minutes Page 4 June 18, 1981. 7. Subdivision Regulations for Owasso, Oklahoma Staff reviewed the final draft of the Subdivision Regulations. The commission and staff discussed several modifications to the draft: 19 Sections 1.3.1 and 1.8.2 Change from 10 acres to 5 acres. 2. Specify in lot split section that a parcel may be split no more than twice without going through a subdivision or resubdivision procedure. 3. Leave out reference to erosion controls. 4. Sections 2.4.3.2, 2.503.3 and 3.3,6 Redraft to indicate one review procedure for construction plans rather than two 5. Section 2.7.3 Add language under what circumstances a lot split may be processed. Change 10 acres to 2k acres, 6. Section 3.2.1 Add that the cost of submitting names and mailing notices be borne by. the applicant. 7. Section 4.2.4.10 delete items 1- 4 under alleys. 8. Delete Section 5.1.2, 9. Section 2.2 Add recreation fee. 10. Section 5.7.7 add this section - All publically dedicated streets will be cleaned prior to acceptance of the streets by the city. 11. Section 5413.1 Rewrite to emphasize maintenance and delete reference to mandatory trees. I& Section 4.7 Amend the parks sections to incorporate the development fee and parkland dedication provisions of the Broken Arrow Ordinance W 766, Specify that funds generated from this development fee be put into a separate fund, and be kept fluid to be spent only on park facilities, land acquisition or maintenance. Specify the proposals for spending from this fund be reviewed and approved by the Owasso Planning Commission, Specify that if private recreational facilities are constructed in lieu of public ones, the City will not maintain those facilities. L. George moved approval of the Subdivision Regulations per the above modifications. D. Cooke seconded the motion, Aye: Hinkle, George and Cooke. Nay: None, Motion carried 3-0-0. City of Owasso Sion Ordinance Staff noted the city manager's letter of request to review and provide comments or), the proposed sign ordinance now pending before the city council. General discussion followed. Commissioners noted their support for further reasonable control of large business signs, mobile and flashing signs and other signs that could be hazards to traffic safety and aesthetics, They noted that some modifications of the ordinance restrictions for professional, church and yard sale signs should be considered. Commissioners were advised to forward their comments to the city manager and to be present at the city council meeting to discuss their. ideas. No action was taken, There being no further business to consider for the evening, D, Cooke moved to adjourn. L. George seconded the motion.
