OWASSO PLANNING COMMISSION MINUTES
Thursday, May 28, 1981, 7:30 p.m.

2. Roll was called and a quorum was declared present,,
3a L. George moved to approve the minutes of April 16 and May 21, 1981, as
written, D� Cooke seconded the notion.

Nay: None..
Motion carried 4-0-0.
LOT SPLIT ACCESS REVIEW
4, Lot 26B. Block 5, Tbreq Lakes - Charles NorL o.
Staff presented the case history:
The applicant wishes to locate two 20' drives onto Lot 266, a
CG commercial lot, rather than one 40' access that is usually ap-
proved by the building inspector The building inspector
referred this proposal to the Planning Commission for review. No
access provisions were specified at the time of the lot split.
There are at least three access points existing between the high-
way and the creek, which borders the subject property to the east.
The vacant lot to the north (shown on the aerial photograph) is
also zoned commercial and will require access as it is developed.
Charles Norton, the applicant, spoke supporting the request stating that he
needed the two accesses to channel the traffic coming to his building around
the sides of the building to the parking lot in the rear, Discussion followed
to clarify location of the building, the creek and an existing fire hydrant.
Don Cooke moved to approve two 20' accesses into Lot 26B, Block 5, Three Lakes
with one access to be located 5' from the west lot line and the other access
centered within the 35' between the creek and the fire hydrant along the east
property line. L. George seconded the motion.

Nay: None,
Motion tarried 4-0-0.
The commission decided to change the order of the items on the agenda, with
the consent of those present, to discuss item #9, Townhouse Ordinance.

5. Townhouse: ___-- An_Alternative Zoni=ng Category Lodi - Attached Single Fami
Housi.n2 and RTH Ordinance
Staff presented the proposed RTU Townhouse zoning districts ordinance and
the explanatory study. Staff and commissioners discussed the need for
this type of zone and various types of applications in rezoning land.
Several ciiizv ns made comments stating tte2 r concerns about keeping single
family homes in their neighborhood and the negative effects of intruding
apartments or duplexes. The commission discussed with the audience the
possible uses of townhouses in newly developing areas as well as in older
neighborhoods. Members of the audience equated attached single-family
townhouses with apartments and again expressed their fears over high
density residential development in the neighborhood,
Staff pointed out that townhouse zoning would allow approximately 12 units
to the acre, less than the 14 to 13 units per acre allowed in multi-family
(apartment) zoning, Staff and commissioners also re-explained that passage
of this ordinance would not rezone anyone's land, but would only allow
landowners to apply for RTH rezoning, as any other category-. Extensive
discussion followed.
L. George moved to approve the RTH zoning district as an additional.
district to the zoning code, Ma Hinkle seconded the motion. Discussion
followed, L. George stated that he was not in favor of RTH zoning in any
particular areas, but thought: that it was a viable alternative, and that
the city should allow it to be considered. Go Phillips stated that he
had not decided if an RTH zone was needed. Additional discussion followed.
The question was called,

The vote was 2-2- -0 and the proposed ordinance passed to the council without
a recommendation,
ZONING REVIEW

Staff reviewed the case history and the previous public hearing and referred
to the minutes of the previous hearing. Discussion with audience members
followed,
Mrs. Fry said she did not want the neighborhood chopped up and more housing
units added,
Mrs. Boyd wanted to keep the area residential and their property values up„
If this case were granted, she did not know what other property owners might
want,

Mrs. Wynn stated that she was worried about future developers continuing
a rezoning trend,
L. George moved to deny the RM-1 rezoning, D. Cooke seconded the motion. 1'"
George stated that the RM.-I was too high intensity for the area. and that he
did not support spot zoning,

7� 0Z-60 Lutheran Church - Missouri Synod - AG to RS3 and OL
Staff presented the case history and the staff recommendation:
The applicant requests rezoning for a parcel of land located
at the NWIc of 22nd Street and Garnett from AG agricultural. to
RS-3 single fami.ly (8.,62 ac,) an.d 01., light office (1.3 ac.).
The proposed uses are an office building on the OL a-ad a church
(NE 5 ac.) and single family homes on the remainder, The Compre-
hensive Plan recommends low -J.ntensiLy residential for this parcel.,
1.1wenty Second Street is fully constructed, with a divided entrance
(with one median cut) from Garnett, The new Hwy. 169 will be de
veloped to the east, so Garnett will- eventually revert to a local-
arterial status.
Although the Plan recommends low intensity residential uses for
this parcel, the physical facts of the area have some bearing.
The frontage property to the south of the subject parcel is zoned
CG commercial. general, the middle intensity commercial designation.
Commercial development is proceeding along this frontage from Stith
Street North northward, The OL zoning is considered a median in-
tensity use. The Plan states "_,.:tedium intensity uses are used as
transitional uses between high and low intensity areas." In this case
the OL land use could serve as a buffer between the high intensity
commercial and low intensity residential/church uses. The office and
church uses would also prevent further commercial strip zoning north-
ward to 96th Street.
Staff therefore recommends approval of RS-3 rezoning and an amend-
ment to the Plan to approve OL rezoning®
Church trustees, Mike Weiser and B. J. Honeycutt spoke for the application and
explained their potential plans for development: a Lutheran Church on the north-
east 5 ac., an office building on the southeast 1 ®3 ac, and single family homes
on the balance of the property similar to abutting homes on the west.

Cary Wollenburg spoke about existing traffic Problems on Hwy, 169 and his concern
about traffic and access on this pro-oerty� He also discussed water pressure pro=,
aggravate -1 would blems in th ' e area and concerns that any added residential development wou
those problems. Commissioner Cooke discussed his concerns about water
pressure in the area. Russell Smith stated that -no more homes should be built
on the hill until water pressure is imrroved, D� Cooke and john Edelman discussed
the distribution system, how Ator gets its water and what: improvements have been
made, Mr� Wollenburg stated that. he was riot against the church's plan, but felt
that the water problems should be solved first,
D Cooke moved to deny the R-S-3 and 0., -request, I George seconded the motion.
Discussion followed, D� Cooke noted that the church could be built]. on AG property
by going to the Board of Adjustment, without rezoningfl They could come back for
rezoning of the remainder of the tract later when the water situation is changed.
M, Weiser stated that they couldn's afford a 10 aee church site and needed re-
zoning to market and sell the land,
The vote was called:
Aye: Cooke
Nay- '.Hinkle and Phillips.
Abstain: George
The mot-ion to deny failed,
Ga Phillips moved to zone only the northeast: .5 ac, to RS-3. The motion was
withdrawn.
Discussion continued. L George was concerned with the pressure on the
planning commisssion to zone everything to RS-3. Ile felt they should consider
less dense zoning.
L. George moved to rezone the SE 143 ac. to OL, leave the NE 5 ac. as AG and
rezone the balance to RS-1a Da Cooke seconded the motion.
Aye: Cooke, George, Hinkle, and Phillips,
Nay: None.

8. -Owasso Office Park ---Conditional Final Plat
Staff presented the plat and discussed the TAC recommendations. Louis Levy,
representing the applicant, stated that they had no problem with completing
41 of the 40-plus TAC conditions. He listed several conditions he wished to
have waived or amended:
#14 Requests a waiver of submitting a site plan,

#21 Request a waiver on the final plat (this was a requirement
of the preliminary plat which was not completed),
# 5 Delete language specifying the type of storm drainage
facilities requested as this would be worked out with the
city engineer,
#43 Amend this requirement to eliminate improving the Reserve
A drainage area,,
# 4 Requests a waiver of completing Dogwood Street.,
Considerable discussion followed concerning the above items and completion of
other TAC requirements. L. George requested staff to ask the city manager for
a legal opinion from the city attorney as to whether the apartment drive is a
"public" extension of 4th Street.
L. George moved to continue consideration of this plat to the June 18, 1981
meeting, D. Cooke seconded the motion.

Nay: None.

COMPREHENSIVE PLANNING
9. A795 Reivew - U.S. Post Office Site
Staff presented the case history and the staff recommendation:
The Holred States Postal Service has proposed a new post office site
northeast of 86th Street North and Cedar. A post office is included in
Use Unit 2, Area Wide Exception Uses, which is a use by right on this CG -
commercial general property. The property has been platted; however, a
lot split may be necessary for this parcel if only a portion of the lot is
bought for the post office. The property is not located within the limits
of the 100-year flood limit shown by the preliminary Flood Insurance Study
maps of Owasso.
Staff recommends approval of this A-95.
L. George moved to approve the A-95. D. Cooke seconded the motion.
Aye: Cooke, Phillips, George and Hinkle.
Nay: None.

Due to the lateness of the hour, this item was continued until the June
meeting,
