Simons C. Dickey G. Phillips J. Wayman 1. Chair M. Hinkle called the meeting to order at 7:40, 2. Roll was called and a quorum was declared present, 30 J. Wayman moved to approve the minutes of December 189 19809 as written, G. Phillips seconded the motion,, Aye: Phillips, Hinkle and Wayman, Nay: None. Motion carried 3-0-0. LOT SPLIT REVIEW C OLS-21 Pat Larkin Staff presented the case history and the staff recommendation. The applicant seeks a lot split for Lot 99 Block 29 Three Lakes Village because the existing structure was inadvertently built over the Lot 10 lot line into Lot 9. The lot split would not affect the rear 15 foot utility easement. The existing structure infringes approximately six inches upon the 785 foot utility easement along the south of Lot 9. Staff recommends approval of the lot split subject to granting an addition- al .5 foot utility easement along the north side of the existing easement running along the south of Lot 9. Staff related that since none of the utility companies required the addi- tional 95 foot utility easement in Lot 99 she was deleting that portion of the staff recommendation. Pat Larkin spoke for the application and answered commissioners' questions. George Phillips moved to approve the lot split, J. Wayman seconded the motion, Aye: Wayman, Phillips and Hinkle, Nay: None. Motion carried 3-0-0. Owasso Planning Commission Minutes January 159 1981 Page 2 ZONING PUBLIC HEARING 5. OZ-57 CI-1e Johnson - AG to CC Staff presented the case history. Mr. Norton, one of the applicants, spoke for the application explaining that he wanted to locate his cable-laying business there and that that type of business would cause less traffic than other commercial businesses. Billy Hughes added that rezoning the subject parcel would "line up" the commercial zoning boundaries on the north (even, Frith Big C Lubber) and an the west (even with the Wal Mart property to the south), Staff presented the staff recommendation. The applicant requests rezoning for an 100' x 660' parcel from AG to CG. The parcel is located north of 116th Street North, west of Big C Lumber company. This parcel was part of a larger zoning case (OZ-45) in May, 1979; the parcel was part of the zoning re- quest for CS (lesser intensity than CG) which was denied, The Comprehensive Plan recommends residential land use for this area. The previous staff recommendation (OZ-45) supported a total of ten acres commercial zoning (CG and CS) surrounding the existing church. Staff recommended denial of additional rezoning westward because it was not in conformance with plan policies of no more than ten acres medium intensity land use at corners of primary- secondary arterial intersections and because of the pressures for additional commercial rezoning west of this area that this would create. Staff still supports this recommendation and recommends denial of OZ-57 to rezone the subject tract to CV V Phillips asked what kind of business was proposed. Mr. Norton said he wanted space to store his cable-laying equipment, an office and a retail outlet, Additional discussion followed. G. Phillips moved to deny CG rezoning. Wayman seconded the motion. Discussion of the motion followed. Clyde Johnson stated the he thinks that this type of use would be the most compatible with the existing lubber yard. Commissioners asked what type of development was planned for the balance of the five acres west of Big C Lumber as well as other abutting property owned by the applicant. Mr. Johnson replied that there were no firm plans yet. Representatives of Westport Addition, vest of the application, asked when the property was annexed and how much of the area was currently in the Owasso City Limits. The motion was called for a vote. Aye: Phillips and Wayman. Nay: Hinkle, Motion carried 2-1-0. Owasso Planning Commission Minutes January 15, 1981. Page 3 14. Johnson asked why commissioners voted to deny the application. C. Phillips stated his concern for additional commercial rezoning requests to the west and that he thought that this was not in conformance with the plan and future residential development in the area, Staff reminded Mr, Johnson that he could appeal the recommendation to the City Council. Mr. Johnson wrote out an appeal letter to be transmitted with the minutes and the case material to the City Council for public hearing, 6. Request to Waive Subdivision Plattina Reauirement on OZ-57 Because OZ-57 was denied, the Commission took no action on the request to waive the platting requirement. COMPREHENSIVE PLANNING 7. Subdivision ReRulations This item was continued to the end of the agenda in order to hear all items which had persons present to represent them, 7A. Request for Annexation - Freewill Baptist Church Staff gave the case history (petition attached to these minutes) that the church had a Board of Adjustment action pending with Tulsa County for the portion of the church property located within Tulsa County (the existing church lies within Owasso). The church was advised to seek annexation to Owasso in order to deal with one governmental jurisdiction in further development of the church. They plan to expand the church building, parking, and eventually open a day care center, Rev. Pirtle spoke for the application. Staff gave the staff recommendation: The applicant requests annexation of a 2.04 acre parcel immediate- ly west of the existing Freewill Baptist Church at 708 North Atlanta. The Comprehensive Plan recommends this area for low intensity residen- tial land use - church use would also be compatible within this designation® Annexation of areas within the fenceline contiguous to the city, where urban level services can be extended, is supported by the plan. This area can be served by city utilities and services. Staff supports the annexation of this parcel, With this annexation all of the church-owned property would be within one governmental jurisdiction® The church could then follow the City of Owasso's procedures and requirements for development, The property would be annexed as AG (Agricultural) zoning in accordance with Section 11003 of the Zoning Code. Applications for rezoning would be reviewed separately by the Planning Commission and City Council. Owasso Planning Commission Minutes January 15, 1981 Page 4 Commissioners asked questions to clarify the location of the property and to assure that Owasso would be the jurisdiction to supply all necessary public sewers, G. Phillips moved to approve the annexation, Aye: Wayman, Hinkle and Phillips,, Nay: None, Motion carried 3-0-0. 8. -New -Bus -Iness - Westport Annexation J, Wayman seconded the motion, Representatives from Westport Addition, Donald Wright and Daniel and Mary Giuseppone, expressed interest in Westport being annexed into Owasso, and asked questions about the application procedures. They were advised of the annexation process and were referred to the City Clerk for processing their petition,, 9, -Subdivision Regulations The first three articles of the final draft of the Owasso Subdivision Regulations were reviewed and discussed. Staff answered questions regard- ing the subdivision platting process and the way platting relates to zoning, Several questions were asked about specific sections, and changes and ad- ditions from present regulations were noted by staff Commissioners agreed to hold approval of the first three articles until the entire final draft had been reviewed. The remaining sections are scheduled for review at the February meeting. There being no further business to conside for the evening,G. Phillips moved to adjourn. J. Wayman seconded the motion.
