Phillips moved to approve the minutes of November 209 19809 as written. J. Wayman seconded the motion. Aye: G. Phillips, Mn Hinkle, and J. Wayman Nay: None Notion carried 3-0-0 SUBDIVISION REVIEW 4. Clark Plaza Fourth - Final Plat This item was continued to later in the meeting because no one was present to represent the plat, ZONING PUBLIC HEARING 5. 0Z-55 D. M. Sokolos Staff presented the case history and the staff recommendation: The applicant requested CG zoning on a five acre parcel of land south of 86th Street North, west of 129th East Avenue. Currently there is twenty acres of vacant CG - zoned land approximately 400' to the east of the subject tract and additional vacant land zoned CS to the north of the twenty acres. There is a parcel of vacant land zoned low intensity office to the northeast of the subject tract. The tract is abutted on the east and west by existing churches. The Comprehensive Plan indicates low intensity resi- dential land use for this tract, The Plan indicates Type 2 Activity Centers at three corners of intersection of 86th Street and 129th which will accommodate medium intensity office or commercial development. The Plan shows low intensity public use (indicating the church) west of the activity center. Owasso Planning Commission Minutes Page 2 December 18, 1..980 The Comprehensive Plan and Developmental Guidelines recommend commercial/office uses at the intersections of arterials, and not along the interior portions of arterials. This creates a "strip commercial" situation and detrimental, effects to surrounding lower intensity residential and public (school, church, ere.) development, as well as traffic along the arterial. A low-intensity buffer has been created west of the 86th Street/129th East Avenue activity center with the existing church. Staff recommends support of the Comprehensive Plan and denial of the CC rezoning, Mr. Sokolosky spoke in the CC zoning to build and eventually, a full cussed the application church and residential uses along 86th Street traffic and curb cuts other commercial areas favor of the application stating that he wanted a convenience store with gas station,a car wash, strip commercial center. The Commission dis- concerning location of commercial uses among uses, the possibility of having strip commercial from 1-169 to 129th East Avenue, increased along 86th Street North and the availability of in the near vicinity, G. OZ-56 Leroy Tremain and Request to Waive Subdivision Platti requirement Staff presented the case history and the staff recommendation-, Applicant requests rezoning of an approximately 075 acre + parcel on 99th Street North west of Garnett to RS-2. The area is an unplatted parcel currently outside the Owasso City Limits, This application is contingent upon the property being annexed into Owasso. The Comprehensive Plan recommends low intensity residential land use for this area, The application would be in accordance with the Plan, and staff re- commends approval. The applicant also requests a waiver of the sub- division platting requirement required by Section 260 of the Zoning Code. The property already has 25' of Owasso Planning Commission Minutes Page 3 December 18, 1980 rigbt-of-way dedicated for a street. It is served by existing water and sewer lines, and would only need taps rather that utility construction plans. There is no recreation land dedication requirement. The pro-, posed four lots would meet all the RS-2 bulk and area requirements. Because of these factors staff would recommend a waiver of platting requirements and approval. of a detailed site plan by Owasso staff instead prior to issuance of building permits. The site plan should show compliance with all RS-2 bulk and area and bearings on the drawing and accompanying legal descriptions. The applicant should obtain approval letters from all utility companies indicating that utility easements are adequate. Commission members discussed the effects of allowing a site plan to serve as the platting requirement for this particular parcel. Mr. Tremain spoke in favor of the rezoning and the plat waiver. The Commission stated <.tgain that the entire 99th Street area should be annexed into the City. G. Phillips moved to approve the rezoning to RS-2 contingent upon the parcel being annexed into Owasso. Phillips moved to approve the waiver of the subdivision platting requirement subject to a site plan approval as per staff recommendation. J. Wayman seconded the motion, Aye: C. Phillips, J. Wayman, M. Hinkle Nay: None Motion carried 3-0-0 L CZ-3 Referral - Steven Clark Staff presented the case history, Dr. Clark and Joe Caudle spoke in favor of the application. Dr. Clark stated that he intended to build a shopping center in the future and wanted to locate ministorage on the rear of the property now. He also stated that he owns property immedi- ately to the north and east which he does not intent to develop. Staff presented staff recommendation: The applicant requests rezoning of twenty acres from AG to CS commercial, located southeast of 116th Street North and Highway 169. This application was amended from an IL request to CS. The property is surrounded on the north, east and south by predominantly vacant land zoned AG, To the west is a strip of predominantly vacant land zoned CG (within. Owasso's City Limits). The Comprehensive Plan for Owasso Owasso Planning Commission Minutes Page 4 December 18, 1980 recommends medium intensity office/commerical land use for the frontage of the subject property for approximately 450 feet east from the centerline of Garnett Road (Highway 169). The Plan recommends rural residential intensity residential land use for the remainder of the property. The Plan recommended a strip of ccommerc ia.l develop-, ment along Garnett Road because of the existing situation of strip commercial zoning on the west side of Garnett to Hale Acres. The intent of the Plan and the Developmental.. Guidelines is to concentrate medium and high intensity commercial and office land uses in Activity Centers at the intersections of arterial streets, Development of a twenty acre commercial area one quarter mile south of the inter- section would increase pressures to continue strip zoning, increase traffic problems on an already over capacity road- way, and adversely affect development of residential neigh-- borhoods in the interior of the square mile. The developmem of the new Highway 169 interchange Q mile east on 116th Street North will also increase pressure for additional.. commercial development in the interior of that square mile. Staff, therefore, recommends approval of CS zoning along the frontage of the property a distance 450 feet east from the centerline of Garnett Road and denial of CS zoning on the remainder of the property. Commissioners discussed alternatives to approving 20 acres to commercial, Dr. Clark indicated that he was most interested in the minisLorage at the rear of the property. Staff reminded the Commission that this would be strip zoning and would still increase pressure for additional commercial zoning in the area. C. Phillips moved to approve CS zoning on the property as follows: * 250' wide strip along the North side * 450' wide strip (from the centerline of Garnett) along the west side and denial of CS zoning on the remainder of the property, J. Way-juan moved approval and G. Philli Owasso Planning Commission Minutes Page 6 December 18, 1980 of building codes, housing codes, and zoning codes, a site development plans review, for compliance, is established as follows. 1. The petitioner or developer shall submit to the Planning Commission a Site Development Plan for the multifamily development showing a unified and organized arrangement of buildings, off-street parking, points of egress and ingress, internal traffic circulation and service facilities, which is feasible with the property on which the multi- family development on the properties surrounding the pro- posed development. The plan must contain information showing compliance with the requirements of this section and chapters, and all other applicable city ordinances. The Commission discussed the apartment complex and expressed some concern that the lot dimensions on the application were not accurate. They ex- pressed interest in seeing the stie development plan for review. G. Phillips moved to approve staff recommendation and to forward. these coJ.,frf,)eJ:).ts to INCOG. J. Amendment to the Comprehensive Plan Staff presented the case history and the staff recommendation- The City of Owasso requests an amendment to the Com- prehensive Plan to include two full grade separation inter- sections along Highway 169 located on 96th Street North west of 129th East Avenue and on 129th East Avenue north of 96th Street North. The proposed highway cuts through an area of future prime residential and commercial development for Owasso, effectively cutting the city in two pieces at 96th Street North or 129th East Avenue. The City is planning to locate an emergency services center south of 96th Street North just west of Highway 1690 This is the most effective location for a combined police - fire - ambulance station to serve the northern and eastern portions of the city. The station's effectiveness and response times will be greatly reduced if the emergency vehicles can- not have complete access to areas of the city east and north along those two arterials. Owasso Planning Commission Minutes Page 7 December 18, 1980 Staff recommends this amendment to the Comprehensive Plan and a formal request by the City Council to the State Highway Department to amend the highway plans to include the two full grade separation intersections on Highway 1690 Commissioners discussed the importance of full access for this area of the coinman.!.Ly, citing the future growth potential and the value of an emergency services substation at this location,, J, Wayman moved to amend the Comprehensive Plan per staff recommendation and to forward these comments to the State Highway Department. Request for Annexation - Section 21-21-14 Staff presented the case history and the staff recommendation: Staff requests the City of Owasso to pursue annexation into Owasso of the square mile of land northeast of the Owasso High School at 86th Street North and 129th East Avenue. The Comprehensive Plan recommends this area for low intensity re- sidential land use with activity centers on three corners, The Owasso High School stands on forty acres on the forth corner, Annexation of areas within the fenceline contiguous to the City, where urban level services can be extended, is supported by the Plan. The area can be served my municipal utilities and services, just as the High School is now, There is pressures for urban. development in the Elm Creek watershed area. It is a logical. extension of the City. Annexing it as rural land can ensure that future development will be to the standards of the rest of the City., Staff supports the annexation of this square mile area, The property would be annexed as AG (Agricultural) zoning in accord- ance with Section 110 ®3 of the Zoning Code. Twenty-eight acres of the area is currently zoned RE (Residential Estate) in Tulsa County. Staff recommends that at the time the area is annexed, the City would initiate an administrative rezoning for that parcel to RE within Owasso to spare property owners the expense of an identical rezoning. Other applications for rezoning would be re- viewed separately by the Planning Commission, Commissioners discussed the implications of annexation for property owners and for the City. Subdivision regulations for Owasso, Oklahoma Due to the lateness of the hour, the review of the draft of the Sub- division Regulations wa8 continued until the January 1981, meeting. INFORMATION ITEMS 13. Elray Stevens Resignation Letter Staff presented Elray Stevens' letter of resignation from the Planning Commission, The Chair directed staff to draft a letter of appreciation for Commissioners to sign at City Hall and to forward the resignation to the City Council for action. 14. Zoning Referral Procedures Staff presented memos outlining the new TMAPC procedure on reviewing Tulsa County zoning cases for the Commissioners' information. 15. New Business - Informal discussion of OZ-57 The applicants for the upcoming zoning case OZ-57, Charles Norton and Billy Hughes, requested time to discuss their case, understanding that since the case had not completed all required publication notices the Commission could not take any action on the case. Charles Norton described his property and stated that he wished to put a warehouse and office on property to the west of Big C Lumber on 116th Street North. Staff presented the Commission a map of the area and a copy of a previous staff recommendation made a year ago when this property (within a larger application) was denied commercial zoning. Consider- able discussion followed. The Commission indicated to Mr. Norton that while they couldn't make a decision, they felt that his case had enough merit that he should pursue the rezoning application which would be heard at the January meeting. SUBDIVISION REVIEW 16. Clark Plaza Fourth - Final Plat Staff presented the case history and the list of Technical Advisory Committee recommendations, The applicant was not present. Staff Owasso Planning Commission Minutes Page 9 December 18, 1980 indicated that the applicant had completed all requirements except approval of the following. 1a paving and drainage plans 2. restrictive covenants and amendments 3, sewage disposal method V building pad elevations 5, sidewalks V traffic circulation and site plan. 7. mutual access agreement for Lots 1 and 2 Staff indicated applicant was in the process of completing these last items. Staff presented the applicant's revised site plan - traffic circulation plan for the Clark Plaza Fourth lots having building and parking layout and how traffic would be handled within the lots and onto the street and surrounding property, Staff noted that recommendation 9 should be reworded to read, that Lots I and 2 shall retain mutual access rights V Phillips moved to conditionally approve the final plat for Clark Plaza. Fourth subject to completion of all TAC recommendations and the revision. of TAC recommendation 9 to read, "... that Lots I and 2 shall retain mutual access rights ..." J. Wayman seconded the motion.
