ZONING PUBLIC 1JEARING /i, OZ-45 Jim Butler Staff presented case report and history. Chairman asked if there was any- one present wishing to speak in favor of request, J.Lm Butler explained he was the applicant seeking approval- of the zoning request. Chairman asked if there was anyone in opposition to the request. Residents to the west of the parcel proposed for rezoning expressed concern for any commercial. road abutting their residential homes on the east side of the A.T. & S.F. Railroad, for reason that their residential properties would devalue. A petition was submitted with 42 signatures opposing the rezoning, Applicant assured residents 'living to the west of the subject parcel that he plans to buffer their residential area from the proposed commercial with additional low to medium intensity residential development. Representatives from the German Church expressed concern about trash from the proposed lumber yard to the west. Staff noted that the proposed lumber yard (CG parcel) and any CS parcel is required to have screening per zoning ordinance, when it is abutting a residential district. Church representa- tives expressed they could support the zoning request if effective screening was provided. Chairman asked for Staff's recommendation, which was given as follows: (SEE ATTACHED) OZ-45 STAFF RECOMMENDATION May 17, 1979 Normally Staff could support 10 acres of medium intensity development with a general configuration of 660' x 660' at the northwest corner of 116th Street North and Garnett Road, This is what the Comprehensive Plan indicates. However, due to the existing location of 905 acres (482' x 853') of low intensity use involving church activities directly at the northwest corner of the inter- section, Staff could support the following-., 1. The 5 acre parcel of CG Commercial General just to the west of the church property, having a frontage of 330' on 116th Street North. The proposed use for this parcel is for a lumber yard ((1se Unit 15). This frontage of 330', plus 853' of frontage which is church property, would place the westernmost boundary of this proposed commercial parcel 1183' from the intersection. Staff could support this 5 acre CG parcel because of the existing 1320' of commercial frontage directly across from this parcel; and, while extending outside of the desired 660' medium intensity frontage from the intersection, it will not result in more than 10 acres of overall medium intensity (commercial) zoning at the northwest corner of this intersection, There exists 1320' of commercial frontage from the intersection west on 116th Street North on the southside of the road. The Comprehensive Plan shows 660' of this existing commercial with the remaining 660' to be down- zoned to low intensity residential, Staff feels that an amendment to the Comprehensive Plan is in order, indicating commercial land use stopping at a point 1320' west from the intersection of 116th Street North and Garnett Road on either side of 116th Street North, except for 853' of low intensity development on the north side of 116th Street shown as public and quasi- public land use. This would take into consideration the existing zoning as well as establish future policy to prevent further strip commercial and related traffic problems along 116th Street North. E A 5 acre parcel of CS Commercial Shopping zoning beginning approximately 482' north from the intersection on Garnett Road with a frontage of 660' and a depth of 330'8 The Comprehensive Plan indicates 660' of medium intensity land use frontage north from the intersection of 116th Street North and Garnett Road® The existing low intensity use (church and City of Owasso) has 482' of frontage from said intersection along west side of Garnett Road. This allows for a possible 188' of medium intensity development along Garnett, However, due to the existing low intensity use of 9.5 acres at the north- west corner of the intersection, Staff could support a five acre parcel of commercial along Garnett Road with a frontage of 660' and a depth of 330'0 .OZ -45 Staff Recommendation {coast® This would result in Staff supporting no more than 10 acres (two 5 acre parcels) of commercial zoning overall. Except for not following the desirable dimensions of medium intensity land use (660' x 660') at this corner as indicated in the Comprehensive Plan, it would be in conformance with the Comprehensive Plan for allowing no more than 10 acres of medium intensity land use at each corner of the intersection of 116th Street North and Garnett Road. Staff cannot support rezoning to commercial, the remaining parcels (a 5 acre parcel of CS west of the CG parcel, and a strip of CS, 178' x 5238 , bordering the church on the north) for the following reasons : E The 5 acre parcel of CS Commercial Shopping along 116th Street North lies outside the boundary of the 1.320' commercial frontage existing on the south side of 116th Street North. To allow this parcel to be rezoned commercial would result in additional pressures for commercial zoning along 116th Street, Plus, it would be difficult to establish policy identifying where boundaries for medium intensity development should be to prevent further strip commercial zoning, Z The 2 acre strip of proposed CS land (178' x 5238) bordering the church on the northwest would present a definite problem should the church need to acquire additional land for expansion. Plus, Staff feels this parcel could better be utilized as residential property combined with the undeveloped property to the north, with residences backing up to the church property. In summary, Staff could support two 5 acre parcels of commercial - one directly to the west of the church and the other directly to the north of the church with the balance of the requested zoning remaining as AG Agricultural District till such time as adequate sewer and water is available to support residential develop- ment for this area. Stevens seconded motion, FOR: C. Carr, L. George, M. Hinkle, J, Simmons, E. Stevens AGAINST: None Motion passed: 5-0,, SUBDIVISION PLATS 5. Amended Plat of Lot 26, Block 5, Three Lakes Addition - Preliminary Plat. Staff presented plat and stated conditions that needed to be met before final plat approval. The conditions were indicated in the subdivision checklist, Developer explained to the Commission that it is planning duplexes and four-plexes for the site. After general discussion, C. Carr made a motion to approve preliminary plat, subject to conditions stated in the subdivison checklist. M. Hinkle seconded motion. FOR: C. Carr, L. George, M, Hinkle, J. Simmons, E. Stevens AGAINST: None Motion passed: 5-0. 6. Because of the vacancy left by past Planning Commission Chairman A. Lambert, Commission members voted to re-elect officers to fill vacancy, Jv Simmons made a motion to elect Co Carr as Chairman. E. Stevens seconded motion. FOR: L. George, J. Simmons, M. Hinkle, E. Stevens AGAINST: None Motion passed: 4-0. Because the election of Co Carr as Chairman affects the other offices, elections for vice-chairman and secretary were also held. J. Simmons made a motion to elect L. George as Vice-Chairman. M. Hinkle seconded motion, FOR: Co Carr, Mn Hinkle, J. Simmons, E. Stevens AGAINST: None Motion passed: 4-0. C.
