A request for a Variance of the Owasso Zoning � ode - Section `730, uulk and Area Requirements in Industrial. Districts to allow for the development of an industrially zoned property with less than the required 75 foot setback from abutting residential property. The subject property is described as sots d & 7, Block 1, Three Lakes Industrial park 11, Mr. Looney presented the staff report. The applicants are requesting; a Variance to allow for the development of an industrially zoned property with less that the -required 75 foot setback from abutting residentially zoned property, Section 730 of the Owasso Zoning Code requires a 75 foot setback frorn abutting; AG, R, or O districts when developing within IL,, IM, or ILI zoning districts. The subject property is at the end lot of a cul- de-sac and contains unusually a small dimensions on the east and northwest sides. When one applies the 75 foot setback requirement, as well as the 25 foot front building line, the applicants find themselves with an extremely limited area on the lot which they can locate a building. Application of the ordinance, the requirement of a 75 foot setback, would leave the applicant with a very small developable area, The shape of the property, and its limited dimension on the northwest and eastern side, is a peculiar condition. It would also appear that granting of this variance would not be a detriment to the public good. AYE: Imbriano, 1=loudyshell NAY Tapp RECUSE `dines ';Fhe motion carried 2 -- l a, OBOA ­941- _1 ozrtir art_ :' c r LtiQgj, 4.). - A request for a Variance of the Owasso Zoning Code, Section 430, Bulk and Area Requirements in Residential Districts to allow for deviations in front and rear yard setbacks in an RS -2 (Residential Single-Family Medium Density) zoning district, The subject property is described as various lots within the Camden Park 11 Addition, Mr. Rooney presented the staff report. T'he applicant is requesting; a Variance From the Board of Adjustment in order to allow a lesser setback on certain lots within the proposed "Camden Park :11„ Addition. The rnain reason for this development challenge can be directed to the Zoning Code itself, Most subdivisions that developed within the 70's and 80's, the time fra-me in which the Owasso 'honing Code was created, were RS 3 (High Density) zoned. This type of zoning would be found through Double Oars, Elm Creek, El Rio Vista, Old Town Owasso, and Copper Meadows, It has only been recently (within the last 3 years), that RS- -2 development has been occurring within Owasso (Windsor° Lake I & 11, Camden Parr, Barrington Point) and the setbacks of that district have come into question. Typically, variance requests in setbacks occur at the time of building permit application when a property owner realized that the actual building pad is not large enough to accommodate their predetermined house plan. Often times, this results in the Board of Adjustment hearing cases within the same residential area for 5 or 10 foot setback deviations, Terri Floudyshell moved to approve the request for the Variance, seconded by Vicki Tapp, AYE: Iloudyshell, 'Tapp, `Mines, lmbriano NAY: done The motion carried 4--0 5.
