The reading of the minutes of March 20, 1985 was dispensed with due -to the fact that board members reviewed copies sent in the mail., C,., Adams moved approval of the minutes as written,, I Trammel seconded the motion,, Ay e Borgna, Adams and Trammel,, Nay: None. Motion carried 3-0-0. PUBLIC HEARING 4, OBOA-81 - Central Baptist Church Chairman Borgna reviewed the case history and the staff evaluation. The applicant, Central Baptist Church, requests a Special Excep- tion to allow a church use on a lot zoned RM-1, The church wishes to demolish the existing sanctuary and build a -larger one on the same site. The lot is located at the SE/c of Birch and 2nd Street, The church owns five of the six lots in the block. The tract is surrounded on the west and south by homes zoned CH and RM--I, re- spectively, To the north are additional homes zoned RS-3 residential, A church is permitted by Special Exception in an RM-1, (apartment) zone. The existing church has been located on the property for many years. The TAC had no negative comments or requirements on this application. A church can be considered compatible with residential use in some circumstances. The church has adequate area for parking and access to two public streets, The site plan for the church has been reviewed as a part of OBOA-82, a variance. Staff has no negative comments to make regarding this application. Bob Atwood and Terry Parker, representing the church, were present to answer questions from the Board. The applicant, Central Baptist Church, requests a variance from the side yard setback abutting a public street from 15' to W on a lot zoned RM­L, The church wishes 'to demolish the existing sanctu- ary and build a larger one on the same site 'The -lo-t 'is 'located at 'the SE/c of Birch and 2nd Street. The church owns 5 of the 6 lots in the block, The tract is surrounded on the west and south by homes zoned CH and RM-1., respectively. To the north are additional homes zoned RS­3 residential, There -is an application pending to close and vacate the north 5,,5' of the west 100' of the platted alley in the subject block because the church also wishes to extend the new building into the alley. The church wishes 'to build the building -to the property line on the west side of the lot,,, The street right-of­way on -that side (Birch Avenue) has a larger right­of-way than normal (75') rather than 50'. The centerline of the existing 26' street lies approxi - mately 37,,5' west of the property line, leaving approximately 24.5' of right-of-way between the street and the property line. City of Owasso ordinances and state law state that three criteria must be present to grant a variance- a., By reasons of extraordinary or exceptional conditions or circumstances which are peculiar to the land, structure, or building 'involved, the literal enforcement of the terms of the code would result in unnecessary hardship. b. Such extraordinary or exceptional conditions or circum- stances do not apply generally to other property in the same use district. c. The variance to be granted will not cause substantial detriment to the public good or impair the purposes, spirit, and intent of the code, or the comprehensive plan, City and state provisions for a variance as well as recent Supreme Court decisions require showing a hardship "peculiar" to the land, structure or building involved (that doesn't) apply to the other property in the same use district, The Board would consider whether there are "exceptional or extraordinary conditions" present relating to the property in deciding this variance, If the Board determines that a variance is appropriate, there are a few site requirements to be met: Owasso Board of Adjustment Minutes May 29, 1,985 Page 3 L, There should be a minimum of one parking space for each 40 sq., ft., of sanctuary space. All parking to serve the beai l d� rig should be paved,, 3,> All parking spaces should be 10' x 2C ` <, Handicapped spaces should be 1.2' x 2' and so ria.rked on the surface and with a sign Bob Atwood, pastor, explained the request stating that -the church had to build the new building to the property line on the west because there was nowhere else to build. The alley and utility lines were on the south, the existing educational building was on the east and because of -the location of that building they had to attach the proposed sanctuary _in the requested location, To build farther to the north would make the sanctuary too wide to be usable. He stated that the proposed building would pease no inter - ference with the existing street or, sidewalk,, Board members discussed in detail the design of -the building and the lot and reviewed the parking re- quirements. Board members asked several questions of applicants and staff,'.
