Motion carried 3 -04, PUBLIC HEARING ri,,, OBOA -79 and OBOA -80 Apple Homes Chairman Borgna reviewed the case history and the staff eval uatli on: The applicant requests a Variance and a Special Exception to allow placement of a temporary office structure (an Apple Modular home) on a commercial lot zoned CS,, The lot is located north of the northeast corner of Garnett (FIm 169) and 113th Street North, a part of German Acres subdivision, The lot is now vacant and is surrounded on the south and west by commercially zoned lots, To the north lies vacant AG land, To the east lies a mobile home park zoned RMH, The applicants request a Special Exception from Section 610 under Use Unit 2 to allow a temporary office structure in a CS district. They also request a Variance from Section 1120, off - street parking requirements, to allow a gravel parking lot rather than a paved lot since the office building will be temporary, They state that this office is not intended as the final development of the lot, A temporary office structure can be allowed by a Special Excep -- tion if the Board feels that this request meets the requirements for an Exception. A Variance may be granted if the applicant can show that the application meets the three statutory requirements for approval of a Variance, These requirements are listed on the new Variance form. Because of the change in law, the Board will have to cite in the minutes the evidence that the application meets each of the three requirements Owasso Board of Adjustment Minutes March 20, 1985 Page The Technical Advisory Committee did not have specific require- ments of the site plan. Trash pickup would be handled with a poly cart to prevent trash trucks from having to drive on the gravel. Any storm - water drainage plans should be reviewed with the city engineer. All utilities are available fora hookup,, If the Board grants 'the exception, a time limit should be placed on the build- ing, such as 5 months or a year,, and a requirements made that any extension of time would have to be granted through another appli- cation to the Board Harold Sexton, applicant, explained his office concept and why he was seek-- ing temporary permission for the structure. Board members discussed both the variance (OBOA -I9) and the special exception (OBOA -80) requests at the same time since they concerned the same property, The chairman discussed the details of the requests and asked several questions. Mr. Sexton showed pictures and elevations of the office building. A time limit of 6 months was suggested and Sexton indicated that would be no problem since the pro- perty was for sale. City Manager Galloway commented that his office would let questions from the handicapped as to why the City would allow a building with gravel parking and no handicapped access if the application were approved as presented, wilding Inspector, Condray requested that the gravel parking ..lot request be denied due to problems of utility and city vehicles driving on the site and of other properties not paving their lots, He also stated that for the size of the building a minimum of two parking spaces would be needed, one of those to be a handicapped space. Aye: Helm, Adams, Trammel, Eckel and Borgnam Nay: None® Motion carried: 5 -0 -0a Owasso Board of Adjustment Minutes March 20, 1985 Page 3 of the code of the City of Owasso or the Comprehensive Plan of the City of Owasso, because the commercial lot is surrounded on three sides by commercial zoning and, the use being temporary in nature, the lot will be developed to city standards when a permanent commercial business is located there, The conditions attached to the motion were: L Approval of the variance is limited to twelve months to run with the OBOA-80 approval, 2, Access drive widths will be limited to the limits-of-access shown on the plat. S. Applicant will provide a hard surface for the driveway entrance, adequate driveway and turn space and a minimum of two parking spaces - one, 10' x 20', the other 12' x 22' and labeled as a handicapped space, C. Adams seconded the motion, Aye: Helm, Adams, Trammel, Eckel and Borgna., Nay: None, Motion carried 5-0-0,, There being no further business to consider, R. Helm moved to adjourn the meeting. L.
