MINUTES OF REGULAR MEETING
Tuesday, June 24, 2014

The meeting agenda was posted at the north entrance to City Hall on the 19th day of June, 2014 at
11:00 AM.

3. Approval of Minutes from the May 27, 2014 Regular Meeting — Dean Knoten
moved to approve the minutes of May 27, 2014 regular meeting, Brad Boyd seconded the
motion to approve the minutes.
AYE: Bausch, Knoten, Boyd, Jacobs, Ramey
NAY: None
The motion carried 5 -0.
4. OBOA -14 -05 — Variance. Ron Staggs — Consideration and appropriate action related to
a request for approval of a variance to allow a front yard setback be changed from 25 feet
to 20 feet on Lots 1 - 10, Block 4, Keys Landing subdivision.
Joe Ramey presented the item and Karl reviewed the staff report. Karl described the
property location. This request is to allow for a reduction of the front yard setback from
25 feet to 20 feet due to the lots being encumbered by the 100 -year floodplain.
Letters were mailed to all property owners within three- hundred (300) feet of the subject
property and the request was advertised in the Owasso Reporter. Property owner Ron
Staggs was present to answer any questions. Staff recommends approval of OBOA 14 -05
with the following condition:
Each lot shall be required to have an individual flood plain development
permit signed off by the City Engineering Department prior to issuance of
a building permit.
Below are comments made from several surrounding property owners expressing their
concerns regarding storm water:

Scott Rutherford — (12112 East 74 Street North) — He is against the approval of this
variance. Handed out pictures of the area from a flooding in 2008. The problem has
improved since the dirt was removed and we don't want it back. Feels that criteria #3 has
not been met, it will be a detriment to the public good. Has concerns regarding fences
being built in the flood plain and backing up water onto his property. The creek needs to
be straightened out, but we can't because it is privately owned. He is not against
development but does not want the water runoff on his land. How is the city going to
regulate the fencing and outbuilding issues?
Velma Leach —12010 East 69 Street North — She is against the approval of the variance.
Don't put more water on them than what we have already. The creek needs straightening.
We want to matter; we pay taxes and sent kids through Owasso Public Schools. We live
on a low spot and the creek gets high when there are heavy rains.
Vic Koenning — 7403 North 119 East Avenue — He is against the variance. He's the
citizen that calls the city to let them know what is going on. The area needs to be cleaned
out.
Public Works Engineer Daniel Dearing explained the FEMA flood boundaries. He also
stated that there are requirements for flood plain development and the developer must
submit flood plain development permits for those ten lots. You can't do whatever they
want when you are in a flood plain. There is a reviewed and approved detention pond
within Keys Landing that will contain the water in the subdivision. The City of Owasso
doesn't have the manpower to monitor every neighborhood, but if we hear from nearby
homeowners regarding any dirt moving in the area it will help us.
The applicant Ron Staggs asked to approach the board members. He stated that pulling
the houses closer to the street should help to get the structures further away from the
flood plain. He went through all of FEMA's requirements in order to get the LOMR. All
he is asking for is a 5 foot relieve on the front building line. He wants to be a good
neighbor.
Jim Bausch moved to approve the variance subject to the following condition:
Each lot shall be required to have an individual flood plain development
permit signed off by the City Engineering Department prior to issuance of
a building permit.
Dean Knoten seconded the motion. A vote on the motion was recorded as follows:
AYE: Bausch, Boyd, Knoten, Jacobs, Ramey
NAY: None
The motion was approved 5 -0.

5. New Business (New Business is any item of business which could not have been foreseen
at the time of posting of the agenda).
6. ADJOURNMENT — Dean Knoten moved for adjournment, seconded by Jim Bausch. A
vote on the motion was recorded as follows:
AYE: Bausch, Boyd, Knoten, Jacobs, Ramey
NAY: None
The motion was approved 5 -0 and the meeting was adjourned at 7:04 PM.
