PUBLIC HEARING
4, TCBOA-408 Harold Ko
The chairman reviewed the case history and the staff evaluat-,ion:
The applicant requests a Special Exception for a church use in
an AG district on a vacant -tract 'located north of the northwest
corner of 129th East Avenue and 106th Street North. The tract is
surrounded by vacant land on all four sides zoned AG and AG-R,.
To the south and west are scattered homes on small acreages zoned
AG-R. At the intersection of 129th and 106th there are three
existing homes. Vacant agricultural land and large lot subdivi-
sions characterize the general area. The Comprehensive Plan
indicated rural residential land use for the area. The tract is
flat and has good access and visibility from both 1.29th and 107th
Street North, There is another church located approximately
three blocks south on 129th East Avenue.
Churches are a use permit-Led by Special Exception in agricul-
tural and residential districts. The applicant has not submitted
a site plan at this time. Items to be considered for a church at
this site include:
14 Buffer all outdoor lighting away from nearby residences.
2. Require adequate off-street paved parking for all
church traffic. No church parking should be allowed on
107th St. North or 129th East Avenue.
3. Allow one access on 129th East Ave. and one on 107th St.
North and mark the remaining boundaries as limits-of--no-
access.

persons, There were no

to protest the
application,
The
Board discussed details
of the site
plan, access and
parking with
the
applicant.
R. Helm moved to recommend approval of the application subject to com-
pletion of the four items outlined in the staff, evaluation, L. Trammel
seconded the motion.

5. TCBOA-396 United Penecostal Church
The chairman reviewed the case history and the staff evaluation;
The applicant requests a Special Exception in an RE Residential
Estate district to permit a church use, The property is a vacant
tract located 1/4 mile south of the SE/c of 76th S0 N. and 117th
East Ave, The neighborhood is one of large unplatted lots with
scattered homes and a few businesses nearer 76th St. North, The
tract has access from 117th East Avenue connecting with 76th St.
North and the 1-169 service road, The Comprehensive Plan recommends
rural residential land use for this area. Church use is a use by
Special Exception in an RE area.
The site plan for the proposed church is attached. There are
several items that should be considered on this site plan if a
church use is decided to be an appropriate use in this location:
L Adequate off street paved parking should be required to
accommodate all church-related traffic. No church park-
ing should be allowed on 117th East Avenue.
2. Coordinate and mark in-out access points to the church
to reduce congestion on neighboring streets,
3o Meet all bulk and area requirements of an RE district.
0 Buffer all outdoor lighting away from nearby residences.
5. Provide limits-of-no-access on all boundaries of the
property except two 30' driveways.

Robert Hobbs, pastor of the church explained the application and
presented a petition reques�# ion approval of he church signed by church
members. He stated that other churches existed within residential
neighborhoods without causing harm. He showed a site plan o,.. the

Approximately 8 owners of nearby property were present in protest,
They stated the:', neighborhood or°'hood was opposed to the application due Co in-

street conditions and the "lc; that the street is not r through s!5eot
and their desire to maintain the residential character of the neighbor-
hood. Paul Young, spokesman, presented a petition signed by neighboring
property owners who opposed the application. That petition and that of
the church are attached to and made a part of these minutes. Several
neighbors spore saying if the church were approved it would open the
door to other non-residential uses to locates in the neighborhood. They

Board members discussed these "issues with .gilt', applicants and neighbors
at length. L. lrai"finel moved to 'recommend denial of the application to
the County Board due to the protests of the neighbors, traffic an
drainage problems. R. Helm seconded the motion. In discussion, Board
members said they felt part of their job was to protect the neighbor-
hood landowners, and it this situation they neighbors opposed the
application. They stated that the landowners bought their properties
for residential purposes and wile land may be rezoned for something
more undesirable later, the current application was considered incom-
patible with the neighborhood.

Abstain: Fickle.

NEW AND GENERAL BUSINESS
5� Resignation . City Manager
Staff related that Dale Block, City Manager, had resigned the previous
evening at the City Council meeting. Staff suggested that the Board
might want to redirect the letter concerning the Smyth Medical Clinic
to the Mayor instead of the City Manager. The letter requested the
city to enforce the variance to require paved parking at the clinic.
The Board directed the chairman to send the letter to the Mayor.

There being no further business to consider, L. Trammel moved to adjourn
the meeting, R. Fickle seconded the motion..,
